SỬA ĐỔI, BỔ SUNG MỘT SỐ ĐIỀU CỦA THÔNG TƯ SỐ 01/2012/TT-BNNPTNT NGÀY 04/01/2012 CỦA BỘ NÔNG NGHIỆP VÀ PHÁT TRIỂN NÔNG THÔN QUY ĐỊNH HỒ SƠ LÂM SẢN HỢP PHÁP VÀ KIỂM TRA NGUỒN GỐC LÂM SẢN

Căn cứ Luật Bảo vệ và phát triển rừng năm 2004;

Căn cứ Nghị định số 199/2013/NĐ-CP ngày 26/11/2013 của Chính phủ Quy định chức năng, nhiệm vụ, quyền hạn và cơ cấu tổ chức của Bộ Nông nghiệp và Phát triển nông thôn;

Theo đề nghị của Tổng cục trưởng Tổng cục Lâm nghiệp;

Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn ban hành Thông tư sửa đổi, bổ sung một số điều của Thông tư số 01/2012/TT-BNNPTNT ngày 04/01/2012 của Bộ Nông nghiệp và Phát triển nông thôn Quy định hồ sơ lâm sản hợp pháp và kiểm tra nguồn gốc lâm sản.

Điều 1. Sửa đổi, bổ sung một số điều của Thông tư số 01/2012/TT- BNNPTNT

1. Khoản 7 Điều 3 được sửa đổi, bổ sung như sau:

“7. Vận chuyển nội bộ là trường hợp lâm sản được vận chuyển giữa các đơn vị hạch toán phụ thuộc như: lâm trường, các công ty lâm nghiệp, nhà máy chế biến, các chi nhánh, cửa hàng ... trong một doanh nghiệp có tư cách pháp nhân và hạch toán độc lập; hoặc trường hợp lâm sản được vận chuyển từ doanh nghiệp có tư cách pháp nhân và hạch toán độc lập đến các tổ chức hạch toán phụ thuộc và ngược lại.

Trường hợp vận chuyển lâm sản từ nơi khai thác đến nơi chế biến, kho hàng; vận chuyển lâm sản từ nơi chế biến, kho hàng đến nơi giao hàng giữa bên mua và bên bán theo hợp đồng kinh tế của lô hàng đó cũng là vận chuyển nội bộ”.

2. Khoản 1 Điều 4 được sửa đổi, bổ sung như sau:

“1. Xác định khối lượng gỗ tròn, gỗ xẻ, gỗ đẽo hộp thực hiện theo quy định hiện hành của Bộ Nông nghiệp và Phát triển nông thôn.

Đối với gỗ gốc, rễ, gỗ có hình thù phức tạp, gỗ dạng cây cảnh, cây bóng mát, cây cổ thụ bao gồm cả rễ, thân, cành, lá, nếu không thể đo được đường kính, chiều dài để xác định khối lượng và gỗ rừng trồng tập trung không phân loại theo cấp đường kính thì cân trọng lượng theo đơn vị là ki-lô-gam (kg) và quy đổi cứ 1.000 kg bằng 1 m^3 gỗ tròn hoặc đo, tính theo đơn vị ster và quy đổi cứ 1 ster bằng 0,7 m^3 gỗ tròn”.

3. Điểm c Khoản 3 Điều 5 được sửa đổi, bổ sung như sau:

“c) Ghi tổng hợp chung số lượng, khối lượng hoặc trọng lượng đối với gỗ tròn, gỗ đẽo, gỗ xẻ rừng tự nhiên trong nước không đủ kích thước quy định tại điểm b Khoản 3 Điều 5 của Thông tư này hoặc gỗ khai thác từ rừng trồng tập trung không phân loại theo cấp đường kính.

Trường hợp lập bảng kê lâm sản tổng hợp chung trên đây, khi đưa lâm sản vào chế biến để sản xuất các sản phẩm khác nhau, thì chủ lâm sản phải lập bảng kê lâm sản sử dụng cho sản xuất từng loại sản phẩm và ghi rõ nguồn gốc được trích ra từ bảng kê lâm sản tổng hợp gốc đó”.

