PHÁP LỆNH

CẢNH SÁT MÔI TRƯỜNG

Căn cứ Hiến pháp nước Cộng hòa xã hội chủ nghĩa Việt Nam;

Căn cứ Nghị quyết số 45/2013/QH13 của Quốc hội về điều chỉnh Chương trình xây dựng luật, pháp lệnh nhiệm kỳ Quốc hội khóa XIII, năm 2013 và Chương trình xây dựng luật, pháp lệnh năm 2014;

Ủy ban thường vụ Quốc hội ban hành Pháp lệnh Cảnh sát môi trường.

Chương I

NHỮNG QUY ĐỊNH CHUNG

Điều 1. Phạm vi điều chỉnh

Pháp lệnh này quy định về chức năng, nhiệm vụ, quyền hạn, tổ chức, bảo đảm hoạt động và chế độ, chính sách đối với Cảnh sát môi trường; trách nhiệm của cơ quan, tổ chức, cá nhân có liên quan.

Điều 2. Đối tượng áp dụng

Pháp lệnh này áp dụng đối với Cảnh sát môi trường, cơ quan, tổ chức, công dân Việt Nam và tổ chức, cá nhân nước ngoài cư trú, hoạt động trên lãnh thổ nước Cộng hòa xã hội chủ nghĩa Việt Nam.

Điều 3. Vị trí, chức năng của Cảnh sát môi trường

Cảnh sát môi trường là lực lượng chuyên trách thuộc Công an nhân dân thực hiện chức năng phòng ngừa, phát hiện, ngăn chặn, đấu tranh chống tội phạm và vi phạm hành chính về môi trường; chủ động, phối hợp phòng ngừa, đấu tranh chống tội phạm, vi phạm pháp luật về tài nguyên và an toàn thực phẩm có liên quan đến môi trường.

Điều 4. Nguyên tắc tổ chức và hoạt động của Cảnh sát môi trường

1. Đặt dưới sự lãnh đạo toàn diện của Đảng ủy Công an Trung ương và sự chỉ huy, quản lý của Bộ trưởng Bộ Công an.

2. Tuân thủ Hiến pháp và pháp luật; tôn trọng và bảo vệ lợi ích của Nhà nước, quyền con người, quyền và lợi ích hợp pháp của cơ quan, tổ chức, cá nhân; tạo môi trường thuận lợi cho phát triển kinh tế, xã hội và bảo đảm an sinh xã hội.

3. Chủ động phòng ngừa, kịp thời phát hiện, ngăn chặn và xử lý nghiêm minh tội phạm, vi phạm pháp luật theo phạm vi chức năng, nhiệm vụ.

4. Phối hợp chặt chẽ với cơ quan, tổ chức có liên quan trong phòng ngừa, đấu tranh chống tội phạm, vi phạm pháp luật theo phạm vi chức năng, nhiệm vụ.

5. Dựa vào Nhân dân, phát huy sức mạnh của Nhân dân và chịu sự giám sát của Nhân dân.

Điều 5. Xây dựng Cảnh sát môi trường

1. Nhà nước xây dựng Cảnh sát môi trường cách mạng, chính quy, tinh nhuệ, từng bước hiện đại.

2. Cơ quan, tổ chức, cá nhân có trách nhiệm tham gia xây dựng, phối hợp, giúp đỡ Cảnh sát môi trường thực hiện chức năng, nhiệm vụ, quyền hạn theo quy định của pháp luật.

3. Cảnh sát môi trường được ưu tiên tuyển chọn, đào tạo nguồn nhân lực và đầu tư cơ sở vật chất, thiết bị, phương tiện kỹ thuật nghiệp vụ đáp ứng yêu cầu nhiệm vụ được giao.

Điều 6. Các hành vi bị nghiêm cấm

1. Đối với Cảnh sát môi trường:

a) Các hành vi không được làm theo quy định của Luật Công an nhân dân;

b) Cố ý bỏ lọt tội phạm và vi phạm hành chính về môi trường, tài nguyên, an toàn thực phẩm;

c) Lợi dụng thực hiện nhiệm vụ, quyền hạn của Cảnh sát môi trường để gây phiền hà, sách nhiễu, xâm phạm lợi ích của Nhà nước, quyền con người, quyền và lợi ích hợp pháp của cơ quan, tổ chức, cá nhân.

