CIRCULAR

PREVENTION AND CONTROL OF TERRESTRIAL ANIMAL DISEASE EPIDEMIC

Pursuant to the Law on veterinary medicine dated June 19, 2015;

Pursuant to the Government’s Decree No. 199/2013/ND-CP dated November 26, 2013 on functions, tasks, powers and organizational structure of the Ministry of Agriculture and Rural Development;

At the request of the Director of Department of Animal Health;

The Minister of Agriculture and Rural Development issues a Circular on prevention and control of terrestrial animal disease epidemics.

1. This Circular elaborates a number of articles of the Law on Veterinary on prevention and control of terrestrial animal disease epidemics, including:

a) List of animal diseases subject to outbreak declaration, list of zoonotic diseases; list of animal diseases banned from slaughtering/treatment.

b) Compulsory prophylactic measures; requirements for veterinary hygiene and environmental hygiene in animal husbandry; requirements for transport of animals/animal products from epidemic zones;

c) Use of veterinary drugs that have not been granted marketing authorization in Vietnam for emergencies for prompt prevention and control of animal disease epidemic;

d) Report, diagnosis and inspection of animal disease epidemic;

dd) Compulsory handling of infected animals, animals suspected of being infected and animal products carrying pathogens on the List of animal diseases subject to outbreak declaration, the List of zoonotic diseases or newly discovered pathogens of infectious diseases;

e) Conditions for declaration of the end of an animal disease epidemic.

2. This Circular applies to Vietnamese and foreign organizations and individuals involved in the prevention and control of terrestrial animal disease epidemics in the territory of Vietnam.

2. The list of zoonotic diseases shall comply with regulations of Section 2, Appendix I issued together with this Circular.

3. The list of animal diseases banned from slaughtering/treatment shall comply with regulations of Section 3, Appendix I issued together with this Circular.

Chapter II

PREVENTION AND CONTROL OF TERRESTRIAL ANIMAL DISEASE EPIDEMIC

Article 3. Compulsory measures for prevention and control of terrestrial animal disease epidemics

1. Compulsory measures for prevention and control of terrestrial animal disease epidemics:

a) Periodically conduct cleaning, decontamination and disinfection according to guidance of Appendix VIII issued together with this Circular.

b) Compulsory vaccination against a number of dangerous infectious diseases as prescribed in Section 1 of Appendix 07 issued together with this Circular;

According to epidemiological characteristics, circulation of pathogens of dangerous infectious diseases of animals in the local areas and guidelines for prevention by vaccines for each disease in Appendices 09, 10, 12, 13, 15, 16, 21 and 22 issued together with this Circular, the local veterinary authority shall submit to the competent authority for decision on the compulsory vaccination against each specific animal disease epidemic as prescribed in Section 1.1 of Appendix 07 in conformity with conditions of the local area and issue a Certificate of Vaccination according to the form specified in Section 3 of Appendix 07.

a) The local veterinary authority shall periodically monitor diseases at the establishments that raise livestock and poultry for breeding and dairy cows under management of the local authority;

b) Department of Animal Health shall periodically monitor diseases at the establishments that raise livestock and poultry for breeding and dairy cows under management of central authorities;

Article 4. Requirements for veterinary hygiene and environmental hygiene in animal husbandry for the concentrated animal husbandry establishments.

1. The concentrated animal husbandry establishments shall meet requirements for veterinary hygiene and environmental hygiene in animal husbandry according to regulations of the law in order to prevent animals epidemics.

2. The concentrated animal husbandry establishments shall meet requirements for veterinary hygiene and environmental hygiene and be subject to sampling and testing of the veterinary authority. If the samples test negative for the disease specified in Section 1, Appendix 07 issued with this Circular, the vaccination against the disease is not compulsory.

Article 5. Requirements for transport of animals/animal from epidemic zones;

1. If the establishments certified epidemic-free or participate in the program on supervision of epidemics want to transport animals susceptible to the declared animal disease and the derivatives thereof out of the epidemic zones, they shall ensure the following conditions:

a) The veterinary authority shall organize sampling and testing; and the samples test negative for the declared animal disease;

b) The vehicles that transport animals susceptible to the declared animal diseases and the animal products from epidemic zones shall meet requirements at National technical regulation (01 - 100: 2012/BNNPTNT) on general veterinary hygiene requirements for Equipment and vehicles using for transport of live animal, animal’s fresh and primary processing products

2. The provincial – level veterinary authority shall take samples, test, clean, decontaminate and disinfect the vehicles that transport animals and the animal products specified in Clause 1 of this Article and provide guidance on routes in order to transport them out of epidemic zones.

