According to the Circular, the general regulations on the certification mechanism for the origin of goods under the CEPA Agreement are as follows:
(1) Goods originating in the territory of the United Arab Emirates imported into Vietnam shall be entitled to preferential tariffs under the Agreement upon submission to the customs authority of one of the following proofs of origin:
- A C/O issued in accordance with Article 23 of Circular 24.
- A self-certification of origin document issued by an approved exporter in accordance with Article 24 of Circular 24.
- A self-certification of origin document issued by the exporter for originating consignments with a value not exceeding USD 500 (five hundred United States dollars), in the form provided in Appendix IV enclosed with Circular 24. However, such consignment must not form part of a series of importations that the Vietnamese customs authority suspects to have been arranged or planned for evading compliance with the laws of Vietnam.
(2) Goods originating in Vietnam imported into the United Arab Emirates shall be entitled to preferential tariffs under the Agreement when accompanied by one of the following proofs of origin:
- A C/O issued in accordance with Article 23 of Circular 24.
- A self-certification of origin document issued by the exporter for originating consignments with a value not exceeding USD 500 (five hundred United States dollars), in the form provided in Appendix IV enclosed with this Circular. However, such consignment must not form part of a series of importations that the customs authority of the United Arab Emirates suspects to have been arranged or planned for evading compliance with the laws of the United Arab Emirates.
Within 3 working days from the date of issuance of the self-certification of origin document, the Vietnamese exporter shall declare and upload the self-certification of origin document and documents relating to the export consignment as prescribed from Point c to Point h Clause 1 Article 15 of Decree No. 31/2018/ND-CP onto the Electronic Origin Certification and Issuance Management System of the Ministry of Industry and Trade of Vietnam at www.ecosys.gov.vn
(3) Proofs of origin shall be made in English, remain valid for 1 year from the date of issuance, and be submitted to the customs authority of the importing Member State within such validity period to enjoy preferential tariff treatment.
