Thời gian qua, Tổng cục Hải quan nhận báo cáo, phản ánh vướng mắc của một số Cục Hải quan tỉnh, thành phố về việc dừng đưa hàng qua khu vực giám sát hải quan và việc kiểm tra hàng hóa chuyển cửa khẩu bằng máy soi container dẫn đến thời gian kiểm tra kéo dài, số lượng lô hàng dừng, kiểm tra nhiều nhưng tỷ lệ phát hiện vi phạm thấp, làm kéo dài thời gian thông quan hàng hóa, tăng chi phí và gây bức xúc cho doanh nghiệp.

Thực hiện thông báo số 4244/TB-TCHQ ngày 10/10/2022 của Tổng cục trưởng tại Hội nghị trực tuyến giao ban kết quả công tác Quý III triển khai nhiệm vụ Quý IV năm 2022, Tổng cục Hải quan yêu cầu các đơn vị thực hiện thống nhất các nội dung sau:

1. Việc dừng đưa hàng qua khu vực giám sát hải quan đối với hàng hóa xuất nhập khẩu:

1.1. Đối với hàng xuất khẩu:

Thực hiện theo quy định tại Điều 52d Thông tư số 38/2015/TT-BTC ngày 25/3/2015, được sửa đổi, bổ sung tại Thông tư số 39/2018/TT-BTC ngày 20/4/2018 của Bộ Tài chính.

1.2. Đối với hàng nhập khẩu:

a) Trường hợp có thông tin hàng hóa nhập khẩu là hàng cấm nhập khẩu, tạm ngừng nhập khẩu hoặc có chứng cứ về sai phạm thì thực hiện theo quy định tại Điều 52d Thông tư số 38/2015/TT-BTC ngày 25/3/2015, được sửa đổi, bổ sung tại Thông tư số 39/2018/TT-BTC ngày 20/4/2018 của Bộ Tài chính.

b) Trường hợp có thông tin nghi vấn vi phạm thì Chi cục Hải quan nơi lưu giữ hàng hóa không tạm dừng đưa hàng qua khu vực giám sát; Chi cục Hải quan nơi lưu giữ hàng hóa thông báo cho Chi cục Hải quan nơi đăng ký tờ khai biết thông qua đường dây nóng để quyết định việc thay đổi hình thức, mức độ, địa điểm kiểm tra, thiết lập tiêu chí rủi ro (nếu cần) hoặc quyết định kiểm tra sau thông quan theo quy định.

1.3. Trách nhiệm xác định vi phạm, xử lý vụ việc và báo cáo:

a) Khi ra quyết định dừng đưa hàng qua khu vực giám sát, Chi cục trưởng Chi cục Hải quan phải xác định cụ thể các dấu hiệu vi phạm, căn cứ trên kết quả đánh giá thông tin có sẵn được thu thập theo quy định; Trường hợp lô hàng có nhiều container thì phải xác định cụ thể số hiệu container nghi vấn cần kiểm tra; Chỉ yêu cầu người khai hải quan xuất trình các container có nghi vấn để kiểm tra; Đối với các Cục Hải quan tỉnh thành phố đã được trang bị máy soi, việc kiểm tra được thực hiện bằng máy soi, sau khi kiểm tra bằng máy soi nếu xác định hàng hóa có vi phạm thì mới thực hiện mở kiểm tra thủ công; Đối với các Cục Hải quan tỉnh thành phố chưa được trang bị máy soi, việc kiểm tra được thực hiện bởi công chức hải quan và phải đảm bảo hoàn thành trong thời hạn theo quy định tại khoản 2 Điều 23 Luật Hải quan;

b) Giao Cục Hải quan các tỉnh, thành phố định kỳ vào thứ hai hàng tuần tổng hợp, báo cáo, đánh giá kết quả thực hiện dừng đưa hàng qua khu vực giám sát của các Chi cục Hải quan trực thuộc theo Phụ lục I (đính kèm) và gửi qua email: [e-mail] để tổng hợp; Các đơn vị không phát sinh quyết định dừng đưa hàng qua khu vực giám sát không phải báo cáo số liệu.

2. Việc kiểm tra hàng hóa chuyển cửa khẩu bằng máy soi container:

a) Việc kiểm tra container bằng máy soi đối với các lô hàng chuyển cửa khẩu được thực hiện theo quy định tại Quyết định 3272/QĐ-TCHQ ngày 24/11/2020 của Tổng cục trưởng Tổng cục Hải quan về việc ban hành Quy định kiểm tra hàng hóa xuất khẩu, nhập khẩu bằng máy soi container, trên cơ sở luồng hàng hóa di chuyển để tạo điều kiện thuận lợi cho hoạt động xuất nhập khẩu của doanh nghiệp.

b) Hàng hóa nhập khẩu vận chuyển từ cửa khẩu nhập đến địa điểm kiểm tra của Chi cục Hải quan ngoài cửa khẩu để làm thủ tục, kiểm tra hải quan phải thực hiện niêm phong, kẹp chì và giám sát hải quan theo quy định. Các địa điểm kiểm tra phải được cơ quan hải quan công nhận, đáp ứng yêu cầu về kiểm tra, giám sát hải quan theo quy định pháp luật.

