Multiple Circulars coming into force from January 01, 2018

From January 01, 2018, multiple Circulars related to transport, proceedings, etc. will come into force. THƯ VIỆN PHÁP LUẬT introduces some of their notable provisions:

1. Motor vehicles having 07 – 09 seats have to bear energy labels before being sold

This is a notable content of Circular No. 40/2017/TT-BGTVT on energy labels for motor vehicles having 07 – 09 seats.

According to the Circular, new motor vehicles having 07 – 09 seats that are manufactured or assembled from new parts or imported must bear energy labels before they are sold.

Manufacturers, assemblers and importers of motor vehicles having 07 – 09 seats may declare their fuel consumptions and put on the energy labels in the following cases:

- The certificate of technical safety and environmental safety is issued to the domestically manufactured or assembled motor vehicles before January 01, 2018 according to Circular No. 30/2011/TT-BGTVT and Circular No. 54/2014/TT-BGTVT.

- The certificate of technical safety and environmental safety is issued to the domestically imported motor vehicles before January 01, 2018 according to Circular No. 31/2011/TT-BGTVT and Circular No. 55/2014/TT-BGTVT.

Note: Circular No. 40 does not apply to vehicles serving national defense or diplomatic purposes.

2. Requirements for inland watercraft to carry tourists

Circular No. 42/2017/TT-BGTVT requires that inland watercraft that carries tourists must have the following equipment:

For watercraft having 12 – 20 seats:

- Instructions to use personal rescue devices;

- Phone number and address of the search and rescue center;

- Route map of the tour;

- Beverage container;

- Waste bin.
 
For watercraft having 20 – 50 seats:

- Shading devices, microphone;

- First aid cabinet and first aid kits;

- Catering area and kitchen (if any) that meet requirements of the Ministry of Health and fire safety requirements.

Apart from the aforementioned equipment, a watercraft having more than 50 seats must have roofs, sun protection screens, air conditioners or electric fans and restrooms.

3. Allowance of VND 500,000 per day for narcotic testers

Circular No. 49/2017/TT-BCA specifies allowances for forensic scientists; composition of a forensic team performing autopsy or exhumation.

According to the Circular, an allowance of VND 500,000 per day will be paid to the person that performs the following tasks:

- Testing of flammable and explosive substances;

- Testing of narcotic substances;

- DNA testing;

- Detection of engraved characters that have been removed or falsified;

- Detection of prints using techniques such as: fuming, ninhydrin, small grains, amilo black, etc.;

- Tests using toxic chemicals;

- Testing of semen or blood of suspects who are infected with HIV/AIDS or have Category A infectious diseases.

4. New courtroom rules

Some notable courtroom rules mentioned in Circular No. 02/2017/TT-TANDTC :

- The judge, jurors and court reporter must wear uniforms;

- The trial panel, procurators, court reporter, litigants and other participants must sit at their correct positions in the courtroom;

- Video and audio recordings in court shall be made in accordance with proceedings laws.

Before the court session is initiated, the court reporter must maintain order in the courtroom, check the presence of people summoned to the court, inform them of the courtroom rules and perform other tasks.

Note: The judge, juror or court room reporter who fails to wear uniform will be dealt with according to the seriousness of their violation.
