According to the Circular, after being granted a license by the State Bank of Vietnam, an economic organization may open and use a foreign-currency account abroad in accordance with the contents stipulated in the license, any Decision on amendment and supplementation of the license (if any), the provisions of Circular No. 39/2025/TT-NHNN and the laws of the host country where the economic organization opens the account, in the following cases:
(1) The economic organization opens and uses a foreign-currency account abroad to satisfy the licensing conditions for the establishment and operation of its branch or representative office in accordance with the laws of the host country.
(2) The economic organization opens and uses a foreign-currency account abroad to serve the operations of its branch or representative office abroad.
(3) The economic organization, being an enterprise, cooperative, or cooperative union (the borrower), opens and uses a foreign-currency account abroad to implement a foreign loan under an agreement with the foreign lender. The borrower may use one foreign-currency account abroad to implement one or multiple foreign loans.
(4) The economic organization, being an enterprise, classified as being of special importance under a Government program, or an enterprise investing in the form of public–private partnership (PPP), opens and uses a foreign-currency account abroad to perform its commitments, arrangements, or contracts with the foreign party.
(5) The economic organization opens and uses a foreign-currency account abroad to perform its commitments, arrangements, or contracts with the foreign party, including construction bidding contracts abroad; vessel purchase and sale contracts with the foreign party; and other commitments, arrangements, or contracts with the foreign party, excluding the opening and use of a foreign-currency account abroad to implement a foreign loan at the request of the foreign lender.
