1. Cases of early discharge from the military
These are notable regulations of Circular No. 279/2017/TT-BQP on discharge of non-commissioned officers and soldiers serving in the people’s army.
According to the Circular, a non-commissioned officer or soldier will be discharged from the military ahead of schedule in any of the following cases:
- The medical assessment council of the division or higher or a competent medical assessment council gives a conclusion that his/her health is not adequate for service;
- The People’s Committee of the commune and military command center of the district issues a certification that his/her family is facing difficulties and he/she is eligible for suspension or exemption from conscription;
- The Military Security Agency issues a decision that he/she is not politically qualified for serving in Vietnam’s army.
Circular No. 279/2017/TT-BQP comes into force from December 15, 2017.
2. Procedures for promulgation of decisions on announcement of administrative procedures by Ministers
On October 31, 2017, Office of the Government issued Circular No. 02/2017/TT-VPCP providing instructions on control of administrative procedures.
According to the Circular, a decision on announcement of administrative procedures by a Minister must follow these procedures:
- Draft the decision;
- Submit the decision for promulgation;
- Provide explanation, revise and complete the decision;
- Sign the decision and send it to Administrative Procedure Control Department of Office of the Government and the People’s Committee of the province within 03 days from the day on which it is signed;
- Publish the decision on the national administrative procedure database, the web portal of the Ministry and ministerial agencies.
In addition, the Circular also provide procedures for announcement of legislative documents that come into force when they are ratified or signed.
Circular No. 02/2017/TT-VPCP comes into force from December 15, 2017.
3. A person must not be nominated for 02 state awards per year
This is a notable content of Circular No. 08/2017/TT-BNV which elaborates Decree No. 91/2017/NĐ-CP elaborating the Law on Emulation and Commendation and comes into force from December 15, 2017.
A person or collective must not be nominated for and receive 02 state awards in a year, except for those who have irregular excellent achievements, awards for lifetime achievements and annual awards;
Circular No. 08/2017/TT-BNV also specifies that:
- The awards must be suitable for the persons’ positions, duties and achievements.
- A single achievement must not receive more than one awards; a collective or person will be nominated for the type of award that is suitable for their ranks.
- A single achievement must not be nominated for 02 medals or receive both the Prime Minister’s medal and certificate of merit.
4. Adjustments to some fee schedules from mid-December 2017
The following legislative documents on fees in various fields come into force from December 11, 2017:
- Circular No. 111/2017/TT-BTC on adjustments to fees for notarization, authentication, examination of qualifications and conditions for providing notarization services, conditions for running private notary offices; fees for issuance of notary’s cards;
- Circular No. 110/2017/TT-BTC adjusting fees for assessment of conditions for providing occupational safety inspection services and training in occupational hygiene and safety;
- Circular No. 112/2017/TT-BTC adjusting fees for inspection of fire safety and firefighting devices, payment, collection management and use thereof;
- Circular No. 113/2017/TT-BTC adjusting fees for registration of secured transactions, payment, collection management and use thereof;
- Circular No. 114/2017/TT-BTC adjusting fees related to pharmaceuticals and cosmetics.
