CIRCULAR
PROMULGATING
CONSTRUCTION NORMS
Pursuant to the Government’s Decree No.
81/2017/ND-CP dated July 17, 2017 defining the functions, tasks, powers and
organizational structure of the Ministry of Construction;
Pursuant to the Government’s Decree No.
68/2019/ND-CP dated August 14, 2019 on construction cost management;
At the request of the Director of the Institute
of Construction Economics and the Director of the Department of Construction
Economics;
The Minister of Construction hereby promulgates
a Circular on construction norms.
Article 1. Scope
The following construction norms are promulgated
together with this Circular: norms of construction survey cost estimates; norms
of construction cost estimates; norms of technical system installation cost
estimates; norms of machinery and equipment installation cost estimates; norms
of specialized construction testing cost estimates; norms of construction
work repair and maintenance cost estimates; and construction material use
norms. Construction norms mentioned in this Circular shall be applied to
determine construction investment costs of projects funded by state budget and
external-source state capital and public-private partnership (PPP) construction
investment projects.

1. This Circular applies to organizations and
individuals involved in the determination of construction investment costs of
projects funded by state budget and external-source state capital and PPP
construction investment projects specified in Clause 1 Article 2 of the
Government’s Decree No. 68/2019/ND-CP dated August 14, 2019.
2. Investment projects funded by other capital may
apply construction norms set forth in this Circular to determine construction
investment costs as the basis for discharge of financial obligations to the
State.
Article 3. Transition
Construction norms shall be applied as prescribed
in Article 36 of the Decree No. 68/2019/ND-CP as follows:
1. Regarding ongoing investment projects approved
before the effective date of the Government’s Decree No. 68/2019/ND-CP, the
construction norms specified in the Government's Decree No. 32/2015/ND-CP dated
March 25, 2015 shall be applied. In case a construction contract has not yet
been signed after the effective date of this Circular, the investment decider
shall decide to apply the construction norms prescribed in this Circular to
adjust the construction contract package value provided that project progress
and proficiency requirements are met.
2. Regarding a construction investment project
approved after the effective date of the Decree No. 68/2019/ND-CP:
a) In case the construction contract package for which
the construction norms have been applied under the Decree No. 32/2015/ND-CP to
determine the construction contract package value, a contractor has been
selected and a construction contract has been signed before the effective date
of this Circular, the signed contract shall prevail.
b) In case the construction contract package for
which a contractor has not yet been selected or is being selected before the
effective date of this Circular, construction norms set forth in this Circular
shall be applied to update the construction contract package value.
3. For the construction contract signed before the
effective date of this Circular at the adjusted unit price, the contract price
shall be adjusted under the signed contract and regulations applied to the contract.

2020.
