QUY ĐỊNH DANH MỤC CHẤT CẤM SỬ DỤNG TRONG SẢN XUẤT, KINH DOANH THỰC PHẨM BẢO VỆ SỨC KHỎE

Căn cứ Luật an toàn thực phẩm ngày 17 tháng 6 năm 2010;

Căn cứ Nghị định số 15/2018/NĐ-CP ngày 02 tháng 02 năm 2018 của Chính phủ Quy định chi tiết thi hành một số điều của Luật An toàn thực phẩm;

Căn cứ Nghị định số 75/2017/NĐ-CP ngày 20 tháng 6 năm 2017 của Chính phủ Quy định chức năng, nhiệm vụ, quyền hạn và cơ cấu tổ chức của Bộ Y tế;

Theo đề nghị của Cục trưởng Cục An toàn thực phẩm;

Bộ trưởng Bộ Y tế ban hành Thông tư quy định Danh mục chất cấm sử dụng trong sản xuất, kinh doanh thực phẩm bảo vệ sức khỏe.

Điều 1. Phạm vi điều chỉnh và đối tượng áp dụng

1. Thông tư này quy định Danh mục chất cấm sử dụng trong sản xuất, kinh doanh thực phẩm bảo vệ sức khỏe.

2. Thông tư này áp dụng đối với tổ chức, cá nhân Việt Nam; tổ chức, cá nhân nước ngoài tại Việt Nam tham gia sản xuất, kinh doanh thực phẩm bảo vệ sức khỏe; tổ chức, cá nhân có hoạt động liên quan đến thực phẩm bảo vệ sức khỏe tại Việt Nam.

Điều 2. Nguyên tắc xây dựng Danh mục chất cấm sử dụng trong sản xuất, kinh doanh thực phẩm bảo vệ sức khỏe

1. Bảo đảm phù hợp với các quy định của pháp luật và có cơ sở khoa học.

2. Phù hợp với thông lệ quốc tế và thực tiễn quản lý an toàn thực phẩm tại Việt Nam.

3. Kịp thời cập nhật, sửa đổi, bổ sung Danh mục để đáp ứng yêu cầu bảo vệ sức khỏe và yêu cầu quản lý nhà nước.

4. Chất đưa vào Danh mục là chất có khả năng gây hại đến sức khỏe hoặc tính mạng người sử dụng hoặc các chất không thuộc loại dùng trong thực phẩm.

Điều 3. Danh mục chất cấm sử dụng trong sản xuất, kinh doanh thực phẩm bảo vệ sức khỏe

Chất cấm sử dụng trong sản xuất, kinh doanh thực phẩm bảo vệ sức khỏe, bao gồm chất có trong các Danh mục sau:

1. Phụ lục V “Danh mục thuốc, nguyên liệu làm thuốc cấm nhập khẩu, cấm sản xuất” ban hành kèm theo Nghị định số 54/2017/NĐ-CP ngày 08 tháng 5 năm 2017 của Chính phủ quy định chi tiết một số điều và biện pháp thi hành Luật dược.

2. Danh mục I "Các chất ma túy tuyệt đối cấm sử dụng trong y học và đời sống xã hội; Việc sử dụng các chất này trong phân tích, kiểm nghiệm, nghiên cứu khoa học, điều tra tội phạm theo quy định đặc biệt của cơ quan có thẩm quyền"; Danh mục II "Các chất ma túy được dùng hạn chế trong phân tích, kiểm nghiệm, nghiên cứu khoa học, điều tra tội phạm hoặc trong lĩnh vực y tế theo quy định của cơ quan có thẩm quyền"; Danh mục III "Các chất ma túy được dùng trong phân tích, kiểm nghiệm, nghiên cứu khoa học, điều tra tội phạm hoặc trong lĩnh vực y tế, thú y theo quy định của cơ quan có thẩm quyền"; Danh mục IVA "Các tiền chất thiết yếu, tham gia vào cấu trúc chất ma túy" ban hành kèm theo Nghị định số 73/2018/NĐ-CP ngày 15 tháng 5 năm 2018 của Chính phủ quy định các danh mục chất ma túy và tiền chất.

3. Phụ lục I “Danh mục dược chất gây nghiện” ban hành kèm theo Thông tư số 20/2017/TT-BYT ngày 10 tháng 5 năm 2017 của Bộ trưởng Bộ Y tế Quy định chi tiết một số điều của Luật dược và Nghị định số 54/2017/NĐ-CP ngày 08 tháng 5 năm 2017 của Chính phủ về thuốc và nguyên liệu làm thuốc phải kiểm soát đặc biệt.

4. Danh mục Thuốc độc và nguyên liệu độc làm thuốc ban hành kèm theo Thông tư số 06/2017/TT-BYT ngày 03 tháng 5 năm 2017 của Bộ trưởng Bộ Y tế ban hành Danh mục Thuốc độc và nguyên liệu độc làm thuốc.

5. Phụ lục I “Danh mục dược liệu có độc tính nguồn gốc thực vật”; Phụ lục II “Danh mục dược liệu có độc tính nguồn gốc động vật”; Phụ lục III “Danh mục dược liệu có độc tính nguồn gốc khoáng vật” ban hành kèm theo Thông tư số 42/2017/TT-BYT ngày 13 tháng 11 năm 2017 của Bộ trưởng Bộ Y tế Ban hành Danh mục dược liệu độc làm thuốc, trừ các dược liệu có dấu (*) đã được chế biến theo đúng phương pháp chế biến do Bộ trưởng Bộ Y tế quy định tại Thông tư số 30/2017/TT-BYT ngày 11 tháng 7 năm 2017 hướng dẫn phương pháp chế biến các vị thuốc cổ truyền và bảo đảm an toàn khi làm thực phẩm.

