CIRCULAR

FORMULATION, APPROVAL AND IMPLEMENTATION OF LOCAL PLANNING FOR PASSIVE TELECOMMUNICATIONS INFRASTRUCTURE

Pursuant to the Law on Telecommunications dated November 23, 2009;

Pursuant to the Law on Construction dated November 26, 2003;

Pursuant to the Law on Urban Planning dated June 17, 2009;

Pursuant to the Government’s Decree No. 25/2011/ND-CP dated April 06, 2011 detailing and guiding the implementation of the Law on Telecommunications;

Pursuant to the Government’s Decree No. 92/2006/ND-CP dated September 07, 2006 on formulation, approval and management of the master plan for socio-economic development and the Government’s Decree No. 04/2008/ND-CP dated January 11, 2008 providing amendments to the Government’s Decree No. 92/2006/ND-CP dated September 07, 2006 on formulation, approval and management of the master plan for socio-economic development;

Pursuant to the Government’s Decree No. 187/2007/ND-CP dated December 25, 2007 defining the functions, tasks, powers and organizational structure of Ministry of Information and Communications and the Government’s Decree No. 50/2011/ND-CP dated June 24, 2011 on amendments to the Government’s Decree No. 187/2007/ND-CP dated December 25, 2007 defining the functions, tasks, powers and organizational structure of Ministry of Information and Communications;

At the request of Director of Vietnam Telecommunications Authority,

Minister of Information and Communications promulgates a Circular providing guidance on the formulation, approval and implementation of local planning for passive telecommunications infrastructure.

Chapter 1.

GENERAL PROVISIONS

Article 1. Scope

This Circular provides guidance on the formulation, approval and implementation of planning for local passive telecommunications infrastructure with respect to significant telecommunications works relating national security, points of public telecommunications service and outside network.

In addition to these contents, based on the reality of each local area and pursuant to application regulations of law, a local planning may include other contents concerning local passive telecommunications infrastructure.

Article 3. Interpretation of terms

For the purposes of this document, these terms are construed as follows:

1. "local area" refers to central-affiliated cities or provinces.

2. “significant telecommunications works relating national security” refers to telecommunications works whose nature, characteristics and scale are conformable with criteria for significant telecommunications works relating national security provided for in the Prime Minister’s Decision No. 45/2012/QD-TTg dated October 23, 2012.

3. “point of public telecommunications service” (hereinafter referred to as “PPTS”) refers to a location where terminal devices and other relevant telecommunications equipment are installed, managed and operated by a telecommunications enterprise so as to provide telecommunications services to clients, including: points of public telecommunications service with attendants (hereinafter referred to as “D1-type PPTS”) and points of public telecommunications service without attendants (hereinafter referred to as “D2-type PPTS”).

4. “outside network” is a part of the telecommunications network, including cable system, antenna system and other telecommunications equipment and systems located outside telecommunications buildings or stations.

5. “passive telecommunications infrastructure” includes telecommunications buildings, telecommunications stations, antenna masts, aerial cable posts and underground infrastructural constructions (such as conduits/duct, jointing chamber, trench and tunnel, etc.) leased or constructed by authorities, organizations or enterprises that possess telecommunications license or frequency license to install telecommunications equipment.

6. “telecommunications station” refers to a building or equivalent structure constructed to install network equipment.

7. “antenna mast” refers to a tall structure designed to install radio transmitters and receivers (excluding antenna for radio or television receivers of households).

a) “A1a-type antenna masts or self-supporting antenna masts” are installed on structures. Maximum height of an A1a-type antenna mast (including antenna but lightning rod) is 03m. It shall not be taller than 20% of the height of structure. The width measured from the center of the mast to the outermost point of the mast (including lever arms of the mast and antenna) shall not be longer than 0.5m.

b) “A1b-type antenna masts or eco-friendly antenna masts” are designed and installed in existing structures, or disguised as handrails, porches, arches, window sills, air-conditioner covers, water tanks, clock towers, or other sculpture works, etc., or carefully installed on power poles or lamp-posts, or disguising features in harmony with surrounding areas. Heights and widths of these masts conform to regulations in Point a Clause 8 of this Article.