2. Đối với cơ quan, tổ chức, cá nhân:

a) Chống lại hoặc cản trở Cảnh sát môi trường thi hành công vụ;

b) Giả danh Cảnh sát môi trường;

c) Mua chuộc, hối lộ hoặc có hành vi xúi giục, lôi kéo, ép buộc Cảnh sát môi trường thực hiện hành vi trái với chức năng, nhiệm vụ, quyền hạn của Cảnh sát môi trường;

d) Trả thù, đe dọa trả thù, cản trở người làm chứng, người tố giác, người tố cáo hoặc người thân thích của họ trong việc tố giác, tố cáo, khai báo và xử lý tội phạm, vi phạm hành chính về môi trường, tài nguyên, an toàn thực phẩm.

Chương II

NHIỆM VỤ, QUYỀN HẠN VÀ TỔ CHỨC CỦA CẢNH SÁT MÔI TRƯỜNG

Điều 7. Nhiệm vụ, quyền hạn của Cảnh sát môi trường

Trong phạm vi chức năng, Cảnh sát môi trường có nhiệm vụ, quyền hạn sau đây:

1. Thu thập thông tin, phân tích, đánh giá, dự báo tình hình để tham mưu, đề xuất với cấp có thẩm quyền chỉ đạo công tác phòng ngừa, đấu tranh chống tội phạm và vi phạm pháp luật;

2. Áp dụng các biện pháp công tác công an để tổ chức phòng ngừa, đấu tranh chống tội phạm và vi phạm pháp luật;

3. Tiếp nhận, xử lý, giải quyết tố giác, tin báo về tội phạm và vi phạm pháp luật theo quy định của pháp luật;

4. Tiến hành điều tra các tội phạm về môi trường và tài nguyên, an toàn thực phẩm có liên quan đến môi trường theo quy định của pháp luật;

5. Tiến hành các hoạt động kiểm tra việc chấp hành pháp luật của cơ quan, tổ chức, cá nhân theo quy định của pháp luật; kiểm tra phương tiện, đồ vật, địa điểm khi trực tiếp phát hiện có dấu hiệu tội phạm, vi phạm hành chính hoặc khi có tố giác, tin báo về tội phạm, vi phạm hành chính theo quy định của luật.

Việc kiểm tra phải có quyết định bằng văn bản của người đứng đầu cơ quan Cảnh sát môi trường thuộc Bộ Công an, Công an tỉnh, thành phố trực thuộc trung ương; quyết định bằng văn bản của Giám đốc Công an tỉnh, thành phố trực thuộc trung ương, Trưởng Công an huyện, quận, thị xã, thành phố thuộc tỉnh và đơn vị hành chính tương đương;

6. Xử lý vi phạm hành chính theo quy định của pháp luật;

7. Trong trường hợp cần thiết, cấp bách được quyền huy động người, phương tiện của cơ quan, tổ chức, cá nhân theo quy định của luật;

8. Sử dụng vũ khí, vật liệu nổ, công cụ hỗ trợ theo quy định của luật; sử dụng thiết bị, phương tiện kỹ thuật nghiệp vụ theo quy định của pháp luật;

9. Thu giữ mẫu vật, tài liệu, vật chứng liên quan đến tội phạm, vi phạm hành chính để kiểm định hoặc phối hợp với cơ quan, tổ chức có thẩm quyền kiểm định, giám định;

10. Được yêu cầu cơ quan, tổ chức, cá nhân cung cấp thông tin, tài liệu, đồ vật liên quan đến tội phạm, vi phạm hành chính về môi trường và tài nguyên, an toàn thực phẩm có liên quan đến môi trường theo quy định của luật;

11. Phối hợp với các cơ quan, tổ chức, đơn vị trong phòng, chống tội phạm và vi phạm pháp luật về môi trường, tài nguyên, an toàn thực phẩm theo quy định của Chính phủ;

12. Thực hiện hợp tác quốc tế theo quy định của Bộ trưởng Bộ Công an;

13. Thực hiện nhiệm vụ, quyền hạn khác theo quy định của pháp luật.

Điều 8. Tổ chức của Cảnh sát môi trường

1. Tổ chức của Cảnh sát môi trường gồm:

a) Cục thuộc Bộ Công an;

b) Phòng thuộc Công an tỉnh, thành phố trực thuộc trung ương;

c) Đội thuộc Công an huyện, quận, thị xã, thành phố thuộc tỉnh và đơn vị hành chính tương đương.

