BAN HÀNH QUY TRÌNH XÁC ĐỊNH TRƯỚC MÃ SỐ; KIỂM TRA TÊN HÀNG, MÔ TẢ HÀNG HÓA, MÃ SỐ, MỨC THUẾ, ĐƠN VỊ TÍNH CỦA HÀNG HÓA XUẤT KHẨU, NHẬP KHẨU TRONG THÔNG QUAN; THỐNG NHẤT CÔNG TÁC PHÂN LOẠI HÀNG HÓA, ÁP DỤNG MỨC THUẾ ĐỐI VỚI HÀNG HÓA XUẤT KHẨU, NHẬP KHẨU

Căn cứ Luật Hải quan số 54/2014/QH13 được sửa đổi, bổ sung bởi Luật số 90/2025/QH15;

Căn cứ Nghị định số 08/2015/NĐ-CP ngày 21/01/2015 của Chính phủ quy định chi tiết và biện pháp thi hành Luật Hải quan về thủ tục hải quan, kiểm tra, giám sát, kiểm soát hải quan được sửa đổi, bổ sung tại Nghị định số 167/2025/NĐ-CP ngày 30/6/2025 của Chính phủ;

Căn cứ Thông tư số 38/2015/TT-BTC, ngày 25 tháng 03 năm 2015 của Bộ trưởng Bộ Tài chính hướng dẫn về thủ tục hải quan; kiểm tra giám sát hải quan; thuế xuất khẩu, thuế nhập khẩu và quản lý thuế đối với hàng hóa xuất khẩu, nhập khẩu được sửa đổi, bổ sung tại Thông tư số 39/2018/TT-BTC và Thông tư số 121/2025/TT-BTC;

Căn cứ Thông tư số 14/2015/TT-BTC ngày 30 tháng 01 năm 2015 của Bộ trưởng Bộ Tài chính hướng dẫn về phân loại hàng hóa, phân tích để phân loại hàng hóa, phân tích để kiểm tra chất lượng, kiểm tra an toàn thực phẩm được sửa đổi, bổ sung tại Thông tư số 17/2021/TT-BTC;

Căn cứ Quyết định số 382/QĐ-BTC ngày 26 tháng 2 năm 2025 của Bộ trưởng Bộ Tài chính quy định chức năng, nhiệm vụ quyền hạn và cơ cấu tổ chức của Cục Hải quan, được sửa đổi, bổ sung tại Quyết định số 1892/QĐ-BTC ngày 30 tháng 5 năm 2025, Quyết định số 2019/QĐ-BTC ngày 11 tháng 6 năm 2025 của Bộ trưởng Bộ Tài chính;

Căn cứ Quyết định số 368/QĐ-CHQ ngày 15 tháng 4 năm 2025 của Cục trưởng Cục Hải quan ban hành Quy chế công tác văn thư của Cục Hải quan;

Xét đề nghị của Trưởng Ban Nghiệp vụ thuế hải quan.

QUYẾT ĐỊNH:

Điều 1. Ban hành kèm theo Quyết định này Quy trình Xác định trước mã số; Kiểm tra tên hàng, mô tả hàng hóa, mã số, mức thuế, đơn vị tính của hàng hóa xuất khẩu, nhập khẩu trong thông quan; Thống nhất công tác phân loại hàng hóa, áp dụng mức thuế đối với hàng hóa xuất khẩu, nhập khẩu.

Điều 2. Hiệu lực thi hành

1. Quyết định này có hiệu lực thi hành kể từ ngày 01 tháng 02 năm 2026.

2. Bãi bỏ Quyết định số 1921/QĐ-TCHQ ngày 28 tháng 6 năm 2018 của Tổng cục Hải quan về việc ban hành quy trình phân loại hàng hóa, áp dụng mức thuế đối với hàng hóa xuất khẩu nhập khẩu.

Điều 3. Chi cục trưởng Chi cục Hải quan khu vực, Thủ trưởng các đơn vị thuộc cơ quan Cục Hải quan chịu trách nhiệm thi hành Quyết định này. Trong quá trình thực hiện, nếu có vướng mắc phát sinh thì kịp thời báo cáo đề xuất để Cục Hải quan xem xét, điều chỉnh cho phù hợp./.

QUY TRÌNH

QUY TRÌNH XÁC ĐỊNH TRƯỚC MÃ SỐ; KIỂM TRA TÊN HÀNG, MÔ TẢ HÀNG HÓA, MÃ SỐ, MỨC THUẾ, ĐƠN VỊ TÍNH CỦA HÀNG HÓA XUẤT KHẨU, NHẬP KHẨU TRONG THÔNG QUAN; THỐNG NHẤT CÔNG TÁC PHÂN LOẠI HÀNG HÓA, ÁP DỤNG MỨC THUẾ ĐỐI VỚI HÀNG HÓA XUẤT KHẨU, NHẬP KHẨU

Phần I

QUY ĐỊNH CHUNG

Điều 1. Phạm vi điều chỉnh

Quy trình này quy định trình tự, thủ tục ban hành, sửa đổi, thay thế, hủy bỏ Thông báo kết quả xác định trước mã số; các nghiệp vụ về kiểm tra tên hàng, mô tả hàng hóa, mã số, áp dụng mức thuế, đơn vị tính của hàng hóa xuất khẩu, thuế nhập khẩu trong thông quan; thống nhất công tác phân loại hàng hóa, áp dụng mức thuế đối với hàng hóa xuất khẩu, nhập khẩu trong toàn ngành và xử lý vướng mắc vượt thẩm quyền trong công tác phân loại, áp dụng mức thuế.

Điều 2. Nguyên tắc thực hiện

1. Việc thực hiện phân loại hàng hóa, áp dụng mức thuế, công chức hải quan phải căn cứ các văn bản sau:

a) Luật Hải quan;

b) Nghị định số 08/2015/NĐ-CP ngày 21 tháng 01 năm 2015 của Chính phủ quy định chi tiết và biện pháp thi hành Luật hải quan về thủ tục hải quan, kiểm tra, giám sát, kiểm soát hải quan được sửa đổi, bổ sung tại Nghị định số 167/2025/NĐ-CP;

c) Thông tư số 38/2015/TT-BTC, ngày 25 tháng 03 năm 2015 của Bộ trưởng Bộ Tài chính hướng dẫn về thủ tục hải quan; kiểm tra giám sát hải quan; thuế xuất khẩu, thuế nhập khẩu và quản lý thuế đối với hàng hóa xuất khẩu, nhập khẩu được sửa đổi, bổ sung tại Thông tư số 39/2018/TT-BTC và Thông tư số 121/2025/TT-BTC;

d) Thông tư số 14/2015/TT-BTC ngày 30 tháng 01 năm 2015 của Bộ trưởng Bộ Tài chính hướng dẫn về phân loại hàng hóa, phân tích để phân loại hàng hóa, phân tích để kiểm tra chất lượng, kiểm tra an toàn thực phẩm được sửa đổi, bổ sung tại Thông tư số 17/2021/TT-BTC;

đ) Thông tư số 31/2022/TT-BTC ngày 08 tháng 6 năm 2022 của Bộ trưởng Bộ Tài chính về việc ban hành Danh mục hàng hóa xuất khẩu, nhập khẩu Việt Nam;

e) Biểu thuế xuất khẩu, Biểu thuế nhập khẩu ưu đãi, Danh mục hàng hóa và mức thuế tuyệt đối, thuế hỗn hợp, thuế nhập khẩu ngoài hạn ngạch thuế quan, Quyết định về việc áp dụng thuế suất thông thường đối với hàng hóa nhập khẩu và các Biểu thuế xuất khẩu ưu đãi, Biểu thuế nhập khẩu ưu đãi đặc biệt, các Quyết định về thuế nhập khẩu bổ sung có hiệu lực áp dụng tại thời điểm đăng ký tờ khai;

g) Quyết định của Cục Hải quan ban hành Danh mục hàng hóa xuất khẩu, nhập khẩu rủi ro về phân loại hàng hóa và áp dụng mức thuế và các hướng dẫn tại Quy trình này.

2. Việc tra cứu, sử dụng, cập nhật cơ sở dữ liệu trong quá trình phân loại hàng hóa áp dụng mức thuế, thực hiện theo Quy chế thu thập, cập nhật, sử dụng cơ sở dữ liệu về Danh mục hàng hóa xuất khẩu, nhập khẩu Việt Nam, cơ sở dữ liệu về Biểu thuế, cơ sở dữ liệu về phân loại hàng hóa và áp dụng mức thuế (sau đây gọi chung là hệ thống MHS).

3. Việc phân loại hàng hóa, áp dụng mức thuế, phải bảo đảm công khai, minh bạch, đảm bảo nguyên tắc một mặt hàng chỉ có một mã số duy nhất theo Danh mục hàng hóa xuất khẩu, nhập khẩu Việt Nam và việc áp dụng mức thuế đúng quy định.

4. Trong quá trình thực hiện nhiệm vụ, các vướng mắc nghiệp vụ phát sinh phải được khẩn trương xem xét, giải quyết theo thẩm quyền, trường hợp khó khăn thì báo cáo cấp trên trực tiếp để xử lý, đảm bảo tạo thuận lợi cho doanh nghiệp, kịp thời tháo gỡ khó khăn, vướng mắc.

5. Trong quá trình tiếp nhận, luân chuyển, xử lý hồ sơ để phân loại hàng hóa, áp dụng mức thuế, công chức hải quan phải thực hiện đúng quy định về bảo quản hồ sơ và sắp xếp theo bảng liệt kê tài liệu có trong hồ sơ.

Phần II

QUY ĐỊNH CỤ THỂ

Chương 1

TRÌNH TỰ, THỦ TỤC BAN HÀNH, SỬA ĐỔI, THAY THẾ, HỦY BỎ THÔNG BÁO KẾT QUẢ XÁC ĐỊNH TRƯỚC MÃ SỐ

Điều 3. Tiếp nhận và phân công xử lý hồ sơ xác định trước mã số

1. Văn phòng Cục Hải quan tiếp nhận hồ sơ xác định trước mã số do tổ chức, cá nhân gửi theo quy định hiện hành về công tác văn thư, xử lý công văn đến, chuyển hồ sơ kèm nguyên mẫu hàng hóa (nếu có) đến Ban Nghiệp vụ thuế Hải quan (sau đây gọi tắt là “Ban NVTHQ”).

2. Sau khi nhận được hồ sơ, kèm mẫu hàng hóa (nếu có), Ban NVTHQ thực hiện luân chuyển hồ sơ đến Tổ Phân loại hàng hóa - Biểu thuế (sau đây gọi là “Tổ Phân loại”) theo quy định hiện hành về công tác văn thư để phân công công chức xử lý.

Điều 4. Kiểm tra hồ sơ và xử lý kết quả kiểm tra

1. Kiểm tra hồ sơ.

Công chức được phân công xử lý hồ sơ thực hiện kiểm tra tính đầy đủ, chính xác của các chỉ tiêu khai báo trên Đơn đề nghị xác định trước mã số theo mẫu số 01/XĐTMS/NVTHQ tại Thông tư số 121/2025/TT-BTC (sau đây gọi tắt là Đơn đề nghị XĐTMS); kiểm tra tính thống nhất, phù hợp giữa các chứng từ, tài liệu kỹ thuật gửi kèm với nội dung khai báo trên Đơn đề nghị XĐTMS và mẫu hàng gửi kèm (nếu có).

a) Trường hợp hồ sơ không đáp ứng quy định: công chức lập phiếu đề xuất, dự thảo văn bản từ chối xác định trước mã số trong đó nêu rõ lý do từ chối, trình Lãnh đạo Tổ Phân loại, Lãnh đạo Ban NVTHQ ký phê duyệt văn bản trả lại hồ sơ trong thời hạn 05 (năm) ngày làm việc kể từ ngày nhận được hồ sơ đề nghị xác định trước mã số. Các trường hợp từ chối hồ sơ xác định trước mã số:

a.1) Hồ sơ xác định trước mã số kê khai không đúng quy định, bao gồm: Đơn đề nghị XĐTMS không đúng theo mẫu, không điền đầy đủ thông tin; không có đầy đủ các chứng từ theo quy định; thời gian dự kiến xuất khẩu, nhập khẩu không đúng quy định; không thống nhất giữa thông tin trên Đơn đề nghị XĐTMS, các chứng từ tài liệu và mẫu hàng (nếu có).

a.2) Hàng hóa nêu tại Đơn đề nghị XĐTMS đang chờ kết quả xử lý của cơ quan quản lý nhà nước theo quy định tại điểm b khoản 5 Điều 7 Thông tư 38/2015/TT-BTC được sửa đổi, bổ sung tại Thông tư 39/2018/TT-BTC và Thông tư 121/2025/TT-BTC, bao gồm: Hàng hóa nêu tại Đơn đề nghị XĐTMS thuộc vụ việc đã được cơ quan nhà nước có thẩm quyền thông báo về việc đang điều tra, thanh tra, kiểm tra; Hàng hóa nêu tại Đơn đề nghị XĐTMS đã được Cục Hải quan tiếp nhận và chờ kết quả xử lý.

a.3) Hàng hóa nêu tại Đơn đề nghị XĐTMS đã có văn bản hướng dẫn về mã số của Bộ Tài chính, Cục Hải quan theo quy định tại điểm c khoản 5 Điều 7 Thông tư 38/2015/TT-BTC được sửa đổi, bổ sung tại Thông tư 39/2018/TT-BTC và Thông tư 121/2025/TT-BTC, bao gồm: Thông báo kết quả xác định trước mã số (tra cứu tại chức năng 2.02 mục 2 MHS) hoặc Thông báo kết quả phân tích, phân loại (tra cứu tại chức năng 2.03 mục 2 MHS) của chính tổ chức, cá nhân đề nghị xác định trước mã số; văn bản hướng dẫn phân loại cho mặt hàng trong Đơn đề nghị XĐTMS (tra cứu tại chức năng 3.03.06 mục 3 MHS hoặc trên website hoặc tại hệ thống quản lý văn bản Edoc, Cces, Net office).

b) Trường hợp hồ sơ đáp ứng quy định: công chức chuyển thực hiện khoản 2 Điều này.

2. Xác định mã số.

Công chức căn cứ các nguyên tắc được quy định tại Điều 2 Quy trình này đối chiếu với hồ sơ xác định trước mã số, mẫu hàng hóa (nếu có) và xử lý như sau:

a) Trường hợp đủ căn cứ để xác định được mã số của hàng hóa: công chức xác định mã số, lập phiếu đề xuất, dự thảo Thông báo kết quả xác định trước mã số theo Mẫu số 01a-TB XDTMS tại Thông tư số 121/2025/TT-BTC, báo cáo Lãnh đạo Tổ phân loại, trình Lãnh đạo Ban NVTHQ duyệt ký.

b) Trường hợp chưa đủ căn cứ để xác định mã số hàng hóa:

b.1) Trường hợp hàng hóa cần bổ sung thông tin: Công chức lập phiếu đề xuất, dự thảo văn bản yêu cầu tổ chức, cá nhân có Đơn đề nghị XĐTMS bổ sung, làm rõ thông tin, cung cấp chứng thư phân tích, giám định của tổ chức có chức năng theo quy định của pháp luật hoặc mời đến cơ quan hải quan để đối thoại, giải thích, làm rõ các nội dung tại hồ sơ.

