Căn cứ Quyết định số 307-TTg ngày 10-6-1994 của Thủ tướng Chính phủ quy định một số vấn đề về kinh doanh và sử dụng các sản phẩm thay thế sữa mẹ để hỗ trợ việc nuôi con bằng sữa mẹ.

Liên bộ Y tế - Thương mại - Văn hoá và Thông tin - Uỷ ban Bảo vệ và chăm sóc trẻ em Việt Nam hướng dẫn việc thực hiện cụ thể như sau:

I- NHỮNG QUY ĐỊNH CHUNG

1- Các sản phẩm thay thế sữa mẹ là sữa và các loại thức ăn cho trẻ em được chế tạo bằng phương pháp công nghiệp hoặc thủ công nghiệp dùng để thay thế hoàn toàn hoặc một phần sữa mẹ bao gồm các sản phẩm sữa, ngũ cốc, hỗn hợp rau, nước hoa quả, các loại chè, bình đựng sữa và đầu vú cao su.

2- Các cơ sở sản xuất, buôn bán, xuất khẩu, nhập khẩu các sản phẩm thay thế sữa mẹ có trách nhiệm bảo đảm tiêu chuẩn chất lượng và tiêu chuẩn vệ sinh đối với các sản phẩm này theo quy định của Bộ Y tế.

3- Việc tuyên truyền, giáo dục là một biện pháp quan trọng để thực hiện Quyết định của Thủ tướng Chính phủ số 307-TTg ngày 10-6-1994. Bộ Văn hoá và Thông tin, Uỷ ban Bảo vệ và chăm sóc trẻ em Việt Nam, Bộ Y tế, Bộ thương mại có trách nhiệm phối hợp với các cơ quan thông tin đại chúng, Hội Liên hiệp phụ nữ Việt Nam, Hội Nông dân Việt Nam và các tổ chức xã hội khác để tổ chức việc tuyên truyền, giáo dục các bà mẹ về tính ưu việt của sữa mẹ và duy trì việc nuôi con bằng sữa mẹ.

4- Việc thông tin và quảng cáo các sản phẩm thay thế sữa mẹ phải tuân theo quy định của pháp luật về thông tin, quảng cáo và các quy định của Thông tư này.

II- QUY ĐỊNH CỤ THỂ VỀ KINH DOANH CÁC SẢN PHẨM THAY THẾ SỮA MẸ

1- Bộ Thương mại chỉ cấp giấy phép nhập khẩu các sản phẩm thay thế sữa mẹ sau khi có ý kiến của Bộ Y tế.

2- Trình tự xét cấp giấy phép nhập khẩu các sản phẩm thay thế sữa mẹ:

a) Các doanh nghiệp xin cấp giấy phép nhập khẩu các sản phẩm thay thế sữa mẹ phải gửi hồ sơ đầy đủ theo quy định của Bộ Thương mại đến Bộ Y tế xin ý kiến. Trong thời gian 20 ngày kể từ ngày nhận đủ hồ sơ, Bộ Y tế phải xem xét và gửi ý kiến tới Bộ Thương mại (Phòng cấp giấy phép).

b) Chậm nhất 15 ngày kể từ ngày nhận hồ sơ và ý kiến bằng văn bản của Bộ Y tế, Bộ Thương mại có trách nhiệm xem xét cấp hoặc không cấp, nếu không cấp phải trả lời bằng văn bản nêu rõ lý do.

3- Các doanh nghiệp được cấp giấy phép nhập khẩu các sản phẩm thay thế sữa mẹ muốn nhập khẩu các sản phẩm này phải đưa sản phẩm mẫu và hồ sơ của sản phẩm đến Bộ Y tế. Sau khi được Bộ Y tế cấp giấy chứng nhận đủ tiêu chuẩn vệ sinh an toàn thực phẩm đối với sản phẩm mẫu, doanh nghiệp đến Phòng cấp giấy phép của Bộ Thương mại tại khu vực doanh nghiệp đó đóng trụ sở chính để nhận giấy phép không phải qua Bộ Thương mại.

4- Mặt hàng ghi trong hợp đồng nhập khẩu các sản phẩm thay thế sữa mẹ phải là các mặt hàng trong danh mục đã được Bộ Y tế đồng ý cho nhập và Bộ Thương mại cấp giấy phép nhập khẩu.

