CIRCULAR

LIST OF PERMISSIBLE AND BANNED AGROCHEMICALS IN VIETNAM

Pursuant to the Government's Decree No. 15/2017/ND-CP dated February 17, 2017 defining the functions, tasks, powers and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to the Law on Plant Protection and Quarantine dated November 25, 2013;

At the request of the Director of Plant Protection Department;

The Minister of Agriculture and Rural Development hereby promulgates a List of permissible and banned agrochemicals in Vietnam.

Article 1. The following are promulgated together with this Circular:

1. List of permissible agrochemicals in Vietnam in Appendix I enclosed herewith, which comprises:

- Pesticides: 861 active ingredients with 1821 trade names.

- Fungicides: 587 active ingredients with 1282 trade names.

- Herbicides: 241 active ingredients with 702 trade names.

- Rodenticides: 8 active ingredients with 26 trade names.

- Growth regulators: 54 active ingredients with 157 trade names.

- Insect baits: 8 active ingredients with 8 trade names.

- Snailicides: 31 active ingredients with 151 trade names.

- Supporting substances: 5 active ingredients with 6 trade names.

b) Termiticides: 15 active ingredients with 25 trade names.

d) Storage disinfectant: 3 active ingredients with 10 trade names.

dd) Agrochemicals for golf courses:

- Fungicides: 2 active ingredients with 2 trade names.

- Herbicides: 1 active ingredient with 1 trade name.

- Growth regulators: 1 active ingredient with 1 trade name.

e) Agrochemicals for seed treatment:

- Pesticides: 10 active ingredients with 15 trade names.

- Fungicides: 12 active ingredients with 13 trade names.

g) Harvested agricultural product preservatives

2. List of banned agrochemicals in Vietnam in Appendix II enclosed herewith, which comprises:

a) Pesticides and forest product preservatives: 23 active ingredients.

b) Fungicides: 6 active ingredients.

c) Rodenticides: 1 active ingredient.

d) Herbicides: 1 active ingredient.

3. List of HS codes assigned to permissible and banned agrochemicals in Vietnam in Section 25 and Section 26 in Appendix I enclosed with the Circular No. 15/2018/TT-BNNPTNT dated October 29, 2018 of the Ministry of Agriculture and Rural Development and relevant amending documents.

Article 2. Grandfather clauses

1. Agrochemicals containing chlorpyrifos ethyl and fipronil shall not be produced and imported; may be sold and used until February 12, 2021.

2. Agrochemicals containing glyphosate shall not be produced and imported; may be sold and used until June 30, 2021.

1. This Circular comes into force from October 25, 2020.

2. This Circular replaces:

a) The Circular No. 10/2019/TT-BNNPTNT dated September 20, 2019 of the Minister of Agriculture and Rural Development;

b) The Circular No. 06/2020/TT-BNNPTNT dated April 24, 2020 of the Minister of Agriculture and Rural Development.

Article 4. Responsibility for implementation

1. Chief of the Ministry Office, Director of Plant Protection Department, heads of units affiliated to the Ministry of Agriculture and Rural Development, Directors of Departments of Agriculture and Rural Development of provinces and central-affiliated cities, relevant organizations and individuals are responsible for the implementation of this Circular.

2. Difficulties that arise during the implementation of this Circular should be reported to the Ministry of Agriculture and Rural Development (via the Plant Protection Department) for consideration and resolution./.
