CIRCULAR
DOSSIERS ON TASKS AND PROJECTS ON INTER-DISTRICT, DISTRICT AND
SPECIAL PURPOSE ZONE CONSTRUCTION PLANNING; URBAN AND RURAL PLANNING
Pursuant to Clause 3 Article 18
of the 2009 Law on Urban Planning amended in the 2019 Law on amendments to some
Articles concerning planning of 37 Laws;
Pursuant to Clause 5 Article 27
of Government’s Decree No. 44/2015/ND-CP dated May 06, 2015 on detailed
regulations on construction planning; amended in Decree No. 72/2019/ND-CP dated
August 30, 2019 on amendments to a number of Articles of Decree No.
37/2010/ND-CP dated April 07, 2010 on formulation, appraisal, approval and
management of urban planning and Decree No. 44/2015/ND-CP dated May 06, 2015 on
detailed regulations on construction planning (hereinafter referred to as
“Decree No. 37/2010/ND-CP and Decree No. 44/2015/ND-CP”);
Pursuant to Government’s Decree
No. 52/2022/ND-CP dated August 08, 2022 on functions, duties, powers and
organizational structure of the Ministry of Construction;
At request of Director of
Department of Planning - Architecture,
The Minister of Construction
hereby issues a Circular on dossiers on tasks and projects on inter-district,
district and special purpose zone construction planning; urban and rural
planning.

Article 1.
Scope and regulated entities
1. This
Circular stipulates contents of dossiers on tasks and projects on
inter-district, district and special purpose zone construction planning; urban
and rural planning (hereinafter referred to as “urban and rural planning”)
2. Domestic
and overseas entities that directly participate or engage in urban and rural
planning within the territory of Vietnam shall comply with regulations of this
Circular.
Article 2.
General provisions for specifications
1. The
contents of descriptions, drawings of tasks and projects in the documents on
collection of opinions and the documents that have been submitted for appraisal
and approval shall be clearly and fully stated for each type and level of
planning and comply with regulations of Chapter II and Appendices of this
Circular.
2. Drawing
abbreviations and symbols of tasks and projects on urban and rural planning
shall comply with regulations of Appendices of this Circular.
3. According
to conditions and characteristics of the planned inter-district, district,
urban and rural areas and special purpose zones, the maps and diagrams can be
established for each orientation and current status of technical infrastructure
in order to ensure presentation of all contents as required.
4. In case
the regional planning or the provincial planning has not been approved, the
urban-rural system development orientation map; urban-rural system planning
map; land use planning map at provincial level; map of organization of space
and zoning of special purpose zone in regional and provincial planning shall be
replaced by space development orientation diagrams in the province construction
planning that has been approved.
5. All
diagrams and maps in the drawings of the dossiers on tasks and projects on
urban and rural planning shall clearly show the boundaries of planning; the
boundaries and names of administrative units within the planning scope; name of
administrative unit adjacent to the perimeter of the planning area.

Section I.
DOSSIERS ON TASKS AND PROJECTS ON INTER-DISTRICT AND DISTRICT CONSTRUCTION
PLANNING (HEREINAFTER REFERRED TO AS “DISTRICT PLANNING”)
Article 3.
Contents of dossiers on tasks in district planning
1. The
drawing includes the diagram of location and regional relationship; map of the
boundaries and scope of the planned region. The drawing shall be shown in
the urban-rural system planning map in the provincial planning at the
appropriate scale.
2. Description
of tasks in district planning includes:
a) Reasons and necessity of
planning, grounds for planning The inter-district construction planning shall
have the basis rationales for identification of the scale, scope and the
boundaries of the planned region.
b) Overview of natural features
and current status of the planned region; development orientations and planning
options in relevant planning that affect the planned region. Overview of
existing problems that must be handled in the district planning.
c) Identification of viewpoints
and objectives of planning; properties and functions of the district.
d) Basis and method of
identification of the driving force of development of the planned region;
preliminary forecast about population, land, urbanization rate, economic development,...;
proposal for indicators for technical and social infrastructure according to
each stage of development.