III- QUY ĐỊNH VỀ THÔNG TIN, GIÁO DỤC, QUẢNG CÁO CÁC SẢN PHẨM THAY THẾ SỮA MẸ

1- Các Hội chợ, triển lãm thương mại có liên quan đến sản phẩm thay thế sữa mẹ tổ chức tại Việt Nam đều phải có giấy phép của Bộ Thương mại sau khi được sự chấp thuận của Bộ Y tế.

2- Các chương trình thông tin về bảo vệ sức khoẻ bà mẹ và trẻ em phải dành sự ưu tiên cho thông tin giáo dục về lợi ích của việc nuôi con bằng sữa mẹ và các phương pháp nuôi dưỡng trẻ sơ sinh, trẻ nhỏ.

3- Các cơ quan thông tin đại chúng có trách nhiệm phản ánh trung thực, đầy đủ về tính ưu việt của sữa mẹ đối với trẻ sơ sinh, trẻ nhỏ, chỉ sử dụng các sản phẩm thay thế sữa mẹ theo sự chỉ dẫn của cán bộ y tế.

4- Việc quảng cáo các sản phẩm thay thế sữa mẹ phải tuân theo quy định tại Điều 4, 5 của Quyết định số 307-TTg ngày 10-6-1994 của Thủ tướng Chính phủ.

5- Trong nhãn hiệu của các sản phẩm thay thế sữa mẹ và nội dung quảng cáo các sản phẩm này không được có lời bình hoặc bức tranh nhằm tuyên truyền cho việc kinh doanh hoặc khuyến khích việc sử dụng sản phẩm, không được quảng cáo các sản phẩm sữa có đầy đủ các chất như sữa mẹ hoặc có thể thay thế hoàn toàn sữa mẹ.

6- Các tổ chức, cá nhân không được quảng cáo, trưng bày các sản phẩm thay thế sữa mẹ tại các cơ sở y tế.

IV- ĐIỀU KHOẢN THI HÀNH

1- Bộ Y tế, Bộ thương mại, Bộ Văn hoá và Thông tin, Uỷ ban Bảo vệ và chăm sóc trẻ em Việt Nam có trách nhiệm phổ biến Quyết định số 307-TTg và Thông tư này xuống các đơn vị trực thuộc và địa phương, đồng thời phối hợp thực hiện các quy định có liên quan, tăng cường công tác thanh tra, kiểm tra để làm tốt việc khuyến khích, duy trì nuôi con bằng sữa mẹ và sử dụng hợp lý các sản phẩm thay thế sữa mẹ.

2- Người vi phạm các quy định trong Thông tư này, tuỳ theo mức độ vi phạm sẽ bị xử lý kỷ luật, xử phạt hành chính hoặc truy cứu trách nhiệm hình sự, nếu gây thiệt hại thì phải bồi thường theo quy định của pháp luật, mức phạt tiền của xử phạt vi phạm hành chính được áp dụng theo Khoản 3 Điều 11 của Quyết định số 307-TTg ngày 10-6-1994 của Thủ tướng Chính phủ.

3- Thông tư này có hiệu lực kể từ ngày ký.

Trong quá trình thực hiện có gì khó khăn xin phản ánh về liên Bộ để nghiên cứu, sửa đổi, bổ sung cho phù hợp.

INTER-MINISTERIAL CIRCULAR

GUIDING THE IMPLEMENTATION OF DECISION No. 307-TTg OF THE PRIME MINISTER ON THE 10TH OF JUNE 1994 PROVIDING FOR SOME QUESTIONS RELATED TO THE TRADE IN AND USE OF SUBSTITUTES FOR BREAST MILK IN SUPPORT OF BREAST FEEDING

Pursuant to Decision No. 307-TTg of the Prime Minister on the 10th of June 1994 providing for some questions related to the and use of substitutes for breast milk in support of breast feeding.
The Ministries of Public Health, Trade, Culture and Information, and the Vietnam Committee for Child Protection and Care provide the following guidance on the implementation of the Decision:

I - GENERAL PROVISIONS:

1. The substitutes for breast milk are milk and foods produced for children by industrial or handicraft methods for use as full or particle substitutes for breast milk, including products prepared from milk products, cereals, vegetable compound, fruit juice, and different kinds of concoctions, the milk bottle and teats.