Trường hợp tổ chức, cá nhân đề nghị xác định trước mã số không cung cấp thông tin, tài liệu hoặc cung cấp không đầy đủ thông tin, tài liệu hoặc không đến làm việc theo yêu cầu của cơ quan hải quan thì công chức lập phiếu đề xuất, dự thảo văn bản, báo cáo Lãnh đạo Tổ Phân loại, trình Lãnh đạo Ban NVTHQ duyệt ký trả lại hồ sơ cho tổ chức, cá nhân đề nghị xác định trước mã số.

Trường hợp sau khi nhận đủ thông tin từ tổ chức, cá nhân và đủ căn cứ để xác định mã số, công chức thực hiện theo quy định tại điểm a khoản 2 Điều này.

Thời gian xử lý hồ sơ xác định trước mã số tính từ ngày Cục Hải quan nhận đủ thông tin từ tổ chức, cá nhân theo quy định.

Lưu ý:

- Đối với trường hợp hàng hóa chưa thể xác định được tên gọi, mã số trên cơ sở mô tả mặt hàng, tài liệu kỹ thuật, hình ảnh, mẫu hàng và các tài liệu khác trong hồ sơ xác định trước mã số mà phải dựa trên kết quả phân tích, giám định bằng trang thiết bị kỹ thuật thì yêu cầu tổ chức, cá nhân cung cấp Chứng thư phân tích, giám định của tổ chức có chức năng phân tích, giám định để làm căn cứ xác định mã số.

- Trường hợp mời tổ chức, cá nhân đến cơ quan hải quan làm việc để làm rõ thông tin tại hồ sơ xác định trước mã số, công chức phải chuẩn bị nội dung làm việc. Nội dung làm việc phải được lập thành biên bản, ghi rõ thời gian, địa điểm, thành phần tham gia, nội dung, ý kiến của những người tham gia, những nội dung đã được thống nhất, những vấn đề còn có ý kiến khác nhau và chữ ký của các bên. Biên bản làm việc được lập thành hai bản, mỗi bên giữ một bản và là một tài liệu không tách rời của hồ sơ xác định trước mã số.

Trường hợp cá nhân, tổ chức đã bổ sung đầy đủ thông tin nhưng chưa đủ cơ sở xác định mã số thì thực hiện theo điểm b.2 hoặc b.3 hoặc b.4 dưới đây:

b.2) Trường hợp có nghi ngờ, cần phân tích để kiểm chứng, đối chiếu, loại trừ theo các tiêu chí phân loại hoặc cần lấy ý kiến về phân loại mặt hàng: Công chức dự thảo văn bản trong đó nêu rõ tiêu chí cần phân tích kiểm chứng hoặc nội dung cần trao đổi, kèm theo mẫu hàng hóa và hồ sơ xác định trước mã số, trình Lãnh đạo Tổ, Lãnh đạo Ban phê duyệt để gửi Chi cục Kiểm định hải quan cho ý kiến.

Sau khi nhận được kết quả phân tích hoặc ý kiến phân loại của Chi cục Kiểm định hải quan, công chức thực hiện theo quy định tại điểm a khoản 2 Điều này.

b.3) Trường hợp cần lấy ý kiến của các đơn vị thuộc Bộ Tài chính, các Bộ, cơ quan quản lý chuyên ngành, Hiệp hội hoặc các tổ chức chuyên môn có liên quan để làm rõ về bản chất hàng hóa, tiêu chí kỹ thuật: công chức lập phiếu đề xuất, dự thảo văn bản đề nghị các đơn vị liên quan tham gia ý kiến (trong văn bản phải nêu rõ nội dung cần xin ý kiến), trình Lãnh đạo Tổ, Lãnh đạo Ban để trình Lãnh đạo Cục phê duyệt, đồng thời có văn bản thông báo cho tổ chức, cá nhân có Đơn đề nghị XĐTMS biết (nếu cần).

Sau khi có ý kiến của các đơn vị nêu trên, công chức thực hiện theo quy định tại điểm a khoản 2 Điều này.

b.4) Trường hợp cần xin ý kiến của Ủy ban HS thuộc Tổ chức Hải quan thế giới, Ban Thư ký WCO, Nhóm Kỹ thuật về phân loại hàng hóa của ASEAN (TSWGC), Hải quan các nước hoặc các tổ chức chuyên môn quốc tế để làm rõ bản chất hàng hóa đề nghị xác định trước mã số, phạm vi của chương, nhóm, phân nhóm, dòng hàng: công chức lập đề xuất trình Lãnh đạo Cục, dự thảo văn bản đề nghị Văn phòng Cục Hải quan làm đầu mối liên hệ với cơ quan nước ngoài nêu trên (trong đó nêu cụ thể các thông tin đề nghị xác minh), đồng thời có văn bản thông báo cho tổ chức, cá nhân có Đơn đề nghị XĐTMS biết (nếu cần).

Sau khi nhận được ý kiến của các đơn vị nêu trên, công chức chuyển thực hiện theo điểm a khoản 2 Điều này.

Điều 5. Phê duyệt hồ sơ

1. Lãnh đạo Tổ Phân loại kiểm tra hồ sơ, đề xuất của công chức và xử lý như sau:

a) Trường hợp Lãnh đạo Tổ Phân loại đồng ý với đề xuất của công chức: ký phê duyệt nội dung đề xuất của công chức để trình Lãnh đạo Ban NVTHQ, chuyển thực hiện theo quy định tại khoản 2 Điều này.

b) Trường hợp Lãnh đạo Tổ Phân loại không đồng ý với đề xuất của công chức: ghi rõ lý do, ý kiến chỉ đạo vào phiếu đề xuất và trả lại hồ sơ để công chức giải trình hoặc thực hiện ý kiến chỉ đạo của Lãnh đạo Tổ Phân loại.

2. Lãnh đạo Ban NVTHQ kiểm tra hồ sơ, đề xuất của Tổ Phân loại và xử lý như sau:

a) Trường hợp Lãnh đạo Ban NVTHQ đồng ý với đề xuất của Tổ Phân loại: phê duyệt nội dung đề xuất và duyệt ký văn bản đính kèm. Trường hợp duyệt ký Thông báo kết quả xác định trước mã số (ký thừa lệnh Lãnh đạo Cục) thì chuyển thực hiện quy định tại Điều 6.

b) Trường hợp Lãnh đạo Ban NVTHQ không đồng ý với đề xuất của Tổ Phân loại: có ý kiến chỉ đạo vào Phiếu đề xuất và trả lại hồ sơ để Tổ Phân loại giải trình hoặc thực hiện ý kiến chỉ đạo của Lãnh đạo Ban NVTHQ.

c) Lãnh đạo Ban NVTHQ trình Lãnh đạo Cục phê duyệt hồ sơ Xác định trước mã số đối với trường hợp mặt hàng khó, phức tạp, có nhiều quan điểm phân loại khác nhau, có chênh lệch mức thuế giữa các quan điểm phân loại, đã lấy ý kiến các đơn vị nhưng ý kiến các đơn vị còn khác nhau hoặc nghi ngờ có rủi ro về mức thuế, chính sách quản lý chuyên ngành trước khi ban hành Thông báo kết quả xác định trước mã số; hồ sơ hủy bỏ, sửa đổi, thay thế Thông báo kết quả xác định trước mã số.

Điều 6. Ban hành Thông báo kết quả xác định trước mã số, cập nhật cơ sở dữ liệu, công khai trên trang thông tin điện tử của Cục Hải quan

1. Ban hành Thông báo kết quả xác định trước mã số thực hiện theo quy định công tác văn thư của Cục Hải quan. Thời hạn ban hành 30 ngày kể từ ngày nhận được đủ hồ sơ (đối với trường hợp thông thường) hoặc 60 ngày kể từ ngày nhận đủ hồ sơ (đối với trường hợp phức tạp cần xác minh, làm rõ).

2. Cập nhật cơ sở dữ liệu.

a) Công chức Tổ Phân loại thực hiện cập nhật văn bản Thông báo kết quả xác định trước mã số tại chức năng 1.02 “Xác định trước mã số” trên hệ thống MHS theo hướng dẫn tại Quy chế xây dựng, thu thập, cập nhật, sử dụng Cơ sở dữ liệu về Danh mục hàng hóa xuất khẩu, nhập khẩu Việt Nam; Cơ sở dữ liệu về Biểu thuế; Cơ sở dữ liệu về phân loại, áp dụng mức thuế đối với hàng hóa đã xuất khẩu, nhập khẩu của Cục Hải quan, trong thời hạn 05 (năm) ngày làm việc kể từ ngày ban hành Thông báo kết quả xác định trước mã số.

b) Văn phòng Cục Hải quan cập nhật nội dung văn bản Thông báo kết quả xác định trước mã số lên trang thông tin điện tử của Cục Hải quan theo hướng dẫn tại Quy chế xây dựng, thu thập, cập nhật, sử dụng Cơ sở dữ liệu về Danh mục hàng hóa xuất khẩu, nhập khẩu Việt Nam; Cơ sở dữ liệu về Biểu thuế; Cơ sở dữ liệu về phân loại, áp dụng mức thuế đối với hàng hóa đã xuất khẩu, nhập khẩu của Cục Hải quan, trong thời hạn 05 (năm) ngày làm việc kể từ ngày ban hành Thông báo kết quả xác định trước mã số.

Điều 7. Hủy bỏ Thông báo kết quả xác định trước mã số

1. Thông báo kết quả xác định trước mã số bị hủy bỏ khi phát hiện hồ sơ xác định trước mã số do tổ chức, cá nhân cung cấp không chính xác, không trung thực, theo quy định tại điểm c khoản 6 Điều 24 Nghị định số 08/2015/NĐ-CP, được sửa đổi, bổ sung tại điểm đ khoản 1 Điều 2 Nghị định 167/2025/NĐ-CP.

2. Trình tự hủy bỏ Thông báo kết quả xác định trước mã số thực hiện như sau:

a) Công chức Tổ Phân loại được phân công rà soát, kiểm tra hoặc thông qua kiến nghị, phản ánh của các đơn vị hải quan, cơ quan quản lý chuyên ngành, các hiệp hội, doanh nghiệp, báo chí... phát hiện thông tin do tổ chức, cá nhân có Đơn đề nghị XĐTMS cung cấp không chính xác, không trung thực: công chức lập phiếu đề xuất, dự thảo văn bản hủy Thông báo kết quả xác định trước mã số theo mẫu số 01c-Huy XDTMS tại Thông tư số 121/2025/TT-BTC, trình Lãnh đạo Tổ Phân loại, Lãnh đạo Ban NVTHQ, Lãnh đạo Cục phê duyệt.

b) Việc phê duyệt hồ sơ, ban hành văn bản hủy Thông báo kết quả xác định trước mã số, cập nhật cơ sở dữ liệu, công khai trên trang thông tin điện tử của Cục Hải quan được thực hiện theo quy định tại Điều 5, Điều 6 Quy trình này.

c) Công chức rà soát hệ thống, đánh giá việc áp dụng Thông báo kết quả xác định trước mã số đã được hủy, báo cáo Lãnh đạo Tổ, Lãnh đạo Ban NVTHQ có văn bản gửi Chi cục Hải quan nơi doanh nghiệp làm thủ tục hải quan thực hiện rà soát để xác định việc khai báo mã số hàng hóa theo Thông báo kết quả xác định trước mã số đã bị hủy của người khai hải quan theo quy định.

Điều 8. Xử lý trường hợp tổ chức, cá nhân có văn bản đề nghị xem xét lại Thông báo kết quả xác định trước mã số

1. Công chức Tổ Phân loại được phân công xử lý kiểm tra, đối chiếu nội dung tại Thông báo kết quả xác định trước mã số với nội dung kiến nghị của doanh nghiệp:

a) Trường hợp đủ cơ sở xác định Thông báo kết quả xác định trước mã số phù hợp: công chức lập phiếu đề xuất và dự thảo văn bản trả lời doanh nghiệp về việc giữ nguyên kết quả xác định trước mã số, báo cáo Lãnh đạo Tổ Phân loại, Lãnh đạo Ban NVTHQ phê duyệt.

b) Trường hợp đủ cơ sở để xác định Thông báo kết quả xác định trước mã số đã ban hành chưa phù hợp, công chức thực hiện theo Điều 9 Quy trình này.

2. Việc thực hiện kiểm tra, phê duyệt hồ sơ, ban hành văn bản trả lời đề nghị xem xét lại kết quả xác định trước mã số, cập nhật cơ sở dữ liệu, công khai trên trang thông tin điện tử của Cục Hải quan được thực hiện theo quy định tại Điều 5, Điều 6 Quy trình này.

Điều 9. Sửa đổi, thay thế Thông báo kết quả xác định trước mã số

1. Thông báo kết quả xác định trước mã số được sửa đổi, thay thế trong trường hợp cơ quan hải quan xác định lại khi rà soát, thu thập thông tin hoặc tổ chức, cá nhân có Đơn đề nghị XĐTMS cung cấp thông tin bổ sung.

2. Công chức Tổ Phân loại được phân công xử lý kiểm tra, đối chiếu nội dung tại Thông báo kết quả xác định trước mã số với thông tin thu thập hoặc thông tin do tổ chức, cá nhân có Đơn đề nghị XĐTMS cung cấp bổ sung, lập phiếu đề xuất dự thảo Thông báo sửa đổi, thay thế Thông báo kết quả xác định trước mã số theo mẫu số 01b-Thaythe XDTMS tại Thông tư số 121/2025/TT-BTC, trình Lãnh đạo Tổ Phân loại, Lãnh đạo Ban NVTHQ, Lãnh đạo Cục phê duyệt.

3. Việc phê duyệt hồ sơ, ban hành Thông báo sửa đổi, thay thế Thông báo kết quả xác định trước mã số, cập nhật cơ sở dữ liệu, công khai trên trang thông tin điện tử của Cục Hải quan được thực hiện theo quy định tại Điều 5, Điều 6 Quy trình này.

4. Công chức rà soát hệ thống, đánh giá việc áp dụng Thông báo kết quả xác định trước mã số đã được sửa đổi, thay thế, báo cáo Lãnh đạo Tổ, Lãnh đạo Ban có văn bản yêu cầu Chi cục Hải quan nơi doanh nghiệp làm thủ tục hải quan thực hiện kiểm tra để xác định lại mã số đối với các lô hàng đã thông quan theo Thông báo kết quả xác định trước mã số.

Chương 2

TRÌNH TỰ, THỦ TỤC KIỂM TRA TÊN HÀNG, MÔ TẢ HÀNG HÓA, MÃ SỐ, MỨC THUẾ XUẤT KHẨU, NHẬP KHẨU, NHẬP KHẨU BỔ SUNG TRONG THÔNG QUAN

Điều 10. Kiểm tra hồ sơ

1. Đối tượng kiểm tra: Hồ sơ hải quan hàng hóa xuất khẩu, nhập khẩu thuộc luồng 2 và luồng 3.

