Vietnam’s Circular No. 08/2026/TT-BNV elaborates on and provides guidelines on the issuance of electronic employment contract identification codes (IDs); the issuance, suspension, and reactivation of access accounts for the eContract platform; connection to the eContract platform; management, use, and utilization of the eContract platform; and the updating, utilization, storage, and sharing of data on the eContract platform.
According to Article 4 of Circular No. 08/2026/TT-BNV the principles for issuing electronic employment contract identification codes are as follows:
(1) Each electronic employment contract submitted to the eContract platform that satisfies the prescribed requirements shall be assigned a unique ID that does not duplicate the ID of any other electronic employment contract.
(2) An ID shall be issued only once and shall remain unchanged, including in cases where the electronic employment contract is amended, supplemented, suspended, or terminated. Any appendix, notice of suspension, or notice of termination relating to the electronic employment contract shall bear the ID of that contract.
(3) State authorities shall use the ID as the digital data management code for electronic employment contracts. The issuance of an ID does not affect the time of conclusion, contents, or effective date of the electronic employment contract agreed upon by the parties.
(4) The ID shall be linked to display codes or search codes (based on administrative unit codes, employee identification numbers, and employer tax identification numbers) generated by the eContract platform to facilitate data retrieval. However, such codes shall not replace the ID.
At the same time, according to Article 5 of Circular No. 08/2026/TT-BNV regulations on the structure of electronic employment contract identification codes are as follows:
The ID structure shall be automatically generated by the eContract platform and shall consist of 1 alphabetic character and 12 numeric characters, as follows:
- The alphabetic character shall be A, B, or C, where: A is assigned to electronic employment contracts concluded from July 1, 2026 through eContract systems that satisfy the requirements prescribed in Article 6 of Decree No. 337/2025/ND-CP; B is assigned to electronic employment contracts converted from paper-based employment contracts; C is assigned to electronic employment contracts concluded before July 1, 2026.
- The 12 numeric characters shall be structured as follows: The first 2 digits represent the last 2 digits of the year in which the eContract platform issues the ID; the remaining 10 digits constitute a randomly generated numerical sequence.
Circular No. 08/2026/TT-BNV comes into force as of July 1, 2026.
