DECISION
ELABORATING
LAW ON EMULATION AND COMMENDATION
Pursuant to the Law on Government Organization No.
63/2025/QH15;
Pursuant to the Law on Emulation and Commendation No.
06/2022/QH15;
Pursuant to Resolution No. 190/2025/QH15 of the National
Assembly of Vietnam on handling certain issues related to the reorganization of
the state apparatus;
Pursuant to Decree No. 152/2025/ND-CP of the Government of
Vietnam on delegation and devolution in emulation and commendation; elaborating
on the implementation of a number of articles of the Law on Emulation and
Commendation;
At the request of the Minister of Home Affairs of Vietnam;
The Prime Minister of Vietnam hereby promulgates the
Decision elaborating on the Law on Emulation and Commendation No. 06/2022/QH15
dated June 15, 2022 of the National Assembly of Vietnam.

GENERAL PROVISIONS
Article 1. Scope
This Decision elaborates on the implementation of Clause 2
Article 12; Clause 2 Article 14; Clause 3 Article 81; Clause 7 Article 83;
Clause 2 Article 85; Clause 3 Article 96 of the Law on Emulation and Commendation
according to the decentralization and devolution prescribed in Decree No.
152/2025/ND-CP dated June 14, 2025 of the Government of Vietnam.
Article 2. Regulated entities
This Decision applies to:
1. State agencies.
2. Vietnamese and foreign organizations and individuals.
3. Other relevant agencies, organizations, and individuals.

Article 3. Commendation jurisdiction and submission of
commendations for enterprises and other economic organizations
1. Presidents of provincial People’s Committees shall award
commendations and submit commendations to superior authorities for:
a) Enterprises, other economic organizations, industrial parks, economic
zones, export-processing zones, or collectives and individuals of enterprises,
and other economic organizations, industrial parks, economic zones,
export-processing zones under their management;
b) Enterprises, other economic organizations or collectives and
individuals of enterprises, and other economic organizations not under their
management but having achievements contributing to the province other than
where the enterprise is headquartered.
In case of proposing State-level commendations for enterprises, other
economic organizations or collectives and individuals of enterprises, and other
economic organizations not under their management, written consensus opinions
(regarding commendation and commendation forms) must be obtained from the
provincial People’s Committee where the enterprise is headquartered, as well as
the ministry or central authority managing the field or sector of such
enterprise or economic organization.
Agencies requested for opinions shall respond in writing within 10
working days from the date of receipt of the written solicitation of opinions,
and take legal liability for the content of their opinions.
2. Heads of ministries, departments, and central authorities shall be
responsible for awarding commendations and submitting commendations to superior
authorities for:
a) Enterprises, other economic organizations, industrial parks, economic
zones, export-processing zones, or collectives and individuals of enterprises,
and other economic organizations, industrial parks, economic zones,
export-processing zones under their management;
b) Enterprises, other economic organizations or collectives and
individuals of enterprises, and other economic organizations not under their
management but having achievements contributing to the field under the
management of relevant ministries, departments, or central authorities.

Agencies requested for opinions shall respond in writing within 10
working days from the date of receipt of the written solicitation of opinions,
and take legal liability for the content of their opinions.
3. For
enterprises, collectives, and individuals of enterprises in the State sector:
a) State economic groups, state corporations, and partially state-owned
joint-stock companies shall comply with the principle that ministries or
central authorities assigned by the Government of Vietnam to exercise the
rights and responsibilities of the state ownership representative for
enterprises shall award commendations or submit commendations to superior
authorities for enterprises, collectives, and individuals of enterprises under
their management;
b) Ministries managing relevant sectors or fields, provincial People’s
Committees, or organizations assigned by the Government of Vietnam to exercise
the rights and responsibilities of the state ownership representative for
enterprises shall award commendations or submit commendations to superior
authorities for enterprises, collectives, and individuals of enterprises
established by them or assigned to them for management;
c) Member units of enterprises operating and fulfilling obligations in
provinces where their headquarters are not located shall have commendations
decided by the heads of enterprises within their jurisdiction or be proposed to
superior authorities for commendations.
4. For enterprises, collectives, and individuals of
enterprises (including FDI enterprises):
a) Enterprises, collectives, and individuals of enterprises
operating in provinces where transaction offices are located (including inside
and outside industrial parks and export-processing zones) shall be commended by
the heads of enterprises, be proposed to the Presidents of commune-level
People’s Committees or provincial People’s Committees where the transaction
offices are located for commendations, be proposed to superior authorities for
commendations;
b) Member units of enterprises that conduct independent
accounting and fulfill obligations in provinces where the headquarters are not
located, in addition to commendations decided by the heads of enterprises
within their jurisdiction, the heads of member units shall conduct
commendations within their jurisdiction and propose the Presidents of
commune-level People’s Committees or provincial People’s Committees where the
member units are headquartered and fulfill obligations to the State for
commendations or propose superior authorities for commendations.
Article 4. Simple commendation dossiers and procedures

2. A dossier requesting commendation under simple procedures shall
include 1 set (original), including:
a) Statement requesting commendation;
b) Summary report of achievements of the individual, collective,
household, or the directly managing agency, organization, or unit according to
Forms No. 06, 07, and 08 in the Appendix issued together with Decree No.
152/2025/ND-CP.
3. Heads of ministries, departments, and central and provincial
authorities, as well as heads of agencies, organizations, and units, shall have
the authority to award commendations and propose commendations immediately
after individuals or collectives achieve irregularly outstanding achievements
as prescribed by the Law.
4. The appraisal time and submission for
commendations for cases proposed for commendations, as prescribed in Points a,
c, d, and dd Clause 1 Article 85 of the Law on Emulation and Commendation,
shall comply with Article 35 of Decree No. 152/2025/ND-CP.
5. Submission of dossiers for State-level commendations:
a) The submission of commendation dossiers under simple procedures shall
comply with Clause 12 Article 33 of Decree No. 152/2025/ND-CP;
b) The Ministry of Home Affairs of Vietnam shall send the statement
together with the list of proposed commendations and commendation dossiers in
electronic file format to the Government Office;
c) The dossier submitted by the Ministry of Home Affairs of Vietnam to
the Prime Minister of Vietnam shall include the statement together with the
list of proposed commendations and electronic files of commendation dossiers
(except dossiers containing state secrets).