e) Requirement for main contents
of district planning
g) Identification of the list of
drawings, descriptions and attached appendices; the quantity and specifications
of the dossiers on projects on planning; cost estimates; plans and progress in
planning; identification of requirements for contents, forms and enquired
entities.
3. Drafts of
the Proposal and Decision on approval for the planning.
Article 4.
Contents of dossiers on projects on district planning
1. The
drawing includes:
a) Diagram of location and
regional relationship: Location and boundary of the planned region; natural,
socio-economic and environmental relationships among regions in the provincial
planning that affect the planned regions. The diagram shall be shown in the
urban-rural system planning map in the provincial planning at the appropriate
scale.
b) Map of current status of
region: Natural conditions, current status of population distribution and land
use in the planned region; current status of social and technical
infrastructure systems at national, regional, provincial and district levels in
district as prescribed in Appendix II of this Circular. The drawing shall be
shown in the topographic map at the scale of 1/10.000 or 1/25.000
c) Development management zoning
map: Identification of the zoned regions for management. The drawing shall be
shown in the topographic map at the scale of 1/10.000 or 1/25.000
d) Space development orientation
map: Identification of the development space of urban areas and rural
residential areas; special purpose zones at national, provincial and district
levels according to regional planning, provincial planning and technical
planning; security and defense areas; administration, commerce - services,
culture, physical training and sports, research, training, healthcare center
development areas at district level or higher level; commune cluster and
commune center location; agricultural and forestry development areas,
historical-cultural relics, scenic spots and other economic-technical
establishments according to planning stages (as specified in Appendix II of
this Circular). The drawing shall be shown in the topographic map at the scale
of 1/10.000 or 1/25.000

2. The
description includes:
a) Reasons and necessity of
district planning; grounds for planning; location, scale and scope of the
planned region; viewpoints and objectives of the development of regions.
b) Analysis and assessment of
natural conditions, socio-economic status; current status of urban and rural
settlement distribution, fluctuations in population in the planned region;
current status of land use and management; current status of social and technical
infrastructure at national, regional, provincial and district levels; current
status of natural resources and environment; current status of programs and
projects on development investment for the planned region; assessment of
management and implementation of the planning, resource management and
environmental protection.
With regard to inter-district
construction planning, the description shall add the following contents:
assessment of cooperation in development among districts in the region; achievements
and limitations in the implementation of joint development of management and
implementation of planning as a basis for proposal for solutions in projects on
planning.
c) Identification of the driving
force and potential for development of the region; impacts of social and
technical infrastructure systems at national, regional and provincial levels on
the planned region.
d) Forecast about economic
development, population, labor, urbanization rate, land use demand,
environmental protection; risks of fluctuations, natural disasters, ...
dd) Zoning and requirement for
management and development of these zones.
e) Space development orientation:
Location, scale and organizational orientation of urban and rural development
areas; special purpose zones at national, provincial and district levels
according to regional planning, provincial planning and sectoral planning;
security and defense areas; agricultural and forestry development areas,
historical-cultural relics, scenic spots and other economic-technical
establishments Organization of allocation of the systems of
administration, commerce - services, culture, physical training and sports,
research, training, healthcare centers at the district level or higher level;
commune cluster and commune centers Identification of general urban planning;
general construction planning, zoning planning for construction of special
purpose zones and general commune planning that must be done according to
stages of the development.
g) Orientation to the development
of regional technical infrastructure system in terms of technical preparation,
traffic, electricity system, water supply, energy supply, water drainage and
wastewater treatment, waste management, cemeteries and passive
telecommunications infrastructure.

i) Proposal for solutions to
implementation of the planning after approval of the competent authority. With
regard to a region that includes many district-level administrative units, it
is required to propose models, mechanisms for management and cooperation in
development of inter-district regions.
k) Proposal for solutions to
environmental protection in the region.
3. Regulations
on management according to district planning: Contents shall comply with
regulations of Article 9 of Decree No. 44/2015/ND-CP and the diagrams must be
attached.
4. Drafts of
the Proposal and Decision on approval for projects on planning.
5. Appendix
attached to the description (explanations, additional rationales for description;
Illustrations; calculated data). The relevant legal documents must be attached.
Section 2.
DOSSIERS ON TASKS AND PROJECTS ON URBAN PLANNING
Article 5.
Contents of dossiers on tasks in general urban planning
The general urban planning covers central-affiliated
cities, cities of centrally-affiliated cities, district-level cities and
district-level towns, commune-level towns and new urban areas (including
grade-IV urban areas and above which have not been recognized as district-level
cities àn towns; new urban areas that are expected to be district-level cities
and towns; grade-V urban areas that have not been recognized as grade-V towns
and new urban areas). The planning shall comply with regulations of Clause 1 of
this Article.

