CIRCULAR
AMENDMENTS AND
SUPPLEMENTS TO CERTAIN ARTICLES OF CIRCULAR NO. 31/2020/TT-BGTVT DATED DECEMBER
8, 2020 OF MINISTER OF TRANSPORT, PRESCRIBING RANGE OF FERRY FARES AND FEES
ALONG NATIONAL HIGHWAYS FUNDED BY STATE BUDGET UNDER THE MANAGEMENT OF CENTRAL
AUTHORITIES
Pursuant to the Law on Road Traffic No.
23/2008/QH12 dated November 13, 2008;
Pursuant to the Law on Prices No. 11/2012/QH13
dated June 20, 2012;
Pursuant to the Government's Decree No.
177/2013/ND-CP dated November 14, 2013, elaborating and providing guidance on
the implementation of a number of articles of the Law on Prices;
Pursuant to the Government's Decree No.
149/2016/ND-CP dated November 11, 2016 on amendments and supplements to certain
Articles of the Government's Decree No. 177/2013/ND-CP dated November 14, 2013,
elaborating and providing guidance on the implementation of a number of
Articles of the Law on Prices;
Pursuant to the Government’s Decree No.
56/2022/ND-CP dated August 24, 2022 on the functions, duties, powers and
organizational structure of the Ministry of Transport;
Upon the request of the Director of the
Financial Department and the Director of the Directorate for Roads of Vietnam;

Article 1. Amendments and supplements to certain
articles of the Circular No. 31/2020/TT-BGTVT dated December 8, 2020 of the
Minister of Transport, prescribing the range of fares and fees of ferries along
national highways funded by the state budget under the management of central
authorities
1. Amending and
supplementing clause 1 of Article 3 as follows:
“1. The range of fares and fees of ferries,
specified in the Schedule 01 through 11 of the Appendix to this Circular, is
applicable to specific ferry terminals along national highways.”
2. Amending and
supplementing clause 4 of Article 6 as follows:
“4. Kenh Tat and Lang Sat ferry terminals on
National Highway 53, Kenh Sau ferry terminal on National Highway 53B shall be
exempt from the requirement of collection of ferry service charges until other
legal document exists as a replacement.”
3. Amending and
supplementing Article 7 as follows:
“Responsibilities of the Directorate for Roads of
Vietnam
1. For new ferry terminals, within 03 months before
being put into operation, the Directorate for Roads of Vietnam shall formulate
limits of vehicles aboard, economic-technical norms, range of charges for usage
of these ferry terminals for submission to the Ministry of Transport to seek
its approval as a basis for further action.
2. Within 06 months before accepting the transfer
of local ferry terminals for the management of the Ministry of Transport under
the decision of the Ministry of Finance, the Directorate for Roads of Vietnam
shall formulate limits of vehicles aboard, economic-technical norms, range of
charges for usage of these ferry terminals for submission to the Ministry of
Transport to seek its approval as a basis for further action.”

“The Chief of the Ministry’s Office, the Ministry’s
Chief Inspector, Directors of Departments, Director of Directorate for Roads of
Vietnam, Heads of entities, organizations or individuals concerned, shall

Article 2. Adding more Schedules to the Appendix
to the Circular No. 31/2020/TT-BGTVT dated December 8, 2020 of the Minister of
Transport, prescribing the range of fares and fees of ferries along national
highways funded by the state budget under the management of central authorities
Adding Schedule 10 (Appendix 1) and Schedule 11
(Appendix II) attached hereto.
Article 3. Implementation provisions
1. This Circular shall enter into force as from
March 1, 2023.
2. The Chief of the Ministry’s Office, the
Ministry’s Chief Inspector, Directors of Departments, Director of Directorate
for Roads of Vietnam, Heads of entities, organizations or individuals
concerned, shall be responsible for implementing this Circular./.