1. Use commendation items for proper purposes in accordance with
Vietnam’s national customs, traditions, and social ethics.
2. It is strictly prohibited to take advantage of commendation forms
from foreign individuals and organizations to conduct the following acts:
a) Violating Vietnamese law;
b) Disseminating, inciting, or encouraging acts contrary to the cultural
traditions and national interests of Vietnam;
c) Infringing upon national security or opposing the State of the
Socialist Republic of Vietnam.
Chapter III
PROCEDURES FOR CONSIDERATION OF CONFERMENT AND
POSTHUMOUS CONFERMENT OF GLORIOUS YOUTH VOLUNTEER MEDALS AND SUMMARY

2. Youth volunteers who sacrificed while performing duties during the
resistance wars and national defense and have been recognized as martyrs.
Article 7. Rights and obligations of Youth Volunteers when
being considered for conferment or posthumous conferment of “Glorious Youth
Volunteer Medal”
1. Youth volunteers considered for
conferment or posthumous conferment of the “Glorious Youth Volunteer Medal”
shall receive the diploma, frame, medal, and medal box in accordance with
regulations.
2. Youth volunteers or their relatives
shall be responsible for making truthful and accurate declarations, providing
complete documents and records proving their working period in Youth Volunteer
units when preparing dossiers requesting commendation. Individuals making
declarations shall take legal liability for the declared contents and the
legality of the supporting documents and records.
Article 8. Authority to consider and propose conferment and
posthumous conferment of “Glorious Youth Volunteer Medal”
1. The President of the commune-level People’s Committee shall
direct the appraisal of dossiers requesting consideration for conferment or
posthumous conferment of the “Glorious Youth Volunteer Medal” within the local
area and submit them to the President of the provincial People’s Committee for
consideration and proposal for commendation.
2. The President of the provincial People’s Committee shall
direct the appraisal of dossiers requesting conferment or posthumous conferment
within the local area and submit them to the Prime Minister of Vietnam for
consideration and submission to the President of Vietnam for decision on the
conferment or posthumous conferment of the “Glorious Youth Volunteer Medal”
through the Ministry of Home Affairs of Vietnam.
3. The Ministry of Home Affairs of Vietnam shall appraise the dossiers
and submit them to the Prime Minister of Vietnam for consideration and
submission to the President of Vietnam for decision on the conferment or
posthumous conferment of the “Glorious Youth Volunteer Medal”.
Article 9. Time periods for commendation calculation

2. The period of the resistance war against the American imperialists,
from July 21, 1954 to April 30, 1975, including:
a) Resistance against the American imperialists in the North;
b) Resistance against the American imperialists in the South;
c) Performance of duties to assist Laos from May 1972 to December 1975.
3. The period of the war for national defense and performance of
international duties:
Individuals who directly participated in combat or directly served
combat. The time periods are as follows:
a) The Southwest border defense war from May 1975 to January 7, 1979;
b) The Northern border defense war from February 1979 to December 31,
1988;
c) Performance of duties to assist Laos from May 1975 to December 31,
1988;

dd) Performance of duties to suppress FULRO from May 1975 to December
1992.
Article 10. Principles for consideration of conferment and
posthumous conferment of “Glorious Youth Volunteer Medal”
1. Each Youth Volunteer shall be considered for conferment or posthumous
conferment of the “Glorious Youth Volunteer Medal” only once.
2. When considered for commendation, the working periods of
participation within the time periods specified in Article 9 of this Decision
shall be aggregated to ensure eligibility for consideration of conferment or
posthumous conferment of the “Glorious Youth Volunteer Medal”.
3. The “Glorious Youth Volunteer Medal” shall not be considered for
conferment or posthumous conferment in the following cases:
a) Persons convicted by a legally effective court judgment or decision
for crimes of infringing upon national security or other crimes subject to
imprisonment penalties;
b) Persons who participated in activities opposing the regime, the CPV,
or the State, deserted, betrayed, or defected, and were terminated from
preferential treatment policies in accordance with the law on preferential
treatment for revolutionary contributors.
Article 11. Dossiers requesting consideration for
conferment and posthumous conferment of “Glorious Youth Volunteer Medal”
1. Declaration form requesting consideration for conferment
of the “Glorious Youth Volunteer Medal”:

b) For cases where the youth volunteer is elderly, weak, or
has sacrificed or passed away, the declaration shall be made by the relative
representative in accordance with Form No. 02 in Appendix I issued together
with this Decision.
2. Supporting documents: If the individual is a youth
volunteer during the periods specified in Article 9, the documents must
indicate the youth volunteer unit in which the individual participated and the
total aggregated participation period of 24 months or more (hereinafter referred
to as “information on the period of participation in the youth volunteer
force”); or if the individual is a martyr, there must be documents proving
martyr status when serving as a youth volunteer.
Supporting documents shall be one or several of the following
documents, ensuring legal validity (originals or certified copies in accordance
with regulations):
a) Official personnel record, personal record, or CPV
member record (including CPV member records of relatives in accordance with
regulations) indicating the period of participation in the youth volunteer
force, declared before the issuance of Decision No. 104/1999/QD-TTg of the
Prime Minister of Vietnam; particularly for grassroots youth volunteers in the
South, records declared before 1995. CPV member records must be certified true
copies by the CPV committee where the CPV member is affiliated;
b) Retirement decision or social insurance entitlement
decision indicating the period of participation in the youth volunteer force in
accordance with regulations;
c) Decision on allowance or policy entitlement for youth
volunteers who have completed duties during the resistance wars and national
defense issued by a competent authority, which specifies personal information
on the period of participation in the youth volunteer force and the allowance
level paid in accordance with State regulations, consistent with the
participation period recorded in the decision on policy entitlement;
d) Decision on lump-sum allowance under Decision No.
176-HDBT dated September 9, 1989 of the Council of Ministers (now the
Government of Vietnam) regarding labor restructuring in state-owned economic
units, which includes information on the period of participation in the youth
volunteer force;
dd) Certificate (confirmation) of youth volunteer status issued by the
Vietnam Youth Volunteer Association at the time the individual completed duties.
Particularly for cases where the Certificate (confirmation) or Youth
Volunteer Commemorative Medal issued by the municipal or provincial Youth
Volunteer Association after 1999 includes information on the period of
participation and unit designation, it must be accompanied by supporting
grounds for issuing such a certificate;