2. Nội dung kiểm tra:

Công chức hải quan được phân công tiếp nhận tờ khai tại đơn vị hải quan nơi đăng ký tờ khai thực hiện kiểm tra các nội dung sau:

a) Kiểm tra tên hàng, mô tả hàng hóa, mã số hàng hóa:

a.1) Tiêu chí kiểm tra:

a.1.1) Tên hàng, mô tả hàng hóa: Mô tả hàng hóa phải rõ ràng, đầy đủ, chi tiết thông tin về tên hàng, đặc điểm, thành phần, hàm lượng, cấu tạo, tính chất lý, hóa, công dụng, quy cách đóng gói và các thuộc tính khác của từng loại hàng hóa để đủ cơ sở phân loại theo Danh mục hàng hóa xuất khẩu, nhập khẩu Việt Nam, quy định tại các Biểu thuế xuất khẩu, Biểu thuế nhập khẩu, các Quyết định áp dụng biện pháp phòng vệ thương mại và các văn bản quy phạm pháp luật khác có liên quan.

a.1.2) Mã số hàng hóa: Mã số hàng hóa phải đầy đủ, chính xác theo mức độ chi tiết 8 số hay 10 số của mặt hàng cần phân loại theo Danh mục hàng hóa xuất khẩu, nhập khẩu Việt Nam, Biểu thuế áp dụng đối với hàng hóa xuất khẩu, nhập khẩu.

a.2) Cách thức kiểm tra:

a.2.1) Kiểm tra, đối chiếu sự phù hợp giữa khai báo tên hàng, mô tả hàng hóa, mã số hàng hóa với hồ sơ hải quan, tài liệu kỹ thuật (nếu có) và các chứng từ khác có liên quan.

a.2.2) Kiểm tra, đối chiếu đảm bảo đủ thông tin để phân loại theo tiêu chí tại điểm a.1 khoản 2 Điều này giữa khai báo tên hàng, mô tả hàng hóa, mã số hàng hóa với nội dung nhóm, chú giải Phần, Chương, Phân nhóm liên quan tại Danh mục hàng hóa xuất khẩu, nhập khẩu Việt Nam; các quy định tại Nghị định ban hành các Biểu thuế xuất khẩu, Biểu thuế nhập khẩu; các Quyết định về việc áp dụng biện pháp phòng vệ thương mại; Thông báo kết quả xác định trước mã số, Thông báo kết quả phân loại, Thông báo kết quả phân tích kèm mã số hàng hóa của chính doanh nghiệp làm thủ tục (nếu có).

a. 2.3) Kiểm tra, đối chiếu và tham khảo các văn bản hướng dẫn về phân loại hàng hóa, chú giải chi tiết HS, tuyển tập ý kiến phân loại của WCO, chú giải SEN, các thông tin khác trên cơ sở dữ liệu về Danh mục hàng hóa xuất khẩu, nhập khẩu Việt Nam và Danh mục hàng hóa xuất khẩu, nhập khẩu rủi ro về phân loại hàng hóa, áp dụng mức thuế.

Lưu ý:

* Tham khảo Thông báo kết quả xác định trước mã số tại chức năng 2.02 MHS.

* Tham khảo Thông báo kết quả phân loại, Thông báo kết quả phân tích kèm mã số hàng hóa tại chức năng 2.03 MHS.

* Tham khảo Văn bản hướng dẫn trên Cces, Edoc, Netoffice.

* Hàng hóa nhập khẩu theo Chương trình ưu đãi thuế linh kiện ô tô và Chương trình CNHT ô tô.

* Mã số hàng hóa được chi tiết cấp độ 10 số.

* Các trường hợp nhập khẩu máy gia công cơ khí phải đối chiếu với danh mục trong nước đã sản xuất được.

* Hàng hóa khai báo thuộc danh mục trừ lùi theo Điều 7, Điều 8 Thông tư 14/2015/TT-BTC.

b) Kiểm tra đơn vị tính

b.1) Tiêu chí kiểm tra:

Đơn vị tính phải được khai báo tại 02 chỉ tiêu: số lượng (1) và số lượng (2) trên tờ khai hải quan theo quy định tại Phụ lục I Thông tư số 39/2018/TT-BTC. Trong đó, chỉ tiêu số lượng (2) là đơn vị tính tương ứng với mã số hàng hóa theo Danh mục hàng hóa xuất khẩu, nhập khẩu Việt Nam.

b.2) Cách thức kiểm tra:

Kiểm tra, đối chiếu thông tin khai báo tại chỉ tiêu số lượng (1) để xác định thông tin tại chỉ tiêu số lượng (1) thống nhất với thông tin trong hồ sơ hải quan.

Kiểm tra, đối chiếu thông tin khai báo tại chỉ tiêu số lượng (2) để xác định đơn vị tính tại chỉ tiêu số lượng (2) là đơn vị tính tương ứng với mã số hàng hóa theo Danh mục hàng hóa xuất khẩu, nhập khẩu Việt Nam và số lượng quy đổi tương ứng từ số lượng (1).

Lưu ý:

* Đơn vị tính tại chỉ tiêu số lượng (1) có thể là thùng, bao, túi, ... theo thông tin trong bộ chứng từ hải quan tuy nhiên đơn vị tính tại chỉ tiêu số lượng (2) bắt buộc phải là đơn vị tính tương ứng với mã số hàng hóa tại Danh mục hàng hóa xuất khẩu, nhập khẩu Việt Nam.

* Chấp nhận sai số tương đối trong trường hợp quy đổi từ chỉ tiêu số lượng (1) sang chỉ tiêu số lượng (2).

c) Kiểm tra mức thuế xuất khẩu, nhập khẩu:

c.1) Tiêu chí kiểm tra:

Mức thuế phải tương ứng, phù hợp quy định tại Nghị định ban hành Biểu thuế, Quyết định quy định việc áp dụng thuế suất thông thường đối với hàng hóa nhập khẩu, Quyết định về việc áp dụng biện pháp phòng vệ thương mại (nếu có) có hiệu lực tại thời điểm đăng ký tờ khai.

c.2) Cách thức kiểm tra:

c.2.1) Kiểm tra, đối chiếu hồ sơ hải quan với điều kiện áp dụng của Biểu thuế, Quyết định về việc áp dụng biện pháp phòng vệ thương mại tương ứng như quy định về xuất xứ, chứng từ chứng nhận xuất xứ (C/O), hình thức vận chuyển từ nước xuất khẩu, hiệu lực của Biểu thuế, tên tổ chức, cá nhân sản xuất, xuất khẩu, tên doanh nghiệp liên quan, thời hạn áp dụng biện pháp phòng vệ thương mại...

c.2.2) Kiểm tra, đối chiếu mức thuế khai báo với mã số hàng hóa, mức thuế tương ứng tại Biểu thuế, Quyết định quy định việc áp dụng thuế suất thông thường đối với hàng hóa nhập khẩu, Quyết định về việc áp dụng biện pháp phòng vệ thương mại tương ứng có hiệu lực tại thời điểm đăng ký tờ khai.

Lưu ý kiểm tra các tiêu chí rủi ro như:

* Mã số hàng hóa trùng với mã số được liệt kê trong Danh mục hàng hóa xuất khẩu, nhập khẩu rủi ro về phân loại và áp dụng mức thuế: kiểm tra các thông tin theo chỉ dẫn để xác định chính xác mức thuế xuất khẩu, thuế nhập khẩu, thuế nhập khẩu bổ sung.

* Hàng hóa thuộc các nhóm hàng đã được chi tiết tại nhóm có số thứ tự 211 Biểu thuế xuất khẩu nhưng không khai báo chứng minh tỷ lệ tài nguyên, khoáng sản cộng chi phí năng lượng dưới 51% giá thành sản phẩm hoặc khai báo thuế suất thuế xuất khẩu 0%.

* Khai mã Biểu thuế B02: Kiểm tra cách thức phân loại, điều kiện, thủ tục áp dụng theo quy định tại Chương 98.

* Mã số hàng hóa trùng với mã số đã được liệt kê trong mã Biểu thuế B17 nhưng không khai thuế suất Chương 98 và mã Biểu thuế B17.

* Khai báo mức thuế suất thủ công (có ký hiệu chữ “M” bên phải cột “thuế suất”).

* Thuế suất đối với mã hàng được chi tiết cấp độ 10 số.

* Mã số hàng hóa thuộc các dòng hàng có đánh dấu (*), các dòng hàng có nước loại trừ áp dụng trong các Biểu thuế nhập khẩu ưu đãi đặc biệt (FTA) để xác định hàng hóa có thuộc nước được hưởng ưu đãi, có thuộc thời điểm được hưởng ưu đãi hay không.

* Hàng hóa thuộc các trường hợp chịu hạn ngạch thuế quan.

* Hàng hóa có xuất xứ từ các nước và vùng lãnh thổ không có thỏa thuận đối xử tối huệ quốc trong quan hệ thương mại với Việt Nam.

3. Xử lý kết quả kiểm tra:

a) Trường hợp có đủ căn cứ xác định các thông tin trong bộ hồ sơ hải quan là đầy đủ và phù hợp với nội dung khai báo về tên hàng, mô tả hàng hóa, mã số, mức thuế, đồng thời mã số hàng hóa, mức thuế, đơn vị tính đáp ứng quy định trong Danh mục hàng hóa xuất khẩu, nhập khẩu Việt Nam, Biểu thuế, Quyết định áp dụng các biện pháp phòng vệ thương mại và các văn bản quy phạm pháp luật khác có liên quan, công chức hải quan chấp nhận nội dung khai báo của người khai hải quan, cập nhật kết quả kiểm tra tại ô “Cập nhật ý kiến của công chức xử lý” trên Hệ thống VCIS.

b) Trường hợp có đủ căn cứ xác định người khai hải quan khai báo không chính xác tên hàng, mô tả hàng hóa, mã số, mức thuế, đơn vị tính công chức hải quan thông báo cho người khai hải quan khai bổ sung theo quy định tại Điều 20 Thông tư số 38/2015/TT-BTC, được sửa đổi, bổ sung tại Thông tư số 39/2018/TT-BTC và Thông tư 121/2025/TT-BTC bằng “Chỉ thị của Hải quan” thông qua nghiệp vụ IDA01/EDA01 (mã A) tại hệ thống VNACCS.

Trường hợp người khai hải quan không khai bổ sung hoặc khai bổ sung không đúng yêu cầu trong thời hạn 05 (năm) ngày làm việc kể từ ngày nhận được yêu cầu của cơ quan hải quan, công chức hải quan ghi nhận vào Hệ thống VCIS tại ô “Cập nhật ý kiến của công chức xử lý”, xác định lại tên hàng, mô tả hàng hóa, mã số, mức thuế, đơn vị tính, ấn định thuế (nếu có) và thực hiện thủ tục xử lý vi phạm (nếu có) theo quy định; cập nhật kết quả điều chỉnh mã số tại chức năng 1.01.07 hệ thống MHS.

c) Trường hợp chưa đủ căn cứ để xác định tên hàng, mô tả hàng hóa, mã số, mức thuế thì công chức hải quan thông báo cho người khai hải quan nộp bổ sung tài liệu kỹ thuật hoặc hợp đồng mua bán hàng hóa hoặc chứng từ khác có liên quan chứng minh cơ sở khai báo bằng “Chỉ thị của Hải quan” thông qua nghiệp vụ IDA01/EDA01 (mã A) tại hệ thống VNACCS và xử lý như sau:

c.1) Trường hợp trên cơ sở chứng từ, tài liệu bổ sung đủ căn cứ xác định tên hàng, mô tả hàng hóa, mã số, mức thuế khai báo là chính xác thì công chức cập nhật tại ô “Cập nhật ý kiến của công chức xử lý” trên Hệ thống VCIS.

c.2) Trường hợp trên cơ sở chứng từ, tài liệu bổ sung đủ căn cứ xác định tên hàng, mô tả hàng hóa, mã số, mức thuế khai báo không chính xác thì công chức hải quan thực hiện theo điểm b khoản này.

c.3) Trường hợp người khai hải quan không cung cấp tài liệu, chứng từ hoặc chứng từ, tài liệu bổ sung chưa đủ căn cứ xác định tên hàng, mô tả hàng hóa, mã số, mức thuế thì công chức đề xuất Lãnh đạo chuyển kiểm tra thực tế hàng hóa hoặc lấy mẫu để phân tích phân loại hoặc kiểm tra, đánh giá tiêu chí kỹ thuật bằng máy móc, thiết bị tại cơ quan kiểm định hải quan hoặc giám định, thử nghiệm theo quy định, trong đó, công chức phải đề xuất rõ các chỉ dẫn kiểm tra hoặc tiêu chí yêu cầu phân tích, giám định hoặc thử nghiệm.

Mẫu hàng hóa gửi phân tích phân loại hoặc kiểm tra, đánh giá tiêu chí kỹ thuật bằng máy móc, thiết bị kỹ thuật tại cơ quan kiểm định hải quan phải thuộc Danh mục hàng hóa tiếp nhận phân tích phân loại hoặc Danh mục kiểm tra, đánh giá tiêu chí kỹ thuật bằng máy móc, thiết bị kỹ thuật tại cơ quan kiểm định hải quan do Cục Hải quan ban hành được công bố trên Cổng thông tin điện tử của ngành Hải quan.

d) Đối với trường hợp lô hàng xuất khẩu, nhập khẩu được lấy mẫu gửi để phân tích phân loại hoặc kiểm tra, đánh giá tiêu chí kỹ thuật bằng máy móc, thiết bị tại cơ quan kiểm định hải quan hoặc giám định, thử nghiệm, ngay sau khi nhận được Thông báo kết quả phân loại hàng hóa hoặc Thông báo kết quả phân tích kèm mã số hàng hóa hoặc Thông báo về kết quả kiểm tra, đánh giá tiêu chí kỹ thuật hoặc Chứng thư giám định, thử nghiệm của lô hàng được lấy mẫu, công chức hải quan thực hiện tiếp theo Điều 13.

Điều 11. Kiểm tra thực tế hàng hóa

1. Nội dung kiểm tra:

Kiểm tra tính chính xác, đầy đủ của nội dung khai về tên hàng, mô tả hàng hóa, mã số hàng hóa, mức thuế trên tờ khai và hồ sơ kèm theo với thực tế hàng hóa xuất khẩu, nhập khẩu và kiểm tra theo các yêu cầu chỉ dẫn các thuộc tính hàng hóa của công chức Bước 2 trên hệ thống (nếu có).

Kiểm tra chi tiết các tiêu chí như tên hàng, đặc điểm, thành phần, hàm lượng, cấu tạo, kích thước, hình dạng, tính chất lý, hóa, tính năng, công dụng, nhà sản xuất, quy cách đóng gói, nội dung nhãn mác và các thuộc tính khác của hàng hóa để làm căn cứ xác định mã số, mức thuế theo Danh mục hàng hóa xuất khẩu, nhập khẩu Việt Nam, Biểu thuế, Quyết định áp dụng các biện pháp phòng vệ thương mại và các văn bản quy phạm pháp luật khác có liên quan.

2. Xử lý kết quả kiểm tra:

a) Trường hợp xác định không có sự sai lệch về tên hàng, mô tả hàng hóa, mã số hàng hóa khai báo so với hàng hóa thực tế xuất khẩu, nhập khẩu, công chức hải quan chấp nhận nội dung khai về tên hàng, mô tả hàng hóa, mã số, mức thuế của người khai hải quan, ghi nhận kết quả kiểm tra trên Phiếu ghi kết quả kiểm tra, cập nhật kết quả kiểm tra vào ô “Cập nhật ý kiến của công chức xử lý” trên Hệ thống VCIS và thực hiện các bước nghiệp vụ tiếp theo quy định tại quy trình thủ tục hải quan.

b) Trường hợp đủ căn cứ để xác định người khai hải quan khai không đúng tên hàng, mô tả hàng hóa, mã số, mức thuế thì công chức ghi nhận kết quả kiểm tra trên Phiếu ghi kết quả kiểm tra, cập nhật kết quả kiểm tra vào ô “Cập nhật ý kiến của công chức xử lý” trên Hệ thống VCIS (ghi rõ nội dung khai sai về tên hàng, mô tả hàng hóa, mã số, mức thuế) và thông báo cho người khai hải quan khai bổ sung theo quy định tại Điều 20 Thông tư số 38/2015/TT-BTC, được sửa đổi, bổ sung tại Thông tư số 39/2018/TT-BTC và Thông tư 121/2025/TT-BTC bằng “Chỉ thị của Hải quan” thông qua nghiệp vụ IDA01/EDA01 (mã A) tại Hệ thống VNACCS và thực hiện thủ tục xử lý vi phạm (nếu có) theo quy định của pháp luật.

