CIRCULAR

ISSUING THE LIST OF SOFTWARE, HARDWARE, AND ELECTRONIC PRODUCTS

Pursuant to the Law on Information technology dated June 29^th 2006;

Pursuant to the Government's Decree No. 71/2007/ND-CP dated May 03^rd 2007, elaborating and providing guidance on the implementation of the Law on Information technology applicable to the information technology industry;

Pursuant to the Government's Decree No. 187/2007/ND-CP dated December 25^th 2007, defining the functions, tasks, entitlements and organizational structure of the Ministry of Information and Communications and the Government's Decree No. 50/2011/ND-CP dated June 24^th 2011 amending the Government's Decree No. 187/2007/ND-CP;

At the request of the Director of the Department of Information technology;

The Minister of Information and Communications issues a Circular on the list of software, hardware, and electronic products,

Article 1. Scope of regulation

1. A list of software products in Appendix 01.

2. A list of hardware and electronic products in Appendix 02.

Article 2. Subjects of application  

This Circular is applicable to organizations and individuals participating in information technology activities, the management, production, and sale of software, hardware and electronic products in Vietnam.

Article 3. The rules for making the list and purposes of the list

1. The list is to establish a system of specialized products for the software, hardware, and electronic industry serving the business registration; investment, application of tax policies and incentive polices, export and import management, quality control, and other activities related to software, hardware, and electronic products

2. The Ministry of Information and Communications shall adjust the list to suit the management requirements based on the development of the market and the policies on information technology development in each period.

Article 4. Effect

This Circular takes effect on May 23^rd 2013.

1. The Director of the Department of Information technology, Heads of units affiliated to the Ministry of Information and Communications, Directors of Services of Information and Communications, involved, enterprise, organizations and individuals stated in Article 2 are responsible for the implementation of this Circular.

2. Organizations and individuals are recommended to report the difficulties arising during the course of implementation to the Ministry of Information and Communications for amendments