g) For individuals who have already received resistance war commendations,
they may submit certified copies of the Diploma of Resistance Order, Diploma of
Resistance Medal, Diploma of Merit of the Prime Minister of Vietnam, or Diploma
of Merit of Ministers, Directors of ministerial agencies, governmental
agencies, or Presidents of provincial People’s Committees under Decision No.
98/2006/QD-TTg of the Prime Minister of Vietnam, together with the achievement
declaration used for the resistance war commendation. The approved achievement
declaration must contain information on the period of participation in the
youth volunteer force;
h) For martyrs: Certified copy of the “Fatherland Recognition Diploma”
indicating the individual was a youth volunteer. If the diploma does not
specify the youth volunteer status, documents issued by a competent authority
confirming that the martyr was a youth volunteer at the time of sacrifice are
required (martyr dossier excerpt).
3. Dossier submitted to the President of the provincial
People’s Committee (1 original dossier and electronic files of the commendation
dossier), including:
a) Statement of the commune-level People’s Committee
together with the list of cases proposed for conferment or posthumous
conferment of the “Glorious Youth Volunteer Medal”;
b) Minutes of the meeting for consideration of conferment
or posthumous conferment of the “Glorious Youth Volunteer Medal” at the commune
level;
c) Dossier of the youth volunteer as prescribed in Clauses
1 and 2 of this Article;
d) Results of public disclosure of cases proposed for
commendation in accordance with regulations.
4. Dossier submitted to the Prime Minister of Vietnam (1
original dossier and electronic files of the commendation dossier), including:
a) Statement of the provincial People’s Committee together
with the list of cases proposed for conferment or posthumous conferment of the
“Glorious Youth Volunteer Medal”;

Article 12. Procedures for consideration of conferment and
posthumous conferment of “Glorious Youth Volunteer Medal”
1. The youth volunteer or the relative of the youth volunteer shall
prepare the dossier in accordance with Clause 1 Article 11 of this Decision and
submit 1 dossier in person or by post to the commune-level People’s Committee
where the youth volunteer registers permanent residence (for living persons) or
where the relative making the declaration resides (for youth volunteers who
have sacrificed or passed away).
2. Within 15 working days from the date of receiving a
complete dossier, the commune-level People’s Committee shall:
a) Publicly disclose the list of cases proposed for
consideration for conferment and posthumous conferment of the “Glorious Youth
Volunteer Medal” through mass media and post it on the electronic portal of the
commune-level People’s Committee (if any) for 10 working days;
b) Organize a meeting for consideration of conferment and
posthumous conferment, with participants including: Representatives of the
leadership of the commune-level People’s Committee, representatives of the
leadership and officers of the Culture and Social Affairs Division responsible
for emulation and commendation, representatives of the commune-level
Association (Liaison Committee) of Former Youth Volunteers (if any),
representatives of the commune-level Veterans Association, representatives of
the Police, representatives of the commune-level Military Command, and
representatives of the commune-level Fatherland Front Committee;
c) Submit the dossier to the President of the provincial
People’s Committee for consideration and proposal for commendation for cases
that fully satisfy the conditions, standards, dossiers, and procedures in
accordance with regulations. The dossier requesting conferment and posthumous
conferment of “Glorious Youth Volunteer Medal” shall be as prescribed in Clause
3 Article 11 of this Decision.
3. Within 15 working days from the date of receiving a
complete dossier, the provincial People’s Committee shall:
a) Direct the Department of Home Affairs to receive the
commendation dossier, cooperate with the provincial Association (Liaison
Committee) of Former Youth Volunteers (if any) in conducting an appraisal of
the dossier requesting consideration for conferment or posthumous conferment of
the “Glorious Youth Volunteer Medal”, and certify the appraisal results in the
individual achievement declaration.
Where verification is required, the Emulation and
Commendation Division, under the provincial Department of Home Affairs, shall
cooperate with the provincial Police, the provincial Military Command, and
relevant agencies in conducting the verification in accordance with the
regulations; the verification report shall be attached to the commendation
dossier.

