NGHỊ QUYẾT

KỲ HỌP THỨ 5, QUỐC HỘI KHÓA XV

QUỐC HỘI

Căn cứ Hiến pháp nước Cộng hòa xã hội chủ nghĩa Việt Nam;

Căn cứ Luật Tổ chức Quốc hội số 57/2014/QH13 đã được sửa đổi, bổ sung một số điều theo Luật số 65/2020/QH14;

Căn cứ kết quả Kỳ họp thứ 5, Quốc hội khóa XV;

Theo đề nghị của Ủy ban Thường vụ Quốc hội và ý kiến của các vị đại biểu Quốc hội,

QUYẾT NGHỊ:

1. Kỳ họp thứ 5, Quốc hội khóa XV họp từ ngày 22/5/2023 đến ngày 24/6/2023 đã xem xét, quyết định và cho ý kiến các nội dung sau đây:

1.1. Thông qua 08 luật: Luật Bảo vệ quyền lợi người tiêu dùng; Luật Đấu thầu; Luật Giá; Luật Giao dịch điện tử; Luật Hợp tác xã; Luật Phòng thủ dân sự; Luật sửa đổi, bổ sung một số điều của Luật Công an nhân dân; Luật sửa đổi, bổ sung một số điều của Luật Xuất cảnh, nhập cảnh của công dân Việt Nam và Luật Nhập cảnh, xuất cảnh, quá cảnh, cư trú của người nước ngoài tại Việt Nam.

Thông qua 17 nghị quyết: Nghị quyết về việc lấy phiếu tín nhiệm, bỏ phiếu tín nhiệm đối với người giữ chức vụ do Quốc hội, Hội đồng nhân dân bầu hoặc phê chuẩn; Nghị quyết về thí điểm một số cơ chế, chính sách đặc thù phát triển Thành phố Hồ Chí Minh; Nghị quyết Chương trình xây dựng luật, pháp lệnh năm 2024, điều chỉnh Chương trình xây dựng luật, pháp lệnh năm 2023; Nghị quyết về Chương trình giám sát của Quốc hội năm 2024; Nghị quyết thành lập Đoàn giám sát chuyên đề “Việc thực hiện Nghị quyết số 43/2022/QH15 ngày 11/01/2022 của Quốc hội về chính sách tài khóa, tiền tệ hỗ trợ Chương trình phục hồi, phát triển kinh tế - xã hội và các nghị quyết của Quốc hội về một số dự án quan trọng quốc gia đến hết năm 2023”; Nghị quyết thành lập Đoàn giám sát chuyên đề “Việc thực hiện chính sách, pháp luật về quản lý thị trường bất động sản và phát triển nhà ở xã hội từ năm 2015 đến hết năm 2023”; Nghị quyết về hoạt động chất vấn tại Kỳ họp thứ 5, Quốc hội khóa XV; Nghị quyết giám sát chuyên đề về việc huy động, quản lý và sử dụng các nguồn lực phục vụ công tác phòng, chống dịch COVID-19; việc thực hiện chính sách, pháp luật về y tế cơ sở, y tế dự phòng; Nghị quyết phê chuẩn quyết toán ngân sách nhà nước năm 2021; Nghị quyết về phân bổ vốn Chương trình phục hồi và phát triển kinh tế - xã hội; phân bổ, điều chỉnh kế hoạch đầu tư công trung hạn vốn ngân sách trung ương giai đoạn 2021 - 2025 và phân bổ kế hoạch đầu tư vốn ngân sách trung ương năm 2023 của các Chương trình mục tiêu quốc gia; Nghị quyết về chủ trương đầu tư Dự án đường giao thông từ Quốc lộ 27C đến đường tỉnh ĐT.656 tỉnh Khánh Hòa - kết nối với tỉnh Lâm Đồng và tỉnh Ninh Thuận; Nghị quyết miễn nhiệm Ủy viên Ủy ban Thường vụ Quốc hội, Chủ nhiệm Ủy ban Tài chính, Ngân sách của Quốc hội và cho thôi làm nhiệm vụ đại biểu Quốc hội khóa XV; Nghị quyết phê chuẩn đề nghị của Thủ tướng Chính phủ về việc miễn nhiệm Bộ trưởng Bộ Tài nguyên và Môi trường nhiệm kỳ 2021 - 2026; Nghị quyết bầu Ủy viên Ủy ban Thường vụ Quốc hội, Chủ nhiệm Ủy ban Tài chính, Ngân sách của Quốc hội khóa XV; Nghị quyết phê chuẩn đề nghị của Thủ tướng Chính phủ về việc bổ nhiệm Bộ trưởng Bộ Tài nguyên và Môi trường nhiệm kỳ 2021 - 2026; Nghị quyết phê chuẩn đề nghị của Chánh án Tòa án nhân dân tối cao về việc bổ nhiệm Thẩm phán Tòa án nhân dân tối cao và Nghị quyết Kỳ họp thứ 5, Quốc hội khóa XV.

Giao Ủy ban Thường vụ Quốc hội tổ chức quán triệt, triển khai các luật, nghị quyết nêu trên; đồng thời, đánh giá tình hình thực hiện luật, nghị quyết được Quốc hội thông qua từ đầu nhiệm kỳ khóa XV đến nay.