6. Danh mục các chất có trong Phụ lục ban hành kèm theo Thông tư này.

Điều 4. Hiệu lực thi hành

1. Thông tư này có hiệu lực thi hành kể từ ngày 01 tháng 9 năm 2021.

2. Trường hợp các văn bản quy phạm pháp luật được dẫn chiếu trong Thông tư này có sự thay đổi, bổ sung hoặc được thay thế thì áp dụng thực hiện theo quy định tại văn bản mới.

Điều 5. Tổ chức thực hiện

1. Cục An toàn thực phẩm (Bộ Y tế) có trách nhiệm:

a) Chủ trì phối hợp với các đơn vị có liên quan quan phổ biến, hướng dẫn và triển khai thực hiện Thông tư này;

b) Chỉ đạo các đơn vị tham gia kiểm nghiệm thực phẩm bảo vệ sức khỏe xây dựng phương pháp, đầu tư nhân lực, trang thiết bị kiểm nghiệm để đáp ứng yêu cầu kiểm nghiệm các chất có trong Danh mục chất cấm quy định tại Thông tư này.

2. Sở Y tế, Ban Quản lý an toàn thực phẩm các tỉnh, thành phố trực thuộc trung ương có trách nhiệm tổ chức thực hiện, Sở Y tế chỉ đạo các Chi cục An toàn vệ sinh thực phẩm và các đơn vị liên quan kiểm tra và giám sát các tổ chức, cá nhân sản xuất, kinh doanh thực phẩm bảo vệ sức khỏe tại địa phương.

Trong quá trình thực hiện Thông tư này, nếu có khó khăn, vướng mắc đề nghị các cơ quan, tổ chức, cá nhân báo cáo về Bộ Y tế (Cục An toàn thực phẩm) để xem xét, giải quyết./.

CIRCULAR

PRESCRIBING NOMENCLATURE LIST OF AGENTS PROHIBITED FROM PRODUCTION AND BUSINESS OF HEALTH PROTECTION FOOD

Pursuant to the Law on Food Safety dated June 17, 2010;

Pursuant to the Government's Decree No. 15/2018/ND-CP dated February 2, 2018, elaborating on implementation of a number of articles of the Law on Food Safety;

Pursuant to the Government's Decree No. 75/2017/ND-CP dated June 20, 2017, defining the functions, tasks, powers and organizational structure of the Ministry of Health;

Upon the request of the Director of Vietnam Food Administration;

The Minister of Health hereby promulgates the Circular on the Nomenclature List of agents prohibited from production and business of health protection food.

Article 1. Scope and subjects of application

2. This Circular shall apply to domestic entities and persons; foreign entities and persons in Vietnam that are involved in production and business of health protection food; entities and persons whose operations relate to health protection food in Vietnam.

Article 2. Compilation principles

1. Ensure compliance with laws and scientificity.

2. Accord with international practices and reality of food safety administration in Vietnam.

3. Punctually update and revise the Nomenclature List to meet health protection and state management requirements.

4. Ensure that agents included in the List are those likely to harm the health or life of users or those that are not food-grade.

Article 3. Nomenclature List

Agents prohibited from production and business of health protection food comprise substances included in the followings:

1. Appendix V - “List of pharmaceuticals and medicinal ingredients prohibited from import or export” to the Government’s Decree No. 54/2017/ND-CP dated May 8, 2017, elaborating on several articles and measures for implementation of the Law on Pharmacy.

3. Appendix I – “List of narcotic active ingredients” to the Circular No. 20/2017/TT-BYT dated May 10, 2017 of the Minister of Health, elaborating some Articles of the Law on Pharmacy and the Government's Decree No. 54/2017/ND-CP on drugs and medicinal ingredients subject to special control.

4. The List of Toxic Drugs and Toxic Medicinal Ingredients annexed to the Circular No. 06/2017/TT-BYT dated May 3, 2017 of the Minister of Health, promulgating the List of Toxic Drugs and Toxic Medicinal Ingredients.

5. Appendix I - “List of toxic medicinal substances of plant origin”; Appendix II – “List of toxic medicinal substances of animal origin”; Appendix III – “List of toxic medicinal substances of mineral origin” to the Circular No. 42/2017/TT-BYT dated November 13, 2o17 of the Minister of Health, issuing the Lists of toxic medicinal substances, except those with (*) that are formulated according to methods regulated by the Minister of Health under the Circular No. 30/2017/TT-BYT dated July 11, 2017, providing instructions about methods for formulation of traditional medicines and assurance of safety for production of food.

6. The List of agents included in the Appendix to this Circular.

Article 4. Entry into force

1. This Circular shall enter into force as of September 1, 2021.

2. If legislative documents used as referents herein are revised, supplemented or replaced, new versions shall be applied.

Article 5. Implementation

1. Vietnam Food Administration (Ministry of Health) shall assume the following responsibilities:

b) Directing its affiliates participating in testing of health protection food to develop test methods, invest in testing personnel and equipment to meet the requirements for testing of agents included in the list of prohibited agents regulated herein.    

2. Departments of Health, Food Safety Management Boards of provinces and centrally-affiliated cities shall be responsible for implementing this Circular while Departments of Health shall be responsible for directing Subdepartments of Food Safety and Hygiene and related units to inspect and supervise local entities and persons manufacturing and trading health protection food. 

In the course of implementation of this Circular, should there be any query or difficulty, entities, organizations and persons need to inform the Ministry of Health (Vietnam Food Administration) to seek their solutions./.