2. Bộ trưởng Bộ Công an quy định cụ thể Điều này.

Chương III

BẢO ĐẢM HOẠT ĐỘNG VÀ CHẾ ĐỘ, CHÍNH SÁCH ĐỐI VỚI CẢNH SÁT MÔI TRƯỜNG

Điều 9. Trang bị của Cảnh sát môi trường

Cảnh sát môi trường được trang bị vũ khí, vật liệu nổ, công cụ hỗ trợ, thiết bị, phương tiện kỹ thuật nghiệp vụ theo quy định của Bộ trưởng Bộ Công an.

Điều 10. Chế độ, chính sách đối với cán bộ, chiến sĩ Cảnh sát môi trường

Cán bộ, chiến sĩ Cảnh sát môi trường được hưởng chế độ, chính sách theo quy định của Luật Công an nhân dân; được hưởng chế độ về độc hại, trang bị phương tiện bảo hộ phòng, chống độc hại theo quy định của pháp luật.

Điều 11. Chế độ, chính sách đối với cơ quan, tổ chức, cá nhân

1. Cơ quan, tổ chức, cá nhân tham gia, phối hợp, cộng tác, giúp đỡ Cảnh sát môi trường trong thực hiện nhiệm vụ có thành tích thì được khen thưởng; bị tổn hại về danh dự thì được khôi phục; bị thiệt hại về tài sản thì được đền bù; người bị thương tích, tổn hại về sức khỏe, tính mạng thì bản thân và gia đình được hưởng chế độ, chính sách theo quy định của pháp luật.

2. Cơ quan, tổ chức, cá nhân tham gia, phối hợp, cộng tác, giúp đỡ Cảnh sát môi trường được bảo vệ và giữ bí mật theo quy định của pháp luật.

Điều 12. Kinh phí hoạt động của Cảnh sát môi trường

Kinh phí hoạt động của Cảnh sát môi trường do ngân sách nhà nước bảo đảm.

Chương IV

TRÁCH NHIỆM CỦA CƠ QUAN, TỔ CHỨC ĐỐI VỚI CẢNH SÁT MÔI TRƯỜNG

Điều 13. Trách nhiệm của Bộ Công an

1. Ban hành theo thẩm quyền hoặc trình cơ quan có thẩm quyền ban hành văn bản quy phạm pháp luật về Cảnh sát môi trường.

2. Chỉ đạo và tổ chức thực hiện văn bản quy phạm pháp luật về Cảnh sát môi trường.

3. Quản lý hệ thống tổ chức, biên chế và hoạt động của Cảnh sát môi trường; tổ chức đào tạo, huấn luyện, bồi dưỡng cán bộ, chiến sĩ Cảnh sát môi trường.

4. Ban hành danh mục các loại vũ khí, vật liệu nổ, công cụ hỗ trợ, thiết bị, phương tiện kỹ thuật nghiệp vụ của Cảnh sát môi trường.

5. Kiểm tra, thanh tra, khen thưởng, xử lý vi phạm, giải quyết khiếu nại, tố cáo liên quan đến Cảnh sát môi trường.

6. Chỉ đạo thực hiện hợp tác quốc tế về trao đổi thông tin, đào tạo, huấn luyện và trang bị cho Cảnh sát môi trường.

Điều 14. Trách nhiệm của Bộ Tài nguyên và Môi trường

1. Chỉ đạo các cơ quan, đơn vị thuộc quyền phối hợp, hỗ trợ Cảnh sát môi trường trong thực hiện chức năng, nhiệm vụ, quyền hạn.

2. Hỗ trợ triển khai thực hiện các dự án, đề tài nghiên cứu, đào tạo, tập huấn, bồi dưỡng nghiệp vụ, hợp tác quốc tế, tư vấn cho Cảnh sát môi trường.

Điều 15. Trách nhiệm của bộ, cơ quan ngang bộ, cơ quan thuộc Chính phủ

Bộ, cơ quan ngang bộ, cơ quan thuộc Chính phủ trong phạm vi chức năng, nhiệm vụ, quyền hạn của mình chỉ đạo cơ quan, đơn vị thuộc quyền phối hợp với Cảnh sát môi trường trong thực hiện chức năng, nhiệm vụ, quyền hạn.

Điều 16. Trách nhiệm của chính quyền địa phương

Trong phạm vi nhiệm vụ, quyền hạn của mình, chính quyền địa phương các cấp bảo đảm và tạo điều kiện để Cảnh sát môi trường thực hiện chức năng, nhiệm vụ, quyền hạn.

