NGHỊ QUYẾT

VỀ KẾT THÚC VIỆC THỰC HIỆN NGHỊ QUYẾT SỐ 08/1997/QH10 VÀ NGHỊ QUYẾT SỐ 73/2006/QH11 VỀ DỰ ÁN TRỒNG MỚI 5 TRIỆU HA RỪNG

Căn cứ Hiến pháp nước Cộng hòa xã hội chủ nghĩa Việt Nam năm 1992 đã được sửa đổi, bổ sung một số điều theo Nghị quyết số 51/2001/QH10;

Căn cứ Nghị quyết số 08/1997/QH10 về Dự án trồng mới 5 triệu ha rừng và Nghị quyết số 73/2006/QH11 về việc điều chỉnh chỉ tiêu, nhiệm vụ của Dự án trồng mới 5 triệu ha rừng giai đoạn 2006-2010;

Trên cơ sở xem xét Báo cáo số 128/BC -CP ngày 09 tháng 8 năm 2011 của Chính phủ, Báo cáo số 243/BC-CP ngày 26 tháng 10 năm 2011 của Chính phủ, Báo cáo thẩm tra số 74/BC-UBKHCNMT13 ngày 24 tháng 10 năm 2011 của Ủy ban Khoa học, Công nghệ và Môi trường của Quốc hội và ý kiến của các vị đại biểu Quốc hội;

QUYẾT NGHỊ:

Điều 1.

Quốc hội ghi nhận Dự án trồng mới 5 triệu ha rừng đã cơ bản hoàn thành các mục tiêu theo Nghị quyết số 08/1997/QH10 của Quốc hội khóa X và các chỉ tiêu, nhiệm vụ đã được điều chỉnh theo Nghị quyết số 73/2006/QH11 của Quốc hội khóa XI; những kết quả đạt được, những tồn tại, hạn chế và nguyên nhân của những tồn tại, hạn chế trong việc thực hiện Dự án.

Điều 2.

Kết thúc việc thực hiện Nghị quyết số 08/1997/QH10 và Nghị quyết số 73/2006/QH11 của Quốc hội về Dự án trồng mới 5 triệu ha rừng.

Giao Chính phủ xây dựng và tổ chức thực hiện kế hoạch bảo vệ và phát triển rừng giai đoạn 2011 - 2020 theo cơ chế chương trình mục tiêu quốc gia và hằng năm báo cáo Quốc hội về tình hình thực hiện.

Điều 3.

Chính phủ tổ chức thực hiện một số nhiệm vụ trọng tâm sau đây:

1. Khẩn trương hoàn thành việc quyết toán và kiểm toán Dự án trồng mới 5 triệu ha rừng theo quy định của pháp luật;

2. Bảo vệ tốt diện tích rừng hiện có, tăng độ che phủ và nâng cao chất lượng rừng. Có giải pháp tổng thể giải quyết tình trạng cháy rừng, chặt phá, khai thác và sử dụng rừng trái pháp luật; trước mắt tiếp tục thực hiện chính sách hỗ trợ lương thực cho đồng bào miền núi để khắc phục nạn đốt phá rừng làm nương rẫy. Lồng ghép việc thực hiện kế hoạch bảo vệ và phát triển rừng với kế hoạch phát triển kinh tế - xã hội, chương trình, dự án khác trên cùng địa bàn để nâng cao hiệu quả tổng hợp về kinh tế - xã hội, bảo vệ môi trường, bảo đảm an ninh, quốc phòng;

3. Bảo đảm kinh phí cho việc bảo vệ và phát triển rừng, đặc biệt ưu tiên cho các xã vùng biên giới, ven biển; tăng mức khoán bảo vệ, khoanh nuôi tái sinh rừng; tăng mức đầu tư cho trồng mới rừng phòng hộ, rừng đặc dụng và hỗ trợ trồng rừng sản xuất ở địa bàn khó khăn. Có chính sách ưu đãi về vay vốn tín dụng trồng rừng sản xuất; giải quyết việc làm, tổ chức lại sản xuất khi Nhà nước thu hồi, chuyển đổi mục đích sử dụng đất lâm nghiệp; phát triển thị trường lâm sản và công nghiệp chế biến lâm sản;

4. Ổn định quy hoạch sử dụng đất lâm nghiệp; rà soát và có giải pháp hợp lý đối với những diện tích rừng đã giao, cho thuê để bảo đảm nhu cầu trồng rừng của người dân địa phương. Đẩy nhanh tiến độ giao đất, giao rừng, cấp giấy chứng nhận quyền sử dụng đất lâm nghiệp;

5. Đổi mới mô hình quản lý rừng theo chức năng từng loại rừng; ban hành các quy định về khai thác gỗ theo phương án quản lý rừng bền vững. Có chính sách bảo đảm cho cộng đồng dân cư nơi có rừng được hưởng lợi trực tiếp từ việc bảo vệ, khoanh nuôi tái sinh và trồng rừng; chú trọng khai thác giá trị phòng hộ, bảo vệ môi trường, cảnh quan, đa dạng sinh học của rừng để đầu tư trở lại cho người trồng rừng;