b) Drawing in the general urban
planning which covers district-level cities and towns and new urban areas:
Diagram of location and relationship in national urban-rural system planning,
regional planning (for urban areas of grade III or above) and provincial
planning; map of the boundaries and scope of general urban planning. The drawing
shall be shown at the appropriate scale on national urban system development
orientation map; urban-rural system development orientation map (for urban
areas of grade III or above) and urban-rural system planning map.
2. The
description includes:
a) Reasons, necessity and grounds
for planning; location, scale and boundaries of general urban planning. With
regard to new urban areas, it is required to have sufficient rationales for the
scope and boundaries of planning.
b) Overview of natural features
and current status of urban areas; existing problems in the process of
management and development of urban areas. Orientation to development in
national planning, regional planning and urban development plans according to
urban development programs; planning options in the provincial planning and
projects in progress that affect the scope of general urban planning.
c) Identification of properties,
driving force and role of urban areas for the country, region and province;
viewpoints and objectives of planning; preliminary identification of main
problems that must be handled in planning.
d) Preliminary forecast about
socio-economic development, population, labor, occupation, land for urban,
rural residential area and technical infrastructure development.
dd) Requirement for the level of
survey, collection of documents and data, assessment of current status of urban
centers; requirement for status database.
e) Requirement for main contents
of general urban planning.
g) Identification of the list of
drawings, descriptions and attached appendices; the quantity and specifications
of the dossiers on projects on planning; cost estimates; plans and progress in
planning; identification of requirements for contents, forms and enquired
entities.

Article 6.
Contents of dossiers on projects on general planning for central-affiliated
cities
1. The
drawing includes:
a) Diagram of location and
regional relationship: Location, scale and boundary of planning; relationships
to nature, society and economy, environment, urban development space and
technical infrastructure in national and regional planning that affects the
planned city. The drawing shall be shown at the appropriate scale on national
urban-rural system development orientation map; urban-rural system development
orientation map.
b) Diagram of current status of
space development and technical infrastructure of the whole city: Location and
scale of special purpose zones, social and technical infrastructure system,
relic protection zones, scenic spots at national and regional level in the
city; location and scale of special purpose zones, urban centers and framework
technical infrastructure system in the city; scope and boundary of central
urban area; location of commune cluster center, commune center and concentrated
rural settlement. The drawing shall be shown in the topographic map at the
scale of 1/25.000 or 1/50.000.
c) Map of current status of
central urban area: Current status of land use functions as prescribed in
Appendix III of this Circular; landscape architecture, social infrastructure
system (education, health care, culture, commerce, trees, houses, ...);
technical infrastructure systems (traffic, electricity supply and lighting,
communications, water supply, elevation and rainwater drainage, wastewater
drainage; solid waste management, cemeteries and environment) . The drawing
shall be shown in the topographic map at the scale of 1/10.000 or 1/25.000
d) Map of general assessment of
land according to identification of appropriate criteria for assessment of
topography, current conditions, hydrogeology; land use (identification of
favorable, less favorable and unfavorable areas for the development of urban
functions...); identification of prohibited and restricted areas for urban
development. The drawing shall be shown in the topographic map at the scale of
1/10.000, 1/25.000 or 1/50.000.
dd) Urban development structure
diagram (including diagrams that analyse current status and propose options
enclosed with the descriptions of criteria for consideration and selection of
options): identification of main traffic system framework, linkage between main
special purpose zones, central areas and the direction of urban expansion development.
The drawing shall be shown in the topographic map at the appropriate scale.
e) Space development orientation
diagram of the whole urban area: Identification of location, scale of urban
areas in the city; scope of central urban areas; scale and scope of special
purpose zones at national and regional levels, agricultural and forestry
development areas, historical-cultural relics, scenic spots, ecological areas,
conservation areas, security and defense areas,...; location of commune
centers, commune cluster centers (if any), concentrated rural settlement.
Identification of spatial axes and urban development corridors of the city. The
drawing shall be shown in the topographic map at the scale of 1/25.000 or
1/50.000.
g) Technical infrastructure
development orientation diagram of the whole urban area: Identification of
network, location and scale of technical infrastructure works at national,
regional, provincial and urban levels in the city and contents specified at
Point a, Clause 6, Article 15 of Decree No. 37/2010/ND-CP according to each
sector, including: Technical preparation, traffic (down to inter-regional
roads), electricity system, water supply, energy supply, water drainage and
wastewater treatment, solid waste management, cemeteries, passive telecommunications
infrastructure and other technical infrastructure works. The drawing shall be
shown in the space development orientation diagram in combination with
topographic map at the scale of 1/25.000 or 1/50.000.