3. The quarantine of transportation of animals and the animal products specified in this Article shall ensure the dossiers, order and procedures for quarantine according to regulations of the Ministry of Agriculture and Rural Development.

Article 6. Regulations on use of veterinary drugs that have not been granted marketing authorization in Vietnam for emergencies for prompt prevention and control of animal diseases;

1. In case of epidemics for animal diseases specified in Article 2 of this Circular or new infectious diseases without veterinary drugs for the purpose of prevention and control, Department of Animal Health shall submit the decision on use of veterinary drugs that have not been granted marketing authorization in Vietnam for emergencies for prompt prevention and control of animal diseases to the Minister of Agriculture and Rural Development

2. The import of veterinary drugs specified in Clause 1 of this Article shall ensure the dossiers, order and procedures for import according to regulations of the Ministry of Agriculture and Rural Development.

3. The use of veterinary drugs for emergencies for prompt prevention and control of animal disease epidemics specified in Clause 1 of this Article shall follow guidance of the drug manufacturers or designation of the veterinary authorities.

Article 7. Declaration and report on animal disease epidemics

1. The organizations or individuals who discover animals being infected, dead or suspected of an infectious disease or animals whose death is unexplained shall immediately report to veterinary staff of communes, the People’s Committees of communes or the nearest veterinary authority on the following information

a) Organizations or individuals who declare;

c) Type of animals;

d) Quantity of animals;

dd) Description of symptoms of diseases;

2. The report on animal disease epidemics shall be made as follows:

a) Commune-level: The veterinary staff of communes shall be responsible for report on animal disease epidemics to the President of the People’s Committees of communes or the veterinary authorities of districts;

b) District-level: The veterinary authorities of districts shall be responsible for report on animal disease epidemics to the People’s Committees of districts or the veterinary authorities of provinces;

c) Provincial-level: The veterinary authorities of provinces shall be responsible for report on animal disease epidemics to Department of Agriculture and Rural Development, Regional Animal Health Authorities or Department of Animal Health;

d) Central level: The Department of Animal Health shall be responsible for report on animal disease epidemics to the Minister of Agriculture and Rural Development and international organizations which Vietnam is a member or countries which Vietnam commits to report and share information on animal disease epidemics;

dd) In case of dangerous infectious animal diseases, diseases capable of quickly spreading on large scale, the organizations and individuals specified at Points a, b and c of this Clause may bypass the authorities at the current level and report the situation to superior authorities;

g) The inspection, verification, collection of information and report on animal disease epidemics specified at Points a, b, c, d, dd and e of this Clause shall be carried out within 24 hours for the Delta and midland areas; 72 hours for rural and remote areas, borders and islands from the date of receipt of information on declaration of animal diseases from relevant individuals and organizations.

3. In case of suspicion of animal diseases specified in Article 2 of this Circular, the veterinary staff of communes and the veterinary authorities shall immediately report on animal disease clusters with the following information:

a) Location where the animals are infected, dead or suspected of infectious diseases: Name of the domestic animal owner or the location where the animals are detected (specific address - village, hamlet or number of house); number of organizations, individuals and households that have infected animals; number of villages, hamlets that have infected animals;

b) Time at which the animals begin to show clinical symptoms or are dead; situation of the animal epidemics from day to day;

c) Information relevant to animals infected, dead or suspected of infectious diseases: type of animals; origin of the animals; total number of infected herds; number of each type of animals infected, dead or subject to destruction; symptoms and lesions of infected animals; type of treatment drugs, vaccines, biological products that are used and duration of use; number of animals subject to treatment, vaccines, number of animals that recover from diseases;

d) Pathogens (if known), original of diseases suspected or confirmed, result of the passive and active monitoring of diseases (if any);

dd) Assessment of the situation, implemented measures, measures that will be applied, suggestions and recommendations.

