VỀ TỔ CHỨC CUỘC BẦU CỬ ĐẠI BIỂU QUỐC HỘI KHÓA XI

Ủy ban Thường vụ Quốc hội đã ban hành Nghị quyết số 284/2002/NQ-UBTVQH10 ngày 26 tháng 12 năm 2002 ấn định và công bố ngày bầu cử Đại biểu Quốc hội khoá XI là ngày chủ nhật 19 tháng 5 năm 2002 và thành lập Hội đồng bầu cử.

Bộ Chính trị đã ra Chỉ thị số 07-CT/TW ngày 25 tháng 01 năm 2002 về việc lãnh đạo cuộc bầu cử đại biểu Quốc hội khoá XI, coi đây là sự kiện chính trị quan trọng của toàn Đảng, toàn quân và toàn dân trong năm 2002; là ngày hội để cử tri cả nước dân chủ lựa chọn ra những đại biểu có đủ đức, tài, xứng đáng đại diện cho ý chí, nguyện vọng của mình tại cơ quan quyền lực nhà nước cao nhất.

Cuộc bầu cử đại biểu Quốc hội khoá XI có ý nghĩa hết sức quan trọng, vì đây là cuộc bầu cử đầu tiên của thế kỷ mới. Thành công của cuộc bầu cử sẽ góp phần to lớn vào quá trình tiếp tục xây dựng và hoàn thiện Nhà nước Cộng hoà Xã hội chủ nghĩa Việt Nam của nhân dân, do nhân dân và vì nhân dân; đồng thời thông qua Quốc hội để phát huy năng lực trí tuệ và sức mạnh của khối đại đoàn kết toàn dân để thực hiện thắng lợi Nghị quyết Đại hội IX của Đảng, đáp ứng yêu cầu công nghiệp hoá, hiện đại hoá đất nước, làm cho dân giàu, nước mạnh, xã hội công bằng, dân chủ, văn minh.

Để cuộc bầu cử đại biểu Quốc hội khoá XI đảm bảo thực sự dân chủ, đúng pháp luật, an toàn, tiết kiệm và thể hiện được không khí ngày hội lớn để nhân dân thực hiện quyền dân chủ, Thủ tướng Chính phủ chỉ thị:

1. Chủ tịch Ủy ban nhân dân các tỉnh, thành phố trực thuộc Trung ương chủ động phối hợp với Thường trực Hội đồng nhân dân và Ủy ban Mặt trận Tổ quốc Việt Nam cùng cấp, đồng thời chỉ đạo ủy ban nhân dân cấp dưới thực hiện tốt các bước chuẩn bị theo hướng dẫn của ủy ban Thường vụ Quốc hội, Hội đồng Bầu cử, ủy ban Trung ương Mặt trận Tổ quốc Việt Nam, các cơ quan của đảng và cơ quan nhà nước cấp trên.

Trên cơ sở tiêu chuẩn, cơ cấu, thành phần, số lượng đại biểu Quốc hội để giới thiệu những người có đủ đức, tài, tham gia ứng cử vào Quốc hội, cơ quan quyền lực nhà nước cao nhất, góp phần nâng cao chất lượng, hiệu quả hoạt động của Quốc hội và thúc đẩy quá trình tiếp tục xây dựng và hoàn thiện Nhà nước Cộng hoà Xã hội chủ nghĩa Việt Nam.

Ở những địa phương mới điều chỉnh địa giới hành chính hoặc còn thiếu đại biểu Hội đồng nhân dân, cần kết hợp tổ chức bầu bổ sung đại biểu Hội đồng nhân dân cùng ngày với việc bầu cử đại biểu Quốc hội khoá XI, theo quy định của Luật Bầu cử đại biểu Hội đồng nhân dân (sửa đổi) năm 1994. Ban Tổ chức - Cán bộ Chính phủ hướng dẫn cụ thể để địa phương tổ chức thực hiện đúng Luật định.

