QUYẾT ĐỊNH

CỦA THỐNG ĐỐC NGÂN HÀNG NHÀ NƯỚC SỐ 306/1999/QĐ-NHNN1 NGÀY 01 THÁNG 9 NĂM 1999 VỀ VIỆC ĐIỀU CHỈNH LÃI SUẤT TIỀN GỬI TỐI ĐA BẰNG ĐÔ LA MỸ CỦA PHÁP NHÂN TẠI TỔ CHỨC TÍN DỤNG

Căn cứ Luật Ngân hàng Nhà nước Việt Nam và Luật Các tổ chức tín dụng ngày 12 tháng 12 năm 1997;
Căn cứ Nghị định số 15/CP ngày 03/02/1993 của Chính phủ về nhiệm vụ, quyền hạn và trách nhiệm quản lý Nhà nước của Bộ, cơ quan ngang Bộ;
Theo đề nghị của Vụ trưởng Vụ Chính sách tiền tệ,

QUYẾT ĐỊNH

Điều 1: Quy định mức lãi suất tiền gửi bằng Đô la Mỹ của pháp nhân tại các tổ chức tín dụng như sau:

- Tiền gửi không kỳ hạn tối đa là: 0,5%/năm

- Tiền gửi có kỳ hạn đến 6 tháng tối đa là: 2,5%/năm

- Tiền gửi có kỳ hạn trên 6 tháng tối đa là: 3,0%/năm

Pháp nhân nói tại Điều này bao gồm: Tổ chức kinh tế, công ty Bảo hiểm (trừ các tổ chức tín dụng); cơ quan Nhà nước, đơn vị vũ trang; Tổ chức chính trị, tổ chức chính trị - xã hội; tổ chức xã hội; Tổ chức xã hội nghề nghiệp; quỹ xã hội, quỹ từ thiện; các tổ chức khác có đủ điều kiện quy định tại Điều 94 của Bộ Luật dân sự.

Điều 2: Lãi suất tiền gửi tối đa bằng đô la Mỹ của pháp nhân tại tổ chức tín dụng quy định tại Quyết định này có hiệu lực thi hành kể từ ngày 04/9/1999. Các quy định trước đây về lãi suất tiền gửi tối đa bằng đô la Mỹ của pháp nhân tại tổ chức tín dụng trái với quy định tại Quyết định này hết hiệu lực thi hành.

Điều 3: Thủ trưởng các đơn vị thuộc Ngân hàng Nhà nước Trung ương, Giám đốc chi nhánh Ngân hàng Nhà nước tỉnh, thành phố; Chủ tịch Hội đồng quản trị và Tổng giám đốc (Giám đốc) các tổ chức tín dụng và khách hàng của các tổ chức tín dụng chịu trách nhiệm thi hành Quyết định này.

DECISION

ON THE ADJUSTMENT OF THE MAXIMUM INTEREST RATE OF US$ DEPOSITS OF LEGAL ENTITIES AT CREDIT INSTITUTIONS

THE GOVERNOR OF THE STATE BANK

Pursuant to the Law on the State Bank of Vietnam and the Law on Credit Institutions dated 12 December, 1997;
Pursuant to the Decree No. 15/CP of the Government dated 3 February, 1993 on the assignment, authority and responsibility for the State management of Ministries, ministry-level agencies;
Upon proposal of the Director of the Monetary Policy Department,

DECIDES

Article 1.

The interest rate of US$ deposits of legal entities at credit institutions shall be as follows:

- The maximum interest rate for demand deposits: 0.5% /annum;

- The maximum interest rate for deposits with terms of more than 6 months: 3.0%/annum.

Legal entities mentioned in this Article shall include: economic organisations, insurance companies (except for credit institutions); State agencies, arm force units, political organisation, socio-political organisations, social organisations, socio-professional organisations, social Funds, charity Funds, other organisations which satisfy conditions provided for in Article 94 of the Civil Code.

Article 2.

The maximum interest rates of US$ deposits of legal entities at credit institutions provided for in this Decision shall be effective since 4 September, 1999.

Previous provisions on the maximum interest rate of US$ deposits of legal entities at credit institutions in contrary to the provision of this Decision shall cease their effectiveness.

Article 3.

Heads of Departments in the State Bank - Head office, General Managers of State Bank branches in provinces and cities; Chairpersons and Directors General (Directors) of credit institutions and their customers shall be responsible for the implementation of this Decision.
