NGHỊ QUYẾT

CỦA QUỐC HỘI NƯỚC CỘNG HOÀ XÃ HỘI CHỦ NGHĨA VIỆT NAM VỀ VIỆC PHÊ CHUẨN HIỆP ĐỊNH THƯƠNG MẠI VIỆT NAM - HOA KỲ

QUỐC HỘI NƯỚC CỘNG HÒA XÃ HỘI CHỦ NGHĨA VIỆT NAM

Căn cứ vào Điều 84 của Hiến pháp nước Cộng hòa Xã hội chủ nghĩa Việt Nam năm 1992;

Theo đề nghị của Chủ tịch nước Cộng hòa xã hội chủ nghĩa Việt Nam;

Sau khi xem xét báo cáo của Chính phủ, báo cáo của Uỷ ban Đối ngoại, ý kiến của các đại biểu Quốc hội về việc phê chuẩn "Hiệp định giữa Cộng hòa xã hội chủ nghĩa Việt Nam và Hợp chủng quốc Hoa Kỳ về quan hệ thương mại".

QUYẾT NGHỊ:

1. Phê chuẩn "Hiệp định giữa Cộng hòa Xã hội chủ nghĩa Việt Nam và Hợp chủng quốc Hoa Kỳ về quan hệ thương mại".

2. Nước Cộng hòa xã hội chủ nghĩa Việt Nam thiết lập và phát triển quan hệ kinh tế và thương mại với Hợp chủng quốc Hoa Kỳ trên cơ sở các nguyên tắc tôn trọng độc lập, chủ quyền, không can thiệp vào công việc nội bộ của nhau, bình đẳng và cùng có lợi, không kèm theo bất cứ điều kiện nào.

Hiệp định giữa Cộng hòa xã hội chủ nghĩa Việt Nam và Hợp chủng quốc Hoa Kỳ về quan hệ thương mại đáp ứng nguyện vọng và lợi ích của nhân dân hai nước, mở ra một giai đoạn mới trong quan hệ kinh tế thương mại giữa Việt Nam và Hoa Kỳ. Mọi hành động đi ngược lại các nguyên tắc nói trên sẽ gây phương hại cho sự phát triển quan hệ hợp tác giữa hai bên, kể cả việc thực thi Hiệp định.

3. Các cơ quan Nhà nước quán triệt cho cán bộ các ngành các cấp và nhân dân ý nghĩa của Hiệp định, thuận lợi và khó khăn, ra sức phát huy nội lực, truyền thống yêu nước, bản sắc văn hóa dân tộc, tận dụng những thuận lợi và thời cơ, khắc phục các khó khăn và thách thức trong quá trình thực hiện Hiệp định nhằm đạt mục tiêu phát triển kinh tế - xã hội, công nghiệp hóa, hiện đại hóa đất nước, giữ vững độc lập chủ quyền và định hướng xã hội chủ nghĩa.

4. Ủy ban Thường vụ Quốc hội, Chính phủ, các cơ quan tư pháp khẩn trương xây dựng chương trình hành động cụ thể, đồng bộ, tiến hành việc sửa đổi, bổ sung các văn bản quy phạm pháp luật theo lộ trình của Hiệp định, tăng cường hệ thống các cơ quan tư pháp, hoàn thiện cơ chế chính sách, đào tạo nguồn nhân lực, tạo môi trường thuận lợi cho hoạt động của các doanh nghiệp. Các doanh nghiệp thuộc mọi thành phần kinh tế cần hiểu rõ các quy định của Hiệp định, ra sức mở rộng thị trường, nâng cao chất lượng, hiệu quả của sản xuất và thương mại, sức cạnh tranh của hàng hóa và dịch vụ. Các tầng lớp nhân dân trong cả nước cùng các doanh nghiệp tăng cường nội lực của nền kinh tế đất nước.

5. Nước Cộng hòa xã hội chủ nghĩa Việt Nam khẳng định đường lối đối ngoại độc lập, tự chủ, rộng mở, đa dạng hóa, đa phương hóa, chủ động hội nhập kinh tế khu vực và quốc tế, sẵn sàng phát triển sự hợp tác bình đẳng cùng có lợi với tất cả các quốc gia trên thế giới, vì hòa bình và phát triển.

6. Chính phủ hoàn tất các thủ tục đối ngoại về phê chuẩn Hiệp định; ban hành văn bản hướng dẫn và tổ chức việc thi hành Hiệp định, kịp thời báo cáo để Quốc hội có những quyết định thích hợp khi nảy sinh yếu tố mới trong quá trình thực hiện Hiệp định.

Nghị quyết này đã được Quốc hội nước Cộng hòa xã hội chủ nghĩa Việt Nam khóa X, Kỳ họp thứ 10 thông qua ngày 28 tháng 11 năm 2001.

RESOLUTION

ON THE RATIFICATION OF THE AGREEMENT BETWEEN THE SOCIALIST REPUBLIC OF VIETNAM AND THE UNITED STATES OF AMERICA ON TRADE RELATIONS

THE NATIONAL ASSEMBLY OF THE SOCIALIST REPUBLIC OF VIETNAM

Pursuant to Article 84 of the 1992 Constitution of the Socialist Republic of Vietnam;
At the proposal of the State President of the Socialist Republic of Vietnam;
After considering the report of the Government, the report of the External Relations Commission, and opinions of deputies of the National Assembly on the ratification of the Agreement between the Socialist Republic of Vietnam and the United States of America on trade relations,

RESOLVES:

1. To ratify the Agreement between the Socialist Republic of Vietnam and the United States of America on trade relations.

2. The Socialist Republic of Vietnam establishes and develops economic and trade relations with the United States of America on the basis of principles of mutual respect for independence, sovereignty and non-intervention in each other’s internal affairs, equality and mutual benefit, without any accompanying conditions.

The Agreement between the Socialist Republic of Vietnam and the United States of America on trade relations meets the aspirations and interests of the peoples of the two countries, ushers in a new period in the economic and trade relations between Vietnam and the United States. All acts that run counter to the aforesaid principles shall cause harms to the development of the cooperative relations between the two sides, including the implementation of the Agreement.

4. The Standing Committee of the National Assembly, the Government and the judicial agencies shall expeditiously formulate concrete and comprehensive action programs, amend and supplement legal documents according to the schedule of the Agreement, strengthen the system of judicial agencies, perfect mechanisms and policies, train human resources, create a favorable environment for activities of enterprises. Enterprises of all economic sectors should clearly understand the provisions of the Agreement, make every effort to expand markets, raise the quality and effectiveness of production and trade, the competitiveness of goods and services. The population of all strata across the country shall, together with enterprises, promote internal resources of the national economy.

5. The Socialist Republic of Vietnam affirms its foreign policy of independence, self-determination, openess, diversification, multilateralization, active integration into the regional and international economy, willingness to develop equitable and mutually beneficial cooperation with all nations in the world for the sake of peace and development.

6. The Government shall complete external relation formalities regarding the ratification of the Agreement; promulgate guiding documents and organize the implementation of the Agreement, report in time to the National Assembly for appropriate decisions when arise new elements in the course of implementation of the Agreement.

This Resolution was adopted on November 28, 2001 by the Xth National Assembly of the Socialist Republic of Vietnam at its 10th session.
