No need to hold a practicing certificate to participate in construction activities

On July 16, 2018, the Government issued the Decree No. 100/2018/ND-CP that amends, supplements and repeals certain regulations on necessary business conditions in the construction sector. The Decree prescribes the followings:

Any individual having yet to obtain a practicing certificate is entitled to participate in the construction sector where appropriate for his/her training specialty, and is not authorized to run their own construction business as well as hold any office that requires the practicing certificate. 

In addition, regulations on requirements for eligibility to be granted the construction practicing certificate that set forth in this Decree have been changed in comparison with the Decree No. 59/2015/ND-CP as follows:

- Rank-II practicing certificate is awarded to those who acquire at least 04 years’ experience relevant to requirements of that practicing certificate (05 years prescribed before);

- Rank-III practicing certificate is awarded to those who acquire at least 02 years’ experience relevant to requirements of that practicing certificate  with respect to holders of the undergraduate degree (03 years prescribed before); at least 03 years' experience with respect to holders of the associate degree or intermediate diploma (05 years prescribed before).