9. “A2-type antenna masts" include:

a) “A2a-type antenna masts" are installed on structures and not qualified as A1-type antenna masts prescribed in Clause 8 of this Article;

b) “A2b-type antenna masts" are installed on ground;

c) “A2c-type antenna masts" are any antenna masts other than A1a, A1b, A2a or A2b-type antenna masts.

10. “aerial cable post” refers to a structure made of steel or reinforced concrete or other materials and used to suspend aerial cable in compliance with the national technical regulation QCVN 33:2011/BTTTT – Installation of outside telecommunications cable network with respect to insulated telecommunications cable posts (hereinafter referred to as “C1-type cable posts”), or relevant technical regulations and/or standards for cable posts shared with other sectors such as power stations or lamp-posts, etc. (hereinafter referred to as “C2-type cable posts”).

11. "underground infrastructure” (such as cable ducts, cable jointing chambers, trenches and tunnels, etc.) refers to infrastructural structures constructed under the ground so as to install cable in conformity with the national technical regulation QCVN 33:2011/BTTTT – Installation of outside telecommunications cable network with respect to insulated underground telecommunications infrastructure (hereinafter referred to as “N1-type underground infrastructure”), or relevant technical regulations and/or standards for underground telecommunications infrastructure shared with other sectors such as underground utility infrastructure to serve electrical/ lighting systems, water systems or energy supply systems, etc. (hereinafter referred to as “N2-type underground infrastructure”).

Article 5. General requirements

1. Planning for local passive telecommunications infrastructure must be conformable and in harmony with the national telecommunications development planning, local socio-economic development planning, urban development planning, local infrastructure development planning in other sectors and relevant technical regulations and standards.

2. Planning for passive telecommunications infrastructure must meet requirements for sharing of infrastructural constructions between authorities, organizations and enterprises as well as between industry sectors, and also the combination of socio-economic development and national defense and security in local area.

3. Objectives, requirements, contents and scale of infrastructure as well as solutions for infrastructure development and implementation period must be included in a planning for passive telecommunications infrastructure.  

4. Advances in information technology should be applied to the formulation and management of the planning for passive telecommunications infrastructure such as digital maps and electronic database, etc.

Chapter 2.

PLANNING FOR LOCAL PASSIVE TELECOMMUNICATIONS INFRASTRUCTURE BY PEOPLE’S COMMITTEES OF CITIES OR PROVINCES

Article 6. Planning for significant telecommunications works relating national security

1. Objectives:

b) Determine locations or routes, scale of a specific location in local area which shall be used for constructing telecommunications works; type and estimated time to put such significant telecommunications works relating national security into official operation.

2. Requirements:

a) Meet works protection requirements: construction of safety corridors, arrangement of security technical systems and personnel;

b) Meet fire safety requirements: arrangement of fire safety systems and internal pathways so as to facilitate the access of vehicles and members of fire forces to the works in case of unexpected fire;
c) Meet requirements for technical corridors if telecommunications works are integrated with radio stations;

d) Contents of the planning for significant telecommunications works relating national security must be kept secret in accordance with regulations of the Law on State Secrets.

3. Contents of the planning (according to the Form No. 1 of the Appendix enclosed herewith):

a) Name of the works;

b) Functions of the works (local, inter-provincial, nationwide or international works, etc. in accordance with Clause 2 Article 20 of Decree No. 25/2011/ND-CP);

c) Managing/operating unit;

dd) Local area (ward, commune/ district) where transmission route goes through; total length of the route passing a province or city; type of infrastructural works used to install telecommunications cables of telecommunications transmission system works such as C1-type cable post, C2-type cable post, N1-type underground infrastructure, N2-type underground infrastructure;

e) Estimated time to put the works into operation.