4. Within 20 working days from the date of receiving a
complete dossier, the Ministry of Home Affairs of Vietnam shall:
a) Appraise the dossier and solicit opinions from relevant
agencies (if any);
b) Submit the dossier to the Prime Minister of Vietnam for
consideration and submission to the President of Vietnam to decide the
conferment or posthumous conferment of the “Glorious Youth Volunteer Medal”.
The dossier includes the statement of the Ministry of Home Affairs of Vietnam,
the list of proposed commendations, and electronic files of the commendation
dossiers (except dossiers containing state secrets).
5. In cases where the youth volunteer’s dossier lacks
supporting grounds, the dossier-receiving authority at the commune level shall
notify and guide the youth volunteer to complete the dossier and resubmit it in
accordance with regulations within 5 working days from the date of guidance.
6. In cases where the
conditions, standards, or procedures for commendation are not met, within 10
working days from the completion of appraisal and review at that level, the
dossier-receiving or dossier-appraising authority shall issue a written
notification returning the dossier to the submitting unit; the notification
must specify the legal grounds for returning the commendation dossier.
7. The authorities receiving dossiers requesting the
conferment or posthumous conferment of the “Glorious Youth Volunteer Medal” at
the provincial and commune levels shall organize verification for cases where
achievements are unclear, complaints or denunciations have been filed, or where
there are indications that the commendation dossier has been falsified.
Article 13. Notification of
commendation results and organization of award conferment
1. The Ministry of Home Affairs of Vietnam shall send the
commendation decision to the submitting authority for commendation. In cases
where the conditions, standards, procedures, or dossiers are not sufficient,
the submitting authority for commendation must be notified of the appraisal
results within 10 working days from the date the appraisal is completed.
2. After receiving the commendation decision of the President of
Vietnam, the provincial People’s Committee shall direct the organization of the
conferment ceremony and presentation of the “Glorious Youth Volunteer Medal” to
the awarded individuals in a manner that is solemn and appropriate to
traditions and to former youth volunteers, in accordance with Decree No.
152/2025/ND-CP. For cases that do not meet the conditions, standards, procedures,
or dossiers, within 5 working days from the date of receiving the notification
from the Ministry of Home Affairs of Vietnam, the provincial People’s Committee
shall notify the appraisal results to the commune-level People’s Committee to
inform the individuals proposed for commendation.

Article 14. Responsibilities of Presidents of People’s
Committees at all levels
1. Directly lead, direct, guide, disseminate information, and organize
the implementation of the work of consideration for conferment and posthumous
conferment of the “Glorious Youth Volunteer Medal” in accordance with the law,
and perform state management in this field in the local area.
2. Conduct inspection, examination, settlement of complaints and
denunciations, and handling of violations within their jurisdiction, and
perform statistics and reporting in accordance with the law.
3. Disclose administrative procedures, administrative procedure results,
and ensure funding for the implementation of consideration for conferment and
posthumous conferment of the “Glorious Youth Volunteer Medal” in accordance
with the current law.
4. Responsibilities for submission for commendation:
a) The President of the commune-level People’s Committee
shall take legal liability for the procedures and contents of dossiers submitted
to the President of the provincial People’s Committee, including: dossiers,
procedures, conditions, standards, process, accuracy of achievements, and
contents related to the implementation of the CPV’s guidelines and the State’s
policies and laws.
b) The President of the provincial People’s Committee shall
take legal liability for the procedures and contents of dossiers submitted to
the Prime Minister of Vietnam, including: dossiers, procedures, conditions,
standards, process, accuracy of achievements, and contents related to the
implementation of the CPV’s guidelines and the State’s policies and laws.
Article 15. Responsibilities of
agencies and organizations in commendation work
1. The Ministry of Home Affairs of Vietnam shall organize
guidance, urge, and inspect the implementation of the work of consideration for
conferment and posthumous conferment of the “Glorious Youth Volunteer Medal”,
and advise the Government of Vietnam on summarizing the conferment work.

3. The Vietnam Youth Volunteer Veterans Association shall
disseminate and universalize regulations on consideration for conferment of the
“Glorious Youth Volunteer Medal” to members at all levels; guide associations
at all levels to cooperate with relevant agencies, organizations, and units in
guiding members to declare, prepare dossiers, and request certification of
working periods in youth volunteer units during resistance wars and national
defense; participate in certification and authentication of working periods of
youth volunteers when requested by competent authorities.
4. Press and media agencies shall disseminate the CPV’s
guidelines and the State’s policies and laws on commendation and the conferment
and posthumous conferment of the “Glorious Youth Volunteer Medal”; promptly
report and combat violations of the commendation law.
5. Agencies, organizations, and units advising and assisting in
emulation and commendation work shall guide, urge, and inspect the
implementation of the work of consideration and proposal for conferment and
posthumous conferment of the “Glorious Youth Volunteer Medal”; receive, review,
and appraise dossiers according to their jurisdiction; and submit to competent
authorities for commendation decisions.
Article 16. Funding for implementation of medal conferment
and posthumous conferment
Funding for the organization and implementation of consideration for
conferment and posthumous conferment of the “Glorious Youth Volunteer Medal”
shall be implemented in accordance with the law on emulation and commendation.
Article 17. Guidance on summary commendation for resistance
war achievements and national defense achievements
Commendation for achievements in resistance wars and national defense
for individuals, collectives, and families that meet the conditions and
standards shall continue to be implemented in accordance with existing legal
documents and the legal system governing commendation for resistance war and
national defense achievements that remain in effect.
Chapter IV
CONSIDERATION FOR HONORING AND AWARDING TITLES AND PRIZES TO
ENTREPRENEURS, ENTERPRISES, AND OTHER ECONOMIC ORGANIZATIONS

Article 18. Subjects for
consideration for honoring and awarding titles and prizes
1. Agencies and units competent to organize consideration for
honoring and awarding titles and prizes to entrepreneurs, enterprises, and
other economic organizations include:
a) Ministries, ministerial agencies, governmental agencies,
central agencies of socio-political organizations, and the Vietnam Chamber of
Commerce and Industry (hereinafter referred to as “ministries, central
authorities, and central mass organizations”);
b) People’s Committees of provinces and centrally-run
cities (hereinafter referred to as “provincial People’s Committees”).
2. Subjects to be honored and awarded titles and prizes:
a) Entrepreneurs who are Vietnamese or foreigners
conducting production and business activities in the territory of Vietnam in
accordance with the law;
b) Enterprises of all economic sectors and other economic
organizations conducting production and business activities in accordance with
Vietnamese law.
Article 19. Principles for
organizing consideration for honoring and awarding titles and prizes
1. The principles for organizing consideration for honoring
and awarding titles and prizes shall comply with Clause 2 Article 81 of the Law
on Emulation and Commendation.

