CIRCULAR
ON ISSUANCE OF LIST
OF TECHNIQUES IN MEDICAL EXAMINATION AND TREATMENT
Pursuant to the Law on
medical examination and treatment dated January 09, 2023;
Pursuant to the Law on
prices dated June 19, 2023;
Pursuant Decree No.
96/2023/ND-CP dated December 30, 2023 of the Government, detailing the Law on
medical examination and treatment;
Pursuant to Decree No.
85/2024/ND-CP dated July 10, 2024 of the Government detailing a number of
articles of the Law on Prices;
Pursuant to Decree No.
95/2022/ND-CP dated November 15, 2022 of the Government, defining the
functions, tasks, powers and organizational structure of the Ministry of
Health;

Article 1. List of
techniques and economic and technical characteristics in medical examination
and treatment
1. Issued together with this
Circular are:
a) List of techniques in
medical examination and treatment (hereinafter referred to as
"medical techniques”) that apply until the eng of June 30, 2026 specified
in Appendix attached to this Circular;
a) List of techniques in
medical examination and treatment (hereinafter referred to as
"medical techniques”) that apply from July 01, 2026 specified in Appendix
attached to this Circular.
2. Economic and technical
characteristics in medical examination and treatment are determined by
specialization specified in Appendices stated in clause 1 of this Article.
3. Techniques in Appendix 01
attached to this Circular are organized by most suitable specialization,
sub-specialization. However, they can also be used in many other
specializations, sub-specializations.
4. Techniques in Appendix 02
attached to this Circular shall be organized by the body system and anatomical
structure.
Article 2. Term of Reference
If the reference documents in
this Circular are replaced, amended, the regulations of the replaced, amended
documents shall apply

1. 1. This Circular comes into
force from October 18, 2024.
2. 1. The following Circulars
shall cease to be effective from the effective date of this Circular:
a) Circular No.
43/2013/TT-BYT dated December 11, 2023 of the Minister of Health, providing for
technical and professional levels in the network of medical establishments.
b) Circular No. 21/2017/TT-BYT
dated May 10, 2017 of the Minister of Health amending and supplementing the
List of medical techniques issued together with Circular No. 43/2021/TT-BYT
dated December 11, 2013 of the Minister of Health detailing the technical and
professional levels in the network of medical establishments.
Article 4. Transition
clauses
1. The techniques specified in
Appendix No. 01 issued with this Circular have already been categorized by
surgeries, medical procedures in accordance with Circular No. 50/2014/TTBYT
dated December 26, 2014 of the Minister of Health on classification of
surgeries, medical procedures and personnel norms applied to every operation,
medical procedure, shall continue following this categorization.
2. People who have been granted
a practicing certificate or practicing license before the effective date of
this Circular may continue to perform approved techniques in accordance with
Circular No. 32/2023/TT-BYT dated December 31, 2023, of the Minister of Health
detailing a number of articles of the Law on Medical Examination and Treatment
and techniques under the List attached to this Circular within their scope of
practice.
3. medical establishments that
have been granted operating licenses by competent state authorities before the
effective date of this Circular may continue to perform approved techniques
within the scope of professional activities until June 30, 2026, without having
to carry out procedures to adjust their operating licenses.
Article 4. Implementation

a) Act as a focal point in
giving instruction, organizing implementation of this Circular and providing
guidance on professional contents within their jurisdiction;
b) Monitor and urge medical
establishments under their management to prepare conditions to implement the
list of medical techniques specified in Appendix No. 02 attached this Circular
from July 1, 2026.
2. The Traditional Medicine
Administration, the Maternal and Child Health Department, the Health Insurance
Department shall give instruction, provide guidance, and urge the
implementation of this Circular within their jurisdiction.
3. Departments of Health of
provinces and centrally affiliated cities shall:
a) Give instruction, provide
guidance, inspect, and urge the implementation of this Circular of medical
establishments under their management;
b) Monitor and urge medical
establishments under their management to prepare conditions to implement the
list of medical techniques specified in Appendix No. 02 attached this Circular
from July 1, 2026.
4. Medical establishments
shall:
a) Ensure that facilities,
human resources, and equipment for implementation of the list of medical
techniques are approved by competent authorities;
b) Prepare conditions to
implement the list of medical techniques specified in Appendix No. 02 attached
to this Circular from July 1, 2026.