Trường hợp người khai hải quan không thực hiện khai bổ sung thì công chức hải quan xác định lại mã số hàng hóa, mức thuế và thực hiện ấn định thuế (nếu có), đồng thời tùy theo mức độ vi phạm giữa nội dung khai hải quan và thực tế kiểm tra để thực hiện xử lý theo quy định của pháp luật, cập nhật kết quả kiểm tra tại ô “Cập nhật ý kiến của công chức xử lý” trên hệ thống VCIS.

c) Trường hợp kiểm tra thực tế do công chức hải quan kiểm tra trực tiếp hoặc bằng các máy móc, thiết bị hiện có mà cơ quan hải quan chưa đủ cơ sở xác định hoặc không xác định được chính xác tên hàng, mô tả hàng hóa, mã số theo các tiêu chí theo Danh mục hàng hóa xuất khẩu, nhập khẩu Việt Nam, Biểu thuế xuất khẩu, Biểu thuế nhập khẩu, các Quyết định về việc áp dụng biện pháp phòng vệ thương mại và các văn bản quy phạm pháp luật khác có liên quan, công chức đề xuất Lãnh đạo thực hiện lấy mẫu để phân tích phân loại hoặc kiểm tra, đánh giá tiêu chí kỹ thuật bằng máy móc, thiết bị tại cơ quan kiểm định hải quan hoặc giám định, thử nghiệm và thực hiện các thủ tục tiếp theo quy định; cập nhật kịp thời, đầy đủ các thông tin liên quan của Phiếu yêu cầu phân tích/kiểm tra, đánh giá tiêu chí kỹ thuật bằng máy móc, thiết bị/giám định/thử nghiệm kiêm biên bản lấy mẫu tại chức năng 1.03.01 “Nhập phiếu yêu cầu” trên Hệ thống MHS trước khi gửi mẫu.

d) Đối với trường hợp lô hàng xuất khẩu, nhập khẩu được lấy mẫu gửi để phân tích phân loại hoặc kiểm tra, đánh giá tiêu chí kỹ thuật bằng máy móc, thiết bị tại cơ quan kiểm định hải quan hoặc giám định, thử nghiệm, ngay sau khi nhận được Thông báo kết quả phân loại hàng hóa hoặc Thông báo kết quả phân tích kèm mã số hàng hóa hoặc Thông báo về kết quả kiểm tra, đánh giá tiêu chí kỹ thuật hoặc Chứng thư giám định, thử nghiệm của lô hàng được lấy mẫu, công chức hải quan thực hiện tiếp theo Điều 13.

Điều 12. Trình tự, thủ tục lấy mẫu, gửi mẫu, phân tích phân loại hoặc kiểm tra, đánh giá tiêu chí kỹ thuật bằng máy móc, thiết bị tại cơ quan kiểm định hải quan hoặc giám định, thử nghiệm.

Trình tự, thủ tục lấy mẫu, hồ sơ lấy mẫu, gửi mẫu, phân tích, phân loại và xử lý vướng mắc liên quan đến kết quả phân tích phân loại hoặc kiểm tra, đánh giá tiêu chí kỹ thuật bằng máy móc, thiết bị tại cơ quan kiểm định hải quan hoặc giám định, thử nghiệm thực hiện theo Quy trình phân tích phân loại hàng hóa xuất khẩu, nhập khẩu và kiểm tra, đánh giá tiêu chí kỹ thuật của hàng hóa bằng máy móc, trang thiết bị tại cơ quan kiểm định hải quan.

Điều 13. Sử dụng, cập nhật việc sử dụng Thông báo kết quả phân loại, Thông báo kết quả phân tích kèm mã số hàng hóa, Thông báo về kết quả kiểm tra, đánh giá tiêu chí kỹ thuật, Chứng thư giám định, thử nghiệm.

Đối với trường hợp lô hàng xuất khẩu, nhập khẩu được lấy mẫu gửi yêu cầu phân tích phân loại hoặc kiểm tra, đánh giá tiêu chí kỹ thuật bằng máy móc, thiết bị tại cơ quan kiểm định hải quan hoặc giám định, thử nghiệm, trong thời hạn 05 (năm) ngày làm việc kể từ ngày nhận được Thông báo kết quả phân loại, Thông báo kết quả phân tích kèm mã số hàng hóa, Thông báo về kết quả kiểm tra, đánh giá tiêu chí kỹ thuật, Chứng thư giám định, thử nghiệm, công chức hải quan thực hiện như sau:

1. Trường hợp tên hàng, mô tả hàng hóa, mã số do người khai hải quan khai không khác biệt với tên hàng, mô tả hàng hóa, mã số tại Thông báo kết quả phân loại hoặc Thông báo kết quả phân tích kèm mã số hàng hóa; tên hàng, mô tả hàng hóa không khác với thông tin trong Thông báo về kết quả kiểm tra, đánh giá tiêu chí kỹ thuật, Chứng thư giám định, thử nghiệm, không làm thay đổi mã số khai báo, công chức hải quan chấp nhận nội dung khai của người khai hải quan, cập nhật kết quả kiểm tra tại ô “Cập nhật ý kiến của công chức xử lý” trên Hệ thống VCIS.

2. Trường hợp tên hàng, mô tả hàng hóa, mã số do người khai hải quan khai có sự khác biệt với tên hàng, mô tả hàng hóa, mã số tại Thông báo kết quả phân loại hoặc Thông báo kết quả phân tích kèm mã số hàng hóa; tên hàng, mô tả hàng hóa khác với thông tin trong Thông báo về kết quả kiểm tra, đánh giá tiêu chí kỹ thuật, Chứng thư giám định, thử nghiệm, làm thay đổi mã số khai báo, công chức hải quan xác định lại mã số và thông báo cho người khai hải quan khai bổ sung theo quy Điều 20 Thông tư số 38/2015/TT-BTC, được sửa đổi, bổ sung tại Thông tư số 39/2018/TT-BTC và Thông tư 121/2025/TT-BTC bằng “Chỉ thị của Hải quan” thông qua nghiệp vụ IDA01/EDA01 (mã A) tại Hệ thống VNACCS.

Trường hợp người khai hải quan không khai bổ sung trong thời hạn 05 (năm) ngày làm việc kể từ ngày nhận được yêu cầu của cơ quan hải quan, công chức hải quan ghi nhận vào Hệ thống VCIS tại ô “Cập nhật ý kiến của công chức xử lý”, xác định lại mã số, mức thuế, ấn định thuế và thực hiện thủ tục xử lý vi phạm (nếu có) theo quy định; cập nhật kết quả điều chỉnh mã số tại chức năng 1.01.07 hệ thống MHS.

Chương 3

THỐNG NHẤT CÔNG TÁC PHÂN LOẠI HÀNG HÓA, ÁP DỤNG MỨC THUẾ

Điều 14. Kiểm tra tên hàng, mô tả hàng hóa, mã số, mức thuế, đơn vị tính đối với tờ khai hải quan thuộc luồng 1 tại Chi cục Hải quan khu vực

1. Đối tượng kiểm tra: Hồ sơ hải quan của hàng hóa thuộc luồng 1 trong vòng 60 ngày kể từ ngày đăng ký tờ khai, được lựa chọn trên cơ sở áp dụng quản lý rủi ro hoặc có thông tin phản ánh dấu hiệu vi phạm.

Lưu ý trong lựa chọn đối tượng kiểm tra:

* Mã số hàng hóa trùng với mã số được liệt kê trong Danh mục hàng hóa xuất khẩu, nhập khẩu rủi ro về phân loại và áp dụng mức thuế: kiểm tra các thông tin theo chỉ dẫn để xác định chính xác mức thuế xuất khẩu, thuế nhập khẩu, thuế nhập khẩu bổ sung.

* Hàng hóa thuộc các nhóm hàng đã được chi tiết tại nhóm có số thứ tự 211 Biểu thuế xuất khẩu nhưng không khai báo hoặc khai báo thuế suất thuế xuất khẩu 0%.

* Khai mã Biểu thuế B02: Kiểm tra cách thức phân loại, điều kiện, thủ tục áp dụng theo quy định tại Chương 98.

* Mã số hàng hóa trùng với mã số đã được liệt kê trong mã Biểu thuế B17 nhưng không khai thuế suất Chương 98 và mã Biểu thuế B17.

* Hàng hóa thuộc các văn bản chỉ đạo, chấn chỉnh, tăng cường kiểm tra, kiểm soát.

* Hàng hóa có mô tả giống hệt, tương tự nhưng được khai báo vào các mã số khác nhau

* Hàng hóa nhập khẩu theo Chương trình ưu đãi thuế linh kiện ô tô và Chương trình CNHT ô tô.

* Các trường hợp nhập khẩu máy gia công cơ khí: phải đối chiếu với danh mục trong nước đã sản xuất được.

2. Nội dung kiểm tra:

a) Kiểm tra hồ sơ hải quan theo quy định tại khoản 2 Điều 10 Quy trình này.

b) Kiểm tra thực tế hàng hóa (nếu cần thiết và đủ điều kiện kiểm tra) Thực hiện theo quy định tại khoản 2 Điều 11 Quy trình này.

3. Xử lý kết quả kiểm tra

a) Trường hợp hàng hóa chưa qua khu vực giám sát hải quan:

a.1) Trường hợp phát hiện có dấu hiệu vi phạm pháp luật hải quan như khai sai tên hàng, mô tả hàng hóa, mã số, mức thuế, công chức hải quan đề xuất Lãnh đạo “Dừng đưa hàng qua khu vực giám sát hải quan” trên E-Customs 5 và kiểm tra thực tế hàng hóa theo hướng dẫn tại khoản 2 Điều 11 Quy trình này, cập nhật kết quả kiểm tra và thông báo cho người khai hải quan khai bổ sung bằng văn bản (nếu có) theo quy định.

Sau khi thực hiện các thủ tục theo quy định và xác định lô hàng đủ điều kiện qua khu vực giám sát, công chức hải quan đề xuất Lãnh đạo “Bỏ dừng đưa hàng qua khu vực giám sát hải quan” trên Hệ thống E-Customs 5.

a.2) Trường hợp phát hiện có dấu hiệu rủi ro như chưa đủ thông tin để xác định tên hàng, mô tả hàng hóa, mã số, mức thuế công chức hải quan đề xuất Lãnh đạo chuyển thông tin để thực hiện kiểm tra đối với hàng hóa đã thông quan theo quy định.

b) Trường hợp hàng hóa đã qua khu vực giám sát hải quan:

b.1) Trường hợp có đủ cơ sở xác định người khai hải quan khai báo không đầy đủ, không đúng tên hàng, mô tả hàng hóa, mã số, mức thuế, đơn vị tính thì thông báo bằng văn bản cho người khai hải quan khai bổ sung theo quy định tại Điều 20 Thông tư số 38/2015/TT-BTC, được sửa đổi, bổ sung tại Thông tư số 39/2018/TT-BTC và Thông tư 121/2025/TT-BTC; cập nhật kết quả điều chỉnh mã số tại chức năng 1.01.07 Hệ thống MHS.

Trường hợp người khai hải quan không khai bổ sung trong thời hạn 05 (năm) ngày làm việc kể từ ngày nhận được yêu cầu của cơ quan hải quan, công chức hải quan xác định lại mã số, mức thuế, ấn định thuế và xử lý vi phạm (nếu có) theo quy định; cập nhật kết quả điều chỉnh mã số tại chức năng 1.01.07 hệ thống MHS.

b.2) Trường hợp phát hiện có dấu hiệu rủi ro như thông tin tại hồ sơ hải quan chưa đủ để xác định chính xác tên hàng, mô tả hàng hóa, mã số, mức thuế công chức hải quan đề xuất Lãnh đạo chuyển thông tin để thực hiện kiểm tra đối với hàng hóa đã thông quan theo quy định.

4. Báo cáo kết quả kiểm tra:

a) Trường hợp phát hiện việc phân loại hàng hóa không thống nhất trong đơn vị thì công chức báo cáo Lãnh đạo để hướng dẫn xử lý thống nhất.

b) Trường hợp phát hiện việc phân loại hàng hóa không thống nhất với Chi cục Hải quan khu vực khác thì báo cáo Cục Hải quan (qua Ban NVTHQ).

c) Trường hợp phát hiện người khai hải quan áp dụng không đúng Thông báo kết quả xác định trước mã số hoặc lợi dụng thông tin trong Thông báo kết quả xác định trước mã số để khai báo ngụy trang, khai sai mã số hàng hóa nhằm gian lận mức thuế, lẩn tránh các chính sách mặt hàng... thì báo cáo Cục Hải quan (qua Ban NVTHQ).

d) Đánh giá các trường hợp vi phạm, đặc biệt các trường hợp khai báo ngụy trang tên hàng, mô tả hàng hóa, mã số và báo cáo Cục Hải quan (qua Ban NVTHQ) trong trường hợp cần thông báo, chấn chỉnh toàn ngành.

Điều 15. Thống nhất công tác phân loại hàng hóa, áp dụng mức thuế tại Chi cục Hải quan khu vực

1. Đối tượng kiểm tra: kiểm tra việc khai báo của người khai hải quan, kiểm tra việc thực hiện nghiệp vụ của công chức hải quan về phân loại hàng hóa và áp dụng mức thuế để đảm bảo việc phân loại hàng hóa chính xác, thống nhất, một mặt hàng chỉ có một mã số duy nhất theo Danh mục hàng hóa xuất khẩu, nhập khẩu Việt Nam và việc áp dụng mức thuế đúng quy định.

2. Nguồn dữ liệu, thông tin phục vụ kiểm tra:

- Dữ liệu tờ khai xuất khẩu, nhập khẩu của đơn vị, của ngành;

- Các báo cáo kết quả thanh tra, kiểm tra;

- Các văn bản hướng dẫn, chấn chỉnh của Cục Hải quan, Thông báo kết quả xác định trước mã số, Thông báo kết quả phân tích phân loại...;

- Các nguồn thông tin khác thu thập được.

3. Phương thức kiểm tra:

a) Trên cơ sở nguồn dữ liệu, thông tin thu thập được tại khoản 2 Điều này, công chức hải quan được giao nhiệm vụ tiến hành lọc, phân tích, xác định các tiêu chí rủi ro, ví dụ như:

- Hàng hóa có tên hàng, mô tả hàng hóa giống hệt, tương tự nhưng có mã số khác nhau.

- Hàng hóa khai báo không đủ mã 10 số theo quy định.

- Hàng hóa khai báo mức thuế không đúng theo quy định.

- Hàng hóa áp dụng sai Biểu thuế.

- Hàng hóa khai báo mô tả không đầy đủ tiêu chí để phân loại theo Danh mục hàng hóa xuất khẩu, nhập khẩu Việt Nam, quy định tại các Biểu thuế xuất khẩu, Biểu thuế nhập khẩu và các Quyết định áp dụng biện pháp phòng vệ thương mại.

b) Trên cơ sở các hàng hóa được xem xét tại điểm a khoản 3 Điều này, công chức hải quan được giao nhiệm vụ kiểm tra lại toàn bộ hồ sơ hải quan để xác định rõ tên hàng, mô tả hàng hóa, mã số, mức thuế, đơn vị tính.

