Ngày 11/10/2022, Bộ Nông nghiệp và Phát triển nông thôn có Văn bản số 6813/BNN-TCLN gửi Ủy ban nhân dân các tỉnh, thành phố trực thuộc Trung ương về việc thực hiện Nghị quyết số 61/2022/QH15 ngày 16/6/2022 và Nghị quyết số 108/NQ-CP ngày 22/8/2022.

Ngày 04/11/2022, Chính phủ ban hành Nghị quyết số 143/NQ-CP phiên họp Chính phủ thường kỳ tháng 10 năm 2022, trong đó có giao Bộ Nông nghiệp và Phát triển nông thôn hướng dẫn các địa phương tháo gỡ khó khăn, vướng mắc trong việc điều chỉnh quy hoạch bảo vệ và phát triển rừng, quy hoạch 3 loại rừng cấp tỉnh, lập, hoàn thiện hồ sơ trình cấp có thẩm quyền xem xét, quyết định chủ trương chuyển mục đích sử dụng rừng sang mục đích khác để thực hiện các dự án đầu tư, bảo đảm khả thi, tuân thủ đúng, đầy đủ các quy định của pháp luật liên quan. Bộ Nông nghiệp và Phát triển nông thôn đề nghị Ủy ban nhân dân các tỉnh, thành phố như sau:

1. Trong thời gian Quy hoạch Lâm nghiệp quốc gia chưa được cấp có thẩm quyền phê duyệt, Quy hoạch bảo vệ và phát triển rừng hoặc Quy hoạch 3 loại rừng được cấp có thẩm quyền phê duyệt trước ngày 01/01/2019 được tiếp tục thực hiện.

2. Trong trường hợp cần thiết thì điều chỉnh nội dung Quy hoạch bảo vệ và phát triển rừng hoặc Quy hoạch 3 loại rừng theo quy định tại điểm d khoản 1 Điều 2 Nghị quyết số 61/2022/QH15 ngày 16/6/2022 của Quốc hội về tiếp tục tăng cường hiệu lực, hiệu quả thực hiện chính sách, pháp luật về quy hoạch và một số giải pháp tháo gỡ khó khăn, vướng mắc, đẩy nhanh tiến độ lập và nâng cao chất lượng quy hoạch thời kỳ 2021-2030. Nội dung điều chỉnh Quy hoạch bảo vệ và phát triển rừng hoặc Quy hoạch 3 loại rừng phải đảm bảo phù hợp với chỉ tiêu quy hoạch, kế hoạch sử dụng đất đã được Thủ tướng Chính phủ phân bổ cho từng tỉnh tại Quyết định số 326/QĐ-TTg ngày 9/3/2022. Khi điều chỉnh Quy hoạch bảo vệ và phát triển rừng hoặc Quy hoạch 3 loại rừng cần chú ý một số nội dung, sau:

a) Tên quy hoạch được điều chỉnh: “Quy hoạch bảo vệ và phát triển rừng” hoặc “Quy hoạch 3 loại rừng” của tỉnh được cấp có thẩm quyền phê duyệt trước ngày Luật Quy hoạch có hiệu lực thi hành (ngày 01/01/2019).

b) Căn cứ điều chỉnh

- Luật Bảo vệ và phát triển rừng; Nghị định số 23/2006/NĐ-CP ngày 03/3/2006 của Chính phủ về thi hành Luật Bảo vệ và phát triển rừng và các văn bản có liên quan.

- Nghị quyết số 61/2022/QH15 ngày 16/6/2022 của Quốc hội về tiếp tục tăng cường hiệu lực, hiệu quả thực hiện chính sách, pháp luật về quy hoạch và một số giải pháp tháo gỡ khó khăn, vướng mắc, đẩy nhanh tiến độ lập và nâng cao chất lượng quy hoạch thời kỳ 2021-2030;

- Nghị quyết số 108/NQ-CP ngày 22/8/2022 của Chính phủ về thực hiện Nghị quyết số 61/2022/QH15 về tiếp tục tăng cường hiệu lực, hiệu quả thực hiện chính sách, pháp luật về quy hoạch và một số giải pháp tháo gỡ khó khăn, vướng mắc, đẩy nhanh tiến độ lập và nâng cao chất lượng quy hoạch thời kỳ 2021-2030;

c) Nội dung điều chỉnh

Đối với các Dự án/Công trình có chuyển mục đích sử dụng rừng (rừng tự nhiên và rừng trồng), đề nghị xác định rõ diện tích, vị trí, loại rừng chuyển mục đích sử dụng rừng (bằng biểu số liệu và trên bản đồ) trong nội dung Quy hoạch bảo vệ và phát triển rừng hoặc Quy hoạch 3 loại rừng (Theo mẫu tại Phụ lục kèm theo).

d) Trình tự, thủ tục điều chỉnh Quy hoạch bảo vệ và phát triển rừng: Thực hiện theo quy định tại Điều 12 Nghị định số 23/2006/NĐ-CP ngày 03/3/2006 của Chính phủ về thi hành Luật Bảo vệ và phát triển rừng.