1.2. Cho ý kiến lần thứ hai về dự án Luật Đất đai (sửa đổi); cho ý kiến lần đầu về 08 dự án luật: Luật Các tổ chức tín dụng (sửa đổi); Luật Căn cước công dân (sửa đổi); Luật Kinh doanh bất động sản (sửa đổi); Luật Nhà ở (sửa đổi); Luật Tài nguyên nước (sửa đổi); Luật Viễn thông (sửa đổi); Luật Quản lý, bảo vệ công trình quốc phòng và khu quân sự; Luật Lực lượng tham gia bảo vệ an ninh, trật tự ở cơ sở.

Chính phủ, các cơ quan của Quốc hội và các cơ quan hữu quan phối hợp chặt chẽ, nghiên cứu tiếp thu tối đa ý kiến các vị đại biểu Quốc hội, hoàn thiện các dự thảo luật, bảo đảm chất lượng, tiến độ, trình Quốc hội xem xét, thông qua tại Kỳ họp thứ 6, Quốc hội khóa XV.

2. Quốc hội đánh giá cao sự chỉ đạo, điều hành và tổ chức thực hiện quyết liệt các nhiệm vụ, giải pháp của Chính phủ, Thủ tướng Chính phủ, các cấp, các ngành, các địa phương; biểu dương tinh thần nỗ lực của cộng đồng doanh nghiệp, các tầng lớp Nhân dân đã hoàn thành cơ bản toàn diện các nhiệm vụ phát triển kinh tế - xã hội và ngân sách nhà nước năm 2022, nhất là tăng trưởng và thực hiện “mục tiêu kép” vừa kiểm soát dịch bệnh có hiệu quả, vừa thúc đẩy phục hồi phát triển kinh tế - xã hội trong điều kiện khó khăn do cả yếu tố bên trong và bên ngoài; nợ công, nợ Chính phủ, bội chi ngân sách nhà nước được kiểm soát theo mục tiêu Quốc hội giao. Những tháng đầu năm 2023, kinh tế vĩ mô nước ta cơ bản ổn định, lạm phát được kiểm soát, tăng trưởng được thúc đẩy, các cân đối lớn được bảo đảm, nông nghiệp, thương mại, dịch vụ có xu hướng tăng; an sinh xã hội, phúc lợi xã hội và đời sống tinh thần, vật chất của người dân tiếp tục được quan tâm, cải thiện; lĩnh vực văn hóa, giáo dục, thể thao, du lịch, thông tin tuyên truyền tiếp tục được đẩy mạnh; quốc phòng, an ninh cơ bản được bảo đảm; công tác đối ngoại, hội nhập quốc tế được mở rộng và tăng cường; công tác phòng, chống tham nhũng, tiêu cực và thực hành tiết kiệm, chống lãng phí đạt nhiều kết quả quan trọng.

Bên cạnh những kết quả đạt được, do ảnh hưởng tác động không thuận lợi của bối cảnh tình hình kinh tế, tài chính thế giới và các hạn chế, yếu kém tích tụ của nền kinh tế trong nước, ổn định kinh tế vĩ mô chưa thực sự vững chắc; tăng trưởng kinh tế đạt thấp, kim ngạch xuất nhập khẩu, chỉ số sản xuất công nghiệp, vốn đầu tư trực tiếp nước ngoài giảm; rủi ro nợ xấu của hệ thống ngân hàng thương mại gia tăng; thu ngân sách nhà nước giảm so với cùng kỳ năm trước; hoạt động của các thị trường, nhất là thị trường tài chính - tiền tệ, bất động sản, chứng khoán, trái phiếu doanh nghiệp còn nhiều điểm nghẽn, tiềm ẩn nhiều rủi ro; tỷ lệ giải ngân vốn đầu tư công đạt thấp, nhiều dự án lớn bị chậm tiến độ, gặp khó khăn, vướng mắc trong triển khai; tiến độ lập, phê duyệt các quy hoạch và việc xử lý các vướng mắc về tiêu chuẩn, quy chuẩn kỹ thuật phòng cháy, chữa cháy còn chậm; công tác kiểm định xe cơ giới còn nhiều hạn chế; hoạt động sản xuất, kinh doanh của doanh nghiệp gặp nhiều khó khăn, số doanh nghiệp ngừng hoạt động, rút lui khỏi thị trường và người lao động mất việc làm tăng; tình trạng người lao động rút bảo hiểm xã hội một lần tăng cao nhất từ trước đến nay; việc giải quyết hồ sơ hoàn thuế giá trị gia tăng còn chậm; tình trạng mất điện, cắt điện diễn ra ở nhiều nơi ảnh hưởng lớn đến sản xuất, kinh doanh của doanh nghiệp và đời sống của người dân; tình trạng mâu thuẫn, chồng chéo, sơ hở, bất cập, áp dụng thiếu thống nhất của một số quy định pháp luật chưa được khắc phục kịp thời, gây khó khăn, cản trở quá trình phát triển và còn nhiều hạn chế trong tổ chức thực hiện pháp luật; vấn đề thiếu vắc-xin tiêm chủng mở rộng, thiếu thuốc, thiết bị, vật tư y tế chưa được giải quyết căn cơ, ảnh hưởng đến công tác chăm sóc sức khỏe Nhân dân và quyền lợi chính đáng của người tham gia bảo hiểm y tế khi khám bệnh, chữa bệnh; tình trạng thiếu giáo viên ở một số môn học, thiếu trường học, lớp học vẫn tiếp diễn; các bất cập về sách giáo khoa vẫn chưa được khắc phục hiệu quả; việc huy động các nguồn lực đầu tư, khai thác, phát huy các thiết chế văn hóa từ cấp huyện đến cơ sở còn nhiều hạn chế; quản lý hoạt động văn hóa trên không gian mạng chưa đáp ứng yêu cầu thực tiễn; an ninh, trật tự, an toàn xã hội còn tiềm ẩn những yếu tố phức tạp; đời sống của người dân miền núi, biên giới, vùng dân tộc thiểu số còn khó khăn; tình hình dịch bệnh, thiên tai dự báo còn nhiều diễn biến phức tạp... Đặc biệt, tình trạng đùn đẩy, né tránh, thiếu trách nhiệm của một bộ phận cán bộ, công chức trong thực thi công vụ dẫn đến sự trì trệ trong giải quyết công việc, gây bức xúc trong xã hội.

