Four law enforcement measures to be taken against commercial entities

The Government promulgates the Decree No. 44/2020/ND-CP regulating law enforcement against commercial entities.

According to this Decree, commercial legal entities that fail to comply with or duly comply with the Court’s verdicts or decisions already in force will be subject to the following law enforcement actions:

- Account freeze.

- Distraint of property of which value is equivalent to the sum put up as guarantee for the execution of judicial measures (briefly called property distraint).

- Temporary custody of records, evidencing documents and devices containing electronic data.

- Temporary custody or withdrawal of their corporate seals.

Law enforcement is carried out according to the following principles:

- Law enforcement will be carried out only after receipt of written law enforcement decisions of competent criminal judgment enforcement agencies.

- Duration of implementation of a law enforcement measure for guarantee for execution of court judgments will not exceed the sentence-serving term specified in the Court's verdict or decision already in force; duration of provision of guarantee for execution of a judicial measure will be determined once such judicial measure is completely executed. 

-  A commercial legal entity may be subject to one or several enforcement measures at the same time if a single enforcement measure does not guarantee their execution.