3. Agencies and units competent to organize consideration
for honoring and awarding titles and prizes to entrepreneurs, enterprises, and
other economic organizations shall publicly disclose the Regulations on award
consideration and award results on their web portals for the People and the
enterprise community to monitor and supervise.
Article 20. Scope and time of
organization
1. Scope of organization
a) The scope for organizing consideration for honoring and
awarding titles and prizes at the nationwide level refers to titles and prizes
organized by ministries, central authorities, and central mass organizations,
or inter-ministerial, inter-sectoral authorities, or inter-provincial
authorities; participants are entrepreneurs, enterprises, and other economic
organizations nationwide. Activities organized
on an inter-provincial basis must obtain written approval from the immediate
superior state management authority in charge of emulation and commendation,
and strictly comply with the organizational regulations issued by the central
authority;
b) The scope for organizing consideration for honoring and
awarding titles and prizes at the provincial level refers to titles and prizes
organized by the provincial People’s Committee; participants are entrepreneurs,
enterprises, and other economic organizations that have enterprise registration
within the area under the provincial management.
2. Time of organization
a) The time for organizing consideration for honoring and
awarding titles and prizes at the nationwide level shall be once every 3 years;
b) The time for organizing consideration for honoring and
awarding titles and prizes at the provincial level shall be once every 2 years;
c) The time for the next organization shall be calculated
from the time of the award ceremony for titles and prizes of the previous
organization.

1. Directors of ministries, central authorities, and
central mass organizations shall be competent to make decisions on the
organization of honoring and awarding titles and prizes to entrepreneurs,
enterprises, and other economic organizations within their sector, field, and
management scope.
2. The President of the provincial People’s Committee shall
be competent to make decisions on the organization of honoring and awarding
titles and prizes to entrepreneurs, enterprises, and other economic
organizations that have enterprise registration within the area under the
provincial management.
3. The President of the Vietnam Chamber of Commerce and
Industry shall be competent to make decisions on the organization of honoring
and awarding titles and prizes to entrepreneurs, enterprises, and other
economic organizations within the scope and functions of the Vietnam Chamber of
Commerce and Industry.
Section 2. BENEFITS AND
RESPONSIBILITIES OF ENTREPRENEURS AND ENTERPRISES; FUNDING FOR CONSIDERATION
FOR HONORING AND AWARDING TITLES AND PRIZES TO ENTREPRENEURS, ENTERPRISES, AND
OTHER ECONOMIC ORGANIZATIONS
Article 22. Benefits and
responsibilities of entrepreneurs, enterprises, and other economic
organizations awarded titles and prizes
1. Such entities shall be entitled to receive Cups,
Certificates, and prize money (if any) as prescribed and certified by the
organizing agency or unit for consideration for honoring and awarding titles
and prizes. They may use and commercially utilize the title and prize symbols
in accordance with the regulations on award consideration. However, they must
not cause misunderstanding about the nature or quality of products or services,
or violate regulations on advertising.
2. Such entities shall maintain and promote the
achievements obtained, and must not abuse the titles or prizes awarded to
commit any legal violation. Where they commit legal violations that negatively
affect the prestige of the titles or prizes, the organizing agency and the
competent authority deciding the organization of honoring, as prescribed in
Article 21 of this Decision, may revoke the titles and prizes awarded.
Article 23. Funding for
organization
1. Funding for organizing consideration
for honoring and awarding titles and prizes shall be formed from the state
budget and other lawful funding sources. The mobilization and use of other
lawful funding sources must comply with the principle of voluntariness and not
be organized in the form of mandatory fees imposed on entities participating in
consideration for honoring and awarding titles and prizes.

Section 3. PARTICIPATION
CONDITIONS; DOSSIERS, PROCEDURES, AND ORGANIZATION OF CONSIDERATION FOR
HONORING AND AWARDING TITLES AND PRIZES TO ENTREPRENEURS, ENTERPRISES, AND
OTHER ECONOMIC ORGANIZATIONS
Article 24. Participation
conditions for entrepreneurs
1. Having good moral qualities, strictly complying with the
CPV’s guidelines, the State’s policies and laws, and the internal rules and
regulations of agencies, organizations, and the place of residence.
2. Holding a managerial position in an enterprise or other
economic organizations with stable and continuous development for at least 5
years when participating in titles and prizes organized by ministries, central
authorities, central mass organizations, and socio-professional organizations,
and at least 3 years when participating in consideration for honoring and
awarding titles and prizes organized by provinces and centrally-run cities
(calculated up to the time of dossier submission). In
cases where an entrepreneur manages multiple enterprises or changes jobs, the
management periods in different enterprises and economic organizations may be
accumulated for consideration as a condition for participating in title and
prize consideration.
3. Actively studying and improving professional
qualifications and enterprise management capacity.
4. Having initiatives for improvement, management
solutions, or application of science, technology, and digital transformation in
production and business with effective results; having innovations and
creativity in production and business activities, contributing to improving
productivity, product quality, and competitiveness of enterprises and other
economic organizations.
5. Paying attention to training and improving
qualifications and skills for employees, improving the quality of human
resources for enterprises and other economic organizations, and fully
implementing policies for employees in accordance with the law.
6. Actively participating in emulation movements, making
contributions, supporting, and fulfilling corporate social responsibilities of
enterprises, entrepreneurs, and other economic organizations in the local area;
paying attention to developing CPV organizations, Trade Unions, and mass
organizations (if any) in enterprises and other economic organizations.
7. Ensuring that enterprises
and other economic organizations managed by the entrepreneur comply with the
law and have revenue, profit, state budget contributions, stable employee
income (not lower than the average income of the sector/field), and positive
growth, indicators of stability and growth are specified in the award
consideration regulations of the organizing agency or unit, and there are no
complaints, denunciations, lawsuits, strikes, or furloughs, and no fatal
occupational accidents.