4. Animal disease cluster update report

a) If the animal disease epidemics specified in Article 2 of this Circular have been certified by the veterinary authority, the animal disease cluster update report shall be applied;

c) The form of animal disease cluster update report shall comply with regulations of Section 1 Appendix III issued together with this Circular.

5. Animal disease cluster investigation report

a) If the animal disease epidemics specified in Article 2 of this Circular have been certified by the veterinary authority, the animal disease cluster investigation report shall be applied;

b) The veterinary authority shall make animal disease cluster investigation report within 07 days from the date on which the animal disease cluster is certified by the veterinary authority;

c) The contents of animal disease cluster investigation report shall comply with regulations of Clause 2, Article 9 of this Circular.

6. The report on the end of animal disease clusters shall be made by the local veterinary authority within 07 days from the end of the animal disease clusters in accordance with the law.

7. Periodic report on animal disease epidemics

a) The monthly report shall be made by veterinary authority in the form of written report and email with information on animal disease epidemics calculated from the 1st to the last day of the month;

b) The quarterly, six-monthly and annual reports on animal disease epidemics shall be compiled and reported by the veterinary authority in the reporting period;

d) The contents of periodic report shall comply with regulations of Section 1 Appendix III issued together with this Circular.

8. The veterinary authority shall organize the storage and confidentiality of information on animal disease epidemics in the area under its management in writing and computer database in accordance with applicable regulations.

Article 8. Diagnosis of animal diseases

1. The organizations and individuals shall take samples and send them to test according to regulations of Vietnam Standard 01 - 83: 2011/BNNPTNT issued together with Circular No. 71/2011/TT-BNNPTNT dated October 25, 2011 of the Ministry of Agriculture and Rural Development.

2. The samples shall ensure the quality for testing and identification of pathogens. The pathology specimens enclosed with the sample delivery note shall be sent to the laboratory recognized by the competent authority. The sample delivery note form shall comply with regulations of Appendix IV issued together with this Circular.

3. The organizations and individuals shall perform the diagnosis and testing of animal diseases according to National Technical Regulations and National Standards on the process of diagnosis of animal diseases, regulations of the Law on veterinary medicine, the Law on prevention and control of infectious diseases and the Law on Environmental Protection.

4. The laboratory must test the samples right after receipt of pathology specimens and provide the results according to the test results reporting sheet as prescribed in Appendix 04 issued with this Circular. If the diagnosis or testing has not been performed or the diseases has not been identified, the laboratory shall notify in writing the organization or individual sending the samples and clearly state reasons.

5. The laboratories shall be responsible for immediately report on the test results to the competent veterinary authority.

6. Department of Animal Health shall provide guidance on collection, diagnosis and testing of new pathogens of infectious disease.

1. Principles

a) The investigation into animal disease clusters shall be carried out in case of suspicion of animal disease epidemics specified in Article 2 of this Circular within 24 hours for the Delta or 72 hours for rural and remote areas from the time for receipt of information about animal disease clusters.

b) Before investigation into animal disease clusters, it is necessary to collect full information on the situation of livestock production and animal disease epidemics; prepare necessary materials, tools, equipment and chemicals for investigation into animal disease clusters; prepare equipment for sampling, preservation and transportation of samples, personal protection; comply with current regulations on prevention and control of diseases; prepare necessary resources and finance, forms and tools for collection of information;

c) The information on the animal disease clusters shall be collected in a detailed, complete, accurate and prompt manner.

2. Contents

a) Collect initial information before and throughout the time for animal disease clusters, identify the basically epidemiological characteristics and existence of the animal disease clusters; trace the origin of the animal disease clusters;

b) Update information on the animal disease clusters: inspection and comparison with the previously reported information; clinical examination, number, species, age, date of detection of infected animals, identification of the first case; number of infected animals; veterinary drugs, vaccines, chemicals that have been used; identification of relevant risk factors;

c) Describe the evolution of the animal disease clusters according to time, location, infected animals, signs of diseases; assess the cause of the animal disease clusters;

d) Propose to conduct research on risk factors;

e) Report the results of the investigation into animal disease clusters, identify and forecast the situation of epidemics in the next time, propose measures to prevent and control the epidemics.

