According to the Circular, there are 27 provinces, cities, 01 other administrative and production unit with highly disadvantaged conditions as the basis for consideration of early retirement specified in Clause 3 Article 169 of the Labor Code and Article 5 of Decree No. 135/2020/ND-CP . For example:
- Bac Kan province: 20 communes;
- Binh Phuoc province: 04 communes;
- Binh Thuan province: 01 commune;
- Da Nang city: Hoang Sa district;
- Cao Bang province: 58 communes and 01 commune-level town;
- Dak Lak province: 14 communes;
- Dak Nong: 46 communes and 01 commune-level town;
- Gia Lai province: 11 communes;
- Other administrative and production units: DK1 Rigs; …..
The seniority before January 01, 2021 as an eligibility for early retirement only includes the time the employee works in an area with a region-based allowance coefficient of 0,7 or above.
The Circular No. 19/2021/TT-BLDTBXH comes into force from January 30, 2022 and shall be applied from January 01, 2021.