1. Complying with the conditions of the business lines
registered or licensed for investment, and the law on enterprises, investment,
labor, land, construction, environmental protection, intellectual property,
product and goods quality, and other laws related to production and business
activities.
2. Ensuring that production
and business activities generate profit, stable state budget contributions, and
positive growth, and indicators on profit, state budget contribution, and
growth are specified by quantitative indicators in the award consideration
regulations of the organizing agency or unit.
3. Having technical initiatives, improvements, or
application of science, technology, and digital transformation in production
and business effectively; having innovation and creativity in production and
business activities, and creating positive value contributions to the overall
development of society and the country.
4. Fully fulfilling
financial obligations, taxes, and other state budget contributions in
accordance with the law; actively contributing to the state budget and social
welfare funds.
5. Ensuring stable employment for employees and income not lower
than the average of the sector/field; fully and promptly implementing social
insurance, health insurance, unemployment insurance, and policies and laws
related to employees.
6. Performing well in social welfare activities, actively
and effectively participating in emulation movements launched by ministries,
central authorities, or local authorities; actively developing CPV
organizations, Trade Unions, and mass organizations (if any) in enterprises and
other economic organizations.
7. Ensuring that there are no complaints, denunciations,
lawsuits, strikes, or furloughs, and no fatal occupational accidents.

b) An organization scheme, including the following
contents: Name of the title, name of the prize, and organizational contents;
purpose and requirements of organization; expected time and location of
organization (the location must ensure fire and explosion safety and security
and order); scope and form of organization; number and structure of titles and
prizes; composition of the Organizing Committee and the Council for
consideration for honoring and awarding titles and prizes, including specific
regulations on the number, structure, composition, functions, and duties of the
Organizing Committee and the Council. The Head of the Organizing Committee and
the President of the Award Consideration Council must be leaders of ministries,
central authorities, central mass organizations, socio-professional
organizations, or leaders of provinces and centrally-run cities. Members of the
Award Consideration Council include representatives of relevant agencies and
experts with knowledge and expertise in the sector, field, and content of the
titles and prizes. Financial plan, specifying the revenue sources, revenue
principles, expenditure principles, and expenditures; financial management
responsibilities and organization of implementation. Commitment of the
organizing unit that no fees shall be collected from entrepreneurs and
enterprises participating in the titles and prizes under any form;
c) The award consideration regulations, which stipulate business
lines and participating subjects, award criteria (criteria must be consistent
with the name and content of the titles and prizes and comply with the
conditions prescribed in Article 24 and Article 25 of this Decision), methods
for organizing consideration for awarding titles and prizes, and specific
regulations on cases where titles and prizes already awarded shall be revoked.
2. Procedures
a) Dossiers submitted to the ministry, central authority,
or central mass organization shall be sent through the advisory agency in
charge of emulation and commendation at the ministerial level;
b) Within 10 working days from the date of receipt of
complete dossiers as prescribed, the advisory agency in charge of emulation and
commendation work at the ministerial level shall appraise and submit them to
the Director of the ministry, central authority, or central mass organization
for decision.
3. In cases where the ministry, central authority, or
central mass organization has issued a decision promulgating regulations on the
organization of consideration for honoring and awarding titles and prizes for
entrepreneurs, enterprises, and other economic organizations, and such
regulations comply with this Decision, the organization of consideration for
honoring and awarding titles and prizes shall be implemented in accordance with
the regulations of such ministry, central authority, or central mass
organization.
4. The Director of the ministry, central authority, or
central mass organization shall decide to organize and be responsible for
organizing the consideration for honoring and awarding titles and prizes for
entrepreneurs, enterprises, and other economic organizations within the
management scope.

b) An organization scheme in accordance with Point b Clause
1 Article 26 of this Decision, specifying the business lines, participating
subjects, award criteria, methods, and procedures for consideration for
awarding titles and prizes. A commitment must be included that no funding shall
be collected from participating entities under any form.
2. Procedures:
a) Dossiers submitted to the President of the provincial People’s
Committee shall be sent through the specialized agency in charge of emulation
and commendation work at the provincial level;
b) Within 10 working days from the date of receipt of
complete dossiers as prescribed, the specialized agency in charge of emulation
and commendation work at the provincial level shall appraise and submit them to
the President of the provincial People’s Committee for decision.
3. In cases where the provincial People’s Committee has
issued a decision promulgating the regulations on organization of consideration
for honoring and awarding titles and prizes for entrepreneurs and enterprises,
which are consistent with this Decision, the organization of consideration for
honoring and awarding titles and prizes shall be implemented in accordance with
the regulations of the provincial People’s Committee.
4. The President of the provincial People’s Committee shall
decide to organize and be responsible for organizing the consideration for
honoring and awarding titles and prizes for entrepreneurs, enterprises, and
other economic organizations within the management scope.
Article 28. Organization of
consideration for honoring and awarding titles and prizes
1. After a decision on the organization of honoring and
awarding titles and prizes for entrepreneurs, enterprises, and other economic
organizations is issued, agencies, units, and information and communication
agencies shall carry out communication and dissemination activities and
organize activities related to the award consideration activities.
2. The organizing agency or unit shall conduct
consideration for honoring and awarding titles and prizes in accordance with
the law, the organization scheme, and the award consideration regulations;
solicit opinions from relevant agencies and public opinions via mass media
regarding participating entrepreneurs, enterprises, and other economic
organizations; compile and explain feedback, and publicly disclose the award
results on its web portal.