Quốc hội yêu cầu Chính phủ phối hợp với các cơ quan hữu quan tiếp tục triển khai đồng bộ, kịp thời, toàn diện các mục tiêu, nhiệm vụ, giải pháp đã được Đảng, Quốc hội, Chính phủ đề ra; đồng thời, theo dõi sát diễn biến, dự báo tình hình trong nước và thế giới, có giải pháp chính sách nhanh nhạy, phù hợp, giải pháp điều hành sát thực tiễn, cụ thể, khả thi và tổ chức thực hiện quyết liệt, tập trung vào một số vấn đề sau đây:

a) Bảo đảm ổn định, củng cố nền tảng kinh tế vĩ mô, kiểm soát lạm phát, tăng cường năng lực thích ứng, sức chống chịu của nền kinh tế trước tác động tiêu cực từ bên ngoài;

b) Điều hành chính sách tài khóa có trọng tâm, trọng điểm; nghiên cứu phương án điều chỉnh tăng mức giảm trừ gia cảnh đối với thuế thu nhập cá nhân; linh hoạt trong điều chỉnh thuế bảo vệ môi trường đối với mặt hàng xăng dầu; đề xuất giải pháp chính sách phù hợp đối với cơ chế thuế tối thiểu toàn cầu, thuế các-bon. Kịp thời giải quyết hồ sơ hoàn thuế giá trị gia tăng theo quy định của pháp luật. Tập trung nguồn lực để thực hiện cải cách tiền lương, báo cáo Quốc hội lộ trình cải cách chính sách tiền lương tại Kỳ họp thứ 6, Quốc hội khóa XV;

c) Điều hành chính sách tiền tệ chủ động, linh hoạt, hiệu quả, phối hợp chặt chẽ với chính sách tài khóa, chính sách vĩ mô khác để góp phần kiểm soát lạm phát, ổn định nền tảng vĩ mô, hỗ trợ phục hồi kinh tế hợp lý. Điều hành lãi suất phù hợp với mục tiêu chính sách tiền tệ. Thực hiện đồng bộ các giải pháp tháo gỡ khó khăn, tăng cường quản lý, giám sát các thị trường chứng khoán, bảo hiểm, trái phiếu doanh nghiệp, bất động sản; khẩn trương xử lý các bất cập trong tư vấn đầu tư trái phiếu doanh nghiệp, môi giới, bán chéo bảo hiểm nhân thọ; thanh tra toàn diện thị trường bảo hiểm nhân thọ, tập trung vào loại hình bảo hiểm liên kết đầu tư; kiểm soát chặt chẽ việc cấp tín dụng sử dụng vốn; bảo vệ quyền lợi của nhà đầu tư theo quy định của pháp luật. Nghiên cứu xây dựng tiêu chí, phương pháp xác định hạn mức tăng trưởng tín dụng đối với các tổ chức tín dụng theo tinh thần Nghị quyết số 62/2022/QH15 của Quốc hội;

d) Nâng cao chất lượng xây dựng dự toán thu ngân sách nhà nước. Tăng cường quản lý các nguồn thu từ đất, cổ phần hóa doanh nghiệp, thuế, phí, chống thất thu, trốn thuế; quản lý chặt chẽ vốn, tài sản nhà nước đầu tư vào hoạt động sản xuất kinh doanh tại doanh nghiệp nhà nước, cổ phần hóa, thoái vốn doanh nghiệp; tập trung giải quyết những dự án thua lỗ kéo dài, những ngân hàng, doanh nghiệp có vi phạm, không để phát sinh tổn thất tiếp theo.

