DECREE
AMENDMENTS TO ARTICLE 14 OF THE GOVERNMENT'S DECREE NO. 168/2017/ND-CP
DATED DECEMBER 31, 2017 ON ELABORATION OF SOME ARTICLES OF THE LAW ON TOURISM
REGARDING TRAVEL SERVICE DEPOSITS
Pursuant to the Law on
Government Organization dated June 19, 2015; Law dated November 22, 2019 on
Amendments to some Articles of the Law on Government Organization and Law on
Local Government Organization;
Pursuant to the Law on
Tourism dated June 19, 2017;
At the request of the
Minister of Culture, Sports and Tourism;
The Government hereby promulgates
a Decree on amendments to Article 14 of the Government's Decree No.
168/2017/ND-CP dated December 31, 2017 on elaboration of some Articles of the
Law on Tourism regarding travel service deposits.
Article
1. Amendments to Article 14 of the Government's Decree No. 168/2017/ND-CP dated
December 31, 2017 on elaboration of some Articles of the Law on Tourism
regarding travel service deposits
Clauses
1 and 2 of Article 14 are amended as follows:

International travel service deposit:
a)
Provision of travel services for inbound tourists: VND 50,000,000 (fifty
million);
b)
Provision of travel services for outbound tourists: VND 100,000,000 (one
hundred million);
c)
Provision of travel services for inbound and outbound tourists: VND 100,000,000
(one hundred million)”.
Article
2. Implementation
1. The
Ministry of Culture, Sports and Tourism shall preside over and cooperate with
ministries and central authorities in providing guidelines for and organize the
implementation of this Decree.
2. Every
bank which receives travel service deposits has the responsibility to:
a)
Revoke certificates of travel service deposit already issued to travel service
providers, issue new certificates of travel service deposit corresponding to
the deposits specified in Article 1 of this Decree and refund the overpaid
deposits as prescribed in the Decree No. 168/2017/ND-CP to travel service
providers from the effective date of this Decree;
b) Send
the list and information on travel service providers applying for replacement
of their deposit certificates to the authority issuing licenses for provision
of travel services in accordance with regulations within 30 days from the
replacement date.

a) Any
provider issued with the certificate of travel service deposit as prescribed in
the Decree No. 168/2017/ND-CP may apply for replacement of its certificate of
travel service deposit corresponding to the deposits specified in Article 1 of
this Decree and send that new certificate to the
authority issuing licenses for provision of
travel services within 30 days from the replacement date;
b) From
January 01, 2024, any provider that has paid its travel service deposit as
prescribed in this Decree shall apply for replacement of its certificate of
travel service deposit corresponding to the deposits specified in clauses 1 and
2 Article 14 of the Decree No. 168/2017/ND-CP and send that new certificate to
the authority issuing licenses for provision of travel services within 30 days
from the replacement date.
4.
Ministers, heads of ministerial agencies, heads of Governmental agencies,
Chairpersons of People’s Committees of provinces and central-affiliated cities
and organizations and individuals concerned are responsible for the
implementation of this Decree.
Article
3. Implementation clause
1. This
Decree comes into force from the date on which it is signed for promulgation.
2. The
travel service deposits specified in Article 1 of this Decree shall apply until
December 31, 2023.
3. From
January 01, 2024, the travel service deposits specified in clauses 1 and 2
Article 14 of the Decree No. 168/2017/ND-CP will apply.
