Trả lời Công văn số 4245/LĐTBXH-CSLĐ ngày 03/8/2021 của Sở Lao động - Thương binh và Xã hội tỉnh Đồng Nai về việc kiến nghị hướng dẫn một số vướng mắc trong việc thực hiện chính sách, Bộ Lao động - Thương binh và Xã hội có ý kiến như sau:

1. Theo quy định của địa phương, doanh nghiệp được phép hoạt động khi đáp ứng điều kiện “3 tại chỗ” và “doanh nghiệp nào không đáp ứng được thì phải tạm dừng sản xuất”. Đối với doanh nghiệp tổ chức sản xuất theo phương án “3 tại chỗ” nhưng có một số người lao động không đồng ý với phương án lưu trú theo yêu cầu “3 tại chỗ” của doanh nghiệp thì những trường hợp này hai bên người lao động và doanh nghiệp thống nhất để xác định theo một trong các cách sau:

- Doanh nghiệp cho người lao động ngừng việc và trả lương ngừng việc cho người lao động theo quy định tại Khoản 3 Điều 99 Bộ luật Lao động. Trong trường hợp này, người lao động được hỗ trợ chính sách ngừng việc khi đáp ứng đủ các điều kiện theo chương V (Điều 17 đến Điều 20) của Quyết định số 23/2021/QĐ-TTg ngày 07/7/2021 của Thủ tướng Chính phủ quy định về việc thực hiện một số chính sách hỗ trợ người lao động và người sử dụng lao động gặp khó khăn do đại dịch Covid - 19 (sau đây gọi là Quyết định số 23/2021/QĐ-TTg).

- Thống nhất với người lao động tạm hoãn hợp đồng lao động theo điểm h Khoản 1 Điều 30 Bộ luật Lao động hoặc hai bên thỏa thuận nghỉ không hưởng lương theo Khoản 3 Điều 115 Bộ luật Lao động.

- Các trường hợp khác theo quy định của pháp luật lao động, như: thỏa thuận chấm dứt hợp đồng lao động theo Khoản 3 Điều 34 Bộ luật Lao động; thực hiện quyền đơn phương chấm dứt hợp đồng lao động với người lao động theo điểm c Khoản 1 Điều 36 Bộ luật Lao động;...

2. Theo quy định của địa phương, doanh nghiệp được phép hoạt động khi đáp ứng điều kiện “3 tại chỗ” và “doanh nghiệp nào không đáp ứng được thì phải tạm dừng sản xuất”, thì:

- Với những doanh nghiệp không đáp ứng được điều kiện “3 tại chỗ” và phải dừng hoạt động sản xuất kinh doanh trong thời gian thực hiện quy định đó của địa phương được xem là phải tạm dừng hoạt động theo yêu cầu của cơ quan nhà nước có thẩm quyền để phòng, chống dịch COVID-19 để được hưởng chính sách hỗ trợ quy định tại Điều 13 Quyết định 23/2021/QĐ-TTg.

- Với những doanh nghiệp nằm trong khu vực bị cách ly y tế nên khó khăn về cung ứng nguyên vật liệu, xuất hàng buộc phải tạm dừng hoạt động có thể được xem là phải tạm dừng hoạt động theo yêu cầu của cơ quan nhà nước có thẩm quyền để phòng, chống dịch COVID-19 để được hưởng chính sách hỗ trợ quy định tại Điều 13 Quyết định 23/2021/QĐ-TTg.

Trong thực tiễn, tùy thuộc vào công tác chỉ đạo chống dịch của mỗi địa phương là tương đối khác nhau theo đặc thù riêng nên cần phải có cách hiểu linh hoạt và phải được thực hiện một cách đơn giản và hiệu quả nhất với mục tiêu hỗ trợ tối đa cho doanh nghiệp, người lao động gặp khó khăn.

3. Quy định “người lao động thuộc đối tượng phải cách ly y tế hoặc trong các khu vực bị phong tỏa theo yêu cầu của cơ quan nhà nước có thẩm quyền” tại Khoản 1 Điều 17 Quyết định số 23/2021/QĐ-TTg được hiểu là nơi làm việc và/hoặc nơi cư trú của người lao động trong các khu vực bị phong tỏa theo yêu cầu của cơ quan nhà nước có thẩm quyền, bao gồm cả “giãn cách xã hội theo Chỉ thị 16/CT-TTg ngày 31/3/2020 của Thủ tướng Chính phủ” hoặc nằm trong “vùng cách ly y tế phòng chống dịch Covid 19”.

Do tình hình dịch bệnh diễn biến phức tạp và khó lường, việc hiểu và áp dụng các chính sách ở mỗi địa phương cần được thực hiện sáng tạo, linh hoạt và chủ động, nhằm đảm bảo phù hợp với công tác chỉ đạo phòng, chống dịch bệnh ở mỗi địa phương và hỗ trợ nhanh chóng, đúng đối tượng cho người dân, người lao động trên địa bàn.

Bộ đề nghị Sở Lao động - Thương binh và Xã hội tập trung chỉ đạo thực hiện theo hướng dẫn để tạo thuận lợi tối đa cho người dân và doanh nghiệp trong quá trình triển khai, thực hiện Nghị quyết./.

1. As per local regulations, enterprises are allowed to operate once they satisfy “3 on-the-spot” principle and “enterprises that fail to satisfy must suspend operation”. For enterprises organizing operation according to “3 on-the-spot” principle where several workers do not agree with accommodation solutions which satisfy “3 on-the-spot” principle of the enterprises, workers and enterprises shall agree with any of the following solutions:

- Enterprises allow workers to suspend working and pay workers with employment suspension pay as per Clause 3 Article 99 of the Labor Code. In this case, workers shall benefit from employment suspension policies when they satisfy all requirements under Chapter V (Article 17 through Article 20) of Decision No. 23/2021/QD-TTg dated July 7, 2021 of Prime Minister.

- Other cases according to labor laws namely: agreement on termination of employment contract according to Clause 3 Article 34 of the Labor Code; implementation of unilateral termination of employment contract with workers according to Point c Clause 1 Article 36 of the Labor Code, etc.

- Enterprises that are situated within medical quarantine areas thus facing difficulties in material supply and product release, and required to suspend operation shall be considered to be under suspension of operation at request of competent authority for COVID-19 epidemic management in order to receive benefits under Article 13 of Decision No. 23/2021/QD-TTg.

In reality, since epidemic management works of each administrative division relatively differs from one another, epidemic management work must be understood on a flexible basis and implemented in the simplest and most effective manner in order to provide the best support for enterprises and workers in hardships.

Due to complicated and unpredictable nature of the epidemic, policies must be understood and applied in each administrative division on a creative, flexible, and active basis to meet epidemic management affairs in each administrative division and support must be implemented quickly and adequately for local workers and beneficiaries.

The Ministry hereby requests Department of Labor – War Invalids and Social Affairs to direct implementation as per guidelines to assist the general public and enterprises during implementation of the Resolution./.
