- Working hours
Working hours shall be arranged in shifts of no more than 6 hours per day for employees performing work of a special nature at sea in the provision of public services for maritime safety assurance.
- Overtime work
+ Overtime hours are working hours outside the work shifts prescribed in Article 4 of this Circular.
+ An employee’s overtime hours must not exceed 50% of the working hours of a work shift in 1 day or 300 hours in one year.
+ Overtime work may only be arranged with the employee’s consent and must comply with applicable law.
+ The arrangement of overtime work in special cases shall comply with Article 108 of the 2019 Labor Code.
- Rest hours
+ After each work shift, an employee shall be given at least 12 consecutive hours of rest before commencing a new work shift.
+ An employer shall arrange breaks during working hours, which shall be included in working hours, ensuring a continuous break of at least 30 minutes or, in the case of night work, at least 45 minutes.
+ In addition to breaks during work shifts, each year, an employee shall be given continuous periods of rest following work rotations, totaling at least 52 days. Such rest may be divided into one or more periods.
- Annual leave; public holiday and Tet holiday leave; personal leave and unpaid leave
+ In addition to the rest periods following work rotations prescribed in Clause 3 Article 6 of this Circular, an employee is entitled to annual leave in accordance with Articles 113 and 114 of the 2019 Labor Code.
+ An employee shall be granted public holiday and Tet holiday leave, personal leave, and unpaid leave in accordance with Articles 112 and 115 of the 2019 Labor Code.
+ Where an employee works on a public holiday or Tet holiday, the employee shall receive overtime pay in accordance with the law.
