QUY ĐỊNH MỨC LƯƠNG TỐI THIỂU VÙNG ĐỐI VỚI NGƯỜI LAO ĐỘNG LÀM
VIỆC Ở CÔNG TY, DOANH NGHIỆP, HỢP TÁC XÃ, TỔ HỢP TÁC, TRANG TRẠI, HỘ GIA ĐÌNH,
CÁ NHÂN VÀ CÁC TỔ CHỨC KHÁC CỦA VIỆT NAM CÓ THUÊ MƯỚN LAO ĐỘNG

Căn cứ Luật
Tổ chức Chính phủ ngày 25 tháng 12 năm 2001;
Căn cứ Bộ luật Lao động ngày 23 tháng 06 năm 1994; Luật sửa đổi, bổ sung một số
điều của Bộ luật Lao động ngày 02 tháng 04 năm 2002; Luật sửa đổi, bổ sung một
số điều của Bộ luật Lao động ngày 29 tháng 06 năm 2006;
Căn cứ Nghị quyết số 56/2006/NQ-QH11 ngày 29
tháng 06 năm 2006 của Quốc hội khoá XI về kế hoạch phát triển kinh tế - xã hội
5 năm giai đoạn 2006 - 2010;
Xét đề nghị của Bộ trưởng Bộ Lao động - Thương binh và Xã hội,
NGHỊ ĐỊNH:
Điều 1. Quy định
mức lương tối thiểu vùng áp dụng đối với:
1. Công ty được
thành lập, tổ chức quản lý và hoạt động theo Luật Doanh nghiệp nhà nước.
2. Công ty
trách nhiệm hữu hạn một thành viên do Nhà nước sở hữu 100% vốn điều lệ được tổ
chức quản lý và hoạt động theo Luật Doanh nghiệp.
3. Doanh nghiệp
thành lập, tổ chức quản lý và hoạt động theo Luật Doanh nghiệp (không bao gồm
doanh nghiệp có vốn đầu tư nước ngoài).
4. Hợp tác xã,
liên hiệp hợp tác xã, tổ hợp tác, trang trại, hộ gia đình, cá nhân và các tổ chức
khác của Việt Nam có thuê mướn lao động.
Các công ty,
doanh nghiệp, tổ chức, cá nhân quy định tại các khoản 1, 2, 3 và 4 Điều này gọi
chung là doanh nghiệp.
Điều 2. Mức lương tối thiểu vùng
dùng để trả công đối với người lao động làm công việc giản đơn nhất trong điều
kiện lao động bình thường ở các doanh nghiệp quy định tại Điều 1 Nghị định này
thực hiện từ ngày 01 tháng 01 năm 2008 theo các vùng như sau:
1. Mức 620.000
đồng/tháng áp dụng đối với doanh nghiệp hoạt động trên địa bàn các quận thuộc
thành phố Hà Nội, thành phố Hồ Chí Minh.
2. Mức 580.000
đồng/tháng áp dụng đối với doanh nghiệp hoạt động trên địa bàn các huyện thuộc
thành phố Hà Nội, thành phố Hồ Chí Minh; các quận thuộc thành phố Hải Phòng;
thành phố Hạ Long thuộc tỉnh Quảng Ninh; thành phố Biên Hoà, thị xã Long Khánh,
các huyện Nhơn Trạch, Long Thành, Vĩnh Cửu và Trảng Bom thuộc tỉnh Đồng Nai; thị
xã Thủ Dầu Một, các huyện: Thuận An, Dĩ An, Bến Cát và Tân Uyên thuộc tỉnh Bình
Dương; thành phố Vũng Tàu thuộc tỉnh Bà Rịa - Vũng Tàu.
3. Mức 540.000
đồng/tháng áp dụng đối với doanh nghiệp hoạt động trên các địa bàn còn lại.
Điều 3.
1. Doanh nghiệp quy định tại khoản 1 và khoản 2 Điều 1 Nghị định