Article 7. Planning for points of public telecommunications service

1. Objectives:

a) Determine specific requirements for arrangement and construction of PPTS so as to ensure their looking and safety as well as facilitate the provision and use of telecommunications services at local PPTS;

b) Determine locations for establishing PPTS and scale of PPTS and estimated time to put such PPTS into use.

2. Requirements:

a) PPTS should be established at train stations, coach stations, sea ports, airports, border checkpoints, trade centers, remote communes, border communes and islands where households and individuals meet difficulty or are unable to access telecommunications network, and other public places where deemed suitable;

b) PPTS must be built at places easily visible and convenient for service users, and designed in harmony with surrounding areas and scenery so as to ensure the beautiful looking of the city.

b) Type of PPTS: D1-type PPTS or D2-type PPTS;

c) Telecommunications service provider;

d) Scale of PPTS: land area, form of land use (land is allocated or leased, etc.), building area, usable floor area, height of PPTS;

dd) Estimated time to put PPTS into use or operation.

Article 8. Planning for antenna masts

1. Objectives:

a) Determine specific requirements for arrangement and construction of antenna masts so as to ensure safe operation of telecommunications network and protect environment and landscape, especially in urban areas;

b) Gradually stop building bulky antenna masts, especially antenna mast is 50m high, and implement the plan for replacement of A2-type antenna masts by A1-type antenna masts in local area within the planning period so as to establish urban space and rural residential area without or with few bulky antenna masts.

a) Antenna masts must be safe and look beautiful and constructed in compliance with design and construction requirements as well as relevant technical regulations and/or standards;

b) The height of an antenna mast must meet requirements on aviation safety as regulated by law;

c) Antenna systems installed on antenna masts must comply with technical standards and/or regulations on electromagnetic compatibility and radiation safety;

d) Only A1-type antenna masts are constructed at local areas where requirements for protection of environment and landscape must be strictly satisfied such as main streets, central squares, historic-cultural monuments, famous landscapes and other regions as decided by People's Committees of provinces or cities;

dd) Limit sharing of too much antennas on antenna masts installed on structures causing such antenna masts to become bulky and influencing on urban safety and beauty;

e) Limit construction of A2b-type antenna masts which are 100m high or above in any regions or which are 50m or high in urban areas.    

3. Contents of the planning (according to the Form No. 3 of the Appendix enclosed herewith):

a) Regions, routes or streets where only A1-type antenna masts may be constructed within the planning period, specifying names of regions, routes or streets, estimated period for completion of the replacement of A2a-type antenna masts by A1-type antenna masts;

b) Regions, routes or streets where A2b-type antenna masts with a height less than 50m may be constructed; those where A2b-type antenna masts with a height less than 100m may be constructed; those where A2b-type antenna masts may be constructed within the planning period; or regions, routes or streets where A2b-type antenna masts may not be constructed; those A2b-type antenna masts with a height of 50m or above may not be constructed; those A2b-type antenna masts with a height of 100m or above may not be constructed within the planning period.

1. Objectives:

a) Determine specific requirements for arrangement and construction of aerial cable posts and underground infrastructure so as to ensure safe operation of telecommunications network and protect environment and landscape, especially in urban areas;

b) Gradually limit suspended telecommunications cables; increase sharing of aerial cable posts and underground infrastructure; implement the plan for undergrounding of cables in local area within the planning period with the aims of establishing urban space and rural residential area without or with few overhead cables.

2. Requirements:

a) On the routes where existing underground infrastructure systems are still suitable for installing telecommunications cables, telecommunications cables must be installed on these systems;

b) In regions where it is unable to put cables underground in underground infrastructure or where it is unable to construct underground infrastructure, telecommunications cables shall be installed on power poles or lamp-posts. In case where power poles and lamp-posts are unavailable, or they are not suitable for installing telecommunications cables, insulated telecommunications cable posts may be constructed;

c) In new urban areas, industrial parks, export processing zones, hi-tech parks, routes or streets newly built, upgraded or expanded, plans for construction of underground infrastructure must be formulated, submitted for approval and implemented in accordance with regulations;

d) Enterprises must invest, construct and share cable posts and/or underground infrastructure if telecommunications cables are installed on same routes or directions;

dd) Cable posts and underground infrastructure must be safe and look beautiful and constructed in compliance with design and construction requirements as well as relevant technical regulations and/or standards.

