General Department of Customs responds to queries about Circular No. 39/2018/TT-BTC

General Department of Customs has just issued the Official Dispatch No. 3899/TCHQ-GSQL dealing with 36 queries relating to contents of the Circular No. 39/2018/TT-BTC on customs procedures, customs inspection and supervision, and import and export duties. Typical queries are specified as follows:

- At Article 16 of the Circular No. 39:

+ Question: The Circular No. 39 has not yet specified “how are electronic documents kept by customs authorities?” Do customs authorities have to print out evidencing documents from the e-customs system for filing purposes?  

+ Answer: Customs authorities are not obliged to print out evidencing documents as part of customs dossiers which are sent via the e-customs system for filing purposes.

- At Article 18 of the Circular No. 39:

+ Question: The Circular No. 39 only provides instructions for customs declaration of consolidation cargo with multiple export declarations of the same consignor, without giving any instruction in case of different consignors.  

In this case, does the Official Dispatch No. 6376/TCHQ-GSQL remain applicable?

+ Answer: Cargo consolidation and segregation must be carried out inside CFS warehouses in accordance with the Circular No.39; directive documents inconsistent with the Circular No.39 will become null and void.