Article 29. Suspension of
organization of consideration for honoring and awarding titles and prizes
1. An agency or unit shall be subject to suspension of the
organization of consideration for honoring and awarding titles and prizes for
entrepreneurs, enterprises, and other economic organizations if committing one
of the following acts:
a) Organizing consideration for honoring and awarding
titles and prizes without permission from the competent authority;
b) Preparing dishonest dossiers to request permission for the
organization;
c) Organizing inconsistently with the organization scheme
and award consideration regulations approved by the competent authority;
d) Committing acts of deception or coercion against
entrepreneurs, enterprises, and other economic organizations to participate;
dd) Mobilizing funding in any form from participating
entities, including participation fees, mandatory sponsorships, or other
non-transparent charges.
2. Based on the conclusion of the competent authority, the
advisory agency in charge of emulation and commendation work at the ministerial
level shall submit to the ministerial Director for suspension of the
organization of titles and prizes at the nationwide level; the provincial
advisory agency shall submit to the President of the provincial People’s
Committee for suspension of provincial-level titles and prizes.

b) Conclusion of the competent authority regarding
violations of the organizing agency or unit organizing the consideration for
honoring and awarding titles and prizes to entrepreneurs, enterprises, and
other economic organizations.
4. Suspension procedures:
a) Within 15 working days from the date of issuance of a
conclusion on legal violations, the inspection team or competent authority
shall send the conclusion to the specialized emulation and commendation agency
at the ministerial or provincial level;
b) Within 10 working days from the date of receipt of the
conclusion on legal violations, the specialized emulation and commendation
agency shall submit to the Director of the ministry, central authority, or
central mass organization or the President of the provincial People’s Committee
for decision on suspension of the organization of honoring and awarding titles
and prizes for entrepreneurs, enterprises, and other economic
organizations.
5. After being suspended, the agency or unit shall
immediately cease the organization of honoring and awarding titles and prizes,
cancel the awarded results, and compensate any damage to related organizations
and individuals in accordance with the law.
Article 30. Cancellation of
results of consideration for honoring and awarding titles and prizes
1. Entrepreneurs, enterprises, and other economic
organizations shall have their award results canceled if they commit one of the
following acts:
a) Conducting fraudulent declarations of achievements to
participate in the consideration for honoring and awarding titles and prizes;
b) Abusing awarded titles or prizes to commit violations of
law;

2. Based on the conclusion of
the competent authority on the fraudulent declaration on achievements or legal
violations of the entrepreneur, enterprise, or other economic organization,
within 15 working days from receipt of such conclusion, the agency or unit
organizing the consideration for awarding titles and prizes shall issue a
decision to cancel the award results, recover/revoke Cups, Certificates, and
prize money (if any), publicly disclose the cancellation to communication
agencies.
Article 31. Responsibilities of
ministries, departments, central authorities, provincial authorities, and
relevant agencies and organizations in consideration for honoring and awarding
titles and prizes to entrepreneurs, enterprises, and other economic
organizations
1. Ministries, ministerial agencies, and provincial
People’s Committees shall, within their functions, duties, and powers, perform
the state management over the consideration for honoring and awarding titles
and prizes to entrepreneurs, enterprises, and other economic organizations; organize
the implementation of the consideration for honoring and awarding titles and
prizes to entrepreneurs, enterprises, and other economic organizations in
accordance with this Decision; at the same time, conduct regular or ad hoc
inspection and supervision of the consideration for honoring and awarding
titles and prizes to promptly detect and handle violations in accordance with
Articles 29 and 30 of this Decision.
2. Central agencies of socio-political organizations shall,
within their functions, duties, and powers, implement regulations on the
organization of consideration for honoring and awarding titles and prizes to
entrepreneurs, enterprises, and other economic organizations in accordance with
this Decision.
3. Mass media agencies
shall disseminate and universalize the law on consideration for honoring and
awarding titles and prizes to entrepreneurs, enterprises, and other economic
organizations; detect and promote exemplary entrepreneurs, enterprises, and
other economic organizations; refrain from broadcasting or reporting on cases
of consideration for honoring and awarding titles and prizes to entrepreneurs,
enterprises, and other economic organizations contrary to the law.

the National Assembly of Vietnam, commemorative medals of ministries,
departments, central authorities, and provincial authorities are printed on
paper with dimensions of 360 mm x 237 mm.
Diplomas certifying “Family of Culture”
are printed on A5 paper size, dimensions 210 mm x 148 mm.
The contents and decorative patterns on
the diploma/certificate shall be prescribed by the Standing Committee of the
National Assembly of Vietnam, ministries, departments, central authorities, and
provincial authorities.
Article 63. Template of Diplomas
of Titles of “Excellent Labor Collective”, “Determined-to-Win Unit”; Exemplary
Commune, Ward, Special Zone; Village, Residential Quarter of Culture
1. Layout:
a) Dimensions: The diploma is printed on A4 paper size,
dimensions 297 mm x 210 mm;
b) Surrounding decorative patterns:
The border is decorated with ornamental patterns, but must
not be identical or similar to those on state-level diplomas of merit.
At the top center is the National Emblem of the Socialist
Republic of Vietnam with rows of red flags on both sides (for diplomas under
the jurisdiction of Ministers, Directors of ministerial agencies, governmental
agencies, Chief Justice of the Supreme People’s Court of Vietnam, Prosecutor
General of the Supreme People’s Procuracy of Vietnam, Chairman of the Office of
the National Assembly of Vietnam, Chairman of the Office of the President of

Article 68. Design of Frames for
Diplomas of emulation titles and commendation forms
Frames are provided together with diplomas of emulation
titles and commendation forms. The design is prescribed as follows:
1. Frames for diplomas
under the jurisdiction of the President of Vietnam and the Prime Minister of
Vietnam shall have dimensions and materials that ensure aesthetics and
solemnity, suitable to the diploma's size and type.
2. Frames for other
diplomas shall be prescribed by the competent authority issuing the
commendation decision, ensuring appropriate dimensions and materials that
conform to each commendation form.
Article 69. Boxes for orders,
medals, badges of state honorary titles, badge “National Emulation Fighter”,
Commemorative Medals; Boxes for Frames of diplomas of emulation titles and
commendation forms under jurisdiction of President of Vietnam, Government of
Vietnam, and Prime Minister of Vietnam
1. Boxes for orders,
medals, badges of state honorary titles, and the badge “National Emulation
Fighter” shall have dimensions and materials that ensure aesthetics and
solemnity, suitable to each form of commendation. The outer top lid of the box
bears the image of the National Emblem.
2. Boxes for commemorative
medals prescribed in Article 71 of the Law on Emulation and Commendation shall
have their design, dimensions, and materials, which ensure aesthetics and
solemnity, prescribed by the competent authority issuing the decision to confer
commemorative medals.
3. Boxes for frames of diplomas of emulation titles and
commendation forms under the jurisdiction of the President of Vietnam, the
Government of Vietnam, and the Prime Minister of Vietnam shall have designs,
dimensions, and materials that ensure aesthetics and solemnity, suitable to the
size of the diploma frames.

