DECISION
ON THE ROADMAP FOR
IMPLEMENTING EMISSION STANDARDS FOR IMPORTED AND LOCALLY MANUFACTURED OR
ASSEMBLED MOTOR VEHICLES
Pursuant to the Law on Government Organization
dated June 19, 2015; the Law on amendments to the Law on Government
Organization and the Law on Local Government Organization dated November 22,
2019;
Pursuant to the Law on Road Traffic Order and
Safety dated June 27, 2024;
Pursuant to the Law on Environmental Protection
dated November 17, 2020;
At the proposal of the Minister of Transport;
The Prime Minister issues a Decision on the
roadmap for implementing emission standards for imported and locally
manufactured or assembled motor vehicles.

2. This Decision does not apply to:
a) Motor vehicles under the management of the
Ministry of National Defense or the Ministry of Public Security used for
defense and security purposes;
b) Motor vehicles imported, manufactured, or
assembled in Vietnam for scientific research; research for production purposes;
display or introduction at trade fairs or exhibitions;
c) Motor vehicles manufactured or assembled for
export;
d) Motor vehicles imported under the provisions of
international treaties to which Vietnam is a party that stipulate otherwise, in
which case such treaties shall prevail;
dd) Motor vehicles designed with special structures
not intended for road traffic use; three-wheeled motorcycles or three-wheeled
scooters intended for persons with disabilities;
e) Automobiles manufactured or assembled using base
vehicles (chassis or complete vehicles) that have already been certified for
technical safety and environmental protection.
Article 2. Regulated entities
This Decision applies to organizations and
individuals involved in the import, manufacture, or assembly of motor vehicles
equipped with internal combustion engines.

1. Emission standards (Level 2, Level 3, Level 4,
and Level 5) for newly imported, manufactured, and assembled vehicles as
stipulated in this Decision correspond to the emission standards (Euro 2, Euro
3, Euro 4, and Euro 5) established by the United Nations Economic Commission
for Europe (UNECE) and the European Union Directives (EC) on motor vehicle type
approval.
2. Emission standards (Level 1, Level 2, Level 3,
and Level 4) for used imported vehicles as stipulated in this Decision refer to
the pollutant limits in emissions defined in the National Standard TCVN
6438:2018 and its Amendment 01:2021 TCVN 6438:2018 - Road Vehicles - Maximum
Allowable Emission Limits.
3. Emission standard Level "0" as
stipulated in this Decision indicates that the emissions from motor vehicle
engines do not contain pollutants defined within the limits of emission
standards mentioned in Clauses 1 and 2 of this Article.
Article 4. Roadmap for applying emission
standards
1. Roadmap for applying emission standards to newly
imported, manufactured, and assembled motor vehicles:
a) Automobiles that are newly imported and
manufactured, assembled shall continue to comply with Emission Standard Level 5
as specified in Clause 1, Article 3 of this Decision, starting from January 1,
2025;
b) Two-wheeled motorbikes that are newly imported
and manufactured, assembled shall continue to comply with Emission Standard
Level 2 as specified in Clause 1, Article 3 of this Decision, from January 1,
2025, until June 30, 2027;
c) Two-wheeled motorcycles that are newly imported
and manufactured, assembled shall continue to comply with Emission Standard
Level 3 as specified in Clause 1, Article 3 of this Decision, from January 1,
2025, until June 30, 2026;
d) Two-wheeled motorbikes that are newly
imported and manufactured, assembled shall comply with Emission Standard Level
4 as specified in Clause 1, Article 3 of this Decision, starting from July 1,
2027;

e) Four-wheeled motorized passenger vehicles and
four-wheeled motorized cargo vehicles that are newly imported and manufactured
or assembled shall comply with Emission Standard Level "0" as
specified in Clause 3, Article 3 of this Decision, starting from January 1,
2026;
g) Three-wheeled motorcycles and three-wheeled
mopeds that are newly imported and manufactured or assembled shall comply with
Emission Standard Level "0" as specified in Clause 3, Article 3 of
this Decision, starting from January 1, 2026.
2. Roadmap for applying emission standards to used
imported motor vehicles
a) Used imported automobiles shall comply with
Emission Standard Level 4 as specified in Clause 2, Article 3 of this Decision,
starting from January 1, 2025;
b) Used imported four-wheeled motorized passenger
vehicles and four-wheeled motorized cargo vehicles shall comply with Emission
Standard Level "0" as specified in Clause 3, Article 3 of this
Decision, starting from January 1, 2026.
Article 5. Implementation
1. Ministry of Transport
a) Take the lead in organizing the implementation
of this Decision; serve as the focal agency for inspecting and supervising
compliance with emission standards for motor vehicles at import facilities and
manufacturing or assembly facilities as stipulated in this Decision;
b) Develop and promulgate national technical
regulations in accordance with its functions, duties, and legal provisions
concerning emission standards in alignment with the roadmap specified in this
Decision;

2. Ministry of Science and Technology
Research and review national technical regulations
on gasoline, diesel fuel, and biofuels to amend them in alignment with the
roadmap for applying emission standards stipulated in this Decision.
3. Ministry of Industry and Trade
a) Take the lead, in coordination with relevant
ministries and sectors, to ensure the production, import, and supply of fuel
for motor vehicles that meets national technical standards for gasoline, diesel
fuel, and biofuels;
b) Collaborate with the Ministry of Transport to
inspect and monitor motor vehicle manufacturing and assembly facilities for
compliance with the emission standards specified in this Decision.
4. Ministry of Finance
Collaborate with the Ministry of Transport to
inspect and monitor motor vehicle import facilities for compliance with the
emission standards specified in this Decision.
5. Ministries and People’s Committees of provinces
and centrally affiliated cities
a) Collaborate with the Ministry of Transport to
organize public information campaigns regarding the roadmap for applying
emission standards for motor vehicles;

c) Based on local socio-economic conditions and
environmental protection requirements, the People’s Committees of provinces and
centrally governed cities may establish stricter local emission standards than
those specified in this Decision, in compliance with the provisions of the Law
on Environmental Protection and the Law on Standards and Technical Regulations.
Article 6. Transitional provisions
1. For types of motor vehicles manufactured or
assembled:
a) Types of motor vehicles manufactured or
assembled and certified for technical safety and environmental protection prior
to the application of emission standards as specified in Points a, b, and c,
Clause 1, Article 4 of this Decision may continue to be manufactured or
assembled within the validity period of the issued certificates;
b) Types of motor vehicles manufactured or
assembled and certified for technical safety and environmental protection prior
to the application of emission standards as specified in Points d, dd, e, and
g, Clause 1, Article 4 of this Decision may continue to be manufactured or
assembled within the validity period of the issued certificates or within 12
months from the effective date of the emission standards, whichever occurs
first.
2. Motor vehicles imported with customs
declarations already filed; those docked at ports; or those that have arrived
at Vietnam's border gates prior to the application of emission standards as per
the roadmap specified in this Decision shall remain subject to the emission
standards effective at the time the customs declarations were filed, or the
vehicles docked at ports or arrived at border gates.
Article 7. Entry into force and responsibilities
for enforcement
1. This Decision comes into force as of January 1,
2025.
2. The following regulations are hereby repealed:

b) Decision No. 49/2011/QD-TTg dated September 1,
2011, by the Prime Minister on the roadmap for applying emission standards to
newly manufactured, assembled, and imported automobiles and two-wheeled
motorcycles;
c) Article 5 of Decision No. 16/2019/QD-TTg dated
March 28, 2019, by the Prime Minister on the roadmap for applying emission
standards to in-use automobiles and imported used automobiles.