4. Điểm a và điểm c Khoản 1 Điều 7 được sửa đổi, bổ sung như sau:

“a) Hạt Kiểm lâm cấp huyện, Chi cục Kiểm lâm tỉnh, thành phố trực thuộc Trung ương ở những địa phương không có Hạt Kiểm lâm cấp huyện xác nhận lâm sản trong các trường hợp sau:

Lâm sản chưa qua chế biến có nguồn gốc khai thác từ rừng tự nhiên trong nước của tổ chức xuất ra;

Lâm sản có nguồn gốc nhập khẩu chưa qua chế biến ở trong nước của tổ chức, cá nhân xuất ra;

Động vật rừng gây nuôi trong nước và bộ phận, dẫn xuất của chúng của tổ chức, cộng đồng dân cư, hộ gia đình, cá nhân xuất ra;

Lâm sản sau xử lý tịch thu chưa chế biến của tổ chức, cộng đồng dân cư, hộ gia đình, cá nhân xuất ra;

Lâm sản sau chế biến từ gỗ rừng tự nhiên trong nước, gỗ nhập khẩu, gỗ sau xử lý tịch thu của tổ chức, cộng đồng dân cư, hộ gia đình, cá nhân xuất ra;

Lâm sản vận chuyển nội bộ giữa các địa điểm không cùng trên địa bàn một tỉnh, thành phố trực thuộc Trung ương”.

“c) Kiểm lâm địa bàn tham mưu cho Chủ tịch Ủy ban nhân dân xã, phường, thị trấn (sau đây viết chung là Ủy ban nhân dân cấp xã) xác nhận lâm sản chưa qua chế biến có nguồn gốc khai thác từ rừng tự nhiên trong nước của cộng đồng dân cư, hộ gia đình, cá nhân xuất ra”.

5. Điểm b Khoản 1 Điều 9 được sửa đổi, bổ sung như sau:

“b) Đối với gỗ đủ tiêu chuẩn đóng búa kiểm lâm theo quy định của Bộ Nông nghiệp và Phát triển nông thôn gồm: biên bản xác nhận gỗ đóng dấu búa kiểm lâm kèm theo bảng kê lâm sản”.

6. Điều 13 được sửa đổi, bổ sung như sau:

“Điều 13. Lâm sản chưa qua chế biến có nguồn gốc khai thác từ rừng trồng tập trung, vườn nhà, trang trại, cây trồng phân tán

1. Hồ sơ lâm sản có nguồn gốc khai thác từ rừng trồng tập trung, vườn nhà, trang trại, cây trồng phân tán của tổ chức xuất ra gồm: hóa đơn theo quy định của Bộ Tài chính tại thời điểm xuất bán lâm sản và bảng kê lâm sản.

2. Hồ sơ lâm sản do cộng đồng dân cư, hộ gia đình, cá nhân xuất ra: bảng kê lâm sản”.

7. Điều 14 được sửa đổi, bổ sung như sau:

“Điều 14. Lâm sản nhập khẩu chưa qua chế biến ở trong nước

1. Hồ sơ một lô lâm sản nhập khẩu trực tiếp thực hiện theo quy định tại Điều 10 của Thông tư này.

2. Hồ sơ lâm sản có nguồn gốc nhập khẩu xuất ra

a) Hồ sơ lâm sản có nguồn gốc nhập khẩu của tổ chức xuất ra gồm: hóa đơn theo quy định của Bộ Tài chính tại thời điểm xuất bán lâm sản và bảng kê lâm sản có xác nhận của cơ quan kiểm lâm sở tại.

b) Hồ sơ lâm sản có nguồn gốc nhập khẩu của cá nhân xuất ra: bảng kê lâm sản có xác nhận của cơ quan kiểm lâm sở tại”.

8. Điểm a Khoản 2 Điều 18 được sửa đổi, bổ sung như sau:

“a) Hồ sơ vận chuyển gỗ rừng tự nhiên trong nước, gỗ nhập khẩu, gỗ tịch thu chưa qua chế biến; động vật rừng, bộ phận, dẫn xuất của chúng gồm: phiếu xuất kho kiêm vận chuyển nội bộ và bảng kê lâm sản có xác nhận của cơ quan kiểm lâm sở tại”.