này áp dụng mức lương tối thiểu vùng quy định tại Điều 2 Nghị định này để tính
đơn giá tiền lương.
Đối với doanh
nghiệp quy định tại khoản 1 Điều 1 Nghị định này bảo đảm các điều kiện quy định
tại Điều 4 Nghị định số 206/2004/NĐ-CP ngày 14 tháng 12 năm
2004 của Chính phủ quy định quản lý lao động, tiền lương, thu nhập trong các
công ty nhà nước thì được áp dụng hệ số điều chỉnh tăng thêm không quá 1,34 lần
so với mức lương tối thiểu chung; trường hợp bảo đảm các điều kiện quy định tại
Điều 4 Nghị định số 206/2004/NĐ-CP và có lợi nhuận kế hoạch
cao hơn từ 5% trở lên so với lợi nhuận thực hiện của năm trước liền kề thì áp dụng
hệ số điều chỉnh tăng thêm tối đa không quá 2 lần so với mức lương tối thiểu
chung quy định tại Nghị định số 166/2007/NĐ-CP ngày 16 tháng 11 năm 2007 để
tính đơn giá tiền lương.
2. Đối với
doanh nghiệp quy định tại khoản 3 và khoản 4 Điều 1 Nghị định này:
a) Áp dụng mức
lương tối thiểu vùng quy định tại Điều 2 Nghị định này để tính các mức lương
trong thang lương, bảng lương, các loại phụ cấp lương, tính các mức lương ghi
trong hợp đồng lao động và thực hiện các chế độ khác do doanh nghiệp xây dựng
và ban hành theo thẩm quyền do pháp luật lao động quy định.
b) Mức tiền
lương thấp nhất trả cho người lao động đã qua học nghề (kể cả lao động do doanh
nghiệp tự dạy nghề) phải cao hơn ít nhất 7% so với mức lương tối thiểu vùng quy
định tại Điều 2 Nghị định này.
c) Khuyến khích
các doanh nghiệp thực hiện mức lương tối thiểu cao hơn mức lương tối thiểu vùng
quy định tại Điều 2 Nghị định này.
d) Căn cứ mức
lương tối thiểu vùng quy định tại Điều 2 Nghị định này, doanh nghiệp điều chỉnh
lại tiền lương trong hợp đồng lao động cho phù hợp.
Điều 4.
1. Mức lương tối thiểu vùng quy định tại Điều 2 Nghị định này
được điều chỉnh tuỳ thuộc vào mức tăng trưởng kinh tế, chỉ số giá sinh hoạt và
cung cầu lao động theo từng thời kỳ.
2. Bộ Lao động
- Thương binh và Xã hội sau khi lấy ý kiến Tổng Liên đoàn Lao động Việt Nam, đại
diện người sử dụng lao động và Bộ, ngành liên quan trình Chính phủ điều chỉnh mức
lương tối thiểu vùng quy định tại Điều 2 Nghị định này.
Điều 5. Nghị định này có hiệu lực
thi hành kể từ ngày 01 tháng 01 năm 2008.
Bộ Lao động -
Thương binh và Xã hội chịu trách nhiệm hướng dẫn thi hành Nghị định này.
Điều 6. Các Bộ
trưởng, Thủ trưởng cơ quan ngang Bộ, Thủ trưởng cơ quan thuộc Chính phủ, Chủ tịch
Ủy ban nhân dân tỉnh, thành phố trực thuộc Trung ương chịu trách nhiệm thi hành
Nghị định này./.

