Several highlighted contents of the Law on Citizen Identification

The Law on Civil Status enters into force from January 1, 2014, including following significant contents:
1. National population database

For the purposes of this Law, setting up the national population database is required to meet the following requirements:

- Such national population database should be manage in a manner of concentration and uniformity and conform to information technology standards, regulations and socio-technical norms. 

- Ensure safety and convenience for data collection, update, access and utilization.

- Keep connected to specialized database systems.

- Ensure that agencies, organizations or individuals will have access to information in accordance with laws.

Types of information will be collected or updated, including:

- Surname, middle name and first name provided in the birth certificate.

- Birth date.

- Gender.

- Birth place.

- Place of origin.

- Ethnicity.

-Religion.

- Nationality.

- Marital status.

- Permanent residence.

-Present residence.

-Blood type. This is required when a citizen applies for information update and presents his/her blood test result.

- Surname, middle name and first name, personal identification number or ID card number, nationality of parent, spouse or legal representative.

- Surname, middle name, first name, personal identification number or ID card number of householder, and relationship with householder.

- Date of death or date missing.

2. Contents of a citizen identification card 

A citizen identification card includes the followings:

- The national emblem of Vietnam; printed texts such as the sentence "Socialist Republic of Vietnam, Independence - Freedom - Happiness", and the card title "Citizen Identification Card"; the cardholder's photo, card number, surname, middle name and first name provided in the birth certificate, birth date, gender, nationality, place of origin, permanent residence; expiry date, must be printed at the front side of each card.

- Encrypted information section; finger print, the cardholder’s anthropometric identities; date of issue; surname, middle name and first name, designation, signature of the issuer and the card issuing authority’s stamp with the national emblem, must be printed at the back side of each card.

3. Persons eligible for being issued a Citizen Identification Card and Citizen Identification Card number 

- Vietnamese citizens aged 14 years or older are eligible for being issued Citizen Identification Cards.

- Citizen Identification Card number is deemed as the personal identification number.

4. Age limit for replacement of a Citizen Identification Card 

- Citizen Identification Card must be replaced when a cardholder has reached the age of 25, 40 and 60.

- If a Citizen Identification Card is issued, replaced or reissued within a period of 2 years prior to such age limits, it remains valid till the next age limit.

5. Cases in which replacement and reissuance of a Citizen Identification Card is permitted

- Replacement of a Citizen Identification Card is permitted under the following circumstances:

+ This card falls within cases defined in paragraph 1 Article 21 of this Law.

+ This card is subject to wear and tear which becomes unusable.

+ This card needs changes made to surname, middle name, first name; anthropometric identities of the cardholder.

+ This card needs re-determination of gender and place of origin.

+ This card contains erroneous information. 

+ Such replacement is requested by a citizen.

- Reissuance of a Citizen Identification Card is permitted under the following circumstances:

+ The issued card is lost.

+ The card holder is entitled to recover his/her Vietnamese citizenship in accordance with the Law on Civil Status of Vietnam.

6. Useful value of a Citizen Identification Card 

 - Citizen Identification Card is a kind of Vietnamese citizens’ personal papers which is useful for proving citizen identities of a cardholder to qualify for transactions that occur within the territory of Vietnam.

 - Citizen Identification Card is used instead of the passport if Vietnam and other countries enter into an international agreement or arrangement under which a citizen of a Party is entitled to use Citizen Identification Card in place of the passport within the territory of the other Party.

- Competent agencies, organizations or individuals are vested with authority to request citizens to present Citizen Identification Card to verify their identities and information in accordance with regulations of Article 18 of this Law; use personal identification number provided in Citizen Identification Card to check information of a cardholder with the national population database and specialized database in accordance with laws and regulations.

Once a citizen has already presented a Citizen Identification Card as requested by these competent agencies, organizations or individuals, they are not allowed to request this citizen to present any other document as a proof of such information.

- The state of Vietnam protects legitimate rights and interests of a Citizen Identification Card holder in accordance with laws and regulations.

- The Circular No. 170/2015/TT-BTC on collection amount, system for collection, payment and management of fees for grant of Citizen Identification Card.