3. Giao Cục Giám sát quản lý về hải quan phân tích hiệu quả việc dừng đưa hàng qua khu vực giám sát và việc kiểm tra hàng hóa chuyển cửa khẩu bằng máy soi, tham mưu lãnh đạo Tổng cục chỉ đạo, điều chỉnh mức độ soi chiếu, đối tượng dừng đưa hàng qua khu vực giám sát để đảm bảo giảm thời gian thực hiện thủ tục hải quan, tạo điều kiện thuận lợi cho hoạt động xuất nhập khẩu của các doanh nghiệp và đảm bảo hiệu lực, hiệu quả quản lý.

Tổng cục Hải quan thông báo để các đơn vị biết, triển khai thực hiện./.

To: Provincial Customs Departments.

The General Department of Vietnam Customs has been informed by some Provincial Customs Departments that the suspension of entry of goods into customs controlled areas and inspection of goods moved to another custom post outside the checkpoint area or vice versa with container scanners have caused extended inspection period and large quantity of suspended or inspected shipments with a low rate of violation detection, and thus caused extended clearance period and increased costs incurred by enterprises.

For the purposes of the Notice No. 4244/TB-TCHQ dated October 10, 2022 announced by the Director General at the online meeting on reporting on working results of Quarter III and assignment of tasks of Quarter IV, the General Department of Vietnam Customs hereby requests relevant units to consistently comply with the following guidelines:

1. Regarding suspension of entry of imported/exported goods into customs controlled areas:

1.1. Regarding exported goods:

The provisions of Article 52d of the Circular No. 38/2015/TT-BTC dated March 25, 2015, as amended in the Circular No. 39/2018/TT-BTC dated April 20, 2018 of the Ministry of Finance of Vietnam shall apply.

1.2. Regarding imported goods:

a) If the imported goods are reported as those banned or suspended from import or there are evidences of violations, the provisions of Article 52d of the Circular No. 38/2015/TT-BTC dated March 25, 2015, as amended in the Circular No. 39/2018/TT-BTC dated April 20, 2018 of the Ministry of Finance of Vietnam shall apply.

1.3. Responsibility to identify violations, take actions and submit reports:

a) When issuing a decision on suspension of entry of goods into a customs controlled area, the Director of the Customs Sub-department is required to identify specific signs of violation and use assessment results of collected information as prescribed. In case a shipment is comprised of multiple containers, the number of the container in question must be identified. Only doubtful containers shall be presented for inspection purpose. If a provincial Customs Department has a scanner, the inspection of goods shall be carried out using the scanner. If a violation is found during the scanner-aided inspection, the manual inspection shall be carried out. Where a scanner is not available, the inspection shall be carried out by the customs official and must be completed by the deadline prescribed in Clause 2 Article 23 of the Law on Customs;

b) Provincial Customs Departments are requested to submit periodical reports on Monday weekly on the suspension of entry of goods into customs controlled areas of their affiliated Customs Sub-departments (using the form in Appendix I enclosed herewith) via email: [e-mail]. Such reports shall not be required if there is no case of suspension.

2. Inspection of goods moved to another custom post outside the checkpoint area or vice versa with container scanners:

a) The inspection of goods moved to another custom post outside the checkpoint area or vice versa with container scanners shall be conducted in accordance with the Decision No. 3272/QD-TCHQ dated November 24, 2020 of the Director General of General Department of Vietnam Customs and on the basis of the volume of moved goods in order to facilitate enterprises’ import.

b) Imports transported from the checkpoint of import to the inspection site of the Customs Sub-department outside that checkpoint area for inspection must be properly sealed and supervised as prescribed. The inspection site must be recognized by the customs authority to meet customs inspection and supervision requirements laid down in law.

3. The Customs Supervision and Management Department is assigned to carry out the analysis of efficiency of suspension of entry of goods into customs controlled areas and inspection of goods moved to another custom post outside the checkpoint area or vice versa with container scanners, provide advice for the Director General about modification of scanning level and goods suspended from entry into controlled areas in order to ensure the prescribed customs clearance period, facilitate import and export as well as ensure validity and efficiency in management tasks.