i) Map of land use planning in
central urban area: Location and scale of land use functions as prescribed in
Appendix III of this Circular; identification of population size, indicators
for population density and land use of each special purpose zone according to
the stages of development. The drawing shall be shown in the topographic map at
the scale of 1/10.000.
l) Map of orientation to the
development of systems for technical infrastructure and environmental
protection of central urban area: Contents shall comply with Point b, Clause 6,
Article 15 of Decree No. 37/2010/ND-CP. The drawing shall be shown in
land use planning map of central urban area in combination with
topographic map at the scale of 1/10.000 or 1/25.000.
m) Drawing for urban design:
Comply with regulations of Circular No. 06/2013/TT-BXD dated May 13, 2013 of
the Minister of Construction on guidance on contents of urban design and
Circular No. 16 /2013/TT-BXD dated October 16, 2013 of the Minister of
Construction on amendments to some Articles of Circular No. 06/2013/TT-BXD
dated May 13, 2016 of the Minister of Construction on guidance on contents of
urban design (hereinafter referred to as “Circular No. 06/2013/TT-BXD”).
2. The
description includes:
Contents of the descriptions:
a) Analysis of location,
assessment of natural conditions; current status of population, land use,
landscape architecture, social and technical infrastructure and environment.
Assessment of management and implementation of space development, land use and
technical infrastructure according to the approved planning. Assessment of
current status of construction and development investment programs and projects
that have been conducted in the city. Identification of underlying problems
that must be handled. The data shall be collected and presented in diagrams and
tables, accompanied by the brief and detailed descriptions.
b) Identification of objectives, properties
and the driving force of the city.
c) Identification of economic -
technical indicators for the whole city, each urban area and central urban
area.
d) Assessment and forecast about
impacts of natural and socio-economic conditions; analysis of orientations and
requirements of national planning, regional planning or technical planning that
has been approved for orientation to the development of the city. Forecast
about development indicators: urbanization rate, population size, land, social
and technical infrastructure for the whole city; each urban area, central urban
area and special purpose zone of urban area in the city.

e) Space development orientation:
Contents shall comply with Point a Clause 5 Article 15 of Decree No.
37/2010/ND-CP. Identification of the scope and limits of space
development of central urban area, district-level cities and towns of central-
affiliated cities; proposal for inner and outer urban areas; identification of
areas subject to urban zoning planning; special purpose zone construction
zoning planning; general commune planning according to the stages of planning.
g) Space development orientation
for central urban area: Contents shall comply with Point b Clause 5 Article 15
of Decree No. 37/2010/ND-CP. The system of centers is identified at the
national, regional and city level.
h) Orientation to land use
planning of the whole urban area and central urban area according to the stages
of planning. Identification of the scale of land use functions according to
regulations of Appendix III of this Circular in central urban area,
i) Urban design according to
regulations of Circular No. 06/2013/TT-BXD
k) Urban technical infrastructure
development orientation: Technical infrastructure development orientation in
the whole city and the technical infrastructure development orientation for the
central urban area as a basis for the implementation of technical
infrastructure planning projects for central- affiliated cities.
l) Proposal for solutions to
environmental protection in the region.
m) Proposal for the lists of prior
planning, programs and projects: rationales and identification of the lists of
planning, programs and projects given priority for investment according to
stages; proposal for resources for implementation.
3. Appendix
and drawing attached to the description: explanations, additional rationales
for description; tables and figures that show the results stated in the description;
drawings (A3 size) and relevant legal documents.
4. Regulations
on management according to general urban planning: Contents shall comply with
regulations of Clause 1 Article 35 of the Law on Urban Planning. The drawings
(A3 size) must be attached.

