The submission, receipt, and processing of petitions, requests, documents, and evidence by electronic means are guided in Vietnam’s Resolution No. 01/2026/NQ-HDTP as follows:
(i) Submission of petitions, requests, documents, and evidence by electronic means
- Agencies, organizations, and individuals shall submit petitions, requests, and accompanying documents and evidence to the Court’s Public Service System, except for cases specified in Clause 4 Article 24 of Resolution No. 01/2026/NQ-HDTP.
- The date of filing a petition or request is the date on which the agency, organization, or individual submits such petition or request via electronic means, and it is confirmed by the Court’s Public Service System as successfully submitted.
- During the proceedings, agencies, organizations, and individuals shall submit documents and evidence to the Court via electronic means through their electronic transaction accounts, except for cases specified in Clause 4 Article 24 of Resolution No. 01/2026/NQ-HDTP.
(ii) Receipt and processing of petitions, requests, documents, and evidence
- Upon receipt of petitions, requests, documents, and evidence from agencies, organizations, or individuals, the Court must send a data message confirming receipt to the electronic transaction account of such agency, organization, or individual.
- The Court shall send the results of the processing of petitions and requests to the electronic transaction account of the agency, organization, or individual.
(iii) Submission of documents and evidence
- Agencies, organizations, and individuals may use electronic documents and evidence already submitted during the proceedings if they have been inspected and accepted by the Court. The Court may request agencies, organizations, or individuals to provide originals or certified true copies in the following cases:
+ There are grounds to believe that the electronic documents show signs of alteration, inaccuracy, or lack of integrity and need to be compared with the originals or certified true copies;
+ The electronic documents are incomplete, unclear in content, or not in the prescribed format.
- For papers, documents, evidence, and case files that have been digitized, stored, connected, and shared with the Court’s Public Service System and the National Public Service Portal, the Court shall not require agencies, organizations, or individuals to resubmit them.
- For papers, documents, evidence, and case files that have not been digitized, stored, connected, or shared with the Court’s Public Service System and the National Public Service Portal, agencies, organizations, or individuals shall request competent state authorities to issue electronic copies for submission to the Court via electronic means.
- For documents and evidence that are material evidence, audio or visual materials, or other documents and evidence that cannot be formatted as data messages, the Court, agencies, organizations, and individuals shall not submit them by electronic means but must submit them by other methods in accordance with procedural law.
