Grounds for market watchdogs’ ad hoc inspections come in use from December 1, 2020

The Ministry of Industry and Trade issues the Circular No. 27/2020/TT-BCT regarding administrative violations, processes and procedures for inspection and enforcement of penalties, and implementation of regulatory approaches of market surveillance forces.

According to this document, competent persons controlled by market surveillance forces can cite the following reasons for considering the prompt issuance of ad hoc inspection decisions:

- Orders to inspect lawbreaking entities and persons, or those showing any single lawbreaking sign received from the Government, Prime Minister, Minister of Industry and Trade, Presidents of provincial People's Committees, General Directors, Directors of Departments or Administrations, Presidents of district-level People's Committees;

- Inspection proposals submitted by market surveillance officers assigned to implement regulatory approaches specified in Articles 34, 35 and 36 of this Circular, or by market surveillance officers for performing the tasks of inspection and handling of administrative violations.

In addition, certain information will be collected, reviewed, verified and overseen before being used as grounds for considering the issuance of decisions on ad hoc inspections, specifically including:

- Information about violations against laws or lawbreaking signs contained in official documents received from all-level market surveillance agencies or units;

- Information about violation against laws and lawbreaking signs broadcast by means of mass media; etc.

Circular No. 27/2020/TT-BCT is set to commence on December 1, 2020.