Chỉ đạo thực hiện nghiêm kết luận, kiến nghị của các cơ quan thanh tra, kiểm tra, kiểm toán; kịp thời xử lý thu hồi về ngân sách nhà nước các khoản thu, chi không đúng quy định đã được kết luận, kiến nghị. Đẩy mạnh thực hành tiết kiệm, chống lãng phí trên các lĩnh vực; tăng cường vai trò của Kiểm toán nhà nước trong kiểm toán, kiểm tra, kiểm soát việc quản lý, sử dụng tài chính, tài sản công;

đ) Tổ chức rà soát hệ thống văn bản quy phạm pháp luật, trọng tâm là pháp luật về đấu thầu, đấu giá, quy hoạch, đầu tư công, quản lý, sử dụng đất đai, tài sản công, ngân sách nhà nước, tài chính công, hợp tác công tư, xã hội hóa các dịch vụ công, đầu tư, môi trường, xây dựng, kinh doanh bất động sản, ngân hàng, tài chính, tự chủ tài chính, chứng khoán, trái phiếu, doanh nghiệp, giám định, định giá và các lĩnh vực khác đã được các đoàn kiểm tra, giám sát, thanh tra, kiểm toán, các cơ quan điều tra, truy tố, xét xử, thi hành án kiến nghị, đề xuất hoặc có nhiều vướng mắc được các địa phương, người dân, doanh nghiệp kiến nghị; phát hiện, xác định cụ thể những quy định có mâu thuẫn, chồng chéo, sơ hở, bất cập, những vấn đề vướng mắc trong các luật và văn bản dưới luật có liên quan, báo cáo Quốc hội kết quả rà soát tại Kỳ họp thứ 6, Quốc hội khóa XV; kịp thời chỉ đạo sửa đổi, bổ sung theo thẩm quyền các văn bản dưới luật không còn phù hợp hoặc kiến nghị Quốc hội sửa đổi, bổ sung, ban hành mới các luật, nghị quyết có liên quan;

e) Đẩy mạnh phân cấp, phân quyền phù hợp đi đôi với tăng cường kiểm tra, thanh tra, giám sát; đề cao trách nhiệm người đứng đầu, khắc phục kịp thời, hiệu quả tình trạng đùn đẩy, né tránh, thiếu trách nhiệm trong một bộ phận cán bộ, công chức, xử lý nghiêm các vi phạm. Sớm đề xuất ban hành hoặc ban hành theo thẩm quyền văn bản quy định cụ thể cơ chế khuyến khích, bảo vệ cán bộ dám nghĩ, dám làm, dám chịu trách nhiệm vì lợi ích chung;

g) Đẩy nhanh tiến độ lập, thẩm định, phê duyệt quy hoạch không gian biến quốc gia, quy hoạch vùng, quy hoạch tỉnh và quy hoạch ngành quốc gia theo đúng tinh thần của Nghị quyết số 61/2022/QH15 của Quốc hội. Thúc đẩy giải ngân vốn đầu tư công, nhất là các công trình, dự án quan trọng quốc gia, Chương trình phục hồi và phát triển kinh tế - xã hội, 03 Chương trình mục tiêu quốc gia;

h) Tăng cường cải cách hành chính, nhất là thủ tục hành chính, tiếp tục rà soát cắt giảm các điều kiện kinh doanh, thủ tục kiểm tra chuyên ngành, kiểm soát chặt chẽ việc ban hành thông tư, văn bản hướng dẫn, không để làm phát sinh thủ tục, “giấy phép con”, tiêu chuẩn, quy chuẩn kỹ thuật mới không phù hợp, thiếu tính khả thi. Tháo gỡ kịp thời khó khăn, vướng mắc trong công tác kiểm định xe cơ giới và việc bảo đảm các yêu cầu phòng cháy, chữa cháy. Khắc phục kịp thời, căn cơ tình trạng thiếu điện, bảo đảm an ninh năng lượng. Tháo gỡ triệt để khó khăn, vướng mắc trong công tác đấu thầu, mua sắm và giải quyết dứt điểm tình trạng thiếu thuốc, thiết bị, vật tư y tế; nâng cao chất lượng công tác khám bệnh, chữa bệnh;

i) Tháo gỡ khó khăn, đẩy mạnh xúc tiến thương mại, thúc đẩy xuất khẩu hàng hóa, tiêu dùng trong nước; khai thác hiệu quả thị trường truyền thống, đa dạng hóa thị trường xuất khẩu, hỗ trợ doanh nghiệp, hợp tác xã, liên hiệp hợp tác xã tận dụng các Hiệp định thương mại tự do (FTA) đã ký kết. Đẩy nhanh tốc độ phục hồi ngành du lịch; tập trung nguồn lực khôi phục và mở rộng, đa dạng hóa thị trường khách quốc tế; tổ chức các chương trình xúc tiến quảng bá ở thị trường mới, thị trường có nhiều tiềm năng;

