CIRCULAR
AMENDING AND SUPPLEMENTING A NUMBER OF ARTICLES OF THE
CIRCULAR NO. 04/2009/TT-BVHTTDL, THE CIRCULAR NO. 07/2011/TT-BVHTTDL, AND THE
DECISION NO. 55/1999/QD-BVHTT
Pursuant to the Law
on Promulgation of legal documents dated June 03, 2008;;
Pursuant to the
Government's Decree No. 24/2009/ND-CP dated March 05, 2009, detailing the
implementation of the Law on Promulgation of legal documents;
Pursuant to the
Government's Decree No. 185/2007/ND-CP dated December 25, 2007, defining the
functions, tasks, powers and organizational structure of the Ministry of
Culture, Sports and Tourism;
Pursuant to the
Government's Decree No. 01/2012/ND-CP dated January 04, 2012, amending, supplementing,
superseding, or annulling the provisions related to the administrative
procedures under the management of the Ministry of Culture, Sports and Tourism;
At the proposal of
the Chief officer and Director of the Legal Affair Department;
The Minister of
Culture, Sports and Tourism promulgates a Circular to amend and supplement a
number of articles of the Circular No. 04/2009/TT-BVHTTDL, the Circular No.
07/2011/TT-BVHTTDL, and the Decision No. 55/1999/QD-BVHTT.

1. Clause 3 Article 4 is amended and supplemented as follows:
“3. The Director of
the Department of Performing arts shall license the circulation of video/audio
tapes and disks of art performances as prescribed in Point a Clause 2 Article 5
in the Regulation.
The Department of
Performing arts and Services of Culture, Sports and Tourism shall issue the
control labels for video/audio tapes and disks of art performances, as
prescribed in Clause 4 Article 5 of the Regulation.
The application for the
control label (form No. 1).”.
2. Article 6 is amended and supplemented as follows:
“Article 6.
Procedures for announcing art performances in lodging establishments and
restaurants
At least 03 days
before the date of performance, the lodging establishment or restaurant that
allow foreign art groups and artist to perform therein without selling tickets
and collecting money, as prescribed in Clause 2 Article 8 of the Regulation,
must notify the Service of Culture, Sports and Tourism in writing of the
location of performance.
The written
notification must specify: The name of the show, the content; the list of
writers, directors, choreographer, composers, artists, painters, actors and
actresses; the time and location of performance (form No. 2)

5. Discarding Clause 4
Article 12.
6. Clause 2 and Clause 3 Article 13 is amended and supplemented as follows:
“2.
The application for the license to open a karaoke club or dance club must
comply with Point g and Point i Clause 2 Article 2 of the Government's Decree
No. 01/2012/ND-CP dated January 04, 2012, amending, supplementing, superseding,
or annulling the provisions related to the administrative procedures under the
management of the Ministry of Culture, Sports and Tourism;
The application for
the license to open a karaoke club (form No. 3).
3. The licensing
agency must verify the conditions of the applicant and compare with the
planning.”.
7. Adding Clause 4 to
Article 13 as follows:
“4. The applicant must
pay fees as prescribed by the Ministry of Finance at the time of applying.”.
Article 2. Amending
a number of articles of the
Circular No. 07/2011/TT-BVHTTDL dated June 07, 2011 of the Ministry of Culture,
Sports and Tourism, amending, supplementing, superseding, or annulling the
provisions related to the administrative procedures under the management of the
Ministry of Culture, Sports and Tourism.

24 is amended as follows:
Remove the phrase “3.
The direct operator of the dance club must have an intermediate diploma in
culture and art or higher” and the phrase “This License is valid until the end
of …” from the License to open dance club (form No. 5).
Article 3. Amending
a number of articles of the Decision No. 55/1999/QD-BVHTT dated
August 05, 1999 of the Minister of Culture, Sports and Tourism, promulgating
the Regulation on producing, exporting, importing, circulating, and trading
audio tapes, audio disks, video tapes, and video disks of art performances
Discarding
Clause 1 and Clause 2 Article 9 of the Regulation on producing, exporting,
importing, circulating, and trading audio tapes, audio disks, video tapes, and
video disks of art performances, promulgated together with the Decision No.
55/1999/QD-BVHTT.
Article 4.
Implementation provisions
1. This Circular takes
effect on June 15, 2012.
2. Heads of agencies
affiliated to Ministries, Directors of the Services of Culture, Sports and Tourism,
relevant organizations and individuals are responsible for implementing this
Circular./.

CONDITIONS
1.
The minimum size of a dance hall is 80m2
2.
Ensure the security and order, noise isolation, explosion and fire safety,
and environmental hygiene as prescribed.
3.
Ensure that the sound come from the dance hall does not exceed the limit of
permissible noise; The light in dance halls must be more than 10 Lux
per 20 m2, equivalent to 01 incandescent lamp 40 W for

The Regulation is posted publicly in the dance club so that everyone can see
and implement.
5.
Only use the songs and compositions allowed to be circulated to dance.
Dancers must wear appropriately.
6. Request drunk people or people that use drugs and
prohibited stimulants to leave the dance club;
7.
Do not let people under 18 to work or dance in the dance club;
8. The employers must have labor contracts and be
managed as prescribed by law provisions on labor contracts.

10.
Striptease, other pornographic activities, prostitution, use and trade of
drugs in the dance club are prohibited.
