According to the Resolution, the Government of Vietnam approves the regulation on the processing of personal data without the consent of data owners in the following cases:
- Protecting the life and health of the data owner or relevant persons in an emergency.
The personal data control party, personal data processing party, personal data control and processing party, and relevant third parties shall provide evidence in this case;
- Disclosing personal data as prescribed by law;
- Processing data of competent state agencies in case of emergencies on national defense, national security, social safety and order, major natural disasters, or dangerous epidemics; risks that threaten national defense and security but not to the extent of declaring a state of emergency; prevention and combat against riot, terrorism, criminal, and other law violations as prescribed by law;
- Fulfilling obligations under the contract of the data owner with relevant agencies, organizations, or individuals as prescribed by law;
- Serving operations of state agencies stipulated by specialized laws.
Resolution No. 13/NQ-CP comes into force as of its date of signing.