DECREE PROVIDING
AREA MINIMUM WAGE RATES FOR EMPLOYEES WORKING FOR [VIETNAMESE] COMPANIES,
ENTERPRISES, CO-OPERATIVES, CO-OPERATIVE GROUPS, FARMS, FAMILY HOUSEHOLDS,
INDIVIDUALS AND OTHER VIETNAMESE ORGANIZATIONS WHICH HIRE EMPLOYEES THE GOVERNMENT Pursuant to the Law on
Organization of the Government dated 25 December 2001;
Pursuant to the Labour Code dated 23 June 1994, the Law on Amendment of the
Labour Code dated 2 April 2002, and the Law on Amendment of the Labour Code
dated 29 June 2006;
Pursuant to Resolution 56-2006-NQ-QH11 of Legislature 11 of the National
Assembly dated 29 June 2006 on the socio-economic developmental master plan for
the five year period 2006 - 2010;
Having considered the proposal of the Minister of Labour, War Invalids and
Social Affairs; DECREES: Article 1 The area minimum wage rate is
hereby regulated and shall apply to the following: 1. Companies established and
which organize their management and operate pursuant to the Law on State

which organize their management and operate pursuant to the Law on
Enterprises (excluding enterprises with foreign owned capital). 4. Co-operatives, federations of
co-operatives, co-operative groups, farms, family households, individuals and
other Vietnamese organizations which hire employees. All the companies,
enterprises, organizations and individuals stipulated in clauses 1 to 4
inclusive of this article are hereinafter collectively referred to as enterprises.
Article 2 The area minimum wage rate to be
used to pay employees doing the most basic work in normal working conditions at
the enterprises stipulated in article 1 of this Decree as from 1 January 2008
shall be as follows: 1. Six hundred and twenty
thousand (620,000) Vietnamese Dong per month, applicable to enterprises
operating in inner city districts of Hanoi and Ho Chi Minh City. 2. Five hundred and eighty
thousand (580,000) Vietnamese Dong per month, applicable to enterprises
operating in outer city districts of Hanoi and Ho Chi Minh City; in inner city
districts of Hai Phong; in the city of Ha Long in the province of Quang Ninh;
in the city of Bien Hoa, in the township of Long Khanh, and in the rural
districts of Nhon Trach, Long Thanh, Vinh Cuu and Trang Bom in the province of
Dong Nai; in the township of Thu Dau Mot and in the rural districts of Thuan
An, Di An, Ben Cat and Tan Uyen in the province of Binh Duong; and in the city
of Vung Tau in the province of Ba Ria Vung Tau. Article 3 1. The enterprises stipulated in
clauses 1 and 2 of article 1 of this Decree shall apply the area minimum wage
rates stipulated in article 2 of this Decree in order to calculate their wage
unit cost. The enterprises stipulated in article 1 of this Decree which ensure
the conditions stipulated in article 4 of Decree 206-2004-ND-CP of the
Government dated 14 December 2004 on labour management, wages and income in
state owned companies, shall apply an increase co-efficient not to exceed 1.34
times the general minimum wage rate. If such enterprises ensure the condition

(a) Shall apply the area minimum
wage rates stipulated in article 2 of this Decree in order to calculate wage
scales, wage tables, and all types of allowances; and for calculating wage
rates to be recorded in labour contracts and for implementing other regimes
formulated by the enterprise and promulgated by it in accordance with its
authority as provided in the law on labour. (b) The lowest wage rates
payable for employees who have passed vocational training courses (including
courses which the enterprise itself holds) must be at least 7% higher than the
area minimum wage rates stipulated in article 2 of this Decree. (c) Enterprises are encouraged
to pay higher area minimum wage rates than those stipulated in article 2 of
this Decree. (d) Based on the area minimum
wage rates stipulated in article 2 of this Decree, an enterprise shall adjust
the amount of wages stipulated in labour contracts accordingly. Article 4 1. The area minimum wage rates
stipulated in article 2 of this Decree shall be amended depending on the
economic growth rate, the cost of living index, and labour supply and demand at
any one time. 2. The Ministry of Labour, or
Invalids and Social Affairs shall, after consultation with the Vietnam General
Confederation of Labour, representatives of employers and relevant ministries
and branches, make submissions to the government for amendment of the area
minimum wage rates stipulated in clause 2 of this article. Article 5 This Decree shall be of full

Article 6 Ministers, heads of ministerial
equivalent bodies, heads of Government bodies, chairmen of people's committees
of provinces and cities under central authority and the organizations and
individuals concerned shall be responsible for implementation of this Decree. FOR THE
