Simplification of applications for issuance of inland water transport licenses in Vietnam

On June 16, 2022, the Minister of Transport of Vietnam promulgated Circular No. 08/2022/TT-BGTVT amending Circulars related to marine business.

According to the Circular, an application for issuance of an inland water transport license for transport of passengers and luggage from cruise ships to the mainland includes:

- The application form as defined in Appendix I issued together with Circular No. 50/2016/TT-BGTVT

- 01 copy of the certificate of sea-going vessel registration;

- 01 set of sea-going vessel inspection documents, including the copies of the certificates of technical safety and environment protection for sea-going vessel as prescribed in the Circular No. 55/2019/TT-BGTVT

- 01 copy of the original or a copy and the original for comparison or a legal electronic copy issued by the competent authority of one of the following documents:

+ Agent contract;

+ Or foreign shipowner’s representative agent appointment letter (in case the proposing organization is foreign shipowner’s representative agent);

- A detailed plan on the transport of passengers and luggage between cruise ships and the mainland.

Circular No. 50/2016/TT-BGTVT currently prescribes that there must be a notarized copy of the agent contract or a certified copy of the foreign shipowner’s representative agent appointment letter.

Circular No. 08/2022/TT-BGTVT also prescribes that electronic copies of agent contracts or foreign shipowner’s representative agent appointment letters may be used instead of physical copies.

Circular No. 08/2022/TT-BGTVT comes into force from June 16, 2022.