Article 7.
Contents of dossiers on projects on general planning for cities,
district-level towns and urban areas of grade-IV and above which have not
been recognized as cities or district-level towns; new urban areas that are
expected to be district-level cities or towns
1. The
drawing includes:
a) Diagram of location and
regional relationship: Location, scale and boundary of planning; relationships
to nature, society and economy, environment, urban development space and
technical infrastructure in national and regional planning (for urban areas of
grade III or above) and provincial planning (central- affiliated cities for
urban areas under central- affiliated cities) that affect the planned urban
areas. The drawing shall be shown at the appropriate scale on national urban
system development orientation map; urban-rural system development orientation
map (for urban centers of grade III or above) and urban-rural system planning
map (or space development orientation of the whole urban area for urban area of
central-affiliated cities
b) Map of current status: Current
status of land use functions as prescribed in Appendix III of this Circular;
landscape architecture, social infrastructure system (education, health care,
culture, commerce, trees, houses, ...); technical infrastructure systems
(traffic, electricity supply and lighting, communications, water supply,
elevation and rainwater drainage, wastewater drainage; solid waste management,
cemeteries and environment) . The drawing shall be shown in the topographic map
at the scale of 1/10.000.
c) Map of general assessment of
land according to appropriate criteria for assessment of topography, current
conditions, hydrogeology; assessment of legal status, land use: identification
of favorable, less favorable and unfavorable areas for the development of urban
functions; identification of prohibited and restricted areas for urban
development. The drawing shall be shown in the topographic map at the scale of
1/10.000.
d) Urban development structure
diagram (including diagrams that analyse current status and propose options
enclosed with the descriptions of criteria for consideration and selection of
options). The drawing shall be shown in the topographic map at the
appropriate scale.
dd) Space development orientation
map of urban area: Identification of zones with restricted potentials for
development, zones needing embellishment and renovation; new development zones
(identification of the scope and scale of residential areas, special purpose
zones at the national, regional, provincial and urban levels); conservation
areas; no-construction zones; development reserve zones, security and defense
areas; administration centers, commerce – services centers, culture centers,
physical training and sports centers, parks, trees, research, training,
healthcare and other specialized centers from urban level or higher levels;
areas where the underground works are expected to be built (urban areas of
grade III or above). Identification of spatial axes and open space of urban
area. Identification of rural residential zones. The drawing shall be shown in
the topographic map at the scale of 1/10.000.
e) Map of land use planning in
urban area according to the stages of planning: Location and scale of land use
functions as prescribed in Appendix III of this Circular. Identification of
population size and land scale of each special purpose zone; indicators for
population density and urban planning land according to the stages of
development. The drawing shall be shown in the topographic map at the scale of
1/10.000.
g) Technical infrastructure
development orientation map: Identification of network, location and scale of
technical infrastructure works at national, regional, provincial and urban
levels and contents specified at Clause 5, Article 16 of Decree No.
37/2010/ND-CP according to each sector, including: technical preparation,
traffic, electricity system, water supply, energy supply, water drainage and
wastewater treatment, solid waste management, cemeteries, passive
telecommunications infrastructure and other technical infrastructure works. The
drawing shall be shown in the map of urban land use planning according to
the stages of planning in combination with topographic map at the scale of
1/10.000.

2. The
description includes:
a) Analysis of location,
assessment of natural conditions; current status of population, land use,
landscape architecture, social and technical infrastructure and environment.
Assessment of management and implementation according to the approved
planning for space development, land use and technical infrastructure;
comparison and contrast with orientations and indicators in the approved
planning (if any); assessment of the current status of urban areas according to
standards and criteria for classification of urban areas. Assessment of current
status of programs and projects on development investment that have been
conducted. Identification of underlying problems that must be handled.
b) Identification of objectives,
properties and the driving force of the urban area.
c) Identification of economic -
technical indicators for urban areas and each special purpose zone of
urban areas.
d) Assessment and forecast about
impacts of natural and socio-economic conditions; national planning, regional
planning or technical planning that has been approved for orientation to the
development of urban areas. Forecast about development indicators: urbanization
rate, population size, land, social and technical infrastructure for urban
areas and special purpose zones of urban areas.
dd) Identification of principles
and criteria for selection for urban development structure options
e) Space development orientation:
Contents shall comply with Clauses 4 Article 16 of Decree No. 37/2010/ND-CP.
Proposal for inner and outer urban areas; identification of areas subject
to zoning planning and general commune planning according to the stages of
planning.
g) Urban land use planning
orientation according to the stages of planning. Identification of the
scale of land use functions according to regulations of Appendix III of this
Circular.
h) Urban designs: Comply with
regulations of Circular No. 06/2013/TT-BXD