k) Có các giải pháp phù hợp và thực hiện hiệu quả để ổn định việc làm cho người lao động, hỗ trợ kịp thời cho người lao động thất nghiệp, mất việc làm; xây dựng nhà ở xã hội, xây dựng và nâng cao hiệu quả các thiết chế văn hóa cho công nhân khu công nghiệp, khu chế xuất. Chú trọng bảo tồn và phát huy các giá trị di sản, văn hóa tốt đẹp của các dân tộc; phát triển đồng bộ các lĩnh vực văn hóa, xã hội. Xây dựng nếp sống văn hóa lành mạnh; ngăn chặn suy thoái về đạo đức, lối sống; phòng, chống bạo lực gia đình, bạo lực học đường, xâm hại trẻ em và tệ nạn xã hội; thực hiện tốt chính sách đối với người có công. Xây dựng môi trường văn hóa số phù hợp với nền kinh tế số, xã hội số và công dân số. Phát huy vai trò của các trường đại học sư phạm trong việc đào tạo, nâng cao chất lượng bồi dưỡng, tập huấn đội ngũ giáo viên, đánh giá thực trạng để bố trí giáo viên dạy các môn học mới phù hợp; xử lý có hiệu quả các bất cập về sách giáo khoa, tình trạng thừa, thiếu giáo viên, thiếu trường học, lớp học; ưu tiên ngân sách đầu tư cơ sở vật chất, mua sắm thiết bị dạy học, bảo đảm điều kiện thực hiện đổi mới phương pháp dạy học theo mục tiêu Chương trình giáo dục phổ thông năm 2018. Bảo đảm quốc phòng, an ninh, giữ vững ổn định trật tự, an toàn xã hội gắn với ổn định sinh kế, nhất là tại khu vực Tây Nguyên, Tây Bắc, Tây Nam Bộ, vùng đồng bào dân tộc thiểu số và miền núi; chủ động ứng phó kịp thời với biến đổi khí hậu, thiên tai, bão lũ, dịch bệnh...

3. Quốc hội đánh giá cao nỗ lực của Chính phủ, Thủ tướng Chính phủ, các Bộ, ngành, cơ quan và chính quyền địa phương trong việc trả lời, giải quyết kiến nghị của cử tri; đồng thời yêu cầu tập trung giải quyết có hiệu quả các vụ việc khiếu kiện, tố cáo phức tạp, kéo dài; trả lời bằng văn bản ý kiến đề xuất, kiến nghị của các vị đại biểu Quốc hội.

Giao Ủy ban Thường vụ Quốc hội chỉ đạo, đôn đốc, giám sát việc trả lời, giải quyết kiến nghị của cử tri và đại biểu Quốc hội.

4. Thực hiện giảm 2% thuế suất thuế giá trị gia tăng quy định tại điểm a, khoản 1.1 Điều 3 của Nghị quyết số 43/2022/QH15 của Quốc hội về chính sách tài khóa, tiền tệ hỗ trợ Chương trình phục hồi và phát triển kinh tế - xã hội trong thời gian từ ngày 01/7/2023 đến hết ngày 31/12/2023.

Giao Chính phủ tổ chức thực hiện kịp thời, hiệu quả, phấn đấu không làm ảnh hưởng đến dự toán thu và bội chi ngân sách nhà nước năm 2023 theo Nghị quyết của Quốc hội; báo cáo tình hình thực hiện chính sách trên cùng với tổng kết thực hiện Nghị quyết số 43/2022/QH15 tại Kỳ họp thứ 6, Quốc hội khóa XV.

5. Điều chỉnh nội dung của Nghị quyết số 93/2019/QH14 về chủ trương đầu tư Dự án Hồ chứa nước Ka Pét, huyện Hàm Thuận Nam, tỉnh Bình Thuận như sau:

a) Quy mô diện tích sử dụng đất của Dự án là 697,73ha. Thời gian thực hiện Dự án từ năm 2019 đến hết năm 2025;

b) Tổng mức đầu tư và nguồn vốn của Dự án là 874,089 tỷ đồng, gồm ngân sách trung ương là 519,927 tỷ đồng và ngân sách địa phương là 354,162 tỷ đồng; gia hạn thời gian giải ngân 47,3 tỷ đồng nguồn vốn dự phòng ngân sách trung ương đến hết ngày 31/12/2023; mở rộng địa điểm trồng rừng thay thế theo quy định của pháp luật về lâm nghiệp;

c) Giao Chủ tịch Ủy ban nhân dân tỉnh Bình Thuận quyết định đầu tư Dự án; trình tự lập, thẩm định, quyết định đầu tư Dự án thực hiện theo quy định của pháp luật về đầu tư công và các quy định của pháp luật có liên quan đối với dự án nhóm A do cấp tỉnh quản lý; bảo đảm tiến độ hoàn thành Dự án;

Các nội dung khác tiếp tục thực hiện theo Nghị quyết số 93/2019/QH14; trường hợp cần điều chỉnh chủ trương đầu tư Dự án trong thời gian Quốc hội không họp, Quốc hội ủy quyền Ủy ban Thường vụ Quốc hội xem xét, quyết định.

6. Chấp thuận chủ trương đầu tư bổ sung vốn điều lệ cho Ngân hàng Nông nghiệp và Phát triển nông thôn Việt Nam giai đoạn 2021 - 2023 tương ứng với số lợi nhuận còn lại thực nộp ngân sách nhà nước giai đoạn 2021 - 2023 của Ngân hàng Nông nghiệp và Phát triển nông thôn Việt Nam, tối đa là 17.100 tỷ đồng.

Năm 2023, bố trí 6.753 tỷ đồng từ nguồn ngân sách trung ương đã được Quốc hội phê duyệt tại Nghị quyết số 70/2022/QH15; năm 2024, bố trí tối đa 10.347 tỷ đồng từ nguồn ngân sách nhà nước theo quy định của Luật Ngân sách nhà nước.

