CIRCULAR
AMENDMENTS TO CERTAIN CIRCULARS PRESCRIBING FEES AND
CHARGES OF MINISTER OF FINANCE WITH THE AIM OF ENCOURAGING THE USE OF ONLINE
PUBLIC SERVICES
Pursuant to the Law on
Fees and Charges dated November 25, 2015;
Pursuant to the
Government’s Decree No. 14/2023/ND-CP dated April 20, 2023 defining the
functions, tasks, powers and organizational structure of the Ministry of
Finance;
At the request of
Director General of Tax Policy Department;
The Minister of
Finance hereby promulgates a Circular on amendments to certain Circulars
prescribing fees and charges of Minister of Finance with the aim of encouraging
the use of online public services.
Article 1. Amendments
to Article 3 of the Circular No. 148/2016/TT-BTC dated October 14, 2016 of the
Minister of Finance providing for the fees for processing of applications
for the license to use industrial explosives and the collection,
transfer and management thereof
Clause 4 is added to
Article 3 as follows:

a) From December 01, 2023
to December 31, 2025 inclusive, the fees shall be 90% (ninety percent) of the fees
prescribed in clause 1 of this Article.
b) From January 01, 2026
onwards, the fees prescribed in clause 1 of this Article shall be applied.”
Article 2. Amendments
to Article 4 of the Circular No. 245/2016/TT-BTC dated November 11, 2016 of the
Minister of Finance providing for the fees for assessment of conformance
to business requirements for occupational safety technical testing activities;
occupational safety and health training activities and the collection, transfer
and management thereof
Article 4 is amended as
follows:
“Article 4. Fees
1. The fees for
assessment of conformance to business requirements for occupational safety
technical testing activities; occupational safety and health training
activities are specified in the Fee schedule promulgated together with this
Circular.
2. In the case where a
public service provider or enterprise submits an online application for the
certificate of eligibility to carry out occupational safety technical testing
activities:
a) From January 01, 2024
to December 31, 2025 inclusive, the fees shall be 90% (ninety percent) of the
fees prescribed in point a Section 1 of the Fee Schedule promulgated together
with this Circular.
b) From January 01, 2026
onwards, the fees prescribed in point a Section 1 of the Fee Schedule
promulgated together with this Circular shall be applied.”

Clause 4 is added to
Article 4 as follows:
“4. In the case where an
organization or individual submits an online application for the protection of
industrial property rights (including application for application
for registration of protection of industrial property rights; issuance of
protection certificates, certificates of registration of industrial property
right assignment contracts; maintenance, extension, invalidation or annulment
of certificates of industrial property right protection; issuance of industrial
property representation service practicing certificates and declaration and
registration of industrial property representative):
a) From January 01, 2024
to December 31, 2025 inclusive, the fees shall be 50% (fifty percent) of the
fees prescribed in Section A of the Industrial property fee
and charge schedule promulgated together with this Circular.
b) From January 01, 2026
onwards, the fees prescribed in Section A of the Industrial property fee and
charge schedule promulgated together with this Circular shall be applied.”
Article 1. Amendments
to Article 4 of the Circular No. 287/2016/TT-BTC dated November 15, 2016 of the
Minister of Finance providing for fees and charges in atomic energy sector, and
the collection, transfer and management thereof
Article 4 is amended as
follows:
“Article 4. Fees and
charges
1. The fees and charges
in atomic energy sector are specified in the Fee and charge schedule
promulgated together with this Circular.
2. If an organization or individual
submits an online application for the license to perform radiation works or the
certificate of eligibility to provide atomic energy application support
services or for approval of internal or provincial nuclear and radiation
emergency response plans (except for administrative procedures handled using
the national or ASEAN single-window system):

b) From January 01, 2026
onwards, the fees prescribed in clause 1 of this Article shall be applied.”
Article 5. Amendments
to Article 4 of the Circular No. 25/2021/TT-BTC dated April 07, 2021 of the
Minister of Finance providing for on fees and charges in immigration, transit
and residence in Vietnam, and the collection, submission, management and use
thereof
Clause 3 is added to
Article 4 as follows:
“3. In the case where a
Vietnamese citizen submits an online application for passport:
a) From January 01, 2024
to December 31, 2025 inclusive, the fees shall be 90% (ninety percent) of the
fees prescribed in point 1 Section I of the Fee and charge schedule promulgated
together with this Circular.
b) From January 01, 2026
onwards, the fees prescribed in point 1 Section I of the Fee and charge
schedule promulgated together with this Circular shall be applied.”
Article 1. Amendments
to Article 4 of the Circular No. 38/2022/TT-BTC dated June 24, 2022 of the
Minister of Finance on fees for issuance of construction permits and fees for
issuance of architecture practicing certificates, collection, payment, and
transfer thereof
Clause 6 is added to
Article 4 as follows:
“6. In the case where an
organization submits an online application for issuance of certificate of
construction capacity, an individual submits an online application for issuance
of construction practicing certificate or a foreign submits an online
application for issuance of construction permit:

b) From January 01, 2026
onwards, the fees prescribed in clauses 1 and 3 of this Article shall be
applied.”
Article 1. Amendments
to clause 1 Article 4 of the Circular No. 48/2022/TT-BTC dated August 03, 2022
of the Minister of Finance on fees for extracting and using information in the
National Population Database, and the collection, submission, management and
use thereof
Clause 1 of Article 4 is
amended as follows:
“1. Fees for verifying
citizen information and extracting information
a) From December 01, 2024
to December 31, 2025 inclusive, the fees shall be 50% (fifty percent) of the
fees prescribed in Section I of the Appendix on Fees for extracting and using
information in the National Population Database promulgated together with this
Circular.
b) From January 01, 2026
onwards, the fees prescribed in Section I of the Appendix on Fees for extracting
and using information in the National Population Database promulgated together
with this Circular shall be applied.”
Article 8. Amendments
to Article 3 of the Circular No. 37/2023/TT-BTC dated June 07, 2023 of the
Minister of Finance on fees for driving tests; charges for issuance of driving
licenses and certificates of operation of means of transport and charges for
vehicle registration and issuance of license plates of special vehicles, rates,
collection, transfer, management and use thereof
Article 3 is amended as
follows:

2. If an organization or
individual submits an online application for issuance, re-issuance or
replacement of (national and international) driving license:
a) From December 01, 2023
to December 31, 2025, the charge of 115,000 dong/application shall be applied.
b) From January 01, 2026
onwards, the charges prescribed in the Fee and charge schedule promulgated
together with this Circular shall be applied.”
Article 9.
Implementation clause
1. This Circular comes
into force from November 01, 2023.
2. Difficulties that
arise during the implementation of this Circular should be promptly reported to
the Ministry of Finance for consideration and instructions./.