9. Khoản 3 Điều 22 được sửa đổi, bổ sung như sau:

“3. Mọi trường hợp kiểm tra lâm sản phải thực hiện đúng trình tự, thủ tục kiểm tra theo quy định của pháp luật; phải lập biên bản theo mẫu số 03 hoặc 04 (đối với kiểm tra khai thác lâm sản) ban hành kèm theo Thông tư này”.

10. Thay thế cụm từ: “hóa đơn bán hàng theo quy định của Bộ Tài chính” bằng cụm từ: “hóa đơn theo quy định của Bộ Tài chính tại thời điểm xuất bán lâm sản” tại điểm b Khoản 2 Điều 7, Điều 12, Điều 15, Điều 16 và Điều 17.

11. Thay thế cụm từ: “phiếu xuất kho nội bộ” bằng cụm từ: “phiếu xuất kho kiêm vận chuyển nội bộ” tại Khoản 1 và điểm b Khoản 2 Điều 18.

12. Bổ sung Khoản 3 Điều 31 như sau:

“3. Đối với gỗ cao su và sản phẩm chế biến từ gỗ cao su, trường hợp cần làm hồ sơ xác định nguồn gốc hợp pháp thì chủ hàng lập bảng kê lâm sản theo quy định tại Thông tư này”.

Điều 2. Điều khoản thi hành

1. Thông tư này có hiệu lực kể từ ngày 02 tháng 12 năm 2015

2. Thông tư này thay thế Thông tư số 42/2012/TT-BNNPTNT ngày 21/8/2012 Sửa đổi, bổ sung một số điều của Thông tư số 01/2012/TT-BNNPTNT ngày 04/01/2012 của Bộ Nông nghiệp và Phát triển nông thôn Quy định hồ sơ lâm sản hợp pháp và kiểm tra nguồn gốc lâm sản.

3. Trong quá trình thực hiện, nếu có vướng mắc, các tổ chức, cá nhân phản ánh kịp thời về Bộ Nông nghiệp và Phát triển nông thôn để giải quyết./.

CIRCULAR

AMENDING AND SUPPLEMENTING SEVERAL ARTICLES OF THE CIRCULAR NO. 01/2012/TT-BNNPTNT OF THE MINISTRY OF AGRICULTURE AND RURAL DEVELOPMENT DATED JANUARY 4, 2012 ON STIPULATING DOSSIERS OF LAWFUL FOREST PRODUCTS AND INSPECTION OF THE ORIGIN OF FOREST PRODUCTS

Pursuant to the 2014 Law on Forest Protection and Development;

Pursuant to the Government’s Decree No. 199/2013/ND-CP dated November 26, 2013 on defining functions, duties, powers and organizational structure of the Ministry of Agriculture and Rural Development;

After considering the request of the Director of the General Department of Forestry;

The Minister of Agriculture and Rural Development hereby enforces the Circular on amending and supplementing several articles of the Circular No. 01/2012/TT-BNNPTNT of The Ministry Of Agriculture and Rural Development dated January 4, 2012 on stipulating dossiers of lawful forest products and inspection of the origin of forest products.

Article 1. Amending and supplementing several articles of the Circular No. 01/2012/TT-BNNPTNT

1. Clause 7 Article 3 shall be amended and supplemented as follows:

Transportation of forest products from other places to product processing and warehousing facilities, and transportation of forest products from product processing and warehousing facilities to the delivery point between buyers and sellers as agreed upon in economic contracts for such shipments, shall be considered the internal transportation:.

2. Clause 1 Article 4 shall be amended and supplemented as follows:

“1. Volume of round timber, sawn timber and square timber shall be determined under the Ministry of Agriculture and Rural Development's regulations.

For stumps and roots, timber with complex shape, ornamental trees, trees for shadow or secular trees, including their roots, trunks, branches and leaves, which cannot be measured for determining their volumes, or timber harvested from forests which have not been planted in an consolidated manner and have not been classified by diameter ranges, they shall be weighed in kilogram (kg) and converted at the ratio of 1,000 kg equivalent to 1 m3 of round timber or measured in stere and converted at the ratio of one stere equivalent to 0.7 m3 of round timber.”.