3. Đối với diện tích rừng của các Dự án/Công trình có chuyển mục đích sử dụng rừng được điều chỉnh trong “Quy hoạch bảo vệ và phát triển rừng” hoặc “Quy hoạch 3 loại rừng”, khi chưa có phê duyệt, quyết định của cấp có thẩm quyền cho phép chuyển mục đích sử dụng rừng thì phải được quản lý theo quy chế quản lý rừng đặc dụng, rừng phòng hộ, rừng sản xuất cho đến khi được cấp có thẩm quyền phê duyệt hoặc quyết định chuyển mục đích sử dụng rừng.

Trong quá trình triển khai thực hiện, có vấn đề phát sinh, vướng mắc, đề nghị thông tin về Tổng cục Lâm nghiệp để tổng hợp, báo cáo kịp thời theo quy định.

Bộ Nông nghiệp và Phát triển nông thôn đề nghị Ủy ban nhân dân các tỉnh, thành phố nghiên cứu chỉ đạo thực hiện./.

To: Provincial People’s Committees 

On October 11, 2022, the Ministry of Agriculture and Rural Development of Vietnam has sent the Official Document No. 6813/BNN-TCLN to Provincial People’s Committees for the purpose of implementation of the Resolution No. 61/2022/QH15 dated June 16, 2022 and the Resolution No. 108/NQ-CP dated August 22, 2022.  

On November 04, 2022, the Government has promulgated the Resolution No. 143/NQ-CP on the Government’s Regular Meeting in October, 2022, in which the Ministry of Agriculture and Rural Development of Vietnam is assigned to deal with difficulties encountered during the modification of provincial forest protection and development plannings or plannings for 3 forest types, prepare and submit completed documents to competent authorities for considering and deciding policies for repurposing of forests to serve the implementation of investment projects provided that the feasibility of such policies as well as strict and adequate compliance with regulations of relevant laws must be ensured. The Ministry of Agriculture and Rural Development of Vietnam hereby requests Provincial People’s Committees to comply with the following provisions:

1. While the national forestry planning is not yet granted approved by a competent authority, forest protection and development plannings or plannings for 3 forest types which have been approved by competent authorities before January 01, 2019 shall continue to be implemented.

2. Where necessary, forest protection and development plannings or plannings for 3 forest types may be modified according to the provisions of Point d Clause 1 Article 2 of the National Assembly’s Resolution No. 61/2022/QH15 dated June 16, 2022 on increase of efficiency and validity of policies and laws on planning and certain solutions for dealing with difficulties to accelerate the formulation process and improve quality of plannings for the 2021-2030 period. Amendments to forest protection and development plannings or plannings for 3 forest types must be conformable with land use plans or planning criteria assigned to each province by the Prime Minister according to the Decision No. 326/QD-TTg dated March 09, 2022. When making amendments to forest protection and development plannings or plannings for 3 forest types, the following contents should be paid attention:

a) Name of the amended planning: “Forest protection and development planning” or “Planning for 3 forest types” of provinces which have been approved by competent authorities before the effective date of the Law on plannings (i.e. January 01, 2019).

b) Grounds for making amendments

- The Law on Forest Protection and Development; the Government’s Decree No. 23/2006/ND-CP dated March 03, 2006 on implementation of the Law on Forest Protection and Development, and relevant documents.

- The Government’s Resolution No. 108/NQ-CP dated August 22, 2022 on implementation of the Resolution No. 61/2022/QH15 dated June 16, 2022 on increase of efficiency and validity of policies and laws on planning and certain solutions for dealing with difficulties to accelerate the formulation process and improve quality of plannings for the 2021-2030 period;

c) Amended contents

With regard to projects/works including forest repurposing contents (natural forests and cultivated forests), determination of areas, positions and types of forests to be repurposed (by datasheets and on maps) must be included in forest protection and development plannings or plannings for 3 forest types (according to the form in Appendix enclosed herewith).

d) Procedures for amending forest protection and development plannings shall comply with the provisions of Article 12 of the Government's Decree No. 23/2006/ND-CP dated March 03, 2006 on implementation of the Law on Forest Protection and Development.

3. Forest areas of projects/works including forest repurposing contents which are amended under “Forest protection and development planning” or “Planning for 3 forest types” shall be managed according to regulations on management of reserve forests, protective forests and production forests until competent authorities grant approval or issue decisions on forest repurposing.

Vietnam Administration of Forestry is requested to promptly report any difficulties that arise during the implementation of this document.

Provincial People’s Committees are requested to organize the implementation of contents specified in this document./.
