CIRCULAR
ON RESTRICTION ON
THE USE OF TOBACCO USE IN CINEMATOGRAPHIC WORKS, ON STAGE
Pursuant to Law on Tobacco harm prevention dated
June 18, 2012;
Pursuant to Law on Cinematography dated June 15,
2022;
Pursuant to Decree No. 144/2020/ND-CP dated
December 14, 2020 of the Government on performance arts;
Pursuant to Decree No. 01/2023/ND-CP dated
January 16, 2023 of the Government on the functions, tasks, powers and
organizational structure of the Ministry of Culture, Sports and Tourism;
At the request of the Director General of
Department of Legal Affairs,
The Minister of Culture, Sports and Tourism
issues a Circular on restriction on the use of tobacco use in cinematographic
works, on stage.

This Circular provides the restriction on the use
of tobacco use in cinematographic works, on stage and responsibilities of
relevant organization and individuals.
Article 2. Regulated entities
1. Organizations and individuals organizing art
performances.
2. Organizations and individuals producing,
distributing, disseminating, rating films.
3. Actors/Actresses participating in
cinematographic works, art performances.
4. Relevant organizations and individuals in
cinematographic works, on stage.
Article 3. Rules for restricting the use of
tobacco use in cinematographic works, on stage
1. The use of tobacco use in cinematographic works,
on stage is prohibited, except for cases specified in clauses 2 and 3 of this
Article.
2. The use of tobacco use therein for purpose of
condemning and denouncing the prohibited acts stipulated in Article 9 and the
violations of obligations by tobacco smokers as prescribed in Article 13 of the
Law on Tobacco harm prevention.

Article 4. Use of tobacco use on stage for
artistic purposes
1. Uses of tobacco use in on stage for the purposed
artistic purposes include:
a) Portraying real historical figures;
b) Recreating a specific historical period;
c) Criticizing and condemning smoking behavior.
2. When using tobacco for artistic purposes,
actors/actresses shall not actually smoke on stage.
Article 5. Use of tobacco use in cinematographic
works for artistic purposes
1. Uses of tobacco use in cinematographic works for
artistic purposes include:
a) Cases specified in points a, b, and c of Article
4 of this Circular;

2. In cases where a film contains multiple scenes
of tobacco use, based on the assessment of the Film Appraisal and Rating Board,
the film distribution must adhere to the following requirements:
a) The film must be rated according to criteria and
film ratings and warnings must be implemented as prescribed in Circular No.
05/2023/TT-BVHTTDL dated April 5, 2023, by the Minister of Culture, Sports and
Tourism on film rating criteria and display of film ratings and warnings.
b) There must be health warnings about tobacco in
form of text or images included.
Article 6. Responsibilities of relevant
organizations and individuals
1. The Cinema Department, the Department of
Performing Arts, within their jurisdiction, shall cooperate with the Department
of Legal Affairs in guiding, inspecting, and organizing the implementation of
this Circular nationwide.
2. The Department of Culture, Sports and Tourism,
the Departments of Culture and Sports of centrally affiliated provinces and
cities shall implement this Circular in their area.
3. Organizations, individuals organizing art
performances, film production, distribution, dissemination, rating, and other
relevant organizations and individuals shall ensure the restriction of use of
tobacco use in cinematographic works and on stage in accordance with this
Circular during their professional activities.
Article 7. Effect
1. This Circular comes into force from January 25,
2025.

Any issues that arise during the implementation
process should be promptly reported to the Ministry of Culture, Sports and
Tourism for research and amendments./.