2. Those organizations which produce, trade in, export and import substitutes for breast milk must ensure the quality and hygienic standards of these products as stipulated by the Ministry of Public Health.

3. Publicity and education are an important measure for carrying out the Prime Minister's Decision No. 307-TTg on the 10th of June 1994. The Ministry of Culture and Information, the Vietnam Committee for Child Protection and Care, the Ministry of Public Health and the Ministry of Trade must cooperate with the mass media, the Vietnam Women's Union, the Vietnam Peasants' Association and other social organizations to organize a publicity and education campaign to convince the mothers of the superiority of breast milk and to persist in breast feeding.

4. The information and advertisement about substitutes for breast milk must comply with the law on information and advertisement and the stipulations of this Circular.

1. The Ministry of Trade will issue a permit for the import of breast milk substitutes only after getting the consent of the Ministry of Public Health.

2. The procedure of considering the granting of a permit for the import of substitutes for breast milk:

a/ Any business applying for the import of substitutes for breast milk must send a complete dossier as stipulated by the Ministry of Trade to the Ministry of Public Health for approval. Within 20 days after receiving the dossier, the Ministry of Public Health must consider it and send its opinion to the Ministry of Trade (the Permit-Issuing Bureau).

b/ Within 15 days at the latest after receiving the dossier and the written opinion of the Ministry of Public Health, the Ministry of Trade must consider whether or not to grant the permit. If it refuses to grant the permit, it must give a written reply saying clearly the reason why.

3. When a business which is permitted to import substitutes for breast milk want to import these products, it must send samples and the dossier of the product (as enclosed appendix) to the Ministry of Public Health. After receiving a paper from the Ministry of Public Health verifying that the samples meet the hygienic and safety standards set for foods, the business concerned may come to the Permit-Issuing Bureau of the Ministry of Trade at the locality where its Head-office is based to receive the permit without having to go to the Ministry of Trade.

4. The items listed in the contract for the import of substitutes for breast milk must be on the list to which the Ministry of Public Health has given its approval and the Ministry of Trade has granted an import permit.

III.- STIPULATIONS ON THE INFORMATION, EDUCATION AND ADVERTISEMENT OF SUBSTITUTES FOR BREAST MILK:

1. Any trade fair or commercial exhibition related to substitutes for breast milk organized in Vietnam must have a permit from the Ministry of Trade after getting the approval of the Ministry of Public Health.

2. Any information program on the protection of the health of mothers and children must give priority to the information on the benefits of breast feeding and on the methods of nursing babies and children.

4. The advertisement for substitutes for breast milk must abide by the prescriptions at Article 4 and 5 of the Prime Minister's Decision No. 307-TTg on the 10th of June 1994.

5. The labels of substitutes for breast milk and their advertisement should not contain any comment or picture encouraging the trading and use of these products, or saying that these products are as nutritious as breast milk, or can fully replace breast milk.

6. No organization or individual is allowed to advertise or exhibit substitutes for breast milk at medical institutions.

IV.- PROVISIONS FOR IMPLEMENTATION:

1. The Ministry of Public Health, the Ministry of Trade, the Ministry of Culture and Information, the Vietnam Committee for Child Protection and Care must make known Decision No.307-TTg and this Circular to their affiliate organizations and all localities, and at the same time, cooperate with one another in carrying out the stipulations concerned and increase their inspection and supervision to ensure that breast feeding should be maintained and encouraged and that the substitutes for breast milk should be used rationally.

2. Anyone who infringes on the stipulations of this Circular will be disciplined, fined or investigated for penal liability, depending on extent of the violation. If he/she causes damage, he/she must compensate for it in accordance with law. The fine for such infringement will be exacted in accordance with Point 3, Article 11, of the Prime Minister's Decision No.307-TTg on the 10th of June 1994.

3. This Circular takes effect upon the date of its signing.

While carrying out this Circular, if there is any difficulty, please report it to the Ministries concerned for study, modification or supplementation.