Giao Chính phủ chỉ đạo thực hiện việc đầu tư bổ sung vốn điều lệ theo đúng quy định của pháp luật; chịu trách nhiệm trước Quốc hội về tính chính xác của số liệu và quy mô bổ sung vốn điều lệ cho Ngân hàng Nông nghiệp và Phát triển nông thôn Việt Nam.

7. Ủy ban Thường vụ Quốc hội, Chính phủ, Thủ tướng Chính phủ, Ủy ban Trung ương Mặt trận Tổ quốc Việt Nam, Tòa án nhân dân tối cao, Viện kiểm sát nhân dân tối cao, Hội đồng Dân tộc, các Ủy ban của Quốc hội, Kiểm toán nhà nước, các Bộ, ngành, chính quyền địa phương các cấp, theo chức năng, nhiệm vụ được giao, tổ chức thực hiện có hiệu quả Nghị quyết này; tăng cường tuyên truyền, phổ biến, giáo dục pháp luật để sớm triển khai thực hiện các luật, nghị quyết đã được Quốc hội thông qua.

Ủy ban Thường vụ Quốc hội, Hội đồng Dân tộc, các Ủy ban của Quốc hội, Đoàn đại biểu Quốc hội và đại biểu Quốc hội giám sát việc thực hiện Nghị quyết này.

Ủy ban Trung ương Mặt trận Tổ quốc Việt Nam và các tổ chức thành viên của Mặt trận giám sát và động viên các tầng lớp Nhân dân thực hiện Nghị quyết.

Nghị quyết này được Quốc hội nước Cộng hòa xã hội chủ nghĩa Việt Nam khóa XV, Kỳ họp thứ 5 thông qua ngày 24 tháng 6 năm 2023.

Pursuant to the Constitution of the Socialist Republic of Vietnam;

Pursuant to the Law on Organization of National Assembly No. 57/2014/QH13 amended by the Law No. 65/2020/QH14;

Pursuant to the result of the 5^th meeting of the 15^th National Assembly;

Ratifying 08 Laws: Law on Protection of Consumers’ Rights; Law on Bidding; Law on Prices; Law on E-transactions; Cooperative Law; Law on Civil Defense; Law on amendments to certain Articles of Law on the People’s Public Security Force; Law on amendments to some Articles of Law on Entry and Exit of Vietnamese Citizens and Law on Entry, Exit, Transit and Residence of Foreigners in Vietnam.

Assigning the Standing Committee of the National Assembly to thoroughly grasp and implement the aforesaid Laws and Resolutions; at the same time, assess the implementation of Laws and Resolutions ratified by the National Assembly from the beginning of the 15^th term to the present.

1.2. Giving opinions for the second time on the bill of the Land Law (amended); giving opinions for the first time about 08 bills of the Law on Credit Institutions (amended); the Law on Citizen Identification (amended); the Law on Real Estate Trading (amended); the Law on Housing (amended); the Law on Water Resources (amended); the Law on Telecommunications (amended); the Law on Management and Protection of National Defense Structures and Military Zones; the Law on Forces Participating in Protection of Security at Grassroots Level.

The Government, agencies of the National Assembly and relevant agencies closely cooperate, study and fully absorb the opinions from the National Assembly deputies in order to complete draft laws in such a way to ensure quality and progress, and then submit them to the National Assembly for consideration and approval at the 6^th Meeting of the 15^th National Assembly.

2. The National Assembly highly appreciates the direction, administration and organization of strong performance of tasks and solutions by the Government, the Prime Minister, authorities at all levels, central and local authorities; and praises efforts of enterprises and all classes of people to basically and comprehensively complete tasks of socio-economic development and the state budget in 2022, especially growth and fulfillment of dual goals of effective control of the epidemic and promotion of socio-economic development and recovery in difficult conditions due to both internal and external factors. In addition, public debt, government debt, and state budget deficit have been controlled according to objectives assigned by the National Assembly. In the first months of 2023, the Vietnam's macroeconomic situation has remained stable, the inflation has been controlled, major balances have been maintained, and agriculture, trade and services have developed; social security, social welfare and spiritual and material life of the people have been concerned and improved; fields of culture, education, sports, tourism and dissemination information have been promoted; national defense and security have been  guaranteed; foreign affairs and international integration have been expanded and strengthened; anti-corruption and thrift practice and wastefulness prevention have achieved many positive results.