k) Proposal for solutions to
environmental protection.
l) Proposal for the lists of prior
planning, programs and projects: rationales and identification of the lists of
planning, programs and projects given priority for investment according to the
stages of planning; proposal for resources for implementation.
The description of the project on
general planning for a city in a province or district-level town shall have
statistical tables, calculation appendices, illustrations and system of
diagrams and drawings (A3 size) with symbols and notes enclosed with each part
of the relevant description.
c) Appendix and drawing attached
to the description: explanations, additional rationales for description; tables
and calculation figures that show the results stated in the description;
drawings (A3 size) and relevant legal documents.
d) Regulations on management
according to general urban planning: Contents shall comply with regulations of
Clause 1 Article 35 of the Law on Urban Planning. The drawings (A3 size) must
be attached.
dd) Drafts of the Proposal and
Decision on approval for projects on planning.
Article 8.
Contents of dossiers on projects on general planning for district-level towns,
urban areas of grade V that have not been recognized as new towns and urban
areas of grade V
1. The
drawing includes:
a) Diagram of location and
regional relationship: Location, scale and boundary of planning; relationships
to nature, society-economy, environment, urban development space and technical
infrastructure in provincial planning (general planning for central-affiliated
cities) and district planning that affect the planned urban areas. The drawing
shall be shown at the appropriate scale on rural-urban system planning
orientation map; (or space development orientation diagram of the
central-affiliated city for urban area of the central-affiliated city) and
space development orientation diagram of the inter-district or district region
(if any).

c) Map of general assessment of
land according to appropriate criteria for assessment of topography, current
conditions, hydrogeology; land use value (identification of favorable and
unfavorable areas, less-favoured areas for the development of urban
functions...); identification of prohibited and restricted areas for urban
development. The drawing shall be shown in the topographic map at the scale of
1/5.000.
d) Urban development structure
diagram (including diagrams that analyse current status and propose options
enclosed with the descriptions of criteria for consideration and selection of
options). The drawing shall be shown in the topographic map at the scale
of 1/5.000.
dd) Space development orientation
map of urban area: Identification of zones needing embellishment and
renovation; new development zones (identification of the scope and scale of
unité d'habitations, special purpose zones at the national, provincial and
district levels (if any); conservation areas; no-construction zones;
development reserve zones and security and defense areas; administration
centers, commerce – services centers, culture centers, physical training and
sports centers, training centers, healthcare centers, green parks at
urban, district and provincial levels (if any). Identification of spatial axes

landscape architecture, social infrastructure system (education, health care,

supply, energy supply, water drainage and wastewater treatment, solid waste
management, cemeteries, passive telecommunications infrastructure and other
technical infrastructure works. The drawing shall be shown on map of land use
planning for special purpose zone according to the stages of planning in
combination with topographic map at the scale of 1/10.000.

1. Comply

April 07, 2010 on formulation, appraisal, approval and management of urban
planning and Decree No. 44/2015/ND-CP dated May 06, 2015 on elaboration of some
contents of construction planning.
2. Ensure
national set of criteria on new rural development at commune and district level
according to Decision of the Prime Minister.
Districts under the approved urban
general planning for central-affiliated cities and communes under the approved
urban general planning have met criteria for planning to considerate, assess
and recognize new rural districts and new rural communes.

Contents of dossiers on projects on general commune planning
1. The
drawing includes:
a) Diagram of location and
regional relationship: Identification of location, the boundaries of planning
(administrative boundaries of commune); socio-economic relationship between
communes and regions in the district; conditions for topography and regions
that have great influence on the landscape architecture of commune; focal
technical infrastructure and other issues that affect the development of commune.
The diagram shall be shown at an appropriate scale.
b) General map of current status
and assessment of construction land: land use, landscape architecture, social
infrastructure system (education, health care, culture, commerce, trees,
houses, ...); current status of traffic, electricity supply and lighting, water
supply, elevation and rainwater drainage, wastewater drainage; solid waste
collection, cemeteries and environment). Identification of favorable, less
favorable and unfavorable areas for the development of commune. The map shall