6. Đẩy mạnh nghiên cứu khoa học và ứng dụng công nghệ trong chọn tạo giống, quản lý rừng, khai thác, chế biến lâm sản để làm gia tăng giá trị của sản phẩm lâm nghiệp;

7. Thực hiện nghiêm các quy định của pháp luật về bảo vệ và phát triển rừng về việc xác định giá rừng, đặc biệt là xác định giá rừng đặc dụng, rừng phòng hộ trước khi chuyển sang rừng sản xuất hoặc chuyển đổi sang mục đích sử dụng khác để tránh lãng phí, thất thoát tài nguyên rừng;

8. Tăng cường công tác tuyên truyền, thanh tra, kiểm tra việc thực hiện pháp luật về bảo vệ và phát triển rừng; xử lý kịp thời, nghiêm minh các hành vi vi phạm pháp luật về bảo vệ và phát triển rừng.

Điều 4.

Uỷ ban thường vụ Quốc hội, Hội đồng dân tộc, các Uỷ ban của Quốc hội, Đoàn đại biểu Quốc hội, đại biểu Quốc hội, Hội đồng nhân dân các cấp theo chức năng, nhiệm vụ, quyền hạn của mình giám sát việc thực hiện Nghị quyết này.

Nghị quyết này đã được Quốc hội nước Cộng hoà xã hội chủ nghĩa Việt Nam khoá XIII, kỳ họp thứ 2 thông qua ngày 25 tháng 11 năm 2011.

RESOLUTION

ON TERMINATING THE IMPLEMENTATION OF RESOLUTION NO. 08/1997/QH10 AND RESOLUTION NO. 73/2006/QH11 ON THE PROJECT ON PLANTING FIVE MILLION HECTARES OF NEW FORESTS

THE NATIONAL ASSEMBLY OF THE SOCIALIST REPUBLIC OF VIETNAM

Pursuant to the 1992 Constitution of the Socialist Republic of Vietnam, which was amended and supplemented under Resolution No. 51/2001/QH10;

Pursuant to Resolution No. 08/1997/QH10 on the project on planting five million hectares of new forests, and Resolution No. 73/2006/ QH11 on adjustment of targets and tasks of the project on planting five million hectares of new forests in the 2006-2010 period;

After considering the Government's Reports No. 128/BC-CP of August 9,2011, and No. 243/BC-CP of October 26, 2011, and the National Assembly's Science, Technology and Environment Committee's Verification Report No. 74/BC-UBKHCNMT13 of October 24, 2011, and opinions of National Assembly deputies;

RESOLVES:

Article 1. The National Assembly acknowledges the achievement of the key targets of the project on planting five million hectares of new forests under the X^th National Assembly's Resolution No. 08/1997/QH10, and the targets and tasks adjusted under the XI^th National Assembly's Resolution No. 73/2006/QH11; achieved results, problems, shortcomings and their causes in course of project implementation.

To assign the Government to formulate and organize the implementation of the forest protection and development plan for the 2011-2020 period under the mechanism applicable to national target programs and report annually to the National Assembly on its implementation.

Article 3. The Government is assigned to:

1. Urgently complete the cost finalization and audit of the project on planting five million hectares of new forests under law;

2. Protect existing forest areas, increase the forest coverage rate and improve the quality of forests. Adopt overall solutions to stop forest fires, deforestation and illegal exploitation and use of forests; for the near future, further implement policies on food support for people in mountainous areas to prevent deforestation through slash-and-burn farming. Integrate forest protection and development plans with other socio-economic development plans and other programs and projects in the same locality in order to improve the general efficiency of socio-economic development, environmental protection and security and defense maintenance;

Assure sufficient funds for forest protection and development, especially for border and coastal communes; increase the levels of package allocations for forest protection and regeneration zoning; increase investments in planting new protection forests, special-use forests and production forests in difficulty-hit areas. Adopt policies on preferential loans for planting production forests; create jobs and reorganize production activities of those whose forestry land is recovered by the State or converted in its allocated use purposes; and develop the forest product market and forest product processing industry;

Stabilize forest land use planning; review and adopt rational solutions regarding assigned forest areas and lease forest areas to meet the needs of forest planting of local people. Step up the allocation of land and forests and the grant of forest land use right certificates;

5. Renew the forest management model based on functions of each type of forests; issue regulations on timber exploitation under sustainable forest management plans. Adopt policies to assure direct enjoyment of benefits from forest protection and regeneration zoning and planting by local communities; and pay attention to exploiting protection value, environmental protection, sceneries and bio-diversity of forests for reinvestment in favor of forest planters;

6. Step up scientific research and technological application in variety selection, forest management, and forest product exploitation and processing in order to increase the value of forest products;

7. Strictly implement legal regulations on forest protection and development and determination of prices of forests, especially prices of special-use forests and protection forests before converting them to production ones or changing their use purposes in order to reduce waste and loss of forest resources;

Article 4. The National Assembly Standing Committee, the Ethnic Council and other Committees of the National Assembly, National Assembly deputies' delegations and National Assembly deputies and People's Councils at all levels shall, within the ambit of their functions, tasks and powers, supervise the implementation of this Resolution.

This Resolution was adopted on November 25, 2011, by the XIII^th National Assembly of the Socialist Republic of Vietnam at its 2nd session.-