4. Xử lý kết quả kiểm tra:

a) Chỉ thị doanh nghiệp khai bổ sung và ấn định thuế, xử lý vi phạm (nếu có) theo quy định đối với các tờ khai xác định khai không đúng, không đủ tên hàng, mô tả hàng hóa, mã số, mức thuế, đơn vị tính;

b) Làm rõ trách nhiệm của công chức đối với các sai phạm trong quá trình thực thi công vụ, xử lý sai phạm theo quy định (nếu có);

c) Báo cáo kết quả định kỳ theo Quyết định số 636/QĐ-CHQ ngày 02/6/2025 của Cục Hải quan về danh mục báo cáo định kỳ ngành hải quan.

d) Chi cục Hải quan khu vực báo cáo đột xuất Cục Hải quan (qua Ban NVTHQ) trong trường hợp phát hiện sự bất cập, chưa thống nhất trong công tác phân loại của ngành, chưa thống nhất tại các văn bản quy phạm pháp luật, văn bản hướng dẫn, Thông báo kết quả phân tích phân loại, Thông báo xác định trước mã số, vướng mắc vượt thẩm quyền, các vụ việc vi phạm cần thiết báo cáo để cảnh báo, chấn chỉnh toàn ngành.

Điều 16. Thống nhất công tác phân loại hàng hóa, áp dụng mức thuế tại Cục Hải quan

1. Đối tượng kiểm tra: kiểm tra việc thực hiện nghiệp vụ phân loại hàng hóa, áp dụng mức thuế tại các đơn vị nghiệp vụ thuộc Cục Hải quan nhằm đảm bảo đúng quy định, thống nhất toàn ngành, đảm bảo nguyên tắc một mặt hàng chỉ có một mã số duy nhất theo Danh mục hàng hóa xuất khẩu, nhập khẩu Việt Nam.

2. Nội dung kiểm tra, xử lý kết quả kiểm tra

a) Kiểm tra việc ban hành và áp dụng Thông báo kết quả xác định trước mã số

a.1) Kiểm tra việc ban hành Thông báo kết quả xác định trước mã số:

Ban NVTHQ có trách nhiệm kiểm tra việc ban hành Thông báo kết quả xác định trước mã số, đảm bảo công chức thực thi theo đúng quy định tại mục 1 Quy trình này. Trường hợp phát hiện việc Thông báo kết quả xác định trước không chính xác, không thống nhất thì báo cáo Lãnh đạo Cục và đề xuất phương án xử lý.

a.2) Kiểm tra việc áp dụng Thông báo kết quả xác định trước mã số:

Kiểm tra, rà soát dữ liệu trên hệ thống, rà soát báo cáo của các Chi cục Hải quan khu vực về việc áp dụng Thông báo kết quả xác định trước mã số theo quy định tại điểm c khoản 4 Điều 14 Quy trình này. Trường hợp phát hiện người khai hải quan không kê khai hoặc áp dụng không chính xác Thông báo kết quả xác định trước mã số thì tổng hợp, đánh giá lại mức độ tuân thủ của doanh nghiệp, mức độ rủi ro của mặt hàng trong việc phân loại, áp dụng mức thuế để báo cáo Lãnh đạo Cục và đề xuất phương án xử lý.

b) Kiểm tra việc ban hành và áp dụng các Thông báo kết quả phân loại, Thông báo kết quả phân tích kèm mã số hàng hóa:

b.1) Chi cục Kiểm định hải quan có trách nhiệm kiểm tra việc ban hành Thông báo kết quả phân loại, Thông báo kết quả phân tích kèm mã số hàng hóa đảm bảo công chức thực thi theo đúng Quy trình phân tích phân loại hàng hóa xuất khẩu, nhập khẩu và kiểm tra, đánh giá tiêu chí kỹ thuật của hàng hóa bằng máy móc, trang thiết bị tại cơ quan kiểm định hải quan; đảm bảo kết quả phân tích đúng với bản chất hàng hóa, đủ tiêu chí, thông tin để phân loại, xác định mã số chính xác, thống nhất trong đơn vị.

b.2) Định kỳ hàng tháng, Chi cục Kiểm định hải quan báo cáo kết quả kiểm tra công tác phân tích, phân loại hàng hóa tại đơn vị về Cục Hải quan (qua Ban NVTHQ) theo Quy chế phối hợp giữa Chi cục Kiểm định hải quan và Ban NVTHQ địa chỉ email: [email protected].

b.3) Chi cục Kiểm định hải quan báo cáo đột xuất Cục Hải quan (qua Ban NVTHQ) trong trường hợp phát hiện sự bất cập, chưa thống nhất tại các văn bản quy phạm pháp luật, văn bản hướng dẫn, Thông báo kết quả phân loại, Thông báo kết quả phân tích kèm mã số hàng hóa, Thông báo kết quả xác định trước mã số, các vụ việc phức tạp vượt thẩm quyền.

b.4) Ban NVTHQ có trách nhiệm rà soát báo cáo của Chi cục Kiểm định hải quan và báo cáo của các Chi cục Hải quan khu vực liên quan đến việc áp dụng các Thông báo kết quả phân loại, Thông báo kết quả phân tích kèm mã số hàng hóa để báo cáo Lãnh đạo Cục và đề xuất phương án xử lý đối với các trường hợp phát sinh vướng mắc.

c) Kiểm tra việc phân loại hàng hóa, áp dụng mức thuế thông qua các chương trình kiểm tra, điều tra.

Chi cục Kiểm tra sau thông quan, Chi cục Điều tra chống buôn lậu, Ban Kiểm tra khi tiến hành các chương trình kiểm tra, điều tra theo chức năng, nhiệm vụ, nếu phát hiện các vi phạm về phân loại hàng hóa, áp dụng mức thuế thì thực hiện xác định lại mã số, thuế suất theo đúng quy định, chuyển thông tin vi phạm cho Ban NVTHQ theo dõi. Trường hợp cần thiết, Ban NVTHQ báo cáo Lãnh đạo Cục đề xuất có văn bản cảnh báo, chấn chỉnh toàn ngành.

d) Kiểm tra, rà soát trên hệ thống và báo cáo của các Chi cục Hải quan khu vực.

Ban NVTHQ rà soát dữ liệu hệ thống trên cơ sở quản lý rủi ro, thông tin phản ánh dấu hiệu vi phạm, rà soát báo cáo của các Chi cục Hải quan khu vực về công tác phân loại hàng hóa, áp dụng mức thuế. Trường hợp phát hiện việc phân loại hàng hóa, áp dụng mức thuế không chính xác, không thống nhất thì báo cáo Lãnh đạo Cục để có văn bản hướng dẫn, cảnh báo, chấn chỉnh.

Bộ phận Trực ban của Cục Hải quan trong quá trình kiểm tra, giám sát trực tiếp hoạt động của các đơn vị trên hệ thống Trực ban giám sát trực tuyến, trường hợp phát hiện các vi phạm về phân loại hàng hóa, áp dụng mức thuế thì thực hiện theo Quy chế Trực ban, chuyển thông tin vi phạm cho Ban NVTHQ theo dõi. Trường hợp cần thiết, Ban NVTHQ báo cáo Lãnh đạo Cục đề xuất có văn bản cảnh báo, chấn chỉnh toàn ngành.

đ) Kiểm tra thông qua công tác xử lý sự vụ, kiến nghị, vướng mắc của doanh nghiệp về phân loại hàng hóa.

Trên cơ sở thông tin nhận được từ công tác xử lý sự vụ hàng ngày, xử lý vướng mắc, kiến nghị của doanh nghiệp về phân loại, Ban NVTHQ kiểm tra, đánh giá, rà soát trên hệ thống, trường hợp cần thiết báo cáo Cục Hải quan có văn bản hướng dẫn, chỉ đạo, chấn chỉnh trong toàn ngành.

Chương 4

XỬ LÝ VƯỚNG MẮC VƯỢT THẨM QUYỀN TRONG LĨNH VỰC PHÂN LOẠI HÀNG HÓA, ÁP DỤNG MỨC THUẾ

Điều 17. Đối với Chi cục Hải quan khu vực

Khi phát sinh vướng mắc phân loại vượt thẩm quyền, Chi cục Hải quan khu vực gửi hồ sơ vướng mắc về Cục Hải quan để được hướng dẫn, bao gồm:

1. Văn bản báo cáo vướng mắc về phân loại hàng hóa: Trong đó nêu rõ nội dung vướng mắc; cơ sở và tiến trình xử lý vụ việc; bản chất hàng hóa (thành phần, cấu tạo, chất liệu, tính chất lý, hóa, tính năng, công dụng, cơ chế hoạt động...); kết quả kiểm tra, rà soát xác định việc thực hiện phân loại thống nhất hay không trong đơn vị.

2. Hồ sơ hải quan và các chứng từ, tài liệu có liên quan.

3. Hồ sơ họp Tổ chuyên gia phân loại của đơn vị.

4. Đề xuất mã số và căn cứ đề xuất.

Điều 18. Đối với các đơn vị nghiệp vụ khác thuộc Cục Hải quan

Trong quá trình thực hiện nhiệm vụ thuộc phạm vi thẩm quyền, các đơn vị phải căn cứ vào các văn bản quy phạm pháp luật về phân loại hàng hóa, cơ sở dữ liệu hải quan và các văn bản hướng dẫn, chỉ đạo của Bộ Tài chính, Cục Hải quan, đối chiếu với hồ sơ hải quan, chứng từ tài liệu có liên quan, kết quả kiểm tra thực tế hàng hóa hoặc kết quả phân tích, giám định hàng hóa để kiểm tra xác định tên hàng, mô tả hàng hóa, mã số, mức thuế, đơn vị tính hàng hóa theo quy định. Trường hợp thực hiện đầy đủ theo các căn cứ quy định nêu trên nhưng còn vướng mắc về phân loại hàng hóa, các đơn vị có văn bản trao đổi với Ban NVTHQ, hồ sơ bao gồm:

1. Văn bản trao đổi về phân loại hàng hóa: Trong đó nêu rõ nội dung vướng mắc; cơ sở và tiến trình xử lý vụ việc; bản chất hàng hóa (thành phần, cấu tạo, chất liệu, tính chất lý, hóa, tính năng, công dụng, cơ chế hoạt động...); căn cứ và quan điểm phân loại.

2. Hồ sơ hải quan và chứng từ, tài liệu liên quan.

3. Biên bản kiểm tra và các tài liệu khác liên quan.

4. Biên bản họp nội bộ đơn vị về việc xác định mã số hàng hóa (nếu có).

Điều 19. Đối với Ban Nghiệp vụ thuế hải quan

Ban NVTHQ tiếp nhận, thực hiện kiểm tra hồ sơ kiến nghị, vướng mắc từ các Chi cục Hải quan khu vực, các đơn vị thuộc Cục Hải quan:

1. Trường hợp nội dung và hồ sơ báo cáo đáp ứng yêu cầu, đầy đủ, rõ ràng thì đề xuất, phối hợp với các đơn vị có liên quan (nếu cần thiết) để giải quyết theo quy định:

a) Trường hợp vụ việc không phải xin ý kiến của các đơn vị có liên quan thì trình Cục Hải quan tối đa không quá 10 (mười) ngày làm việc kể từ ngày nhận đủ hồ sơ theo yêu cầu;

b) Trường hợp mặt hàng có cấu tạo kỹ thuật phức tạp, cần có ý kiến về các tiêu chí kỹ thuật, cấu tạo, thành phần, ... để thực hiện phân loại thì đề nghị Chi cục Kiểm định Hải quan làm rõ để xử lý. Chi cục Kiểm định Hải quan trả lời Ban NVTHQ trong thời hạn 10 (mười) ngày làm việc kể từ ngày nhận được đề nghị. Ban NVTHQ tổng hợp, trình Cục Hải quan tối đa không quá 05 (năm) ngày làm việc kể từ ngày nhận đủ hồ sơ, thông tin theo yêu cầu, ý kiến tham gia của Chi cục Kiểm định hải quan;

c) Đối với vụ việc phức tạp cần trao đổi ý kiến với các cơ quan, đơn vị ngoài Ngành hoặc trường hợp mặt hàng cần áp dụng tiêu chuẩn chuyên ngành để phân loại và cần thiết lấy ý kiến của các đơn vị quản lý chuyên ngành có liên quan để xử lý thì trong vòng 10 (mười) ngày làm việc phải có văn bản lấy ý kiến các đơn vị liên quan. Ban NVTHQ tổng hợp, trình Cục Hải quan trong vòng 05 (năm) ngày làm việc kể từ khi nhận được đầy đủ ý kiến tham gia của các đơn vị.

2. Trường hợp nội dung và hồ sơ báo cáo không đáp ứng yêu cầu, không đầy đủ, rõ ràng theo hướng dẫn tại Điều 17, 18 Quy trình này thì gửi trả lại hồ sơ trong thời hạn 05 (năm) ngày làm việc kể từ ngày nhận được hồ sơ để các Chi cục Hải quan khu vực và các đơn vị thuộc Cục Hải quan hoàn thiện.

Phần III

TỔ CHỨC THỰC HIỆN

Điều 20. Tổ chức thực hiện

1. Thủ trưởng các đơn vị chịu trách nhiệm quán triệt, tổ chức thực hiện nghiêm túc quy trình này. Quá trình thực hiện nếu có vướng mắc, đề nghị các đơn vị phản ánh kịp thời về Cục Hải quan (qua Ban NVTHQ) để được hướng dẫn, giải đáp.

a) Thủ trưởng các Chi cục Hải quan khu vực:

a.1) Thực hiện theo quy chế kiểm tra, kiểm soát nội bộ đối với việc thực hiện thủ tục hải quan, kiểm tra, giám sát hải quan theo quy định.

a.2) Bố trí, phân công công chức đã được đào tạo về phân loại hàng hóa, có kỹ năng, kinh nghiệm thực tế thực hiện xác định tên hàng, mô tả hàng hóa, mã số chính xác.

a.3) Tổ chức các lớp đào tạo thực tế, tập huấn cho công chức làm công tác phân loại hàng hóa tại đơn vị về kỹ năng đánh giá nghi vấn trên cơ sở thông tin rủi ro để thực hiện thủ tục hải quan đúng quy định; xây dựng cẩm nang hướng dẫn về kiểm tra phân loại hàng hóa, cập nhật hệ thống.

a.4) Xây dựng đội ngũ chuyên gia về phân loại hàng hóa, lưu ý việc luân chuyển cán bộ phải gắn với nghiệp vụ chuyên sâu, hạn chế lãng phí nguồn nhân lực đã được đào tạo.

a.5) Tổ chức bố trí nguồn lực cập nhật kịp thời đầy đủ thông tin dữ liệu của các đơn vị trên hệ thống MHS theo đúng quy định.

b) Thủ trưởng Ban Nghiệp vụ thuế hải quan:

b.1) Tổ chức bố trí nguồn nhân lực để xử lý kịp thời các vướng mắc phát sinh do các Chi cục Hải quan khu vực, tổ chức, cá nhân phản ánh liên quan đến việc áp dụng mã số, mức thuế trong toàn ngành.

b.2) Tổ chức kiểm tra việc thực hiện của các Chi cục Hải quan khu vực về phân loại hàng hóa, áp dụng mức thuế thông qua việc kiểm tra trên hệ thống, trên hồ sơ và tại trụ sở cơ quan hải quan khi cần thiết.

b.3) Xây dựng đội ngũ chuyên gia về phân loại hàng hóa.

b.4) Tổ chức tập huấn về phân loại hàng hóa, cung cấp thông tin cập nhật về các quyết định phân loại và khuyến nghị của Tổ chức Hải quan thế giới.

b.5) Tổ chức kiểm tra việc cập nhật kịp thời đầy đủ thông tin dữ liệu của các đơn vị trên hệ thống MHS theo đúng quy định.

b.6) Chỉ đạo việc tham mưu, đề xuất, ký ban hành Thông báo kết quả xác định trước mã số theo đúng quy định và phân cấp của Lãnh đạo Cục.

c) Thủ trưởng Chi cục Kiểm định hải quan:

c.1) Chỉ đạo việc tham mưu, đề xuất ban hành Thông báo kết quả phân loại, Thông báo kết quả phân tích kèm mã số hàng hóa đúng quy định của pháp luật.

c.2) Tổ chức kiểm tra việc thực hiện gửi mẫu phân tích để phân loại đúng đối tượng, đúng tiêu chí, đúng hồ sơ theo quy định.

c.3) Xử lý kịp thời các vướng mắc phát sinh liên quan đến Thông báo kết quả phân loại, Thông báo kết quả phân tích kèm mã số hàng hóa.

c.4) Tổ chức bố trí nguồn lực để cập nhật kịp thời đầy đủ thông tin dữ liệu Thông báo kết quả phân loại, Thông báo kết quả phân tích kèm mã số hàng hóa trên hệ thống MHS theo đúng quy định.

d) Thủ trưởng Ban Công nghệ thông tin và Thống kê hải quan thực hiện:

d.1) Chỉ đạo kết nối Cơ sở dữ liệu về phân loại hàng hóa và áp dụng mức thuế với các hệ thống thông tin, dữ liệu có liên quan phục vụ công tác phân loại, xác định mã số hàng hóa;

d.2) Tổ chức bố trí nguồn lực duy trì, bảo đảm tính ổn định, tính bảo mật của Cơ sở dữ liệu về phân loại hàng hóa và áp dụng mức thuế trong quá trình cập nhật, khai thác, sử dụng;

d.3) Chỉ đạo xử lý các sự cố kỹ thuật phát sinh trong quá trình vận hành, sử dụng Cơ sở dữ liệu về phân loại hàng hóa và áp dụng mức thuế.

