QUY ĐỊNH VIỆC NGỪNG CẤP PHÉP XUẤT KHẨU PHÂN BÓN CÓ NGUỒN GỐC NHẬP KHẨU THEO QUY ĐỊNH TẠI THÔNG TƯ SỐ 04/2006/TT-BTM NGÀY 06 THÁNG 4 NĂM 2006 CỦA BỘ THƯƠNG MẠI (NAY LÀ BỘ CÔNG THƯƠNG)

Căn cứ Nghị định số 189/2007/NĐ-CP ngày 27 tháng 12 năm 2007 của Chính phủ quy định chức năng, nhiệm vụ, quyền hạn và cơ cấu tổ chức của Bộ Công Thương;
Căn cứ Nghị định số 12/2006/NĐ-CP ngày 23 tháng 01 năm 2006 của Chính phủ quy định chi tiết thi hành Luật Thương mại về hoạt động mua bán hàng hoá quốc tế và các hoạt động đại lý mua, bán, gia công và quá cảnh hàng hoá với nước ngoài;

Bộ trưởng Bộ Công Thương quy định việc xuất khẩu phân bón có nguồn gốc nhập khẩu theo quy định tại Nghị định số 12/2006/NĐ-CP ngày 23 tháng 01 năm 2006 của Chính phủ Quy định chi tiết thi hành Luật Thương mại về hoạt động mua bán hàng hoá quốc tế và các hoạt động đại lý mua, bán, gia công và quá cảnh hàng hóa với nước ngoài như sau:

Điều 1. Quy định về xuất khẩu phân bón có nguồn gốc nhập khẩu

1. Tạm thời ngừng thực hiện việc cấp phép xuất khẩu phân bón có nguồn gốc nhập khẩu theo quy định tại điểm a khoản 4 mục IV Thông tư số 04/2006/TT-BTM ngày 06 tháng 4 năm 2006 của Bộ Thương mại (nay là Bộ Công Thương) hướng dẫn một số nội dung quy định tại Nghị định số 12/2006/NĐ-CP.

2. Thương nhân có nhu cầu xuất khẩu phân bón có nguồn gốc nhập khẩu làm thủ tục xuất khẩu tại cơ quan Hải quan theo quy định, không phải xin phép Bộ Công Thương. Việc nhận tiền thanh toán phân bón xuất khẩu phải được thực hiện qua ngân hàng bằng ngoại tệ tự do chuyển đổi.

Điều 2. Hiệu lực thi hành

Thông tư này có hiệu lực sau 45 ngày, kể từ ngày ký./.

CIRCULAR

SUSPENDING THE GRANT OF PERMITS FOR EXPORT OF FERTILIZERS ORIGINATING FROM IMPORTED SOURCES UNDER CIRCULAR NO. 04/2006/TT-BTM OF APRIL 6, 2006, OF THE MINISTRY OF TRADE (NOW THE MINISTRY OF INDUSTRY AND TRADE)

Pursuant to the Government's Decree No. 189/2007/ND-CP of December 27, 2007, defining the functions, tasks, powers and organizational structure of the Ministry- of Trade and Industry;
Pursuant to the Government's Decree No. 12/2006/ND-CP of January 23,. 2006, detailing the implementation of the Commercial Law regarding international goods trading, and goods trading agency, processing and transit with foreign parties;
The Minister of Industry and Trade provides for the export of fertilizers originating from imported sources under the Government's Decree No. 12/2006/ND-CP of January 23, 2006, detailing the implementation of the Commercial Law regarding international goods trading and goods trading agency, processing and transit with foreign parties, as follows:

Article 1. Export of fertilizers originating from imported sources

1. To suspend the grant of permits for export of fertilizers originating from imported sources prescribed at Point a. Clause 4. Section IV of Circular No. 04/2006/TT-BTM of April 6, 2006. of the Ministry of Trade (now the Ministry of Industry and Trade), guiding a number of provisions of Decree No. 12/2006/ND-CP.

2. Traders that wish to export fertilizers originating from imported sources may carry out export procedures at customs offices according to regulations without the Industry and Trade Ministry's permit. The receipt of payments for exported fertilizes shall be effected in freely convertible foreign currencies via banks.
