07 remarkable policies coming into force from the middle of April 2019

THƯ VIỆN PHÁP LUẬT would like to introduce 07 remarkable policies which come into force from the middle of April 2019 (from April 11th to 20th, 2019):

1. Regulations on entities given import quotas

Circular No.04/2019/TT-BCT on principles for management of import quotas on salt and poultry eggs in 2019 is issued by the Ministry of Industry and Trade on March 04, 2019.

According to the Circular, import quotas on salt and poultry eggs shall be allocated to the following entities:

- Salt import quotas shall be allocated to traders who directly use salt as materials for production of chemicals, medicines or medical products.

- Poultry egg import quotas shall be allocated to traders who possess a business registration certificate/certificate of registration of enterprise with import demand. 

Circular No.04/2019/TT-BCT comes into force from April 17, 2019 to the end of December 31, 2019.

2. Adjustments to rates of assistance in trade promotion activities

Decision No.12/2019/QD-TTg on amendments to a number of Articles of Regulation on establishment, management and implementation of the national trade promotion program issued together with Decision No.72/2010/QD-TTg is issued by the Prime Minister.

According to the Decision, the rate of assistance in some trade promotion activities is adjusted as follows:

- Provide 100% of funding for short-term domestic and overseas training courses for the purpose of improving skills in trade promotion provided for enterprises and cooperatives (previously 50%);

- Provide 100% of funding for the following activities (previously 70%):

+ Trade communications, market research, and establishment of a database on article-based key export market;

+ Advertising for well-known products and geographic indications in foreign market;

+ Invitation of representatives of foreign press agencies to visit Vietnam to write reportage in newspapers, magazines or on radio, televisions and the Internet for the purpose of promoting the exports of Vietnam under all-inclusive contracts.

Decision No.12/2019/QD-TTg comes into force from April 15, 2019.

3. 03 types of exhibition requiring prior notice

Decree No.23/2019/ND-CP on exhibition which provides for organization and cooperation in organization of exhibitions for non-profit purposes in Vietnam and foreign countries is promulgated by the Government on February 26, 2019.

According to the Decree, the organizer of an exhibition is required to submit a notice of exhibition when holding:

- An exhibition organized in Vietnam by central authorities;

- An exhibition jointly organized in Vietnam by organizations in 2 or more than 2 provinces/cities;

- An exhibition organized by a local organization or individual.

The organizers of exhibitions shall send a notice according to Form No.06 issued together with this Decree.

Decree No.23/2019/ND-CP comes into force from April 15, 2019.

4. Regulations on enrolments targets applied to lecturers in healthcare

Circular No.01/2019/TT-BGDDT provides amendments to a number of Article of Circular No.06/2018/TT-BGDDT on determining enrolment targets in intermediate or college level courses in teacher training; university, master or doctoral classes;

According to the Circular, qualification requirements for full-time and part-time lecturers in determining enrolment targets in healthcare courses shall be specified as follows:

- Having a level II speciality degree in a major on the list of majors the degree in which is as a doctoral degree;

- Having a residency training certificate, level I speciality degree in a major on the list of majors the degree in which is as a master’s degree.

Circular No.01/2019/TT-BGDDT comes into force from April 12, 2019.

5. Amendments to policies on region-based priority in enrolment

This is a remarkable content of Circular No.02/2019/TT-BGDDT which amends Regulation on university enrolment and enrolment in regular teacher training college courses.

According to the Circular, the region-based priority policy intended for soldiers, officers, non-commissioned officers, enlisted members of the People’s Public Security Force who are appointed to sit the entrance exam shall be amended as follows:

- Priority shall be given based upon their permanent residence registered before enlisting if they have garrisoned for less than 18 months.

- If they have garrisoned in a certain area for at least 18 months, priority shall be given based upon such area or upon their permanent residence registered before enlisting and the place with higher rate of priority will be preferred;

- If they have garrisoned in areas with different priority levels for at least 18 months, the priority shall be given based upon the area with longer stationing period.

In addition, this Circular adds regulations on admission confirmation applied to schools not using the results of the national high school graduation examination, to be specific:

- Successful candidates must confirm their admission by submitting the original certificate of examination result within the time limit specified by the school.

Those fails to confirm their admission within the aforesaid time limit shall be considered to refuse the admission and the school may recruit other candidates.

- Candidates may only confirm their admission to a single school and is not entitled to apply for admission to other schools.

6. Criteria for indication for daytime inpatient treatment by use of traditional medicines

According to Circular No.01/2019/TT-BYT indications for inpatient treatment in traditional medicine healthcare facilities shall be given by the doctors and satisfy the 4 following criteria:

- The patient's health and disease conditions require inpatient treatment but not need all-the-time treatment in medical facility;

- Daytime inpatient treatment is given to the patient for at least 4 hours/day in the medical facility;

- Daytime internal treatment is not given if the patient's disease conditions are eligible for outpatient treatment;

- The patient not residing in the district/city in which the medical facility is located is provided with daytime inpatient treatment or all-the-time inpatient treatment.

Patients may undergo clinical or paraclinical tests every day or according to their appointment with the doctor and shall be given inpatient treatment, supervision and care during daytime working hours.

Everyday medical examination during the treatment period shall not be charged.

7.  New regulations on denunciations and handling of denunciations of the People's Public Security Force

Decree No.22/2019/ND-CP on regulations on denunciations and handling of denunciations of People's Public Security Force is promulgated by the Government on February 25, 2019. 

According to the Decree, there are new regulations which are not specified in Decree No.91/2013/ND-CP such as: 

- Individuals are entitled to denounce violations against laws committed by Public Security officers during their performance and violations against regulations on state management in order and security;

 (previously only citizens have the right to do so)

- There are regulations on the authority to handle denunciations of violations against laws committed by officers of the People's Public Security Force during their performance who are currently transferred to other agencies or no longer are officers.

- And regulations on authority to handle denunciations of violations committed by officers of the People’s Public Security Force temporarily assigned to organizations other than the People's Public Security organizations.