3. Responsibilities

a) In case of receipt of the notification of animals being infected, dead or suspected of an infectious disease, the district-level veterinary authority shall be responsible for investigation into animal disease clusters;

b) The provincial-level veterinary authority shall direct, advise and support the district-level veterinary authority in investigation into animal disease clusters0}

c) The People's Committees at all levels shall direct the local functional agencies to support the veterinary authority in investigation into animal disease clusters in the area under their management;

d) In case of animal disease epidemics with complicated developments and emergence of new factors in epidemiology, the provincial - level veterinary authority shall request the Regional Animal Health Agency and the Department of Animal Health to assist in investigation into the animal disease clusters in the local area.

Article 10. Compulsory handling of infected animals, animals suspected of being infected and animal products carrying pathogens

1. The application of measures for compulsory slaughter and destruction shall depend on each type of animal diseases specified in the Appendices issued together with this Circular, including:

a) Avian Influenza (applicable to highly virulent forms or viruses capable of transmission of diseases to humans) as specified in Appendix 09;

c) Porcine reproductive and respiratory syndrome as specified in Appendix 11;

d) Anthrax as specified in Appendix 12;

did) Swine fever as specified in Appendix 13;

e) Leptospirosis as specified in Appendix 14;

g) Rabies as specified in Appendix 15;

h) Newcastle disease as specified in Appendix 16;

i) Streptococcus suis (type 2) as specified in Appendix 17;

k) Toxocariasis as specified in Appendix 18;

l) Bovine tuberculosis as specified in Appendix 19;

2. In case of animals and animal products carrying new infectious pathogens, the Department of Animal Health shall submit the decision on compulsory handling to the Ministry of Agriculture and Rural Development

3. The technical measures for the destruction and slaughter of infected animals, animals suspected of being infected and animal products carrying pathogens shall comply with the regulations in Appendix 06 and instructions in the Appendices 09, 10, 11, 12, 13, 14, 15, 16, 17, 18, 19, 20, 21 and 22 issued together with this Circular.

Article 11. Conditions for declaration of the end of a terrestrial animal disease epidemic

The declaration of the end of a terrestrial animal disease epidemic the following conditions:

1. Within 21 days from the date on which the last infected animal die or are compulsorily destroyed, slaughtered or fully recover, there is not any other animal infected or dying of the declared animal disease epidemic;

2. The prevention by vaccine have been adopted to animals susceptible to the declared animal epidemics in the epidemic zones (over 90% of animals subject to vaccination) or high-risk zones (over 80% of animals subject to vaccination). Other compulsory prophylactic measures have been adopted to animals susceptible to the declared animal epidemics in the epidemic zones/high-risk zones.

3. The cleansing and disinfection measures have been taken within the duration specified in Clause 1 of this Article in epidemic and high-risk zones according to guidance at Section 5 of Appendix 08 issued together with this Circular to satisfy the veterinary hygiene standards.

4. There are an application for declaration of the end of the animal disease epidemic that has been made by a local veterinary authority and a written approval for declaration of the end of the animal disease epidemic enclosed with record of appraisal of conditions for declaration about the end of the epidemic of the superior veterinary authority.

Article 12. Responsibilities of Department of Animal Health

1. Guide, inspect and supervise the implementation of regulations of this Circular and other relevant regulations on prevention and control of terrestrial animal disease epidemic.

2. Consider and request the Ministry of Agriculture and Rural Development to add animal diseases to the list specified in Article 2 of this Circular in case of emergence of other dangerous diseases in animals.

3. Submit the decision the import and use of veterinary drugs that have not been granted marketing authorization in Vietnam and instructions on the use of veterinary drugs for emergencies for prevention and control of animal diseases to the Minister of Agriculture and Rural Development.

4. Provide detailed guidance on the use of forms of report on terrestrial animal disease epidemics.

5. Guide technical measures to prevent and control terrestrial animal disease epidemics caused by the new pathogens of infectious diseases; provide specific guidance on periodic monitoring of diseases.

6. Organize training for relevant organizations and individuals to take measures to prevent and control terrestrial animal disease epidemics.

7. Cooperate with relevant organizations and individuals in study, review and proposal for amendments to the regulations of this Circular accordingly.