In addition to the achieved results, due to unfavorable impacts of the world economy and finance and existing limitations and weaknesses of the domestic economy, the macroeconomic stability has not been properly maintained; the economic growth remains low, the import-export turnover, industrial production index and foreign direct investment have decreased; the risk of bad debt within the commercial banking system is on the increase; the state budget revenue has decreased, compared to the same period last year; operations of markets, especially financial-monetary market, real estate market, securities market and corporate bond market still have many bottlenecks and potential risks; the disbursement rate of public investment is low, many large projects are behind schedule and face difficulties and obstacles to implementation; the progress of formulation and approval for planning and settlement of problems about fire safety and fighting standards and technical regulations is still slow; the vehicle inspection is still limited; the production and trade of enterprises have faced many difficulties, the number of enterprises that cease their operation or withdraw from markets and job losers has increased; the number of employees who withdraw one-time social insurance rises to the highest ever level; the progress of settlement of the application for refund of VAT is still slow; the electricity showdown or de-energize occur in many places, greatly affecting the production and trade of enterprises and people's lives; contradictions, overlaps, loopholes, inadequacies, inconsistencies with regard to the application of some legal provisions have not been promptly overcome, causing difficulties and obstructing the development process and there are still many limitations in the organization of implementation of the law; the shortage of vaccines in expanded immunization, drugs, equipment and medical supplies has not been fundamentally tackled, affecting the care of people's health and legal interests of the insured when they participate in medical examination and treatment; the shortage of teachers in charge of some subjects, schools and classrooms still occurs; inadequacies in textbooks have not been effectively overcome; resources for investment, maintenance and promotion of cultural institutions from district level to grassroots level have not been effectively mobilized; the management of cultural activities in cyberspace has not yet met practical requirements; the security and social order and safety still have potential instabilities; the life people living in border areas and mountainous and ethnic minority areas is still difficult; the epidemic and natural disaster are forecasted to have many complicated developments, etc.    Especially, some officials and employees pass the buck when they perform official duties, causing stagnation in solution to works and frustration in society.

The National Assembly requests the Government to cooperate with relevant agencies in continuing to synchronously, timely and comprehensively fulfil objectives and tasks and adopt solutions set out by the Communist Party, the National Assembly and Government; at the same time, closely monitor developments and forecasts about the situation in the country and the world, implement policy measures that are appropriate and urgent, adopt practical, specific and feasible solutions to management, and organize effective implementation with a focus on the following issues:

a) Stabilizing and reinforcing the macro-economic foundation, controlling inflation, and increasing adaptive capacity and resilience of the economy to negative external impacts;

c) Operating monetary policy in a proactive, flexible and effective manner in close cooperation with fiscal policy and other macroeconomic policies in order to contribute to inflation control, stabilization of the macro-economic foundation and support for economic recovery. Administering interest rates in line with monetary policy objectives. Synchronously implementing solutions to remove difficulties, strengthen management and supervision of securities, insurance, corporate bond and real estate markets; urgently handling inadequacies in consultancy for investment in corporate bonds, brokerage or selling of life insurance products through bancassurance channels; carrying out thorough inspection of the life insurance market with a focus on investment-linked insurance; strictly controlling the use of funding for granting loans; protecting interests of investors in accordance with the law. Researching development of criteria and methods for determination of credit growth for credit institutions in the spirit of Resolution No. 62/2022/QH15 of the National Assembly;

d) Improving the quality of formulation of state budget revenue estimate. Strengthening the management of revenues from land, equitization of enterprises, taxes and fees, prevention of losses and tax evasion; strictly managing state capital and assets invested in production and trade in state enterprises, equitization and divestment for enterprises; focusing on solution to projects that are unprofitable for several years, violating banks and enterprises so as not to incur further losses.

Directing the strict implementation of conclusions and recommendations from inspection, examination and audit agencies; promptly handling and recover revenues and expenditures that are not consistent with conclusions and recommendations to the state budget. Promoting thrift practice and wastefulness prevention in all fields; strengthening the role of the State Audit in auditing, inspecting and controlling the management and use of finance and public property;

dd) Organizing review of the system of legal documents with a focus on laws on bidding, auction, planning, public investment, management and use of land, public property, state budget, public finance, public-private partnership, public investment in public services, investment, environment, construction, real estate trading, banking, finance, financial autonomy, securities, bonds, enterprises, assessment, valuation and other fields that have been proposed and recommended by inspectorate, supervision and audit teams, investigating, prosecuting, judging and judgment enforcement agencies or those with many problems proposed by local authorities, people and enterprises; detecting and clearly identifying regulations that have conflicts, overlaps, loopholes, inadequacies and problems in relevant laws and sub-law documents, and reporting to the National Assembly on review results at 6^th meeting, 15^th National Assembly; promptly directing amendments within their competence to unsuitable sub-law documents or requesting the National Assembly to amend and issue new relevant laws and resolutions;

e) Promoting decentralization and delegation in line with enhancement of inspection and supervision; upholding responsibilities of leaders, promptly and effectively overcoming the problem that officials and public employees pass the buck and strictly handling violations. Soon proposing promulgation of or promulgate within their competence documents specifying mechanisms for encouragement and protection of officials who dare to think, dare to do, dare to take responsibility for mutual benefits;

g) Accelerating the formulation, appraisal and approval for national spatial planning, regional planning, provincial planning and national sectorial planning in accordance with Resolution No. 61/2022/QH15 of the National Assembly. Promoting disbursement of public investment capital, especially capital for works and projects of national importance, socio-economic recovery and development program, 03 national target programs;

h) Strengthening administrative reform, especially administrative procedures, continuing to review and reduce business conditions and specialized inspection procedures and strictly controlling issuance of Circulars and guiding documents in order to avoid unsuitable or unfeasible procedures, "minor permits", standards and technical regulations. Timely removing difficulties and obstacles to the inspection of motor vehicles and the fulfillment of fire safety and fighting requirements. Timely and basically overcoming electricity shortage, ensuring energy security. Thoroughly removing difficulties and obstacles to bidding and procurement and completely solving the shortage of drugs, equipment and medical supplies; improving the quality of medical examination and treatment;