potential, driving force and forecast about the development of commune:
Forecast about the population size, labor, number of households for the 10-year
planning period and each 5-year sub-period. Forecast about the type and driving
force of key economic development: agro-forestry and agriculture-based economy;
animal husbandry; handicraft; agricultural production in combination with
tourism services; production scale, key products, market capabilities and
output orientation. Identification of the potential of land for the
transformation of land use structure (agricultural to non-agricultural or urban
land) to serve population, infrastructure and production. Identification of
scale of construction land for each type of public works and services at
commune, village or hamlet level; size and indicators for residential land for
each type of households including agricultural production households; handicraft
production households; commercial and service households in the whole commune.
d) Overall space planning
orientation of the commune: Orientation to organization of the system of
commune centers, new residential areas and renovation to villages and hamlets.
Identification of population size, properties and demands for residential land
for each new residential area and hamlet. Orientation to organize the system of
public works and services; identification of the location, scale and
architectural orientation to public works and services at commune, hamlet and
village level. Orientation to organization of space of architectural planning
of new residential areas and old villages and hamlets; identification of
criteria for the planning, architectural orientation for each type of dwellings
in conformity with the characteristics of the commune. Orientation to
organization of concentrated handicraft production areas, craft villages,
production areas and agricultural production areas. Orientation to organization
of combination of other special purpose areas in the commune according to
superior planning, sectoral planning, special purpose zones that support rural
economic development (if any).
dd) Contents of Regulation on
architectural management of rural settlements (integrated according to
regulations of Article 13 of Decree No. 85/2020/ND-CP dated July 17, 2020 of
the Government on elaboration of some Articles of the Law on Architecture).
e) Land use planning: The planning
for land types in the commune is updated according to the land use planning at
district-level. Identification of the land area for the demand for development
in stages of 5 years, 10 years and the main technical specifications for each
type of land including agricultural land, construction land and other types of
land. Synthesis of land use planning according to Appendix VIII of this
Circular.
g) Technical infrastructure
planning: Orientations to the planning for construction of the system of
technical infrastructure works, key technical infrastructure works within the
commune. Identification of infrastructure framework for production:
agricultural roads, irrigation canals. Identification of location and scale of
technical infrastructure works, including: commune trunk roads, inter-village
roads, village trunk roads, elevations, electricity supply, water supply, waste
treatment and cemeteries.

projects: identification of programs and projects given priority for investment
within the commune and the plan for implementation according to each stage.

submitted to the competent authority for approval for construction planning:
Reasons and necessity for local adjustment to the planning; contents of local
adjustment to the planning; analysis and clarification of the continuity and
synchronization of the entire planning project and the socio-economic
effectiveness of the local adjustment to the planning; identification of
indicators for the planning that have been achieved after the local adjustment
to the planning, with comparison with the indicators for planning that have
been approved before proposal for the local adjustment; assessment of the
impact of local adjustment on the implementation of the approved planning;
proposal for solutions to new problems arising from local adjustment; schedule
and progress in the implementation according to the local adjustment to
planning after decision of the competent authority. The report shall be
attached to relevant legal documents and documents.

Article 40.
Transitional clauses
a) After the effective date of
this Circular, the urban and rural planning tasks and projects that are in
progress or have not been completed shall be reviewed and completed according
to regulations of this Circular before submission for appraisal.
b) In case of the urban and rural
planning tasks and projects that have been appraised and submitted for
approval, the dossiers on tasks and projects shall continue to comply with
regulations of Circular No. 12/2016/TT-BXD dated June 29, 2016 and Circular No.
02/2017/TT-BXD dated March 01, 2017.
c) If the tasks have been approved
and the projects are being prepared in urban and rural planning, it is not
required to amend the dossiers on tasks and the dossiers on projects shall be
reviewed and carried out according to regulations of this Circular before
submission for appraisal.
d) The dossiers on projects on the
concise detailed urban planning and detailed construction planning that
have been condensed specified in Articles 13 and 30 of this Circular shall be
carried out after the effective date of Decree on amendments to some Articles
of Decrees on state management of the Ministry of Construction
Article 41.
Responsibility for implementation
1. Entities
participating in preparation, appraisal and approval for urban and rural
planning shall be responsible for the implementation according to regulations
of this Circular on dossiers on tasks and projects on inter-district, district
and special purpose zone construction planning; urban and rural planning.
