Procedures for amendment of licenses to provide social networking services
According to the Resolution, the issuance of amended or renewed licenses to provide social networking services prescribed in Article 32 of Decree No. 147/2024/ND-CP falls under the authority of specialized cultural agencies under the Provincial People’s Committees.
Procedures for amendment of licenses to provide social networking services:
(1) An organization, agency or enterprise holding a license to provide social networking services must carry out procedures for amendment of their licenses in the following cases: change of the governing authority (if any); change of the name of the agency, organization or enterprise providing social networking services; change of the head office address; change of the server location; change of the person bearing responsibility before the law or content management personnel; change of the name of the social network (if any), service type or scope of service provision (domain names or application distribution systems).
(2) An organization or enterprise requesting amendment of a license to provide social networking services shall prepare an application and submit it directly or by post to the Public Administrative Service Center of the province or city where the head office is located, or submit it online via the National Public Service Portal. The application shall include:
- A written request for amendment of the license to provide social networking services made using Form No. 03 in Appendix 04 enclosed with Resolution No. 18/2026/NQ-CP;
- Relevant supporting documents (if any) submitted to the licensing authority.
(3) Within 05 working days from receipt of a valid application, the specialized cultural agency under the provincial People’s Committee shall appraise and issue the amended license in the prescribed form, after updating the amended contents and clearly indicating the date on which the original license is issued and the date on which the amended license is issued. The amended license shall remain valid from the date on which the amended license is issued until the expiry date of the original license.
In case of refusal, the specialized cultural agency under the provincial People’s Committee must issue a written response clearly stating the reasons for refusal.
(4) The agency, organization or enterprise may receive the results at the specialized cultural agency under the provincial People’s Committee where the application was submitted or by post, unless otherwise provided by law.