đ) Thủ trưởng Chi cục Kiểm tra sau thông quan, Ban Kiểm tra, Chi cục Điều tra Chống buôn lậu, Ban Giám sát quản lý về hải quan thực hiện:

đ.1) Tổ chức bố trí nguồn lực để kiểm tra, kiểm soát đảm bảo việc áp dụng đúng mã số, thuế suất tại các Kết luận thanh tra, kiểm tra, điều tra, các Danh mục chuyên ngành.

đ.2) Trao đổi thông tin kịp thời với Ban NVTHQ khi phát hiện sự không phù hợp về mã số, mức thuế và các nội dung khác liên quan trong quá trình thực thi chức năng, nhiệm vụ.

đ.3) Tổ chức bố trí nguồn nhân lực cập nhật kịp thời đầy đủ thông tin dữ liệu của các đơn vị trên hệ thống MHS theo quy định.

e) Văn phòng Cục

Tổ chức bố trí nguồn lực cập nhật nội dung Thông báo kết quả xác định trước mã số, Thông báo hủy bỏ Thông báo kết quả xác định trước mã số, Thông báo sửa đổi, thay thế Thông báo kết quả xác định trước mã số trên hệ thống Cces và trang thông tin điện tử của Cục Hải quan theo quy định.

2. Công chức hải quan thực hiện: Tiếp nhận, kiểm tra, xử lý, báo cáo, luân chuyển, phát hành, cập nhật, lưu trữ hồ sơ theo đúng quy định.

3. Trong quá trình thực hiện, nếu các văn bản liên quan đề cập tại Quy trình này được sửa đổi, bổ sung hoặc thay thế thì thực hiện theo văn bản mới được sửa đổi, bổ sung hoặc thay thế./.

PROMULGATING THE ADVANCE RULING ON TARIFF CLASSIFICATION PROCEDURE; VERIFICATION OF GOODS NAME, DESCRIPTION, HS CODE, DUTY RATE, AND UNIT OF MEASURE OF EXPORTED AND IMPORTED GOODS DURING CUSTOMS CLEARANCE; UNIFICATION OF GOODS CLASSIFICATION AND APPLICATION OF DUTY RATES TO EXPORTED AND IMPORTED GOODS

Pursuant to the Customs Law No. 54/2014/QH13 amended by Law No. 90/2025/QH15;

Pursuant to Decree No. 08/2015/ND-CP dated January 21, 2015 of the Government on elaboration of and measures for implementation of the Law on Customs regarding customs procedures, inspection, supervision, and control amended by Decree No. 167/2025/ND-CP dated June 30, 2025 of the Government;

At the proposal of the Head of the Customs Tax Administration Division.

HEREBY DECIDES:

Article 1. Promulgation together with this Decision of the Advance ruling on tariff classification procedure; Verification of goods name, description, HS code, duty rate, and unit of measure of exported and imported goods during customs clearance; Unification of goods classification and application of duty rates to exported and imported goods.

Article 2. Entry into force

1. This Decision comes into force as of February 1, 2026.

2. Annulment of Decision No. 1921/QD-TCHQ dated June 28, 2018 of the General Department of Customs on promulgation of the procedure for goods classification and application of duty rates to exported and imported goods.

Article 3. Heads of Regional Customs Sub-Departments and heads of units under the Customs Department shall implement this Decision. During implementation, if any difficulties arise, they shall promptly report and propose to the Customs Department for consideration and appropriate adjustment./.

PROCEDURE

ADVANCE RULING ON TARIFF CLASSIFICATION PROCEDURE; VERIFICATION OF GOODS NAME, DESCRIPTION, HS CODE, DUTY RATE, AND UNIT OF MEASURE OF EXPORTED AND IMPORTED GOODS DURING CUSTOMS CLEARANCE; UNIFICATION OF GOODS CLASSIFICATION AND APPLICATION OF DUTY RATES TO EXPORTED AND IMPORTED GOODS
(Enclosed with Decision No. 117/QD-CHQ dated January 20, 2026 of the Director of the Customs Department)

Part I

GENERAL PROVISIONS

Article 1. Scope

This Procedure provides for procedures for promulgation, amendment, replacement, and annulment of Advance ruling on tariff classification result notification; professional operations relating to verification of goods name, description, HS code, application of duty rates, and unit of measure of exported goods and import duty during customs clearance; unification of goods classification and application of duty rates to exported and imported goods throughout the sector and handling of issues beyond competence in goods classification and application of duty rates.

Article 2. Principles of implementation

1. In performing goods classification and application of duty rates, customs officials shall base on the following documents:

a) the Law on Customs;

c) Circular No. 38/2015/TT-BTC dated March 25, 2015 of the Minister of Finance on guidelines for customs procedures; customs inspection and supervision; export duty, import duty and tax administration for exported and imported goods amended by Circular No. 39/2018/TT-BTC and Circular No. 121/2025/TT-BTC;

d) Circular No. 14/2015/TT-BTC dated January 30, 2015 of the Minister of Finance on guidelines for goods classification, analysis for goods classification, analysis for quality inspection and food safety inspection amended by Circular No. 17/2021/TT-BTC;

dd) Circular No. 31/2022/TT-BTC dated June 8, 2022 of the Minister of Finance promulgating Vietnam’s list of exported and imported goods;

e) Export tariff schedule, Preferential import tariff schedule, list of goods and absolute duty rates, mixed duty rates, out-of-quota import duty rates, Decisions on application of ordinary duty rates to imported goods, and preferential export tariff schedules, special preferential import tariff schedules, Decisions on additional import duty effective at the time of declaration registration;

g) Decisions of the Customs Department promulgating the list of exported and imported goods at risk in goods classification and application of duty rates and guidelines in this Procedure.

2. Lookup, use, and update of databases in the process of goods classification and application of duty rates shall comply with the Regulation on collection, update, and use of databases on Vietnam’s list of exported and imported goods, databases on tariff schedules, databases on goods classification and application of duty rates (hereinafter collectively referred to as the MHS system).

3. Goods classification and application of duty rates shall ensure publicity and transparency, ensuring the principle that one item has only one unique HS code under Vietnam’s list of exported and imported goods and correct application of duty rates in accordance with regulations.

4. During performance of duties, professional issues arising shall be promptly considered and resolved within competence; in case of difficulty, they shall be reported to the immediate superior level for handling, ensuring facilitation for enterprises and timely removal of difficulties and obstacles.

5. During receipt, circulation, and processing of documents for goods classification and application of duty rates, customs officials shall comply with regulations on document preservation and arrange documents according to the list of documents contained in the file.

SPECIFIC PROVISIONS

Chapter 1

PROCEDURES FOR PROMULGATION, AMENDMENT, REPLACEMENT, AND ANNULMENT OF ADVANCE RULING ON TARIFF CLASSIFICATION RESULT NOTIFICATION

Article 3. Receipt and assignment for processing of advance ruling documents for tariff classification

1. The Office of the Customs Department shall receive advance ruling documents for tariff classification submitted by organizations and individuals in accordance with current regulations on clerical affairs and incoming document processing, and shall transfer the documents together with original goods samples (if any) to the Customs Tax Administration Division (hereinafter referred to as “the Division”).

2. After receipt of the documents and goods samples (if any), the Division shall circulate the documents to the Goods Classification and Tariff Schedule Team (hereinafter referred to as “the Classification Team”) in accordance with current regulations on clerical affairs for assignment of officials for processing.

Article 4. Examination of documents and handling of examination results

1. Examination of documents

The assigned official shall examine completeness and accuracy of declared information in the Application form for advance ruling on tariff classification according to Form No. 01/XDTMS/NVTHQ under Circular No. 121/2025/TT-BTC (hereinafter referred to as the Application form for advance tariff classification ruling); examine consistency and conformity between accompanying documents and technical materials and the declared contents in the Application form for advance tariff classification ruling and the goods samples submitted (if any).

a.1) The advance ruling documents for tariff classification are not declared in accordance with regulations, including: the Application form for advance tariff classification ruling is not in the prescribed form or not fully completed; required documents are missing; expected time of export or import is not in accordance with regulations; inconsistency exists between information in the Application form for advance tariff classification ruling, accompanying documents, and goods samples (if any).

a.2) The goods stated in the Application form for advance tariff classification ruling are pending handling results of regulatory agencies as prescribed at point b clause 5 Article 7 of Circular No. 38/2015/TT-BTC amended by Circular No. 39/2018/TT-BTC and Circular No. 121/2025/TT-BTC, including: Goods specified in the Application form for advance tariff classification ruling are subject to a case that has been notified by a competent regulatory agency as being under investigation, inspection, or examination; Goods specified in the Application form for advance tariff classification ruling have been received by the Customs Department and are pending handling results.

a.3) The goods stated in the Application form for advance tariff classification ruling have been subject to written guidance on HS code issued by the Ministry of Finance or the Customs Department as prescribed at point c clause 5 Article 7 of Circular No. 38/2015/TT-BTC amended by Circular No. 39/2018/TT-BTC and Circular No. 121/2025/TT-BTC, including:  Advance ruling on tariff classification result notification (lookup at function 2.02 section 2 of the MHS system) or Analysis and classification result notification (lookup at function 2.03 section 2 of the MHS system) of the same organization or individual requesting advance ruling; written guidance on classification for the goods in the Application form for advance tariff classification ruling (lookup at function 3.03.06 section 3 of the MHS system or on the website or document management systems Edoc, Cces, Net office).

b) In case the documents meet requirements: the official shall proceed to clause 2 of this Article.

2. Determination of HS code

The official shall base on principles prescribed in Article 2 of this Procedure, compare with the advance ruling documents for tariff classification and goods samples (if any), and handle as follows:

a) Where sufficient grounds exist to determine the HS code: the official shall determine the HS code, prepare a proposal slip and draft the Advance ruling on tariff classification result notification according to Form No. 01a-TB XDTMS under Circular No. 121/2025/TT-BTC, report to the Head of the Classification Team and submit to the Head of the Division for signature.

b) Where insufficient grounds exist to determine the HS code:

b.1) Where additional information is required: the official shall prepare a proposal slip and draft a written request for the organization or individual submitting the Application form for advance tariff classification ruling to supplement and clarify information, provide inspection and testing certificates issued by legally authorized organizations or attend at the customs authority for dialogue, explanation, and clarification of contents in the documents.

Where, after receipt of complete information from the organization or individual, sufficient grounds exist to determine the HS code, the official shall proceed in accordance with point a clause 2 of this Article.

The processing time limit for advance ruling documents for tariff classification shall be calculated from the date the Customs Department receives complete information from the organization or individual as prescribed.

Notes:

- Where the goods name and HS code cannot be determined on the basis of goods description, technical documents, images, samples, and other documents in the advance ruling documents for tariff classification and must rely on analysis or inspection results using technical equipment, the organization or individual shall be requested to provide an inspection and testing certificate issued by a legally authorized inspection and testing organization as the basis for HS code determination.

- Where the organization or individual is invited to the customs authority for clarification of information in the advance ruling documents for tariff classification, the official shall prepare the working contents. The working contents shall be recorded in minutes clearly stating time, location, participants, contents, opinions of participants, agreed matters, outstanding issues with differing opinions, and signatures of the parties. The minutes shall be made in two copies, each party retaining one copy, and shall constitute an integral part of the advance ruling documents for tariff classification.

Where the organization or individual has fully supplemented information but sufficient grounds to determine the HS code are still lacking, handling shall be carried out in accordance with point b.2 or b.3 or b.4 below:

b.2) Where there is doubt and analysis is required for verification, comparison, or exclusion based on classification criteria, or where opinions on goods classification are required: the official shall draft a written request clearly stating the criteria to be analyzed and verified or the matters requiring consultation, enclosing goods samples and the advance ruling documents for tariff classification, and submit to the Head of the Team and the Head of the Division for approval before sending to the Customs Inspection Sub-Department for opinions.

After receipt of analysis results or classification opinions from the Customs Inspection Sub-Department, the official shall proceed in accordance with point a clause 2 of this Article.

b.3) Where opinions of units under the Ministry of Finance, other ministries, specialized regulatory agencies, associations, or relevant professional organizations are required to clarify the nature of goods and technical criteria: the official shall prepare a proposal slip and draft a written request for opinions (clearly stating the matters for consultation), submit to the Head of the Team and the Head of the Division for submission to the Director for approval, and concurrently notify the organization or individual submitting the Application form for advance tariff classification ruling (if necessary).

b.4) Where opinions of the HS Committee under the World Customs Organization, the WCO Secretariat, the ASEAN Technical Sub-Working Group on Classification (TSWGC), customs authorities of other countries, or international professional organizations are required to clarify the nature of goods proposed for advance ruling on tariff classification, scope of chapter, heading, subheading, or tariff line: the official shall prepare a proposal for submission to the Director and draft a written request for the Office of the Customs Department to act as the focal point for liaison with the above-mentioned foreign bodies (clearly specifying the information to be verified), and concurrently notify the organization or individual submitting the Application form for advance tariff classification ruling (if necessary).

After receipt of opinions from the above-mentioned bodies, the official shall proceed in accordance with point a clause 2 of this Article.

Article 5. Approval of documents

1. The Head of the Classification Team shall examine the documents and proposal of the official and handle as follows:

a) Where the Head of the Classification Team agrees with the proposal of the official: approve the proposal and submit to the Head of the Division, then proceed in accordance with clause 2 of this Article.

b) Where the Head of the Classification Team does not agree with the proposal of the official: clearly state reasons and directions in the proposal slip and return the documents for explanation or implementation of the directions.

