CIRCULAR

GUIDING THE RE-EXPORT OF LOG TIMBER WITH LAWFUL IMPORT ORIGIN FROM CAMBODIA

Pursuant to the Governments Document No.02/CP-KTTH of January 13, 1998 on the import of Cambodian timber and Document No.1455/CP-KTTH of December 10, 1998 on the re-export of log timber with lawful import origin from Cambodia;
The Ministry of Trade guides the re-export of log timber with lawful import origin from Cambodia as follows:

I. GENERAL PROVISIONS:

1. All enterprises that hold business registration certificates with appropriate goods lines, have already registered export/import enterprises code numbers and have log timber lawfully imported from Cambodia shall be entitled to file applications for re-export thereof according to this Circulars provisions.

2. Log timber mentioned in this Circular includes all kinds of log timber exploited from natural and planted forests with lawful import origin from Cambodia.

II. DOSSIERS OF APPLICATION FOR RE-EXPORT:

1. For cases where the enterprise applying for re-export is also the one that has imported log timber:

- The copy of the import customs declaration already liquidated (enclosed with the original for comparison and back subtraction. Such original shall be returned to the enterprise).

- The copy of the business registration certificate and the certificate of registration of export/import enterprises code number.

- The document of the ranger sub-department of the locality where the enterprise rallies timber, certifying the quantity and category of the timber with lawful import origin from Cambodia (with Cambodias hammer stamp).

- The re-export contract.

2. For cases where the re-exporting enterprise is not the one that has imported log timber:

In addition to the dossiers prescribed in Point 1 above, the concerned enterprise shall have to produce the original of the sale/purchase contract signed with the importing enterprise.

III. IMPLEMENTATION PROVISIONS:

The export of sawn timber and wood products made from timber with lawful import origin from Cambodia shall comply with Decision No.65/1998/QD-TTg of March 24, 1998 of the Prime Minister on the export of wood and forest products and import of wood materials and forest products and Decision No.136/1998/QD-TTg of July 31, 1998 of the Prime Minister on the amendments to a number of regulations on the procedures for export of wood and forest products.