RE-ISSUANCE AND REPLACEMENT OF COMMENDATION ITEMS

1. The Ministry of Home
Affairs of Vietnam shall be responsible for the procurement, storage, and
distribution of state-level commendation items to ministries, departments,
central authorities, and provincial authorities having individuals,
collectives, and households awarded; and for managing, guiding, and inspecting
the distribution of state-level commendation items by ministries, departments,
central authorities, and provincial authorities to awarded individuals,
collectives, and households.
2. The organization of
conferment of emulation titles and commendation forms of the President of
Vietnam, the Government of Vietnam, and the Prime Minister of Vietnam, together
with commendation items, to awarded individuals, collectives, and households
shall be carried out by the ministries, departments, central authorities, and
provincial authorities that have submitted the commendation proposals.
3. For other emulation
titles and commendation forms, the competent authority deciding the
commendation shall organize the procurement, storage, conferment, and
distribution of commendation items.
4. Individuals,
collectives, and households awarded emulation titles and commendation forms
shall have the right to retain, display, preserve, and use commendation items
for a long term, in accordance with their purposes and meanings. Collectives
may use the symbols of awarded commendation items for dissemination in official
documents and materials of the collective.
Article 71. Replacement of commendation items
1. A dossier requesting the
replacement of state-level commendation items shall comprise 1 original set,
including:
a) Official letter requesting replacement from the
collective or written request from the individual or household where
commendation items are damaged and no longer usable due to objective reasons,
such as natural disasters, floods, fires, or due to printing errors in diplomas;
b) Official letter requesting replacement from the
ministry, department, central authority, or provincial authority, enclosed with
a list in accordance with Form No. 4.5, Appendix II.4 of this Decision,
submitted to the Ministry of Home Affairs of Vietnam.

b) Ministries, departments, central authorities, and provincial
authorities shall compare with archived dossiers, certify, compile, and send an
official letter requesting replacement together with a list (Form No. 4.5,
Appendix II.4 of this Decision), and retain the old and damaged commendation
items; liquidation and destruction shall be carried out in accordance with the
law;
c) Verification and implementation of replacement:
Based on the official request for replacement from ministries,
departments, central authorities, and provincial authorities, the Ministry of
Home Affairs of Vietnam shall review, verify the commendation, and carry out
the replacement.
Replacement commendation items shall be procured and printed by the
Ministry of Home Affairs of Vietnam in accordance with the prescribed
templates. For former state-level commendation forms (no longer prescribed by
the Law on Emulation and Commendation), replacement shall follow the template
in effect at the time when the commendation decision was issued. Replacement
shall apply only to orders, medals, badges, commemorative medals, and diplomas
of emulation titles and commendation forms.
Replacement diploma templates signed by former office holders shall be printed
according to the original design; the achievement statement shall follow the
commendation decision; at the lower right, the seal and signature of the
competent person at that time shall be pre-printed (reproduced from seals and
signatures in previously issued diplomas, commendation decisions, signature
introduction documents of the Office of the President of Vietnam, Office of the
Government of Vietnam, the Office of the National Assembly of Vietnam, Ministry
of National Defense of Vietnam, and regulations on seal specimens of the
Ministry of Public Security of Vietnam); at the lower left, the diploma shall
record “Decision number, date, month, year, golden register number” and
“Certification of replacement diploma No.: …/GCN-BNV”. Individuals and collectives
receiving replacement diplomas shall also receive a certificate of replacement
(Form No. 4.7, Appendix II.4 of this Decision).
Replacement diploma templates signed by incumbent office holders shall
comply with the currently prescribed diploma templates. The Ministry of Home
Affairs of Vietnam shall compile lists, verify, and request the Office of the
Government of Vietnam and/or the Office of the President of Vietnam to affix
seals to the diplomas.
3. Time limits for settling
cases of replacement of state-level commendation items
Ministries, departments, central authorities, and
provincial authorities shall, within 15 working days from receipt of a request
for replacement from individuals, collectives, or households, submit dossiers
to the Ministry of Home Affairs of Vietnam.
The Ministry of Home Affairs of Vietnam shall, within
90 working days from receipt of the dossier, return the replacement results to
ministries, departments, central authorities, and provincial authorities.

this Decision) to the Ministry of Home Affairs of Vietnam;
c) Verification and implementation of re-issuance:
Based on official requests, the Ministry of Home Affairs of Vietnam
shall review, verify, and carry out the re-issuance of commendation items.
Re-issued commendation items shall be procured and printed by the

Chapter VI
IMPLEMENTATION
Article 73. Entry into force and
transitional provisions
1. This Decision comes into force as of its date of signing.
2. This Decision shall cease to have effect from March 1,
2027.

4. Dossiers for consideration for honoring and awarding titles and
prizes to entrepreneurs, enterprises, and other economic organizations that
have been validly received by competent authorities and are under processing
before the effective date of this Decision shall apply regulations on time,
conditions, and funding for consideration for honoring and awarding titles and
prizes in accordance with Decree No. 98/2023/ND-CP dated December 31, 2023 of
the Government of Vietnam.
5. From the effective date of this Decision, commendation
items manufactured in accordance with Decree No. 85/2014/ND-CP dated September
10, 2014 of the Government of Vietnam and Decree No. 98/2023/ND-CP dated
December 31, 2023 of the Government of Vietnam shall continue to be distributed
together with emulation titles and commendation forms until the existing stock
is exhausted.
Article 74. Implementation
responsibilities
Ministers, Directors of ministerial agencies, Directors of
governmental agencies, Presidents of People’s Committees of provinces and
cities, and relevant agencies, organizations, units, and individuals shall
implement this Decision./.
