Pursuant
to the Law on Tourism dated June 19, 2017;
Pursuant
to the Law on Promulgation of Legislative Documents dated June 22, 2015; Law
dated June 18, 2020 on amendments to some Articles of the Law on Promulgation
of Legislative Documents;
Pursuant
to the Government’s Decree No. 01/2023/ND-CP dated January 16, 2023 defining
the functions, tasks, powers and organizational structure of the Ministry of
Culture, Sports and Tourism;
At
the request of the Director General of the Vietnam National Administration of
Tourism;
The
Minister of Culture, Sports and Tourism hereby promulgates a Circular on
amendments to some Articles of the Circular No. 06/2017/TT-BVHTTDL dated December
15, 2017 of the Minister of Culture, Sports and Tourism elaborating some
Articles of the Law on Tourism and Circular No. 13/2019/TT-BVHTTDL dated
November 25, 2019 of the Minister of Culture, Sports and Tourism on amendments
to some Articles of the Circular No. 06/2017/TT-BVHTTDL dated December 15, 2017
of the Minister of Culture, Sports and Tourism elaborating some Articles of the
Law on Tourism.

“3.
The degree awarded by a foreign training institution shall be acknowledged in
accordance with regulations of law on education, higher education and vocational
education and training.”.
2. Article 13 of the
Circular No. 06/2017/TT-BVHTTDL amended by clause 10 Article 1 of the Circular
No. 13/2019/TT-BVHTTDL is amended as follows:
“Article
13. Foreign language proficiency standards to be
satisfied by tour guides
1.
The person who has a good command of a foreign language as prescribed in
point c clause 2 Article 59 of the Law on Tourism shall satisfy one of the
following standards:
a)
He/she holds at least an Advanced Diploma in Level 5 of VQF in linguistics or a
foreign language, foreign language interpretation or foreign language teacher
education;
b)
He/she holds at least an Advanced Diploma in Level 5 of VQF under the training
program designed in a foreign language. If the diploma or appendix to the
diploma does not state the language used for training, documents proving the
language used for training are required.
c)
He/she holds at least an associate degree issued by a foreign training
institution under the training program designed in the official language of the
home country. If the language used for training is different from the official
language of the home country , the degree or appendix to the degree does not
state the language used for training, documents proving the language used for
training are required;
d)
He/she holds one of the following unexpired certificates of foreign language
proficiency issued by a competent authority or organization: certificate of
foreign language proficiency at level 4 or higher of Vietnam’s Language
Proficiency Framework; certificate of foreign language proficiency issued by a
foreign authority equivalent to level 4 or higher of Vietnam’s Language
Proficiency Framework or equivalent to level B2 or higher of the Common
European Framework of Reference for Languages or satisfies the requirement
specified in the Appendix I to this Circular.
2.
The degree awarded by a foreign training institution shall be acknowledged in
accordance with regulations of law on education, higher education and
vocational education and training.”.

replaced with the phrase “Cục Du lịch Quốc gia Việt Nam” (“Vietnam National

b)
The phrase “cấp biển hiệu” (“issuance of signboard”) in point k clause 2
Article 18 of the Circular No. 06/2017/TT-BVHTTDL and Form No. 10 of Appendix
II to Circular No. 06/2017/TT-BVHTTDL amended by point b clause 5 Article 2 of
the Circular No. 13/2019/TT-BVHTTDL is replaced with the phrase “công nhận cơ
sở” (“recognition of establishment”).
c)
The phrase “Tổng cục trưởng Tổng cục Du lịch” (“Director General of General
Department of Tourism”) in Article 3 of the Circular No. 13/2019/TT-BVHTTDL is
replaced with the phrase “Cục trưởng Cục Du lịch Quốc gia Việt Nam” (“Director

2.
Transitional clauses:
a)
Any domestic tour operator license, international tour operator license; onsite
tour guide license; certificate of training in domestic tour operation,
certificate of training in international tour operation; certificate of
training for domestic tour guide, certificate of training for international
tour guide issued before the effective date of this Circular shall continue to
be used as prescribed;
b)
Any domestic tour guide license, international tour guide license; rating plate
of a rated tourist accommodation establishment; signboard which shows that a
provider of other tourism services is qualified for provision of services for
tourists; certificate of completion of refresher course for domestic and
international tour guides issued before the effective date of this Circular
shall continue to be used until its expiry;
c)
Documents included in applications that are submitted to follow administrative
procedures at competent authorities before the effective date of this Circular
shall continue to be processed without having to be replaced with the forms in
Appendix II to this Circular and the result shall comply with applicable
regulations.
3.
Upon completing the connection to the National Population Database, public
officials, public employees and individuals assigned to receive and process
administrative procedures in the area of tourism may exploit information about
citizens' sex on the National Population Database and must not request citizens
to provide such information./.