3. Point c Clause 3 Article 5 shall be amended and supplemented as follows:

“c) He/she writes the total quantity, volume or weight of round timber, cut timber and sawn timber harvested from domestic natural forests with sizes smaller than those specified at Point b Clause 3 Article 5 hereof or timber harvested from forests which have been planted in a consolidated manner and have not been classified by diameter ranges.

With respect to the making of the general packing list of forest products as stated above, when use forest products as materials for the manufacture of different products, forest product owners must compile the list of forest products used for manufacture of each type of product and clearly state the origin specified in such list".

4. Point a and Point c Clause 1 Article 7 shall be amended and supplemented as follows:

“a) District-level forest ranger offices or provincial-level forest protection sub-departments in localities having no district-level forest ranger offices may certify the following forest products:

...

...

...

Forest products of import origin and not yet processed in the country owned by exporting organizations or individuals;

Forest animals raised in the country and their parts or derivatives owned by exporting organizations, communities, households or individuals;

Confiscated unprocessed forest products owned by exporting organizations, communities, households or individuals;

Processed forest products manufactured from timber in domestic natural forests, imported timber and confiscated timber owned by exporting organizations, communities, households or individuals;

Forest products transported internally among places not in the same province or centrally run city”.

“c) Local forest protection agencies shall assist the Chairperson of the People's Committees of communes, wards or township (hereinafter referred to as communal People's Committee) in certifying unprocessed forest products manufactured from domestic natural forests owned by exporting communities, family households and individuals”.

5. Point b Clause 1 Article 9 shall be amended and supplemented as follows:

 “b) For timber eligible for forest ranger’s hammer-marking under the Ministry of Agriculture and Rural Development's regulations, such a dossier comprises a written certification of timber bearing forest ranger hammer marks enclosed with a packing list of forest products.”

6. Article 13 shall be amended and supplemented as follows:

1. A dossier of forest products exploited from consolidated planted forests, home gardens, farms or scattered trees owned by exporting organizations, including invoices stipulated by the Ministry of Finance at the time of forest product exportation and a packing list of forest products. 

2. A forest product dossier of an exporting community, household or individual: a packing list of forest products.”

7. Article 14 shall be amended and supplemented as follows:

“Article 14. Imported forest products which are not processed in the country

1. A dossier of a directly imported forest product shipment shall be governed under the provisions of Article 10 hereof.

2. A dossier of a forest product with the temporary import and re-export origin

a) A dossier of a forest product which has the import origin kept by exporting organizations including invoices stipulated by the Ministry of Finance at the time of forest product export and the packing list of forest products certified by forestry protection agency in their home countries.

b) A dossier of a forest product with the import origin kept by exporting organizations: a packing list of forest products certified by the forestry protection agency in their home countries”.

8. Point a Clause 2 Article 18 shall be amended and supplemented as follows:

9. Clause 3 Article 22 shall be amended and supplemented as follows:

“3. All forest product inspections shall be conducted according to the legal processes and procedures; must be documented by using the form No. 03 or 04 (applicable to inspection of forest product exploitation) annexed to this Circular".

10. The phrase “invoices stipulated by the Ministry of Finance” shall be replaced by the phrase “invoices stipulated by the Ministry of Finance at the time of forest product exportation” at the Point b Clause 2 Article 7, Article 12, Article 15, Article 16 and Article 17.

11. The phrase “internal product dispatch note” shall be replaced by the phrase “product dispatch and internal transportation note" at Clause 1 and Point b Clause 2 Article 18.

12. Article 31 shall be supplemented with Clause 3 as follows:

“3. As for rubber timber and products manufactured from rubber timber, if it is necessary to present a dossier that helps accredit legal origin, product consigners shall make a list of forest products in accordance with regulations laid down in this Circular."

Article 2. Enforcement provisions

1. This Circular shall enter into force from December 2, 2015.

2. This Circular shall replace the Circular No. 42/2012/TT-BNNPTNT dated August 21, 2012 on amending and supplementing several articles of the Circular No. 01/2012/TT-BNNPTNT of the Ministry of Agriculture and Rural Development dated January 4, 2012 on stipulating dossiers of lawful forest products and inspection of the origin of forest products.