Điều 17. Trách nhiệm của Mặt trận Tổ quốc Việt Nam và các tổ chức thành viên

Mặt trận Tổ quốc Việt Nam và các tổ chức thành viên trong phạm vi nhiệm vụ, quyền hạn của mình tuyên truyền, vận động Nhân dân, phối hợp phòng ngừa, đấu tranh chống tội phạm, vi phạm pháp luật về môi trường, tài nguyên, an toàn thực phẩm; giám sát, giúp đỡ Cảnh sát môi trường thực hiện chức năng, nhiệm vụ, quyền hạn.

Chương V

ĐIỀU KHOẢN THI HÀNH

Điều 18. Hiệu lực thi hành

Pháp lệnh này có hiệu lực thi hành kể từ ngày 05 tháng 6 năm 2015.

Điều 19. Quy định chi tiết

Chính phủ, cơ quan có thẩm quyền quy định chi tiết các điều, khoản được giao trong Pháp lệnh.

ORDINANCE

ENVIRONMENTAL POLICE FORCES

Pursuant to the Constitution of the Socialist Republic of Vietnam;

Pursuant to Resolution No. 45/2013/QH13 issued by the National Assembly which adjusts 2014 law and ordinance establishment Program;

The Standing Committee of the National Assembly hereby promulgates this Ordinance on Environmental police forces.

Chapter I

GENERAL REGULATIONS

Article 1. Governing scope

Article 2. Applied entities

This Ordinance is applied to environmental police forces, Vietnamese agencies, organizations and citizens and foreign organizations and individuals residing and/or operating in the territory of the Socialist Republic of Vietnam.

Article 3. Position and functions of environmental police forces

Environmental police is a branch of the police specialized in preventing, detecting, fighting against criminal and administrative offenses related to environment; proactively and cooperatively preventing, fighting against crimes and violations of law related to natural resources and food safety related to environment.

Article 4. Organizational structure and operation of environmental police forces

1. Under the general leadership of the Communist Party Committee of the National Public Security and management of the Minister of Public Security.

2. Adhering to the Constitution and laws; respecting and protecting the interests of the Government, human right, legitimate entitlements and interests of agencies, organizations and individuals; facilitating socio-economic development and social security assurance.

3. Proactively preventing, detecting timely, interdict and strictly handling crimes and violations of law in accordance with their functions and duties.

4. Closely cooperating with related agencies, organizations preventing, fighting against crimes and violations of law in accordance with their functions and duties.

Article 5. Establishment of environmental police forces

1. The State shall establish revolutionary, professional, elite and modern environmental police forces.

2. All agencies, organizations, individuals shall contribute themselves to the reinforcement of, cooperation with and support towards environmental police forces in the implementation of their functions, duties, authority in accordance with the related laws.

3. Environmental police forces have the preemptive right to recruitment and training of personnel, investment in facilities, equipment, technical and professional equipment to fulfill the assigned duties.

Article 6. Prohibited acts

1. Environmental police forces are prohibited to:

a) Commit prohibited acts as prescribed by the Law of the People’s Public Security forces;

b) Deliberately ignore criminal and administrative offenses related to environment, natural resources, food safety;

c) Take advantage of the duties and/or authority assigned to the Environmental police to cause harassment or infringe upon the interests of the Government, human right, legitimate rights and interests of other entities.

a) Resist or obstruct environmental police officers from performing their duties;

b) Impersonate environmental police officers;

c) Bribe or incite, force environmental police officers to act against their functions, duties, and authority;

d) Revenge, threaten to revenge, obstruct the witnesses, accusers, denouncers or their relatives from making the accusation, denouncement, reporting and taking actions against criminal and/or administrative offenses related to environment, natural resources, food safety.

Chapter II

DUTIES, AUTHORITY AND ORGANIZATIONAL STRUCTURE OF ENVIRONMENTAL POLICE FORCES

Article 7. Duties and entitlements of environmental police forces

Within their area of competence, environmental police forces have following duties and entitlements:

1. Collecting information, analyzing, evaluating and forecasting the situations to counsel, make proposals to the competent authorities for their instructions on prevention, fighting against crimes and violations of law;

3. Receiving, handling and settling accusation, notification on crimes and violations of law in accordance with the related laws;

4. Carrying out investigations on the crimes related to environment and natural resources, food safety related to environment in accordance with the related laws;

5. Inspecting adherence to law of agencies, organizations, individuals; inspecting related means, articles, locations when alleged crimes, administrative offenses are detected or when accusations, reporting on crimes and/or administrative offenses are made in accordance with the related laws.