2. The Head of the Division shall examine the documents and proposal of the Classification Team and handle as follows:

a) Where the Head of the Division agrees with the proposal: approve the proposal and sign the attached document. Where signing the Advance ruling on tariff classification result notification (on behalf of the Director), handling shall proceed in accordance with Article 6.

b) Where the Head of the Division does not agree with the proposal: provide directions in the proposal slip and return the documents to the Classification Team for explanation or implementation of the directions.

Article 6. Issuance of Advance ruling on tariff classification result notification, database update, and publication on the website of the Customs Department

1. Issuance of Advance ruling on tariff classification result notification shall comply with regulations on clerical affairs of the Customs Department. The issuance time limit shall be 30 days from the date of receipt of complete documents (for normal cases) or 60 days from the date of receipt of complete documents (for complex cases requiring verification and clarification).

2. Database update

a) Officials of the Classification Team shall update the Advance ruling on tariff classification result notification at function 1.02 “Advance ruling on tariff classification” in the MHS system in accordance with the Regulation on development, collection, update, and use of databases on Vietnam’s list of exported and imported goods; databases on tariff schedules; databases on goods classification and application of duty rates to exported and imported goods of the Customs Department within 5 working days from the date of issuance of the Advance ruling on tariff classification result notification.

b) The Office of the Customs Department shall update the contents of the Advance ruling on tariff classification result notification on the website of the Customs Department in accordance with the Regulation on development, collection, update, and use of databases on Vietnam’s list of exported and imported goods; databases on tariff schedules; databases on goods classification and application of duty rates to exported and imported goods of the Customs Department within 5 working days from the date of issuance.

Article 7. Annulment of Advance ruling on tariff classification result notification

1. Advance ruling on tariff classification result notification shall be annulled where it is discovered that the advance ruling documents for tariff classification provided by the organization or individual are inaccurate or untruthful as prescribed at point c clause 6 Article 24 of Decree No. 08/2015/ND-CP amended by point dd clause 1 Article 2 of Decree No. 167/2025/ND-CP.

2. Procedures for annulment shall be as follows:

a) Where an official of the Classification Team assigned to review and examine or through recommendations and feedback from customs units, specialized regulatory agencies, associations, enterprises, press, etc., detects that information provided by the organization or individual submitting the Application form for advance tariff classification ruling is inaccurate or untruthful, the official shall prepare a proposal slip and draft a written annulment of Advance ruling on tariff classification result notification according to Form No. 01c-Huy XDTMS under Circular No. 121/2025/TT-BTC, and submit to the Head of the Classification Team, the Head of the Division, and the Director for approval.

c) The official shall review the system and assess application of the annulled Advance ruling on tariff classification result notification, report to the Head of the Team and the Head of the Division for issuance of a written request to the Customs Sub-Department where the enterprise carries out customs procedures to conduct review and determine declaration of HS code according to the annulled Advance ruling on tariff classification result notification of the declarant in accordance with regulations.

Article 8. Handling cases where organizations or individuals request reconsideration of the Advance ruling on tariff classification result notification

1. The official of the Classification Team assigned to handle the case shall examine and compare the contents of the Advance ruling on tariff classification result notification with the contents of the enterprise’s request:

a) Where there are sufficient grounds to determine that the Advance ruling on tariff classification result notification is appropriate, the official shall prepare a proposal slip and draft a written reply to the enterprise on maintaining the advance ruling result, and report to the Head of the Classification Team and the Head of the Division for approval.

b) Where there are sufficient grounds to determine that the issued Advance ruling on tariff classification result notification is inappropriate, the official shall proceed in accordance with Article 9 of this Procedure.

2. Examination, approval of documents, issuance of written reply to the request for reconsideration of the advance ruling result, database update, and publication on the website of the Customs Department shall comply with Articles 5 and 6 of this Procedure.

Article 9. Amendment and replacement of the Advance ruling on tariff classification result notification

1. The Advance ruling on tariff classification result notification shall be amended or replaced where the customs authority re-determines upon review and information collection or where the organization or individual submitting the Application form for advance tariff classification ruling provides additional information.

2. The official of the Classification Team assigned to handle the case shall examine and compare the contents of the Advance ruling on tariff classification result notification with the collected information or additional information provided by the organization or individual submitting the Application form for advance tariff classification ruling, prepare a proposal slip and draft an amended or replacement Advance ruling on tariff classification result notification according to Form No. 01b-Thaythe XDTMS under Circular No. 121/2025/TT-BTC, and submit to the Head of the Classification Team, the Head of the Division, and the Director for approval.

4. The official shall review the system and assess application of the amended or replacement Advance ruling on tariff classification result notification, report to the Head of the Team and the Head of the Division for issuance of a written request to the Customs Sub-Department where the enterprise carries out customs procedures to conduct inspection and re-determine the HS code for consignments already cleared according to the Advance ruling on tariff classification result notification.

Chapter 2

PROCEDURES FOR VERIFICATION OF GOODS NAME, DESCRIPTION, HS CODE, EXPORT DUTY, IMPORT DUTY, AND ADDITIONAL IMPORT DUTY DURING CUSTOMS CLEARANCE

Article 10. Examination of documents

1. Subjects of examination: customs documents for exported and imported goods under channel 2 and channel 3.

2. Examination contents:

The customs official assigned to receive the declaration at the customs unit where the declaration is registered shall examine the following:

a) Verification of goods name, goods description, and HS code:

a.1.2) HS code: the HS code must be complete and accurate at the 8-digit or 10-digit level of detail corresponding to the goods required to be classified under Vietnam’s list of exported and imported goods and the applicable tariff schedule for exported and imported goods.

a.2) Examination methods:

a.2.1) Examine and compare consistency between declared goods name, goods description, and HS code with the customs documents, technical documents (if any), and other relevant documents.

a.2.2) Examine and compare to ensure sufficient information for classification under the criteria at point a.1 clause 2 of this Article between declared goods name, goods description, and HS code and the relevant headings, section notes, chapter notes, and subheadings in Vietnam’s list of exported and imported goods; regulations in decrees promulgating the Export tariff schedule and Import tariff schedule; decisions on application of trade remedy measures; Advance ruling on tariff classification result notification, Classification result notification, Analysis result notification with HS code of the enterprise carrying out customs procedures (if any).

a.2.3) Examine, compare, and refer to written guidance on goods classification, HS Explanatory Notes, WCO classification opinions compendium, SEN Explanatory Notes, and other information in the database on Vietnam’s list of exported and imported goods and the list of exported and imported goods at risk in goods classification and application of duty rates.

b) Verification of unit of measure.

a.1) Examination criteria:

The unit of measure must be declared at 2 criteria: quantity (1) and quantity (2) on the customs declaration in accordance with Appendix I to Circular No. 39/2018/TT-BTC.  Quantity (2) must be the unit of measure corresponding to the HS code under Vietnam’s list of exported and imported goods.

b.2) Examination methods:

Examine and compare the information declared at quantity (1) to determine that the information at quantity (1) is consistent with the information in the customs documents.

Examine and compare the information declared at quantity (2) to determine that the unit of measure at quantity (2) corresponds to the HS code under Vietnam’s list of exported and imported goods and that the converted quantity corresponds to quantity (1).

* The unit of measure at quantity (1) may be carton, bag, sack, etc. according to the customs document set; however, the unit of measure at quantity (2) must be the unit of measure corresponding to the HS code under Vietnam’s list of exported and imported goods.

* Relative tolerance shall be accepted in cases of conversion from quantity (1) to quantity (2).

c) Verification of export duty and import duty rates:

c.1) Examination criteria:

The duty rate must correspond to and comply with the Decree promulgating the tariff schedule, the Decision on application of the ordinary duty rate to imported goods, and the Decision on application of trade remedy measures (if any) effective at the time of declaration registration.

c.2) Examination methods:

c.2.1) Examine and compare the customs documents with the applicable conditions of the tariff schedule and the Decision on application of trade remedy measures such as regulations on origin, certificate of origin (C/O), mode of transport from the exporting country, validity of the tariff schedule, name of producer or exporter, related enterprise name, duration of application of trade remedy measures.

c.2.2) Examine and compare the declared duty rate with the HS code and the corresponding duty rate in the tariff schedule, the Decision on application of the ordinary duty rate to imported goods, and the Decision on application of trade remedy measures effective at the time of declaration registration.

* Goods under headings detailed at serial number 211 of the Export tariff schedule but without declaration proving that the resource and mineral content plus energy cost accounts for less than 51% of product cost price or declaring an export duty rate of 0%.

* HS code coinciding with a code listed under tariff code B17 but without declaration of the duty rate under Chapter 98 and tariff code B17.

b) Where there are sufficient grounds to determine that the declarant has inaccurately declared goods name, goods description, HS code, duty rate, or unit of measure, the customs official shall notify the declarant to make supplementary declaration in accordance with Article 20 of Circular No. 38/2015/TT-BTC amended by Circular No. 39/2018/TT-BTC and Circular No. 121/2025/TT-BTC by “Customs instruction” through IDA01/EDA01 operation (code A) on the VNACCS system.

Where the declarant fails to make supplementary declaration or makes supplementary declaration not in accordance with the request within 5 working days from the date of receipt of the customs authority’s request, the customs official shall record in the “Update handling officer’s opinion” box on the VCIS system, re-determine goods name, goods description, HS code, duty rate, and unit of measure, impose tax assessment (if any), and carry out procedures for handling violations (if any) in accordance with regulations; update the adjusted HS code result at function 1.01.07 of the MHS system.

c) Where there are insufficient grounds to determine goods name, goods description, HS code, and duty rate, the customs official shall notify the declarant to submit additional technical documents or sale contract or other relevant documents evidencing the basis for declaration by “Customs instruction” through IDA01/EDA01 operation (code A) on the VNACCS system and handle as follows:

c.1) Where on the basis of supplemented documents there are sufficient grounds to determine that the declared goods name, goods description, HS code, and duty rate are accurate, the official shall update in the “Update handling officer’s opinion” box on the VCIS system.

c.2) Where on the basis of supplemented documents there are sufficient grounds to determine that the declared goods name, goods description, HS code, and duty rate are inaccurate, the customs official shall proceed in accordance with point b of this clause.

c.3) Where the declarant fails to provide documents or where the supplemented documents are insufficient to determine goods name, goods description, HS code, and duty rate, the official shall propose to the leadership to conduct physical inspection of goods or take samples for analysis and classification or for inspection and assessment of technical criteria using machinery and equipment at the customs inspection authority or for inspection and testing in accordance with regulations. The official must clearly propose inspection instructions or criteria required for analysis, inspection, or testing.

Goods samples sent for analysis and classification or for inspection and assessment of technical criteria using machinery and equipment at the customs inspection authority must fall within the list of goods eligible for analysis and classification or the list of goods subject to inspection and assessment of technical criteria using machinery and equipment at the customs inspection authority issued by the Customs Department and published on the Customs portal.

d) For consignments of exported or imported goods from which samples are taken and sent for analysis and classification or for inspection and assessment of technical criteria using machinery and equipment at the customs inspection authority or for inspection and testing, immediately upon receipt of the Classification result notification, Analysis result notification with HS code, Notification of inspection and assessment of technical criteria results, or Inspection and testing certificate of the sampled consignment, the customs official shall proceed in accordance with Article 13.

Article 11. Physical inspection of goods

Examine the accuracy and completeness of the declared goods name, goods description, HS code, and duty rate on the declaration and attached documents against the actual exported or imported goods and in accordance with inspection instructions on goods attributes by the Step 2 official in the system (if any).

Examine in detail criteria such as goods name, characteristics, composition, content, structure, size, shape, physical and chemical properties, features, uses, manufacturer, packing specifications, labeling contents, and other attributes of goods as the basis for determining HS code and duty rate under Vietnam’s list of exported and imported goods, the tariff schedule, Decisions on application of trade remedy measures, and other relevant legal normative documents.

2. Handling of inspection results:

a) Where no discrepancy is identified between the declared goods name, goods description, HS code, and the actual exported or imported goods, the customs official shall accept the declared goods name, goods description, HS code, and duty rate of the declarant, record the inspection result in the Inspection result record, update the inspection result in the “Update handling officer’s opinion” box on the VCIS system, and carry out subsequent professional steps in accordance with the customs procedure process.

b) Where there are sufficient grounds to determine that the declarant has inaccurately declared goods name, goods description, HS code, or duty rate, the official shall record the inspection result in the Inspection result record, update the inspection result in the “Update handling officer’s opinion” box on the VCIS system (clearly stating inaccurate contents regarding goods name, goods description, HS code, or duty rate), notify the declarant to make supplementary declaration in accordance with Article 20 of Circular No. 38/2015/TT-BTC amended by Circular No. 39/2018/TT-BTC and Circular No. 121/2025/TT-BTC by “Customs instruction” through IDA01/EDA01 operation (code A) on the VNACCS system, and carry out violation handling procedures (if any) in accordance with law.

Where the declarant fails to make supplementary declaration, the customs official shall re-determine the HS code and duty rate, impose tax assessment (if any), and depending on the degree of violation between declared contents and inspection results, carry out handling in accordance with law, and update the inspection result in the “Update handling officer’s opinion” box on the VCIS system.

c) Where physical inspection conducted directly by the customs official or by available machinery and equipment is insufficient to determine or cannot accurately determine goods name, goods description, and HS code under criteria of Vietnam’s list of exported and imported goods, the Export tariff schedule, the Import tariff schedule, Decisions on application of trade remedy measures, and other relevant legal normative documents, the official shall propose to the leadership to take samples for analysis and classification or for inspection and assessment of technical criteria using machinery and equipment at the customs inspection authority or for inspection and testing and carry out subsequent procedures as prescribed; promptly and fully update relevant information of the Request form for analysis/inspection and assessment of technical criteria using machinery and equipment/inspection/testing combined with the sampling minutes at function 1.03.01 “Input request form” on the MHS system before sending the sample.

d) For consignments of exported or imported goods from which samples are taken and sent for analysis and classification or for inspection and assessment of technical criteria using machinery and equipment at the customs inspection authority or for inspection and testing, immediately upon receipt of the Classification result notification, Analysis result notification with HS code, Notification of inspection and assessment of technical criteria results, or Inspection and testing certificate of the sampled consignment, the customs official shall proceed in accordance with Article 13.

Article 12. Procedures for sampling, sample submission, analysis and classification or inspection and assessment of technical criteria using machinery and equipment at the customs inspection authority or inspection and testing

Article 13. Use and update of Classification result notification, Analysis result notification with HS code, Notification of inspection and assessment of technical criteria results, Inspection and testing certificate

For consignments of exported or imported goods from which samples are taken and sent for analysis and classification or for inspection and assessment of technical criteria using machinery and equipment at the customs inspection authority or for inspection and testing, within 5 working days from the date of receipt of the Classification result notification, Analysis result notification with HS code, Notification of inspection and assessment of technical criteria results, or Inspection and testing certificate, the customs official shall proceed as follows:

1. Where the declared goods name, goods description, and HS code are consistent with those stated in the Classification result notification or Analysis result notification with HS code, and goods name and goods description are consistent with the Notification of inspection and assessment of technical criteria results or Inspection and testing certificate, without changing the declared HS code, the customs official shall accept the declared contents and update the inspection result in the “Update handling officer’s opinion” box on the VCIS system.