a) Name of urban/sub-urban district;

b) Names of regions, routes or streets where underground infrastructure should be constructed, where insulated cable posts may be constructed, or where cable posts are in shared use with other industry sectors such as power poles, lamp-posts, etc. for installing telecommunications cables;

c) Type of infrastructure works used to install telecommunications cables, including: N1-type underground infrastructure, N2-type underground infrastructure, C1-type cable post or C2-type cable post;

d) Scale of infrastructure works used to install telecommunications cables, including: types and maximum quantity of telecommunications cables which may be installed on such works, and the length of the works;

dd) Estimated time of completion of undergrounding of telecommunications cables within the planning period.

Article 10. Procedures for formulation and approval for planning for passive telecommunications infrastructure by People’s Committees of provinces or cities

Each Provincial Department of Information and Communications shall take charge and cooperate with relevant units/agencies to assist People’s Committee of such province or city in formulating, submitting for approval and announcing planning for local passive telecommunications infrastructure. To be specific:

1. Investigate, survey and collect information concerning local passive telecommunications infrastructure systems of telecommunications enterprises; private telecommunications network operators; entities or individuals licensed to use radio frequency and other entities involved in the construction of passive telecommunications infrastructure;

2. Investigate, survey and collect information about technical infrastructure systems of other industry sectors (such as transport, electricity, public lighting, energy, water drainage and supply, etc.) in local area;

4. Prepare grassroots-level planning report (Provincial Department of Information and Communications), modify and amend planning report;

5. Present report before the People’s Committee of province or city;

6. Make final and complete planning report;

7. Submit the planning for local passive telecommunications infrastructure to the People’s Committees of province or city for approval and announcement, including the following documents:

a) Explanation about planning project;

b) Diagrams, drawings and appendixes attached to the planning;

c) The map of the planning for local passive telecommunications infrastructure - scale: 1/5,000 ¸  1/25,000.

8. After the planning for passive telecommunications infrastructure of the province or city has been approved, People’s Committee of such province or city shall organize the announcement or notification of such approved planning on means of mass media and its website (excluding contents relating state secrets as regulated), and send a copy of approved planning to the Ministry of Information and Communications (Vietnam Telecommunications Authority).

9. Procedures, funding for planning implementation and other matters concerning the formulation and approval for planning for local passive telecommunications infrastructure of province or city shall be performed in accordance with the Government’s Decree No. 92/2006/ND-CP dated September 07, 2006, the Government’s Decree No. 04/2008/ND-CP dated January 11, 2008 and relevant legislative documents.

PLANNING FOR LOCAL PASSIVE TELECOMMUNICATIONS INFRASTRUCTURE BY TELECOMMUNICATIONS ENTERPRISES

Article 11. Planning for significant telecommunications works relating national security

1. Objectives:

Determine locations or routes, scale, type, construction time and estimated time to put such significant telecommunications works relating national security of a telecommunications enterprise into official operation.

2. Requirements:

In addition to requirements mentioned in Clause 2 Article 6 herein, a location selected by a telecommunications enterprise for building significant telecommunications works relating national security must ensure security and be convenient for operation and management of telecommunications network.

3. Contents of the planning (according to the Form No. 5 of the Appendix enclosed herewith):

a) Name of the works;

b) Functions of the works (local, inter-provincial, nationwide or international works, etc. in accordance with Clause 2 Article 20 of Decree No. 25/2011/ND-CP);

d) Location of the works; scale of the works of management system, control system, routing, switching and transmission of radio/television signals, including: the area of the land plot used, form of land use (land is allocated or leased, etc.), building area, usable floor area, height of the works (excluding the height of antenna mast installed on the works), height of the antenna mast installed on the works or in the building area of the works (if any), safety corridor (if any) and technical corridor (if any),;  

dd) Local area (ward, commune/ district) where transmission route goes through; location where transmission equipment (repeater station, multiplexing/demultiplexing station, add-drop multiplexing station, etc.) is installed; total length of the route; length of route passing each local area; type of infrastructural works used to install telecommunications cables such as N1-type underground infrastructure, N2-type underground infrastructure, C1-type cable post and C2-type cable post;
e) Construction time; estimated time to put the works into operation.