Inspections must be decided in writing by the leaders of the Environmental Police Departments affiliated to the Ministry of Public Security, the police authorities of provinces; by Directors of police authorities of provinces, Police Chiefs of districts and similar administrative units;

6. Taking actions against administrative offenses in accordance with the related laws;

7. In required and/or emergency cases, entitled to mobilize people, facilities of related agencies, organizations and/or individuals in accordance with the related laws;

8. Using weapons, explosives, and combat gear in accordance with the related laws; using specialized equipment in conformity with the related laws;

9. Collecting specimens, materials, evidence related to crimes, administrative offenses for inspection or cooperating with the agencies, organizations competent to carry out inspection and/or examination;

10. Requesting related agencies, organizations, individuals to provide information, documents, items related to crimes, administrative offenses pertaining to environment and natural resources, food safety in environmental field in accordance with the related laws;

12. Promoting international cooperation in accordance with the regulations issued by the Minister of Public Security;

13. Performing other duties and entitlements in accordance with the related laws.

Article 8. Organization of environmental police forces

1. Environmental police forces include:

a) Environmental Police Department affiliated to the Ministry of Public Security;

b) Environmental Police Divisions affiliated to police authorities of provinces;

c) Environmental Police Teams affiliated to police authorities of districts and similar administrative units.

2. The Minister of Public Security shall elaborate this Article.

Chapter III

Article 9. Equipment of environmental police forces

Environmental police forces are equipped with weapons, explosives, combat gear, as specialized equipment as prescribed by the Minister of Public Security.

Article 10. Benefits of environmental police officers

Environmental police officers shall have the benefits prescribed in the Law on the People’s Public Security forces; enjoy the policies related to hazard prevention, receive hazard pay, and be provided with protective equipment in accordance with the related laws.

Article 11. Benefits for other organizations and individuals

1. Any organization or individual that cooperates with environmental police forces in fulfilling their duties and obtains achievements will be rewarded; have their honor redeemed, if required; have damaged properties compensated, if any; In case a person is injured or dead, such person and his/her family will receive corresponding benefits as prescribed by law.

2. Every organization and individual that cooperates with environmental police forces shall be physically and confidentiality protected in accordance with the related laws.

Article 12. Operation fund of the environmental police forces

Operation fund of the environmental police forces shall be provided by the state budget.

RESPONSIBILITIES OF RELATED AGENCIES, ORGANIZATIONS TO ENVIRONMENTAL POLICE FORCES

Article 13. Responsibilities of the Ministry of Public Security

1. Issuing legislative documents on environmental police forces or requesting competent authorities to do so.

2. Instructing and organizing the implementation of legislative documents on the environmental police forces.

3. Managing the organization and personnel of environmental police forces; provide the training for the Environmental police officers.

4. Issuing the list of weapons, explosives, combat gear, specialized equipment of environmental police forces.

5. Carrying out inspections, providing rewards, taking actions against violations, settling complaints and/or accusations related to environmental police forces.

6. Giving instruction on international cooperation in information exchange, training and equipping environmental police forces.

Article 14. Responsibilities of the Minister of Natural Resources and Environment

2. Supporting the development of projects, research projects, training, professional fostering, international cooperation and consultation to the environmental police.

Article 15. Responsibilities of the ministries, ministerial-level agencies under the Government

The ministries, ministerial-level agencies, agencies under the Government shall, within their area of competence, instruct the affiliate agencies and/or units to cooperate with environmental police forces to perform their duties and entitlements.

Article 16. Responsibilities of local authorities

Local authorities are responsible for facilitating the execution of the environmental police forces’ functions, duties and/or authority within the area of their competence and in accordance with the assigned duties.

Article 17. Responsibilities of Vietnam’s Fatherland Front and its member organizations

Vietnam’s Fatherland Front and its member organizations shall, within the area of their competence, encourage the people to cooperate in the prevention and/or fighting against crimes and violations of law related to environment, natural resources, food safety; supervising and supporting environmental police forces in the execution of their functions, duties and/or authority.

This Ordinance takes effect on June 5, 2015.

Article 19. Detailed regulations

The Government and competent agencies shall detail the assigned clauses herein.