8. Disseminate information on regulations on prevention and control of terrestrial animal disease epidemics for relevant organizations and individuals.

1. Organize the implementation; at the same time guide, inspect and supervise the implementation of relevant organizations and individuals in the local areas according to the regulations of this Circular and the guidance of the Department of Animal Health.

2. Develop the plan for proactive prevention and control of domestic animals disease epidemics in the area according to the regulations in Appendix 05 issued together with this Circular, and submit it to competent authorities for approval for implementation.

3. Organize training for relevant organizations and individuals in the local area to take measures to prevent and control terrestrial animal disease epidemics.

4. Organize training for relevant organizations and individuals in the local area to take measures to prevent and control terrestrial animal disease epidemics.

Article 14. Responsibilities of relevant organizations and individuals

1. The organizations and individuals involved in veterinary activities shall take appropriate measures to prevent and control terrestrial animal disease epidemics according to regulations of this Circular and the attached Appendices.

2. Comply with regulations on prevention and control of terrestrial animal disease epidemics according to regulations of this Circular and other relevant regulations of the law on veterinary medicine, environmental protection, prevention of infectious diseases and guidance of the veterinary authorities in order to ensure epidemic safety for domestic animals in the area, food safety and hygiene.

3. Comply with the inspection and guidance of the veterinary authorities and competent state agencies.

2. This Circular replaces the following legislative documents:

a) Decision No. 63/2005/QD-BNN dated October 13, 2005 of the Ministry of Agriculture and Rural Development on promulgation of Regulation on compulsory vaccination for livestock and poultry;

b) Decision No. 64/2005/QD-BNN dated October 13, 2005 of the Ministry of Agriculture and Rural Development on issuance of the List of animal diseases subject to outbreak declaration; dangerous diseases of animals; diseases subject to application of compulsory measures for prevention;

c) Circular No. 69/2005/TT-BNN dated November 07, 2005 of the Ministry of Agriculture and Rural Development on Guidance on implementation of some urgent measures to prevent and control influenza (H5N1) in poultry;

d) Decision No. 38/2006/QD-BNN dated May 16, 2006 of the Ministry of Agriculture and Rural Development on promulgation of Regulation on prevention and control of foot-and-mouth disease in livestock;

dd) Decision No. 67/2006/QD-BNN dated September 12, 2006 of the Ministry of Agriculture and Rural Development on amendments to Decision No. 38/2006/QD-BNN dated May 16, 2006 on promulgation of Regulation on prevention and control of foot-and-mouth disease in livestock;

e) Decision No. 05/2007/QD-BNN dated January 22, 2007 of the Ministry of Agriculture and Rural Development on amendments to Decision No. 38/2006/QD-BNN dated May 16, 2006 on promulgation of Regulation on prevention and control of foot-and-mouth disease in livestock;

g) Decision No. 1037/QD-BNN-TY dated April 13, 2007 of the Ministry of Agriculture and Rural Development on addition of porcine reproductive and respiratory syndrome to the List of animal diseases subject to outbreak declaration;

h) Decision No. 80/2008/QD-BNN dated July 15, 2008 of the Ministry of Agriculture and Rural Development on promulgation of Regulation on prevention and control of porcine reproductive and respiratory syndrome (PRRS);

l) Circular No. 05/2011/TT-BNNPTNT dated January 24, 2011 of the Ministry of Agriculture and Rural Development on Guidance on measures for prevention and control of Newcastle disease in poultry;

m) Circular No. 53/2013/TT-BNNPTNT dated December 12, 2013 of the Ministry of Agriculture and Rural Development on report on terrestrial animal disease epidemics;

n) Circular No. 44/2014/TT-BNNPTNT dated December 01, 2014 of the Ministry of Agriculture and Rural Development on diseases subject to periodic inspection at establishments that raise livestock and poultry for breeding and dairy cows

Article 16. Responsibility of implementation

1. Heads of units under the Ministry of Agriculture and Rural Development, heads of relevant agencies, organizations and individuals within the scope of their assigned tasks and powers shall be responsible for implementation of the regulations of this Circular.

2. Any difficulty or problem that arises during the implementation of this Circular should be reported to the Ministry of Agriculture and Rural Development for consideration and resolution.