Article 12. Planning for points of public telecommunications service

1. Objectives:

Determine locations, scale and type of points of public telecommunication service (PPTS) in local area, and estimated time to put such PPTS into use.

2. Requirements:

In addition to requirements mentioned in Clause 2 Article 7 herein, PPTS established by a telecommunications enterprise must also meet the following requirements:

a) The telecommunications enterprise must prepare a sample design of D2-type PPTS to be consistently applied in the local area. Such sample design must have small and tidy dimension, and bear logo or trade mark of telecommunications service provider; b) All D2-type PPTS established in the local area must bear the same signboard by which telecommunications service provider may be identified.

3. Contents of the planning (according to the Form No. 6 of the Appendix enclosed herewith):

b) Type of PPTS: D1-type PPTS or D2-type PPTS;
c) Scale of PPTS: land area, form of land use (land is allocated or leased, etc.), building area, usable floor area, and height of PPTS;  

d) Telecommunications services to be provided: call services, facsimile services and internet services, etc.

dd) Construction time; estimated time to put PPTS into use or operation.

Article 13. Planning for antenna masts

1. Objectives:

Determine exact location, type, scale and sharing rate of antenna masts and estimated time to complete the replacement of bulky antenna masts installed on structures by A1-type antenna masts within the planning period.

2. Requirements:

In additional to requirements mentioned in Clause 2 Article 8 herein, planning for antenna masts of a telecommunications enterprise must also meet the following requirements:

a) Obtain a license to build passive telecommunications infrastructural works in compliance with Article 41 of the Government's Decree No. 25/2011/ND-CP dated April 06, 2011 and relevant laws;

3. Contents of the planning (according to the Form No. 7 of the Appendix enclosed herewith):

a) Location of installing antenna mast: specifying address and coordinates;  

b) Type of antenna mast (A1a, A1b, A2a, A2b, or A2c); scale of antenna mast: height of antenna mast or height of the structure used to install antenna mast (if A1-type or A2a-type antenna mast is installed) and usable land area of station and antenna mast (if A2b-type is installed);c) Shared use of antenna mast: KDC (separate use), or DC1 (using antenna mast shared by another authority, organization or enterprise), or DC2 (sharing with another authority, organization or enterprise), or DC3 (combination of these two sharing forms);

d) Existing condition of antenna mast: K (sharing unavailable) or C (sharing available);  

dd) Estimated time to put antenna mast into use/operation;

e) Estimated time to complete the replacement of A2a-type antenna masts by A1-type antenna mast within the planning period.

Article 14. Planning for aerial cable posts and underground infrastructure

1. Objectives:

Determine types of underground infrastructural works in regions, routes or streets for installing telecommunications cables; types and maximum quantity of telecommunications cables to be installed on each of such underground infrastructural works within the planning period, and estimated time to complete the undergrounding of telecommunications cables within the planning period.

In addition to the requirements mentioned in Clause 2 Article 9 herein, the telecommunications enterprise that formulates the planning for underground infrastructure for installing telecommunications cables must also obtain a license to build passive telecommunications infrastructural works in compliance with Article 41 of the Government's Decree No. 25/2011/ND-CP dated April 06, 2011 and relevant laws.

3. Contents of the planning (according to the Form No. 8 of the Appendix enclosed herewith):

a) Names of regions, routes or streets;

b) Scale of the route of cable installed on the infrastructural works: length of the infrastructural works; types and maximum quantity of telecommunications cables installed on each of the infrastructural works within the planning period;

c) Estimated time to put the works into use/operation;

d) Estimated time of completing the undergrounding of telecommunications cables within the planning period.