2. Where the declared goods name, goods description, and HS code differ from those stated in the Classification result notification or Analysis result notification with HS code, or goods name and goods description differ from the Notification of inspection and assessment of technical criteria results or Inspection and testing certificate, resulting in change of the declared HS code, the customs official shall re-determine the HS code and notify the declarant to make supplementary declaration in accordance with Article 20 of Circular No. 38/2015/TT-BTC amended by Circular No. 39/2018/TT-BTC and Circular No. 121/2025/TT-BTC by “Customs instruction” through IDA01/EDA01 operation (code A) on the VNACCS system.

Where the declarant fails to make supplementary declaration within 5 working days from the date of receipt of the customs authority’s request, the customs official shall record in the “Update handling officer’s opinion” box on the VCIS system, re-determine the HS code and duty rate, impose tax assessment, carry out violation handling procedures (if any) in accordance with regulations, and update the adjusted HS code result at function 1.01.07 of the MHS system.

Chapter 3

UNIFICATION OF GOODS CLASSIFICATION AND APPLICATION OF DUTY RATES

Article 14. Verification of goods name, goods description, HS code, duty rate, and unit of measure for customs declarations under channel 1 at Regional Customs Sub-Departments

1. Subjects of examination: customs documents of goods under channel 1 within 60 days from the date of declaration registration, selected on the basis of risk management application or information reflecting signs of violation.

* Where the HS code coincides with a code listed in the list of exported and imported goods at risk in goods classification and application of duty rates, examine information according to guidance to accurately determine export duty, import duty, and additional import duty.

* Goods under headings detailed at serial number 211 of the Export tariff schedule but without declaration or declaring export duty rate of 0%.

* Declaration under tariff code B02: examine classification method, conditions, and procedures for application in accordance with Chapter 98.

* HS code coinciding with a code listed under tariff code B17 but without declaration of the duty rate under Chapter 98 and tariff code B17.

* Goods subject to directives, rectification documents, or enhanced inspection and control measures.

* Goods with identical or similar description but declared under different HS codes.

* Imported goods under the automobile components tariff incentive program and the automobile supporting industry program.

* Cases of importation of mechanical processing machines  must be compared with the list of domestically produced goods.

b) Physical inspection of goods (where necessary and conditions permit) in accordance with clause 2 Article 11 of this Procedure.

3. Handling of examination results:

a) Where goods have not passed the customs supervision area:

a.1) Where signs of customs law violations are detected such as inaccurate declaration of goods name, goods description, HS code, or duty rate, the customs official shall propose to the leadership to “Suspend goods from passing the customs supervision area” on E-Customs 5 and conduct physical inspection in accordance with clause 2 Article 11 of this Procedure, update inspection results, and notify the declarant to make supplementary declaration in writing (if any) in accordance with regulations.

After completing procedures as prescribed and determining that the consignment meets conditions to pass the supervision area, the customs official shall propose to the leadership to “Lift suspension of goods passing the customs supervision area” on the E-Customs 5 system.

a.2) Where risk signs are detected such as insufficient information to determine goods name, goods description, HS code, or duty rate, the customs official shall propose to the leadership to transfer information for post-clearance inspection in accordance with regulations.

b) Where goods have passed the customs supervision area:

b.1) Where there are sufficient grounds to determine that the declarant has incompletely or inaccurately declared goods name, goods description, HS code, duty rate, or unit of measure, written notice shall be sent to the declarant requesting supplementary declaration in accordance with Article 20 of Circular No. 38/2015/TT-BTC amended by Circular No. 39/2018/TT-BTC and Circular No. 121/2025/TT-BTC; update the adjusted HS code result at function 1.01.07 of the MHS system.

Where the declarant fails to make supplementary declaration within 5 working days from the date of receipt of the customs authority’s request, the customs official shall re-determine the HS code and duty rate, impose tax assessment, handle violations (if any) in accordance with regulations, and update the adjusted HS code result at function 1.01.07 of the MHS system.

4. Reporting of examination results:

a) Where inconsistent goods classification is identified within the unit, the official shall report to the leadership for unified guidance.

b) Where inconsistent goods classification is identified with another Regional Customs Sub-Department, report shall be made to the Customs Department (through the Customs Tax Administration Division).

c) Where it is detected that the declarant incorrectly applies the Advance ruling on tariff classification result notification or misuses information in the Advance ruling on tariff classification result notification to disguise declaration or inaccurately declare HS code for duty fraud or evasion of goods management policies, report shall be made to the Customs Department (through the Customs Tax Administration Division).

d) Evaluate violation cases, especially cases of disguised declaration of goods name, goods description, and HS code, and report to the Customs Department (through the Customs Tax Administration Division) where sector-wide notification and rectification are required.

Article 15. Unification of goods classification and application of duty rates at Regional Customs Sub-Departments

1. Subjects of examination: examination of declarations of the declarant and examination of professional performance of customs officials in goods classification and application of duty rates to ensure accurate and unified goods classification, one goods item corresponding to only one unique HS code under Vietnam’s list of exported and imported goods, and correct application of duty rates in accordance with regulations.

2. Data and information sources for examination:

- Export and import declaration data of the unit and of the sector;

- Guidance and rectification documents of the Customs Department, Advance ruling on tariff classification result notifications, Analysis and classification result notifications;

- Other collected information sources.

3. Examination methods:

a) On the basis of data and information collected under clause 2 of this Article, the assigned customs official shall filter and analyze to identify risk criteria, such as:

- Goods with identical or similar goods name and goods description but different HS codes.

- Goods declared without full 10-digit HS code as required.

- Goods declared with duty rate not in accordance with regulations.

- Goods subject to incorrect application of the tariff schedule.

- Goods declared with insufficient description criteria for classification under Vietnam’s list of exported and imported goods, the Export tariff schedule, the Import tariff schedule, and Decisions on application of trade remedy measures.

4. Handling of examination results:

a) Instruct enterprises to make supplementary declaration and impose tax assessment, handle violations (if any) in accordance with regulations for declarations determined to be inaccurate or incomplete regarding goods name, goods description, HS code, duty rate, or unit of measure;

b) Clarify responsibilities of officials for violations in the course of performance of official duties and handle violations in accordance with regulations (if any);

c) Report results periodically in accordance with Decision No. 636/QD-CHQ dated June 2, 2025 of the Customs Department on the list of periodic reports of the customs sector;

d) The Regional Customs Sub-Department shall make ad hoc report to the Customs Department (through the Customs Tax Administration Division) where inconsistencies or lack of uniformity are detected in goods classification within the sector, inconsistencies in legal normative documents, guidance documents, Classification result notifications, Advance ruling on tariff classification result notifications, issues beyond competence, or violation cases requiring sector-wide warning and rectification.

Article 16. Unification of goods classification and application of duty rates at the Customs Department

1. Subjects of examination: examination of performance of goods classification and application of duty rates by professional units under the Customs Department to ensure compliance with regulations, sector-wide consistency, and adherence to the principle that one goods item corresponds to only one unique HS code under Vietnam’s list of exported and imported goods.

2. Examination contents and handling of examination results:

a) Examination of issuance and application of Advance ruling on tariff classification result notifications:

The Customs Tax Administration Division shall examine issuance of Advance ruling on tariff classification result notifications to ensure officials comply with Section 1 of this Procedure. Where inaccurate or inconsistent issuance is detected, report shall be made to the leadership and handling measures proposed.

a.2) Examination of application:

Examine and review system data and reports of Regional Customs Sub-Departments on application of Advance ruling on tariff classification result notifications in accordance with point c clause 4 Article 14 of this Procedure. Where it is detected that the declarant fails to declare or incorrectly applies the Advance ruling on tariff classification result notification, consolidate and reassess the enterprise’s compliance level and the risk level of goods in classification and application of duty rates, report to the leadership, and propose handling measures.

b) Examination of issuance and application of Classification result notifications and Analysis result notifications with HS code:

b.1) The Customs Inspection Sub-Department shall examine issuance of Classification result notifications and Analysis result notifications with HS code to ensure officials comply with the Procedure on analysis and classification of exported and imported goods and inspection and assessment of technical criteria of goods using machinery and equipment at the customs inspection authority; ensure analysis results reflect the true nature of goods and contain sufficient criteria and information for accurate and consistent HS code determination within the unit.

b.2) On a monthly basis, the Customs Inspection Sub-Department shall report results of examination of analysis and classification activities to the Customs Department (through the Customs Tax Administration Division) in accordance with the Coordination Regulation between the Customs Inspection Sub-Department and the Customs Tax Administration Division at email address: [email protected].

b.3) The Customs Inspection Sub-Department shall make ad hoc report to the Customs Department (through the Customs Tax Administration Division) where inconsistencies or inadequacies are detected in legal normative documents, guidance documents, Classification result notifications, Analysis result notifications with HS code, Advance ruling on tariff classification result notifications, or complex cases beyond competence.

b.4) The Customs Tax Administration Division shall review reports of the Customs Inspection Sub-Department and reports of Regional Customs Sub-Departments relating to application of Classification result notifications and Analysis result notifications with HS code, report to the leadership, and propose handling measures for arising issues.

c) Examination of goods classification and application of duty rates through inspection and investigation programs:

d) Examination and review of system data and reports of Regional Customs Sub-Departments:

The Customs Tax Administration Division shall review system data on the basis of risk management and information reflecting signs of violation, and review reports of Regional Customs Sub-Departments on goods classification and application of duty rates. Where inaccurate or inconsistent goods classification or application of duty rates is detected, report shall be made to the leadership for issuance of guidance, warning, and rectification documents.

The Duty Monitoring Unit of the Customs Department, during direct supervision of units’ activities on the online monitoring system, where violations in goods classification and application of duty rates are detected, shall handle in accordance with the Duty Monitoring Regulation and transfer violation information to the Customs Tax Administration Division for monitoring. Where necessary, the Customs Tax Administration Division shall report to the leadership to propose issuance of sector-wide warning and rectification documents.

dd) Examination through handling of incidents, petitions, and difficulties of enterprises regarding goods classification.

On the basis of information obtained from daily case handling and settlement of difficulties and petitions of enterprises regarding classification, the Customs Tax Administration Division shall examine, assess, and review on the system and, where necessary, report to the Customs Department for issuance of guidance, direction, and sector-wide rectification documents.

Chapter 4

HANDLING OF ISSUES BEYOND COMPETENCE IN GOODS CLASSIFICATION AND APPLICATION OF DUTY RATES

Article 17. For Regional Customs Sub-Departments

Article 18. For other professional units under the Customs Department

In the course of performing assigned duties, units shall rely on legal normative documents on goods classification, customs databases, and guidance and direction documents of the Ministry of Finance and the Customs Department, compare with customs documents and relevant materials, physical inspection results or analysis and inspection results to examine and determine goods name, goods description, HS code, duty rate, and unit of measure in accordance with regulations. Where full compliance with the above-mentioned grounds has been ensured but classification issues remain, units shall send written exchange to the Customs Tax Administration Division, including:

1. Written exchange on goods classification, clearly stating the issue; basis and handling process; nature of goods (composition, structure, material, physical and chemical properties, features, uses, operating mechanism); grounds and classification viewpoint.

2. Customs documents and relevant documents and materials.

3. Inspection minutes and other relevant materials.

4. Minutes of the unit’s internal meeting on determination of HS code (if any).

The Customs Tax Administration Division shall receive and examine issue dossiers from Regional Customs Sub-Departments and units under the Customs Department:

1. Where the report contents and dossier are sufficient and clear, propose and coordinate with relevant units (if necessary) to handle in accordance with regulations:

a) Where no consultation with other units is required, submit to the Customs Department within a maximum of 10 working days from the date of receipt of complete dossier as requested;

b) Where goods have complex technical structure requiring clarification of technical criteria, structure, composition, etc. for classification, request the Customs Inspection Sub-Department to clarify for handling. The Customs Inspection Sub-Department shall reply within 10 working days from receipt of the request. The Customs Tax Administration Division shall consolidate and submit to the Customs Department within a maximum of 5 working days from receipt of complete dossier, required information, and opinions of the Customs Inspection Sub-Department;

c) For complex cases requiring consultation with external agencies or units, or where goods require application of specialized standards for classification and consultation with relevant specialized regulatory agencies is necessary, a written request for opinions shall be sent within 10 working days. The Customs Tax Administration Division shall consolidate and submit to the Customs Department within 5 working days from receipt of full opinions of the consulted units.

2. Where the report contents and dossier do not meet requirements or are incomplete or unclear as guided in Articles 17 and 18 of this Procedure, return the dossier within 5 working days from the date of receipt for completion by the Regional Customs Sub-Departments and units under the Customs Department.

a) Heads of Regional Customs Sub-Departments:

a.1) Implement internal inspection and control regulations for customs procedures, customs inspection, and supervision in accordance with regulations.

a.2) Assign officials trained in goods classification, with skills and practical experience, to determine goods name, goods description, and HS code accurately.

a.3) Organize practical training courses for officials engaged in goods classification at the unit on skills in assessing suspicion based on risk information to carry out customs procedures in compliance with regulations; develop guidance manuals on goods classification inspection and system update.

a.4) Develop a team of experts in goods classification, ensuring staff rotation is aligned with specialized professional duties to avoid waste of trained human resources.

a.5) Arrange resources to promptly and fully update data information of units on the MHS system in accordance with regulations.

b) Head of the Customs Tax Administration Division:

b.1) Arrange human resources to promptly handle issues arising from Regional Customs Sub-Departments, organizations, and individuals regarding application of HS code and duty rates across the sector.

b.2) Organize examination of implementation by Regional Customs Sub-Departments on goods classification and application of duty rates through system-based review, dossier review, and on-site inspection at customs offices where necessary.

b.4) Organize training on goods classification and provide updated information on classification decisions and recommendations of the World Customs Organization.

b.5) Organize inspection of timely and complete update of data information of units on the MHS system in accordance with regulations.

b.6) Direct advisory, proposal, and signing for issuance of Advance ruling on tariff classification result notifications in accordance with regulations and delegation of the leadership.

c) Head of the Customs Inspection Sub-Department:

c.1) Direct advisory and proposal for issuance of Classification result notifications and Analysis result notifications with HS code in compliance with law.

c.2) Organize inspection of sample submission for analysis and classification to ensure correct subjects, correct criteria, and correct dossier in accordance with regulations.

c.3) Promptly handle issues arising in relation to Classification result notifications and Analysis result notifications with HS code.

c.4) Arrange resources to timely and fully update data information of Classification result notifications and Analysis result notifications with HS code on the MHS system in accordance with regulations.

d) Head of the Information Technology and Customs Statistics Division shall:

d.2) Arrange resources to maintain and ensure stability and security of the database on goods classification and application of duty rates during update, use, and operation;

d.3) Direct handling of technical incidents arising during operation and use of the database on goods classification and application of duty rates.

dd) Heads of the Post-Clearance Audit Sub-Department, Inspection Division, Anti-Smuggling Investigation Sub-Department, and Customs Supervision and Management Division shall:

dd.1) Arrange resources for inspection and control to ensure correct application of HS code and duty rate in inspection, audit, and investigation conclusions and in specialized lists;

dd.2) Promptly exchange information with the Customs Tax Administration Division upon detection of inconsistencies in HS code, duty rate, and other related matters during performance of assigned functions and duties;

dd.3) Arrange human resources to timely and fully update data information of units on the MHS system in accordance with regulations.

e) Office of the Customs Department:

Arrange resources to update contents of Advance ruling on tariff classification result notifications, annulment of Advance ruling on tariff classification result notifications, and amendment or replacement of Advance ruling on tariff classification result notifications on the Cces system and on the website of the Customs Department in accordance with regulations.

2. Customs officials shall receive, examine, handle, report, circulate, issue, update, and archive documents in accordance with regulations.