2. Bộ trưởng, Thủ trưởng cơ quan ngang Bộ, Thủ trưởng cơ quan thuộc Chính phủ; Chủ tịch Ủy ban nhân dân các cấp căn cứ vào chức năng, nhiệm vụ của mình khẩn trương triển khai kế hoạch bầu cử; chỉ đạo các tổ chức, đơn vị, cán bộ, công chức, nhân viên trong ngành tích cực tham gia tổ chức và phục vụ tốt cuộc bầu cử đại biểu Quốc hội khoá XI; đảm bảo phương tiện, điều kiện vật chất cần thiết cho cuộc bầu cử; có kế hoạch phòng chống những diễn biến bất ngờ của thiên tai, kịp thời ngăn chặn các hành vi lợi dụng dân chủ để gây rối, làm ảnh hưởng tới quá trình chuẩn bị và tiến độ cuộc bầu cử.

Tổ chức tuyên truyền kịp thời, sâu rộng trong cán bộ, công chức nhà nước, lực lượng vũ trang và mọi tầng lớp nhân dân ý nghĩa, tầm quan trọng của cuộc bầu cử Đại biểu Quốc hội, vị trí quan trọng của Quốc hội trong bộ máy nhà nước, nội dung cơ bản của Luật Bầu cử đại biểu Quốc hội năm 1997 đã được sửa đổi, bổ sung một số điều theo Luật số 31/2001/QH10 của Quốc hội khoá X kỳ họp thứ 10 và các văn bản hướng dẫn thực hiện của ủy ban Thường vụ Quốc hội, Chính phủ, ủy ban Trung ương Mặt trận Tổ quốc Việt Nam … để mọi công dân hiểu rõ quyền và nghĩa vụ của mình, đồng thời nắm vững những quy định của pháp luật, hướng dẫn của các cơ quan nhà nước về công tác bầu cử. Trên cơ sở đó, nâng cao vai trò làm chủ, ý thức tự giác tham gia của các cơ quan, tổ chức, đơn vị và cử tri trong suốt cuộc bầu cử.

Bộ Văn hoá - Thông tin, Bộ Giao thông vận tải, Tổng cục Bưu điện và các cơ quan thông tin đại chúng ở trung ương, địa phương cần có kế hoạch tuyên truyền, cổ động cho ngày bầu cử, đảm bảo giao thông và thông tin liên lạc thông suốt trong quá trình tiến hành cuộc bầu cử.

Bộ Quốc phòng, Bộ Công an có phương án phối hợp triển khai lực lượng, thực hiện nhiệm vụ giữ gìn trật tự, an ninh và an toàn xã hội trên từng địa bàn và trên toàn quốc trong những ngày bầu cử.

Bộ Tài chính đảm bảo kinh phí phục vụ kịp thời cho cuộc bầu cử đại biểu Quốc hội khoá XI và bầu cử bổ sung đại biểu Hội đồng nhân dân nhiệm kỳ 1999 - 2004 theo tiến độ và kế hoạch được giao và hướng dẫn, kiểm tra chặt chẽ việc sử dụng kinh phí nhằm đảm bảo chi tiêu tiết kiệm, đúng mục đích.

Bộ trưởng, Trưởng Ban Tổ chức - Cán bộ Chính phủ chịu trách nhiệm trước Chính phủ về việc hướng dẫn tổ chức thực hiện công tác bầu cử, kiểm tra, đôn đốc các cấp, các ngành thực hiện các quy định của pháp luật và các quy định khác do Chính phủ hướng dẫn về bầu cử đại biểu Quốc hội; phối hợp chặt chẽ với Văn phòng Quốc hội, Văn phòng Chính phủ theo dõi tình hình chuẩn bị, tiến độ thực hiện công tác bầu cử ở các địa phương, các Bộ, ngành trong cả nước để tổng hợp, báo cáo ủy ban Thường vụ Quốc hội, Thủ tướng Chính phủ và Ủy ban Trung ương Mặt trận Tổ quốc Việt Nam theo tiến độ quy định của Hội đồng bầu cử.

DIRECTIVE

ON ORGANIZATION OF THE ELECTION OF DEPUTIES TO THE XITH NATIONAL ASSEMBLY

The National Assembly Standing Committee issued Resolution No. 284/2001/NQ-UBTVQH10 on December 26, 2001, announcing that the election of deputies to the XIth National Assembly shall be held on Sunday, May 19, 2002, and establishing the Election Council.