Article 15. Procedures for formulation and approval for telecommunications enterprise’s planning for passive telecommunications infrastructure in a province or city

1. The planning for passive telecommunications infrastructure shall be formulated and submitted for approval by a telecommunications enterprise according to the following steps:

a) The telecommunications enterprise shall make surveys to collect information concerning the existing conditions of its passive telecommunications infrastructure systems and those of relevant entities in local area;

c) The Provincial Department of Information and Communications shall take charge and cooperate with relevant units/agencies to appraise and submit the telecommunications enterprise’s planning for passive telecommunications infrastructure to the People's Committee of province or city for approval;

d) After the planning for passive telecommunications infrastructure of the telecommunications enterprise has been approved, the telecommunications enterprise shall organize the announcement or notification of such approved planning on means of mass media and its website (excluding contents relating state secrets as regulated), and send a copy of approved planning to the Ministry of Information and Communications (Vietnam Telecommunications Authority).

2. The telecommunications enterprise shall formulate the planning project, including the following documents:

a) The written request for planning approval;

b) The explanation about the planning project, diagrams, drawings and appendixes attached thereof;

c) The map of the planning for local passive telecommunications infrastructure - scale: 1/5,000 ¸ 1/25,000;

d) The plan for implementation of the approved planning.

Chapter 4.

IMPLEMENTION PROVISIONS

Ministry of Information and Communications shall take charge and cooperate with relevant Ministries to instruct and inspect the implementation of this Circular.

Article 17. People’s Committees of provinces or cities

1. Formulate, submit for approval and announce the planning for local passive telecommunications infrastructure for every five year with the orientations towards the following ten years and any amendments and/or supplements deemed appropriate.

2. Consider giving approval for planning for local passive telecommunications infrastructure formulated by telecommunications enterprises.

3. Add relevant contents of the planning for passive telecommunications infrastructure to local transportation planning and construction planning with scale of 1/2,000 or 1/500.

4. Instruct telecommunications enterprises and relevant organizations and individuals to organize the implementation of planning for passive telecommunications infrastructure granted approval.

5. Based on the planning for passive telecommunications infrastructure granted approval, formulate and organize the implementation of the plans for undergrounding of telecommunications cables and renovation/re-arrangement of antenna masts in the manner so as to ensure efficient sharing of infrastructural works, landscape and environmental safety in local areas.

6. Establish database and maps for updating existing conditions of local passive telecommunications infrastructure systems.

Article 18. Authorities, organizations, enterprises and individuals concerning the construction and use of local passive telecommunications infrastructure

2. Telecommunications enterprises shall formulate planning for local passive telecommunications infrastructure for every five year with the orientations towards the following ten years and any amendments and/or supplements deemed appropriate, and submit them to People’s Committees of provinces or cities for considering approval.

3. Organize the implementation of approved planning for local passive telecommunications infrastructure of People’s Committees of provinces or cities and of telecommunications enterprises.

4. Based on the plans for undergrounding of telecommunications cables and renovation/re-arrangement of antenna masts of People’s Committees of provinces or cities, formulate and organize the implementation of their plans for undergrounding of telecommunications cables and renovation/re-arrangement of antenna in local areas.

5. Establish database and maps for updating information about existing conditions of their passive telecommunications infrastructure, and submit periodical reports to Provincial Departments of Information and Communications.

Article 19. Entry into force and implementation

1. This Circular shall come into force as from August 15, 2013.

2. Chief of the Ministry’s Office, Chief Inspector, Director of Vietnam Telecommunications Authority, heads of affiliates of the Ministry of Information and Communications, Chairperson of People’s Committees of provinces or central-affiliated cities, General Directors (Directors) of telecommunications enterprises and relevant organizations and individuals shall implement this Circular.

3. Difficulties that arise during the implementation of this Circular should be reported to the Ministry of Information and Communications for consideration./.
