CIRCULAR
ON
ISSUANCE OF LIST OF PLANT QUARANTINE ARTICLES; THE LIST OF PLANT
QUARANTINE ARTICLES SUBJECT TO THE PEST RISK ANALYSIS BEFORE BEING IMPORTED
INTO VIETNAM
Pursuant to Decree No.
105/2022/ND-CP dated December 22, 2022 of the Government on function, tasks,
powers, and organizational structure of the Ministry of Agriculture and Rural
Development;
Pursuant to Law on Plant
Protection and Quarantine dated November 25, 2013;
At the request of the Director
General of Department of Plant Protection.
The Ministry of Agriculture and
Rural Development issues the list of plant quarantine articles; the list
of plant quarantine articles subject to the pest risk analysis before being
imported into Vietnam.
Article 1. List of plant
quarantine articles
1. Plants:

2. Plant-based products:
Various types of tubers, bulbs,
fruits, seeds, flowers, leaves, plant bodies, stems, roots, barks;
b) Various types of grains, broken
seeds, oil cakes, tapioca, raw natural fibers and botanic fibers;
c) Flour extracted from plants,
tapioca starch;
d) Tobacco stems, raw cotton, waste
cotton, straw, thatch and aquatic plants (excluding algae, seaweed, marine
aquatic plants);
dd) Round wood, timber, wood
pallets, sawdust, coconut sawdust;
e) Plant-based animal feed
materials (excluding fully packaged and labeled feed);
g) Plant-based growing medium.
3. Various types of mushrooms
(excluding salted, pickled, frozen, canned mushrooms and yeasts).

5. Various types of insects,
spiders, pathogenic fungus, nematodes, germs, viruses, phytoplasmas, viroids
and noxious weeds (excluding biospecimens) used for testing, training,
biological control and scientific research.
6. Where the exportation of
articles that are not specified in the List in accordance with this Article,
the plant inspection shall be carried out at the request of importing countries
and International Agreements of which Vietnam is the signatory.
Article 2. List of plant
quarantine articles subject to the pest risk analysis before being imported
into Vietnam
1. Propagating material: Plant
varieties, seedlings, tubers for propagation, and parts of plants that can be
used for propagation (excluding tissue-cultured plants, seeds from the
cruciferous family, wheat, maize, millet, onion, garlic seeds).
2. Fresh fruits, fresh sweet
potatoes, fresh potatoes.
3. Weeds and weed seeds for
planting purpose.
4. Beneficial organisms used in
plant protection industry (excluding beneficial organisms imported as
biological pesticide).
5. Other plant quarantine articles
likely to carry quarantine plant pests shall be identified by the Plant
Protection Department for submission to the Minister of Agriculture and Rural
Development for his decision.

1. Plant varieties that serve the
purpose of scientific researches or testing and evaluation in laboratories;
2. Beneficial organisms used in
plant protection industry that serve the purpose of scientific researches or
testing and evaluation in laboratories.
3. In some other cases, the
Director General of Department of Plant Protection shall request the decision
from the Minister of Agriculture and Rural Development.
4. The importation of articles
stipulated in Clauses 1, 2 and 3 of this Article must be licensed to conduct
imported plant quarantine and must undergo plant inspection in accordance with
law.
Article 4. Transition clauses
1. Applications for issuance of
Phytosanitary Certificate for articles under the List of plant quarantine
articles; License to conduct imported plant quarantine for articles under the
List of plant quarantine articles subject to the pest risk analysis before
being imported into Vietnam, that are submitted before the effective date of
this Circular, shall be handled in accordance with Circular 30/2014/TT-BNNPTNT
dated September 05, 2014 of the Ministry of Agriculture and Rural Development
issuing the List of plant quarantine articles; the List of plant quarantine
articles subject to the pest risk analysis before being imported into Vietnam.
2. If an article is (i) subject to
plant quarantine and pest risk analysis before import into Vietnam, (ii) has
been granted the import license before the effective date of this Circular, but
(iii) there is evidence that it recently appears in the exporting country, the
plant quarantine authority of the exporting country must notify the Department
of Plant Protection for timely prevention of the import of this product.
Article 5. Implementation

1. This Decree shall come into
force from December 15, 2024.

Article 6. Implementation
1. The Chief of Office of the
Ministry, Director General of the Department of Plant Protection, relevant
organizations and individuals are responsible for implementing this Circular.
2. During the implementation
process, if there are any problems that arise, organizations and individuals
must promptly report to the Ministry of Agriculture and Rural Development
(Department of Plant Protection) for review and decision./.