The Political Bureau issued Directive No. 07-CT/TW on January 25, 2002 on directing the election of deputies to the XIth National Assembly, considering it an important political event for the entire Party, the entire army and the entire population in 2002; a festive occasion for voters throughout the country to democratically select deputies who have good morality and talents, deserving to represent their will and aspirations at the supreme State power organ.

The election of deputies to the XIth National Assembly is of extremely important significance as it is the first election in the new century. The election’s success will greatly contribute to the process of further building and perfecting the Socialist Republic of Vietnam State of the people, by the people and for the people; at the same time, through the National Assembly, the wisdom and strength of the entire population’s unity bloc will be brought into full play in order to successfully implement the Resolution of the Ninth Party Congress, thus meeting the requirements of the cause of national industrialization and modernization, making the people rich, the country strong and the society equitable, democratic and civilized.

In order to ensure that the election of deputies to the XIth National Assembly be conducted in a truly democratic, lawful, safe and thrifty manner, and to create a festive atmosphere for people to exercise their right to democracy, the Prime Minister hereby instructs:

1. The presidents of the People’s Committees of the provinces and centrally-run cities to take initiative in coordinating with the standing bodies of the People’s Councils and Vietnam Fatherland Front committees of the same levels, and at the same time direct the People’s Committees of lower levels to make good preparations under the guidance of the National Assembly Standing Committee, the Election Council, the Central Committee of Vietnam Fatherland Front and the superior Party and State agencies.

On the basis of the criteria, structure, membership and number of deputies to the National Assembly, to recommend persons having good morality and talents to stand for the election to the National Assembly, the supreme State power organ, thus contributing to raising the quality and efficiency of operation of the National Assembly and accelerating the process of further building and perfecting the State of the Socialist Republic of Vietnam.

2. The ministers, the heads of the ministerial-level agencies, the heads of the agencies attached to the Government and the presidents of the People’s Committees of all levels shall base themselves on their respective functions and tasks to expeditiously deploy the election plan; direct organizations, units, officials, public servants and employees in their respective branches to actively participate in organizing and well servicing the election of deputies to the XIth National Assembly; ensure necessary facilities and material conditions for the election; draw up plans to cope with unexpected occurrences of natural disasters, promptly precluding acts of abusing democracy to cause disorder, thus affecting the process of election preparation and schedule.

To organize a timely and widespread propagation among State officials and public servants, armed forces and people of all strata about the significance and importance of the election of deputies to the National Assembly, the important position of the National Assembly in the State’s apparatus, the principal contents of the 1997 Law on the Election of Deputies to the National Assembly and Law No. 31/2001/QH10 of the Xth National Assembly, 10th session, amending and supplementing a number of articles thereof, as well as the implementation-guiding documents of the National Assembly Standing Committee, the Government, and the Central Committee of Vietnam Fatherland Front, so that all citizens can well understand their rights and obligations, and at the same time thoroughly grasp law provisions and the State agencies guidance on the election work. On that basis, to raise the sense of mastery and consciousness of agencies, organizations, units and voters in participating in the election.

The Ministry of Culture and Information, the Ministry of Communications and Transport, the General Department of Post and Telecommunications and mass media agencies at the central and local levels should draw up plans to propagate and campaign for the election day, ensuring the smooth traffic and communication during the election.

The Ministry of Defense and the Ministry of Public Security shall work out plans for the coordinated deployment of their forces and performance of their tasks of maintaining order, security and social safety in each locality and the whole country on the election day.

The Ministry of Finance shall ensure funding in timely service of the election of deputies to the XIth National Assembly and the additional election of deputies to the People’s Councils, the 1999-2004 term, according to the prescribed tempo and plan, and guide and closely examine the use of funding in order to ensure the thrift spending for the right purposes.

The Minister-Director of the Government Commission for Organization and Personnel shall be accountable to the Government for guiding the organization of implementation of the election work, examining and urging various levels and branches to observe law provisions and other regulations on the election of deputies to the National Assembly under the Government’s guidance; closely coordinate with the National Assembly’s Office and the Government’s Office in monitoring the work of preparation for the election by localities, ministries and branches throughout the country in order to synthesize and report thereon to the National Assembly Standing Committee, the Prime Minister and the Central Committee of Vietnam Fatherland Front according to the tempo set by the Election Council.