i) Removing difficulties, developing trade promotion and promoting export of goods and domestic consumption; effectively developing traditional market, diversifying export market, supporting enterprises, cooperatives and unions of cooperatives to take advantage of signed Free Trade Agreements (FTAs). Accelerating the recovery of the tourism industry; mobilizing resources for the purpose of restoring, expanding and diversifying international tourist market; organizing promotion programs in new markets and markets with great potential;

k) Adopting appropriate and effective solutions to stabilize jobs for employees, and timely providing support for unemployed workers and job losers; building social housing, building and improving the efficiency in cultural institutions for workers who work in industrial parks and export processing zones. Focusing on preservation and promotion of good heritage and cultural values ​​of ethnic groups; synchronously developing cultural and social fields. Building up a cultural lifestyle that is healthy; preventing degradation of morality and lifestyle; preventing and combating domestic violence, school violence, child abuse and social evils; effectively implementing policies applicable to people with meritorious services. Building a digital and cultural environment in conformity with the digital economy, digital society and digital citizen. Promoting the role of pedagogical universities in improvement of the quality of refresher training for teachers, and assessment of the current situation for the purpose of suitable arrangement of teachers for new subjects; effectively dealing with inadequacies in textbooks, excess and shortage of teachers, schools and classes; prioritizing budget for investment in facilities, purchase of teaching equipment, and meeting conditions for innovation in teaching methods according to objectives of the 2018 General Education Program. Ensuring national defense and security and maintaining social order and safety in association with livelihood stability, especially those in the Central Highlands, Northwest region, Southwest region, and mountainous and ethnic minority areas; proactively and promptly responding to climate change, natural disaster, storms, floods, epidemics, etc.

The Standing Committee of the National Assembly is assigned to direct, urge and supervise the reply and implementation of recommendations from voters and deputies of the National Assembly.

4. Reducing 2% of VAT according to regulations in Point a, Clause 1.1 Article 3 of Resolution No. 43/2022/QH15 of the National Assembly on fiscal and monetary policies for supporting Socio-economic recovery and development program from July 01, 2023 to the end of December 31, 2023.

The Government is assigned to organize the implementation in a prompt and effective manner and strive to achieve objectives without affecting the estimate of state budget revenue and deficit in 2023 according to the Resolution of the National Assembly; and report on the implementation of the aforesaid policies and review implementation of Resolution No. 43/2022/QH15 at the 6^th Meeting of the 15^th National Assembly.

5. Resolution No. 93/2019/QH14 on investment policy on Ka Pet Reservoir Project, Ham Thuan Nam District, Binh Thuan Province is amended as follows:

a) Land use area: 697,73ha. Project duration: From 2019 to the end of 2025;

b) Total investment and capital sources: 874,089 billion VND (central government budget capital: 519,927 billion VND and local government budget capital: 354,162 billion VND); the duration for disbursement of 47,3 billion VND of reserved capital of the central government budget is extended to the end of December 21, 2023; it is required to expand locations for replacement afforestation according to regulations in the law on forestry;

c) The Chairperson of the People's Committee of Binh Thuan province is assigned to decide investment in the project; the procedure for formulation, appraisal and decision on investment in group-A projects under its management shall comply with regulations in the law on public investment and relevant laws; the project shall be completed on schedule;

Other contents shall continue to be implemented in accordance with Resolution No. 93/2019/QH14; it is necessary to adjust the investment policy on the project while the National Assembly is in recess, the National Assembly shall authorize the Standing Committee of the National Assembly to consider deciding.

6. Approving additional investment guideline for increase in charter capital for the Vietnam Bank for Agriculture and Rural Development in the 2021 - 2023 period, corresponding to the remaining profit actually remitted to the state budget in the 2021 - 2023 period of the Vietnam Bank for Agriculture and Rural Development (up to 17.100 billion VND).

The Government is assigned to direct the implementation of additional investment in charter capital in accordance with regulations of the law; and take responsibility to the National Assembly for the accuracy of data and the scale of additional charter capital for the Vietnam Bank for Agriculture and Rural Development.

7. The Standing Committee of the National Assembly, the Government, the Prime Minister, the Central Committee of Vietnam Fatherland Front, the Supreme People's Court, the Supreme People's Procuracy, the Ethnic Council, Committees of the National Assembly, State Audit Office, ministries, central and local authorities at all levels shall, within their assigned tasks and functions, effectively organize the implementation of this Resolution; strengthen dissemination and education about the law so as to soon enforce laws and resolutions approved by the National Assembly.

The Standing Committee of the National Assembly, Ethnic Council, Committees of the National Assembly, Delegation of the National Assembly and National Assembly deputies shall supervise the implementation of this Resolution.

The Central Committee of Vietnam Fatherland Front and member organizations of the Fatherland Front shall supervise and encourage the People to implement this Resolution.

This Resolution is approved in the 5^th meeting of the 15^th National Assembly of the Socialist Republic of Vietnam in June 24, 2023.
