SỬA ĐỔI, BỔ SUNG, BÃI BỎ MỘT SỐ NỘI DUNG CỦA THÔNG TƯ SỐ 60/2011/TT- BNNPTNT NGÀY 9/9/2011 CỦA BỘ NÔNG NGHIỆP VÀ PHÁT TRIỂN NÔNG THÔN HƯỚNG DẪN KIỂM TRA VỀ CHẤT LƯỢNG MUỐI NHẬP KHẨU

Căn cứ Nghị định số 01/2008/NĐ-CP ngày 03 tháng 01 năm 2008 của Chính phủ quy định chức năng, nhiệm vụ, quyền hạn và cơ cấu tổ chức của Bộ Nông nghiệp và Phát triển nông thôn; Nghị định số 75/2009/NĐ-CP ngày 10 tháng 9 năm 2009 của Chính phủ về việc sửa đổi Điều 3 Nghị định 01/2008/NĐ-CP;

Bộ Nông nghiệp và Phát triển nông thôn sửa đổi, bổ sung, bãi bỏ một số nội dung của Thông tư số 60/2011/TT-BNNPTNT ngày 09 tháng 9 năm 2011 của Bộ Nông nghiệp và Phát triển nông thôn hướng dẫn kiểm tra về chất lượng muối nhập khẩu (sau đây gọi là Thông tư số 60/2011/TT-BNNPTNT) như sau:

Điều 1. Sửa đổi, bổ sung, thay thế, bãi bỏ một số nội dung tại Thông tư số 60/2011/TT-BNNPTNT như sau:

1. Bãi bỏ nội dung về công bố hợp chuẩn quy định tại khoản 2 Điều 3; khoản 1 Điều 7; điểm c khoản 3 Điều 7; Phụ lục II, Phụ lục III.

2. Sửa đổi, thay thế cụm từ "trước khi nhập khẩu người nhập khẩu phải công bố tiêu chuẩn áp dụng phù hợp với tiêu chuẩn kỹ thuật" bằng cụm từ " phải đáp ứng Tiêu chuẩn quốc gia TCVN 3974-2007 về muối thực phẩm, Quy chuẩn kỹ thuật quốc gia QCVN 8-2:2011/BYT đối với giới hạn ô nhiễm kim loại nặng trong thực phẩm" tại khoản 2 Điều 5.

3. Sửa đổi, thay thế cụm từ " tiêu chuẩn công bố áp dụng" bằng cụm từ "Tiêu chuẩn quốc gia TCVN 3974-2007 về muối thực phẩm, Quy chuẩn kỹ thuật quốc gia QCVN 8-2:2011/BYT đối với giới hạn ô nhiễm kim loại nặng trong thực phẩm" tại khoản 2 Điều 8; điểm a, điểm b khoản 2 Điều 9; khoản 1, khoản 3 Điều 10.

Điều 2. Hiệu lực thi hành

1. Thông tư này có hiệu lực thi hành kể từ ngày 24 tháng 10 năm 2011.

2. Cục trưởng Cục Chế biến, Thương mại nông lâm thuỷ sản và Nghề muối, Chánh văn phòng Bộ, Thủ trưởng các đơn vị thuộc Bộ và các tổ chức, cá nhân có liên quan chịu trách nhiệm thi hành Thông tư này./.

CIRCULAR

AMENDING AND ANNULLING SOME CONTENTS OF THE CIRCULAR NO. 60/2011/TT- BNNPTNT DATED SEPTEMBER 09TH 2011 OF THE MINISTRY OF AGRICULTURE AND RURAL DEVELOPMENT, GUIDING THE INSPECTION OF IMPORTED SALT QUALITY

Pursuant to the Government's Decree No. 01/2008/ND-CP dated January 03^rd 2008, defining the functions, tasks, powers and organizational structure of the Ministry of Agriculture and Rural development, the Government's Decree No. 75/2009/ND-CP dated September 10^th 2009, amending Article 3 of the Decree No. 01/2008/ND-CP;

The Ministry of Agriculture and Rural development amends and annuls some contents of the Circular No. 60/2011/TT- BNNPTNT dated September 09^th 2011 of the Ministry of Agriculture and Rural development, guiding the inspection of imported salt quality (hereinafter referred to as the Circular No. 60/2011/TT-BNNPTNT) as follows:

Article 1. Some contents in the Circular No. 60/2011/TT-BNNPTNT is amended and annulled as follows:

1. Annul the part about Declaration of conformity in Clause 2 of Article 3; Clause 1 of Article 7, Point c Clause 3 of Article 7; Annex II, and Annex III.

2. The phrase “The importer must obtain the Declaration of conformity with technical standards before importing” is replaced with the phrase “The National Standard TCVN 3974-2007 on table salt and the National Technical Regulation QCVN 8-2:2011/BYT on the limits on heavy metal contamination in food must be complied with” in Clause 2 of Article 5.

3. The phrase “applicable standards” is replaced with the phrase “The National Standard TCVN 3974-2007 on table salt and the National Technical Regulation QCVN 8-2:2011/BYT on the limits on heavy metal contamination in food” in Clause 2 of Article 8; Point a and Point b Clause 2 of Article 9; Clause 1 and Clause 3 of Article 10.

1. This Circular takes effect on October 24^th 2011.

2. The Director of the Department of Agricultural, Forestry, Aquatic Products and Salt, The Chief of the Ministry Office, heads of Ministerial units, relevant organizations and individuals are responsible for the implementation of this Circular./.
